herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an 'individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

SUBJECT: Status of Black Forest Campground
At this time the Black's are planning to install a
subsurface wastewater disposal system to accommodate the first
phase (approx. 17,000 gallons/day) of the camp. The Transylvania
Co. -Health Dept. is able to permit, under their regulations, a
small wastewater disposal system to serve the swimming pool bath
house. Beyond this, engineering plans and a soil scientist's
report will have to be submitted to the Division of Health
Services (DHS) for approval. Steve Berkowitz, an engineer with
the DHS, has assured us that he will prioritize the project in an
effort to accommodate the Black's time schedule.
We have advised the Blacks that once the first phase is in
the ground and the camp is opened, they should closely monitor
the volume of wastewater actually being generated. If the volume
is less than the volumes originally used to determine the size of
the subsurface system, then a,request can be made to add
additional camp/RV sites to that system.
Mrs. Black has stated that opening'of the first phase should
keep them afloat until permitting of the remaining sites can be
resolved. If you should have -any questions, please give me -a
call.

Dear Representative Ives:
Mr. Steve Levitas, Deputy Secretary, requested that I
respond to your February 5, 1995 letter regarding the efforts of
the owners of the Black Forest Camping Resort to provide sewerage
facilities.
Since this is an issue you spoke to in your letter, I need
to start by saying that it is my personal goal and the goal of
most employees of the Division of Environmental Management to
assist people in resolving problems they may bring to us. I am
proud of our track record in this area.
You are correct that it took approximately six (6) months
for us to respond in writing to the Camping Resort's consulting
engineer, McGill & Associates', November 2, 1993 letter,
requesting speculative limitations for a proposed discharge. It
is unfortunate that it took so long for us to respond in a .
written format. A member of the staff vaguely recalls talking to
McGill & Associates and informing them that we no longer conduct
speculative limits for private facilities. I apologize for
taking so long to respond.
On December 16, 1994, McGill & Associates submitted an
application for a discharge permit on the Camping Resort',s
behalf. That application was returned on February 1, 1995, for
the reason that it did not meet the minimum requirements of the
North Carolina Environmental Management Commission. The
application did not adequately evaluate alternatives to a
discharge to the State's surface waters as required by the North
Carolina Administrative Code. Introducing a discharge to a
stream in this State is a serious matter, particularly when you
consider that it may continue for decades and the Environmental
Management Commission is determined that alternatives to
discharges be considered.
After becoming aware of this situation, staff of this
Division's Asheville Regional Office, the Division of
Environmental Health, and the Transylvania County Health
Department have been working with the owners of the Black Forest
Family Camping Resort to find both short term and long term
solutions to the problem of sewage disposal. In the short term
it seems possible that several small septic tank/drain field
systems will be built under the jurisdiction of the Division of
Environmental Health. It is hoped that such systems could be
built in time to open the campground this spring. For the long
term the Camping Resort seems headed in the direction of,a
discharging wastewater treatment system to serve the ultimate
development. Be assured we will help the owners in every way
possible keeping in mind that we have certain statutory and
regulatory obligations.
Our Asheville Regional Office is already receiving phone
calls from neighbors of the Camping Resort who are strongly
opposed to a treated sewage discharge to Walker Creek. I mention
this so that you will be aware that if we receive a complete
application for discharge permit and propose through public
notice to issue such a permit we may receive sufficient public
objection to warrant a public hearing.
If you wish to discuss this or other matters, please feel
free to call upon me. I appreciate your interest in protecting
North Carolina's precious natural resources.

Dear Mr. and Ms. Black:
This is in reference to your permit application received December 13, 1994, for the construction
and operation of the subject sewer extension proposed to serve the Black Forest Family Camping Resort.
The Division's Asheville Regional Office has been in contact with you concerning the construction
of wastewater facilities to serve your camping resort. It has been confirmed that you propose to install a
,;subsurface facility to be permitted by the Transylvania County Health Department to allow the construction
of a system at least largeenoughto serve one bath house, a camp house, a swimming pool, and a washing
machine. During a coriversati h.vith Mr. Gary Davis on February 24, 1995, it was confirmed that the
subject sewer extension will require a redesign prior to permitting either as a subsurface.or a discharge
facility, therefore, we are returning this information to you for modification. Once modified, these plans
can be submitted to the county health department for consideration. If the subject sewers were to be
constructed as proposed, the Division would have forwarded this information directly to the health
department for their use in evaluating these facilities for permitting.
The NPDES permit application. proposed to serve this facility was received by ,the Division, but
then returned in a letter dated Vdbruary 1, 1995 requiring that additional information be generated and
submitted with the application for a permit. The subject sewers were intended to connect to this NPDES
facility. In light of the fact that the proposed NPDES permit application has been returned, the subject
sewer extension permit application must also be returned since no treatment plant has been permitted to
date to receive the -wastewater.
In light of the delays and complications associated with the processing of the application for a
permit to serve these facilities, the Division is also returning your application processing., fee. This will be
forwarded to you under separate cover.
Additionally, it has been noted that there is a possibility of an application for an NPDES permit to
be resubmitted to the Division to serve the rest of the camping resort, once the requested additional
information has been satisfactorily addressed. If this becomes the case, please be advised that the request
for the sewer extension facilities cannot be submitted at the same time. In that it will require some time for
processing of the NPDES application and an authorization to construct, permitting of this sewer extension
cannot occur until such time as both of those permits are approved. At that time, this application can be
resubmitted for consideration.

On Friday, February, 10, 1995, Ms. Kerry Becker and I visited the
Black Forest Family Camping Resort. We were accompanied by Mr.
John Allison of the Division of Soil and Water Conservation.
Representing the campground were Mr. Scott Halter and Mr. Matt
Bohn.
John Allison found soil in sufficient quantity as to leave no
doubt that surface or subsurface application is a disposal
option.
By the conclusion of our meeting, Scott Halter decided to go with
a subsurface disposal system. Should availability of sufficient
area be a problem, this project could come back to us.

SUBJECT: Reconnaissance Soil Study on Black Forest Family Camping Resort
Transylvania County, North Carolina
On February 10, 1995, you, Roy Davis, Regional Supervisor and I conducted a
preliminary soil and site evaluation on Black Forest Family Camping Resort property to determine the
potential feasibility of a subsurface sewage disposal system. We investigated the sideslope of a low
mountain. The sideslope rolls convex to concave and has many small bedrock outcrops. Brief soils
descriptions of our borings follow:
1. 33 Percent Slope - Convex
A -- 0 to 5 inches; dark brown (10YR 3/3) sandy loam; granular structure; clear
wavy boundary.
Bw -- 5 to 30 inches; strong brown (7.5YR 5/8) sandy loam; subangular blocky
structure less that 2.5 cm in diameter; gradual wavy boundary.
BC -- 30 to 39 inches; strong brown (7.5YR 5/8) sandy loam; subangular blocky
structure less than 2.5 cm in diameter; pockets of multicolored saprolite;
gradual wavy boundary.
C -- 39 to 53 inches; multicolored sandy loam saprolite; massive; abrupt wavy
boundary.

Dear Fellow Chamber of Commerce member;
February 7, 1995
For those of you who haven't met us personally, we would like to take this
opportunity to introduce ourselves and our business to the Chamber and to
Transylvania County.
We are opening a family camping resort in Cedar Mountain. Our resort will
feature approximately 300 sites for RV's, motorhomes, travel trailers and tents.
Each site will be equipped with water and electric hookups and most RV sites
will have a sewer hookup. We plan on many amenities, including a 30 x 60
inground heated pool, an indoor area for movies and activities, a video arcade,
laundry, camp store and snack bar. We are also developing a recreational
program to include family olympics, special events, theme weekends, bonfires,
and ice cream socials, just to name a few.
We spent 5 years on this project, including finding the perfect area of the
country, buying land, having engineering plans developed that would comply
with local and state requirements, and developing a business plan. We adver-
tised in national campground directories and created over 20,000 brochures
to be placed in the Chamber and in the Welcome Centers on the major highways.
Many brochures will be given to friends and business acquaintenances and sent
to mailing lists of campers in the Carolina's and Georgia. We already have
reservations for the Fourth of July Weekend and we couldn't be more excited..
However, we have run into a major problem and would like to take a bit of your
time to explain It to you.
McGill & Associates (our engineers) designed the camping resort to be self-
contained. We dug wells and will install a 20,000 gal. storage tank to take care
of our water needs. Our sewage disposal is a problem. There was never a time
that McGill & Associates believed that the state would not approve of a sewer
treatment plant, with all of the treated wastewater to be emptied into Walker
Creek (the creek which borders our property). They knew there was an abandoned
YWCA camp next door that had a sewer treatment plant and permission to empty
into Walker Creek. Even though Camp Burgess Glen (YWCA) is no longer used as a
camp, we were told the permits for emptying into the creek were current until
8 months ago. McGill believed that if the YWCA was approved, we would be too.
According to Kerry Becker (at the Asheville Regl. Office of the Dept. of
Environmental Health & Natural Resources), our planned total flow would only
be one-third that of the YWCA Camp.
McGill & Associates sent the permit for our treated wastewater system to the
state over a year ago. Because of reasons we don't understand, we have not been
approved yet.

The Division has performed a preliminary review of the proposed Black Forest Campground waste
treatment facility. Based on this review and due to the increased number of proposed projects and their
impact on receiving waters, the Division requires that more. information be provided regarding possible
alternatives to discharge.
As outlined in the Division's Guidance for Evaluation of Wastewater Disposal Alternatives (copy
attached), the analysis of subsurface and irrigation disposal systems must include a prehmnary report
from a soil scientis. To adegquately evaluate subsurface and irrigation disposal systems, o ire soils
analysis needs to^be._performed-and-submitted This evaluation should include:
• a copy of field notes and boring log information,
• a soils site map overlain on a topographic map,
• description of soil characteristics to include texture, structure, soil wetness and mineralogy,
• characterization of the depth of soil to 48 " or to a restrictive horizon, and
• soil loading rate recommendations. '
The on -site soil survey should include enough soil borings to adequately characterize the site.
Additionally, justification should be provided on the number and location of soil borings completed. The
generalized county soil survey maps are not adequate for the evaluation, but may be used as a reference tool
to plan the field work required for the evaluation.
The application materials submitted do contain a letter from the Transylvania CountyHealth
Department recommending that for aesthetic reason_`s►alternatve rriethods of wastewaiei�_dis"posal-be -used:
However, the County also committed to working with the owners on developing a subsurface disposal
system. As you are aware, it is the Division's mandate to- permit the most environmentally sound
wastewater treatment system of the reasonably cost effective alternatives. Subsurface or irrigation
disposal systems are typically considered to be more environmentally sound alternatives.

The Transylvania County Health Department projected a land area of 1.7 acres would required for a
subsurface drain field to service the entire development. With an equal area for repair, the total land
requirements for the disposal field would be less than 5 acres. It is not unreasonable to project that 5 acres of
a 65 acre site could be. located to handle the wastewater treatment and disposal needs. The application
materials did not provide a full map, with scale indicated, of the proposed camping resort.
If however, after further review, soils are found to be inadequate to treat the entire proposed flow of
43,600 gpd, please provide information on what percentage of.the flow could be diverted to a subsurface or
irrigation disposal system and the costs associated with partial discharge and nondischarge alternatives.
Based on the limited mapping information provided,_ it appears that the wastewater needs of the system
may be able to be addressed through construction of several smaller subsurface disposal systems to
individually service the restroom areas, the retreat center and the cabins.
The Division -must also -have a written statement from the local goverrimenf that the propose project
(is consistent with any zoning or subdivision ordinance in effect, .prior to issuance of an NPDES permit.
Attached for your information and use is a form which should be completed, signed by the local government
and submitted with the application.

• description of soil characteristics to include texture, structure, soil wetness and mineralogy,
• characterization of the depth of soil to 48 " or to a restrictive horizon, and
• soil loading rate recommendations. r
The on -site soil survey should include enough soil borings to adequately characterize the site.
Additionally, justification should be'provided on the number and location of soil borings completed. The
generalized county.soil survey maps are not adequate for the evaluation, but may be used as a reference tool
to plan the field work required for the evaluation.
The application materials submitted do contain a letter from the Transylvania County Health
Department recommending that for aesthetic reasons, alternative methods of wastewater disposal be used.
However, the County also committed to working with the owners on developing a subsurface disposal
system. As you are aware, it is the Division's mandate to permit the most environmentally sound
wastewater treatment system of the reasonably cost effective alternatives. Subsurface or irrigation
disposal systems are typically considered to be more environmentally sound alternatives

The Transylvania County. Health Department projected a land area of 1.7 acres would required for a
subsurface drain field to service the entire development. With an equal area for.repair, the total land
requirements for the disposal field would be less than 5 acres. It is not unreasonable to project that 5 acres of
a 65 acre site could be located to handle the wastewater treatment and disposal needs. The application
materials did not provide a full map, with scale indicated, of the proposed camping resort.
If however, after further review, soils are found to be inadequate to treat the entire proposed flow of
43,600 gpd, please provide information on what percentage of.the flow could be diverted to a subsurface or
irrigation disposal system and the costs associated with partial discharge and nondischarge alternatives.
Based on the limited mapping information provided, it appears that the wastewater needs of the system
may be able to be addressed through construction of several smaller subsurface disposal systems to
individually service the restroom areas, the retreat center and the cabins.
The Division --must also -have a written statement from the local government that the proposed project
is consistent with any zoning or, subdivision ordinance in effect, prior to issuance of an NPDES permit.
Attached for your information and use is a form which shoul&be completed, signed by the local government
and submitted with the application.
As a result of the.inadequate alternatives analysis, the proposed project is being returned with this

We are currently working on development of the Black Forest Campground to be located in
Transylvania County. Generally, the campground will have a total of 201 RV sites, 84 tenet sites, 20
cabins and a 6 bedroom bed and breakfast facility. Estimated maximum wastewater discharge is 42,140
gpd. Phase one development will be 17,540 gpd. The proposed wastewater treatment facility will have
an initial design flow of 35,000 gpd and will discharge into Walker Creek. Treatment process will
consist of primary screening followed by flow equalization, secondary treatment utilizing the activated
sludge process in a package type wastewater treatment plant and disinfection prior to discharge.
On behalf of the owners of Black Forest Campground we are submitting three (3) copies of the
NPDES Permit Application and Preliminary Engineering Report for the proposed wastewater discharge
from the Black Forest Campground along with a check in the amount of $400.00 to cover all processing
fees.

a. One original and three copies of the completed and appropriately executed application form.
b. Three sets of detailed plans and specifications signed and sealed by a North Carolina
Professional Engineer. The plans must include a general location map, a plan view of the
sewer extension, a profile of the sewer extension, details on the pump station, and must
show the proximity of the sewer extension to other utilities and natural features.
Specifications may be omitted for delegated authorities. Each sheet of the plans and the first
page of the specifications must be signed and sealed. Three copies of the existing permit if
a renewal'or modification.
C. Three copies of all calculations, including pump selection, friction calculations, cycle
time, pump curves (including system cures applicable with one pump running, two
pumps. running, three pumps running, etc.), and evaluation of downstream pump stations.
These items must be submitted under the signature and seal of the North Carolina
.Professional Engineer.
d. The appropriate permit processing fee, in accordance with 1SA NCAC 2H .0205(c)(5)
c. If the owner/authority of the wastewater treatment facility (WW—IT) that will be accepting
the wastewater flow from this project is different from the applicant of the project, then a
letter must be provided froth -the owner/authority of the VWVtTF specifying the volume of
flow that will be accepted. The letter should be a recent lever and_ should refer to the project
by the same name as that identified on the application and the plans/specifications.
f. An Operational Agreement (original and two copies) must be submitted if the sewer
extension will be serving single family residences, condominiums, mobile homes, or town
houses and if the subject sewer extension is owned by the individual residents, a
homeowners association, or a developer.

OPERATIONAL AGREEMENT
THIS AGREEMENT made pursuant to G.S. 143-215.1(dl) and entered

State of Werth Carolina, hereinafter: known as the COMMISSION; and
Clark Forest Family Campine Resort_, a corporation/general partnership'
registered/licensed to do business in the State of North Carolina,
hereinafter known as the DEVELOPER.
WITNESSETH:
1. The DEVELOPER is the okrne37 of certain lands lying in
Transylvania County, upon which it is erecting and will erect
.a'viviliiig unit- and' t..er -improvements, said ,..e' - 1--
Black Forest Familyi Camping (hereinafter the Development) .
Resort
2. The DEVELOPER desires, to construct a, wastewater collection
system with pumps, wastewater treatment works and/or disposal
facilities (hereinafter Disp System) to provide sanitary sewage
disposal to.serve the Development o said lands.
3. The DEVELOPER has applied to the COMMISSION for the issuance
of a permit pursuant to G.S. 143-215. 1 to construct, maintain, and
operate the Disposal System..
4. The DEVELOPER has created or shall create unit ownership in
said dwellings units, other improvements and lands through filing of a
Declaration of Unit Ownership (here:i371after Declaration), pursuant to
Chapter 47C of the North Carolina General Statutes.
.5. The DEVELOPER has caused to be formed or will cause to be
formed at the time of filing of the Declaration, the
N/A _, (hereinafter Association) a non-profit
(Unit Owners Association)
corporation organized and existing under and by virtue of the laws of
the State of North Carolina, for the purpose, among others, of handling
the property, affairs and business of t;-iL Development;' of operating,
maintaining, re -constructing and repairing the common elements of the
lands and improvements subject to unit ownership, including the
Disposal System; and of collecting dues and assessments to provide
funds for such operation, maintenance, re -construction and repair.
6. The C=IIS.SION desires to assure that the Disposal System of
the Development is properly constructed, maintained and operated in
accordance with law and permit provisions in order to protect the
quality of the waters of the State and the public interest therein.

NOW, THEREFORE, in consideration of the promises and the benefits
to be derived by each of the parties hereto, the COMMISSION and
DEVELOPER do hereby mutually agree as follows:
1. The DEVELOPER shall construct the Disposal System in
accordance with the permit and plans and specifications hereafter
issued and approved by the COMMISSION; and shall thereafter properly
operate and maintain such systems and facilities in accordance with
applicable permit provisions and law.
2. The DEVELOPER shall not transfer ownership and/or control of
the Disposal System to the Association until construction has been
completed in accordance with the permit and approved plans, and the
staff of the Division of Environmental i•ialiage-aie„t h,as ins-, ected and
approved of the facilities. In order to change the name of the permit
holder, the DEVELOPER must request that the permit be reissued to the
Association. The request must include a ropy of: the Association Bylaws
and Declaration.
3. The DEVELOPER shall provide in the Declaration and
Association Bylaws that the Disposal System and appurtenances thereto
are part of- the common elements and shall thereafter be properly
maintained and operated in conformity with law and the provisions of
the permit for construction, operation, repair, and maintenance of the
system and facilities. The Declaration and Bylaws shall identify the
entire wastewater treatment, collection and disposal system as a common
element which will receive the highest priority for expenditures by the
Association except for Federal, State and local taxes, and insurance.
4. The DEVELOPER shall provide in the Declaration and
Association Bylaws that the Disposal System will be maintained. out of
the common -expenses. In order to assure that there shall be funds
readily available to repair, maintain or construct the Disposal
System, beyond the routine operation and maintenance expenses, the
Declaration and Association Bylaws :shall provide that a fund be created
out -of the common expenses. Such fund shall be separate from the
routine maintenance allocated for the facility and shall be part of the
yearly budget.
5. In the event the common expense allocation and separate fund
are not adequate for the construction, repair, and maintenance of the
Disposal System, the Declaration and Association Bylaws shall provide
for special assessments to cover such necessary costs. There shall be
no limit on the amount of such assessments, and the Declaration and
Bylaws shall provide that such special assessments can be made as
necessary at any time.
6. If a wastewater collection system and wastewater treatment
and/or disposal facility provided by any city, town, village, county,
water and sewer authorities, or other unit of government shall
hereinafter become available to serve the Development, the DEVELOPER
shall take such action as is necessary to cause the existing and future
wastewater of the Development to be accepted and discharged into said

speculative NPDES permit limits for a new campground facility located in Transylvania
County. Unfortunately, the Division of Environmental Management (DEM) does not have
the resources to provide speculative limits for privately owned facilities. In order to receive
NPDES permit limits, the facility will have to submit a permit application along with the
appropriate processing fees to the Permits and Engineering Unit.

Wastewater Treatment Facility
Black Forest Campground
Transylvania County
We are currently working on the development of a new campground facility located in Transylvania
County. The campground will have a total of 201 RV sites, 84 tent sites, 20 cabins, and a 6 bedroom bed
and breakfast facility. Estimated maximum wastewater discharge is 40,890 gpd. Phase one development
`\ will be 22,750 gpd. The proposed new facility will have a design flow of 0.041 MGD and will discharge into
Walker Creek. The proposed plant location is shown on the enclosed location map. Treatment facilities at
the proposed plant will consist of primary screening followed by secondary treatment utilizing the activated
sludge process in a package type wastewater treatment plant.
We are hereby requesting that you provide us with speculative NPDES permit limits for the design flow
of 0.041 MGD. The discharge point is as shown on the enclosed location map.
