Authorization is hereby granted for the improvements to Dana Hill Wastewater Treatment Plant (WWTP). In general, this ATC allows: • The proportional splitting of flow to the 0.02 MGD package plant and the refurbished 0.01 MGD package plant, • The addition of a 500 gallon baffled chamber for dechlorination of treated wastewater from both package plants (0.02 MGD and 0.01 MGD), • An effluent composite sampler to be installed at the end of all treatment components (for final effluent sampling of treated wastewater), • and all additional piping and appurtenances. Once construction under this ATC has been completed and an Engineer's Certificate has been submitted, the permittee is authorized to operate the units listed above, with permitted limits as specified in the NPDES permit NCO073393 issued November 8, 2000. This Authorization to Construct permit will allow the increase in permitted flow from 0.02 MGD to 0.03 MGD design flow ,for Dana Hill WWTP. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional wastewater treatment units or modification of treatment units. This Authorization to Construct is issued in accordance with NPDES Permit No. NCO073393 issued November 8, 2000, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in the permit. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. The Asheville Regional Office, telephone number (828) 296 - 4500, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the water pollution control treatment system by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8G, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, 1I1, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions outlined in Title 15A, Chapter 8G, .0204. Once the facility is classified, the Permittee must submit a letter to the Certification Commission which designates the operator in responsible charge within: (A) Sixty calendar days prior to wastewater being introduced into a new system or (B) within 120 calendar days of the following, (i) after receiving notification of a change in the classification of the system requiring the designation of a new ORC and back-up ORC or (ii) a vacancy in the position of ORC or back-up ORC. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct and the approved plans and specifications. Both plants are full package plants with tablet chlorination. This addition also includes a dechlorination basin and composite effluent sampling. REVIEW SUMMARY Executive Summary The subject facility received an NPDES renewal permit November 8, 2000. This facility also received an ATC for a 0.02 MGD package plant February 18, 1999 with the stipulation that if the 0.01 MGD plant were to be used - flow proportioning between the plants must be provided. This ATC includes the flow proportioning, along with dechlorination and effluent composite sampling. Application/Plans Prepared by: Jon H. Laughter, P.E. Laughter, Austin, and Associates, P.A. 131 Fourth Avenue East Hendersonville, NC 28792 Project Location: Henderson County Review Notes: The existing splitter box in the 0.02 MGD plant will be used to split flow to the 0.02 MGD plant and the refurbished 0.01 MGD plant. Both package plants have tablet chlorination with 30 minute contact time. With this ATC, the permittee is being proactive and adding a 500 gallon baffled chamber for dechlorination (tablet). Effluent sampling is shown at the beginning of dechlor chamber - this should be placed at the end of the chamber. This ATC will increase the permitted flow to 0.03 MGD (for which it is permitted). Mr. Roy Davis, ARO, strongly recommends issuance. Although the plans are somewhat inadequate - he has spoken with the operator and assures me that the operator will make this work properly. Due to this and the minimal requirements for this ATC, I will issue it. The facility is being proactive with dechlorination. The plans indicated effluent sampling at the beginning of dechlorination. The request is seeking permission to construct appurtenances necessary to reactivate a 10,000 gpd package plant to be operated in parallel with a 20,000 gpd plant currently in operation. Specifically Jon Laughter proposes to construct a tube type effluent dechlorination system, relocate the recording flow meter, install a composite sampler and modify an existing influent flow splitter to serve both plants. On July 7, 2004 I visited the plant in the company of the owner and ORC. I recommend that you issue the requested Authorization to Construct based on the information we currently have in our hands. I have confidence that the ORC can take the plans and modify the Dana -Hill sewage treatment plant in such a way that it will work quite satisfactorily. Jon Laughter submitted a completion certification for it on August 19, 2002. 073393ACB was issued on February 18, 1999, for a new 0.02 MGD plant. No completion certification was submitted, though Laughter did say that the plant was "in service" in the letter accompanying the certification for 0073393AC. Permit 073393ACB states that another AtC "for flow -proportioning facilities must be requested" before the Permittee can operate the two treatment trains together [for a total capacity of 0.03 MGD]. There's no record that the owner (Vito Montaperto), the engineer (Laughter) or their contract operator (Harry James of James & James) has ever requested such an AtC. Vito called me in November asking for proof we had received the completion certificate for the 0.01 MGD plant; I faxed it to him. Laughter called me in December asking for the same thing; I faxed it to him. You asked for it last month - I faxed it to you. Larry James called yesterday, and I fared it to him. It sounds from your message that what they really wanted was an AtC for operating both plants together, and we have NO RECORD THATfANYONE EVER REQUESTED IT. Further, if any of the parties involved has asked me for "approval to operate both plants", I could have researched the problem long ago. however, I received a succession of calls asking for approval "to use the 10,000-gallon plant", which I provided. Thus my confusion and extreme frustration, and thus our current problem. If they want to operate the 0.01 MGD train, they can. If they want to operate the 0.02 MGD train, they can. If they want to operate the two trains together, they must request an AtC and show how flow will be proportioned among the two trains. I recommend they contact Susan Wilson or Mike Templeton in our Unit for advice on preparing the AtC request. I don't issue AtCs and could offer little help. A review of ARG filed does not produce a copy of an A to C for the necessary improvements to operate the two preatment plants in parallel. In my dealings with the owners and their consulting engineer that will be my position. If I am wrong please I -et me know before I start sawing on this limb I am sitting on. An existing permitted 10,000 GPD (0.01 MGD) WWTP which has been disconnected from service in the past, has recently undergone a complete re -conditioning. Mr. Montaperto intends to put this permitted plant back into service along with the 20,000 gpd plant to expand his treatment capacity. This would provide a total treatment capacity of 30,000 gpd. This combination of the two plants will provide flow proportioning of the facilities.
