Subject: Clarification of Applicable Regulations
Pursuant to 15A NCAC 02T .0506
Water's Edge WWTP
Permit No. WQ0002001
Rowan County
Please find attached a copy of the subject regulation and permit. Specifically, please review item 15A
NCAC 02T .0506(f), which states as follows:
"Habitable residences or places of assembly under separate ownership constructed after
the non -discharge facilities were originally permitted or subsequently modified are
exempt from the setback requirements in Paragraphs (a) and (b) of this Rule."
The Water's Edge WWTP, a non -discharge facility (Permit No. WQ0002001), has been previously
permitted and constructed with an original permit date of 1986. Therefore, pursuant to 15A NCAC
02T .0506(f) noted above, no setback requirements apply to the construction of a habitable residence or
place of assembly under separate ownership. However, please be aware that wastewater treatment
facilities, by their very nature, produce some level of odor that neighbors may find objectionable.
