REQUEST FOR MORE INFORMATION
Dear Mr. Brown:
On November 9, 2007, the Division of Water Quality (DWQ) received your application dated
October 9, 2006 to impact 0.302 acres of wetlands and 126 feet of streams to construct the
proposed residential subdivision.
The DWQ inspected the subject property on January 3, 2006 and observed impacts to wetlands
and streams on the site. The NC Division of Water Quality has not authorized these impacts, and
the site plan that was provided to the Division of Coastal Management does not appear to match
what is currently on the ground. In addition, NPDES General Stormwater Permit NCGO10000
violations were observed, including but not limited to, failure to follow your approved
Sedimentation and Erosion Control Plan and failure to maintain erosion control measures. The
DWQ will require that these violations be resolved prior to reviewing your CAMA Major
application and processing and/or denying a 401 Water Quality Certification. An official Notice
of Violations from DWQ will follow this letter. Please note that DWQ will also require other
additional information in order to process your application to permanently impact protected
wetlands and streams on the subject property; however, the violations must be resolved before
this Office will continue the review. Therefore, the project is being placed on hold, and unless
the violations are resolved, DWQ will have to move toward denial of your application as
required by 15A NCAC 2H .0506.
In your efforts to resolve these violations, this office strongly recommends that you schedule an
on site meeting with staff from the NC Division of Water Quality, the NC Division of Land
Resources, the NC Division of Coastal Management and the U.S. Army Corps of Engineers.

This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your
