PROJECT DESCRIPTION: The project site is located off Stone Chimney Road, near Supply, adjacent to the Lockwoods Folly River, in Brunswick County. To get to the site from Wilmington take US Hwy 17 S to NC Hwy 211, turn left- onto NC Hwy 211 and travel approximately 0.3 miles to Stone Chimney Road. Turn right onto Stone Chimney Road and travel approximately 2.1 miles to Eden Drive SW, turn left onto Eden Drive SW, and travel approximately 0.2 miles to the beginning of the project site. Eden Drive SW runs through the subject property, which is a 60-acre tract of land, which extends to the Lockwoods Folly River. The property has approximately 13.63 acres of § 404 and coastal wetlands. The property is bordered to the east by the Lockwoods Folly River with approximately 390 lineal feet of shoreline, and surrounded by vacant land to the north, west, and south. The property is primarily undeveloped and is forested with hardwoods, conifers, and native underbrush. The only man-made features currently on the property consist of a dirt road. The current average elevation of the property ranges from approximately 10' to 30' above mean sea level (MSL). The high ground portion of the property has been largely untouched with the exception of some preliminary clearing activities landward of the 75' Estuarine Shoreline Area of Environmental Concern (AEC) which have already begun for the road construction. There is a vast stance of coastal and §404 wetlands which border the eastern side of the property and span approximately 550' to 650' to the normal high waterline (NHW) of the Lockwoods Folly River. The coastal wetlands consist primarily of Salt Marsh Cordgrass (Spartina altern~ora), Giant Cordgrass (Spartina Cynocoroides), Sea Lavender (Limoniznn, Spp. ), Spike Grass (Distichlis Spicata), Bulrush (Scirpus spp.), and other species in this area include Bald Cypress (Ta.~odium distichum). The highround vegetation primarily consist of Loblolly Pine (Pinus taeda), Water Oak (Quercus nigra), and Red Maple (Ater rubrum). The Brunswick County Land Use Plan classifies the upland areas of this project as Rural, Conservation. The waters of the project site are classified as SC, HQW by the NC Division of Water Quality. The NC Division of Marine Fisheries has designated this. area of the Lockwoods Folly River as a Primary Nursery Area, and the waters adjacent to tl~e proposed project are closed to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to create a 92-lot single-family subdivision and related infrastructure and amenities. In addition, the applicant is proposing to install an 8-slip docking facility and access pier. The proposed roads would result in permanently impacting approximately 0.30 acres of §404 wetlands and approximately 126 linear feet of stream channel which are all located outside the 75' Estuarine Shoreline AEC. The proposed stream and §404 wetland crossings would be accomplished by the placement of reinforced concrete pipe culverts. Two (2) culverts would be placed in the stream channel (one 24' in diameter by 50' in length, and one 36' in diameter by 52.5' in length) and then backfilled for the road construction (see sheet W2 Area A and sheet W3 Area E for location). The applicant proposes to off-set the §404 wetland impacts by the preservation of all remaining wetlands (approximately 12 acres) on the property. The applicant proposes to accomplish this via a conservation easement or transfer to the North Carolina Environmental [sic] Enhancement Program. Details of the wetland impacts and culvert placements are shown on sheets W2 - W 13. The applicant proposes to create 92 lots for single-family dwellings, giving a density of 1.5 units per acre. No individual units are proposed as part of the application package. As such, each individual property owner proposing to develop within any AEC would be required to obtain their his/her own individual CAMA permit. The applicant is proposing an 8-slip docking facility, which would be located at the eastern side of the project site adjacent to the Lockwoods Folly River near the northeast property line. The access pier would be approximately 6' wide by approximately 765' in total length and would be elevated at least 3' above the marsh.. The platform would create an "L-head" configuration designed to follow the waterward edge of the shoreline. The applicant is also proposing 8 floating docks each measuring approximately 16' in length by 6' in width and would be parallel to the shoreline. Each floating dock would be connected to the platform by indi~~ ideal ramps, each measuring approximately 3' wide by 12' in length. The application indicates that the floating docks would extend into the Lockwoods Folly River approximately 16' and the water depths at the waterward side of the floating docks would be -7.5' relative to Mean Low Water (MLW) within the area of the proposed 8 slips, which would be located on the waterward edge of the proposed floating docks (See Sheet 1 of 2). 10. ANTICIPATED IlVIPACTS The proposed upland development for the subdivision would not be located within the 75' Estuarine Shoreline AEC. Tl~e proposed docking facility would incorporate approximately 768 ft.z of Estuarine Waters and Public Trust Area. The proposed pier would shade approximately 4590 ft.z of coastal wetlands. The proposed subdivision, installation of the roads, utilities and stormwater measures would disturb approximately 45 acres of highground and approximately 0.30 acres of § 404 wetlands. Minor increases in turbidity should be expected during construction. The proposed floating docks would extend approximately 16' into the waterbody, which measures approximately 90 feet across on the eastern end of the property. The proposed distance would conform to the 1/4 width rule, but may encroach into the U. S. Army Corps of Engineers Federal Channel Setback. Brown Sr. Family LLC has proposed the development of the Ruffin's River Landing subdivision in Brunswick County, North Carolina. The 60-acre project area is located south of NC 211 between Stone Chimney Road and the Lockwoods Folly River. Eden Drive SW (private road) passes through the property. The proposed project includes 92 single family residential units, a clubhouse and pool, paved roads, utilities, and an eight-slip boat dock on the Lockwoods Folly River. The undeveloped property is currently occupied by a combination of upland pine-hardwood forest, wet pine flatwoods, hardwood swamp forest, and tidal marsh. The only existing man-made features on the tract consist of dirt roads. The proposed dock is the only portion of the project that would be located in an AEC. The dock walkway would cross approximately 700 feet of tidal marsh along the Lockwoods Folly River. The walkway would lead to eight floating docks (finger piers) in the Lockwoods Folly River. Dock construction would begin in the uplands, and additional pilings and construction materials would be transported along the dock as it is constructed. All pilings would be installed by hand using a high pressure hose to set the pilings in the substrate. All decking would be installed at a height at least three feet above the top of the existing marsh vegetation. No heavy machinery would be placed in wetlands at any time during the dock construction process. The floating docks would extend into the river a distance of 16 feet beyond the marsh vegetation. Subdivision construction would involve land clearing and grading with heavy machinery such as bulldozers, track hoes, and backhoes. Additional construction methods would include typical residential construction methods. Initial construction would include clearing, grading, and the installation of infrastructure (roads, curbs -and gutters, and utilities). Individual lots would be developed as they are sold, and the clubhouse and pool would be constructed at an unspecified later date. The total percent impervious area would be 30 percent. Plans for the subdivision were approved by the Brunswick County Planning Board on 28 November 2005 (see enclosure). An erosion and sedimentation control plan (BRLTNS-2006-388) and a stormwater certification (SW8060325) have been issued by the state. Wetlands on the property have been delineated, and the wetland survey plat has been approved by the Corps of Engineers (Action ID 200501267). Road crossings associated with the subdivision would permanently impact 0.30 acre of Section 404 (Non-Coastal Wetland) wetlands and 126 linear feet of stream channel. These impacts would result from eight wetland road crossings and two wetland/stream road crossings (see attached table). Wetland and stream impacts were minimized by limiting impacts to the minimum required to provide access for future residents. Stream impacts were also minimized by incorporating retaining walls into the stream crossing design plans. In addition, additional acreage was added to the project area to enable the reduction of wetland impacts, while maintaining a sufficient number of lots. The two RECEIVED DCM WILMINGTON, NG O C T II 9 2006 stream crossings, as well as two of the eight wetland crossings, would involve the placement of reinforced concrete pipe culverts. Culverts would be placed in the stream channel and backfilled for road construction. Wetlands on either side . of the culverts would be permanently impacted as described above. Proposed mitigation to off-set Section 404 wetland impacts includes the preservation of all remaining wetlands on the property. This would include approximately 12 acres of undisturbed wet pine flatwoods, small stream swamp, and tidal salt marsh wetlands. Preservation would be accomplished via conservation easement or transfer to the North Carolina Environmental Enhancement Program.
