Wildlands Engineering Inc. (WEI) and DMS are requesting a minor project change (crossing update from a bridge to a
culvert) on the Lyon Hills Mitigation Site. Proposed mitigation credits are not anticipated to change based on the
crossing update.
DMS understands that WEI has contacted the USACE and DWR and a 404/401 permit modification is not necessary for
this minor change.
The crossing change is documented in the attached mitigation plan addendum and will also be documented in the
project's post construction MYO - As -Built/ Record Drawing report.
Project construction is scheduled to begin on October 5, 2020.
Please review and let us know if have any questions, comments or concerns. Unless there is an issue, WEI plans to begin
construction on the site as scheduled.

The purpose of the memorandum is to describe a minor change to the final Lyon Hills Mitigation Plan. Section
3.6 of the mitigation plan submitted in July 2020 includes discussion of six crossings on the project site including
four culverts, a ford, and a bridge. The bridge crossing was proposed for Hanks Branch Reach 2. Due to cost of
construction, it is necessary to change this crossing from a bridge to a double culvert crossing. Table 6 —
Easement Breaks and Crossings in Section 3.6 needs to be amended and the new table is shown below. In
addition, Table 19 — Determination of Credits has a notes column where it is indicated that there is a 42-foot
wide crossing with a bridge on Hanks Branch Reach 2 that is excluded from credit. This table also needs to be
revised and the new version is shown below. These are the only two places in the final mitigation plan where
the bridge was discussed. The width of the easement break will not change so there is no change in credits. A
detail for the new culvert crossing on Hanks Branch Reach 2 is attached.
The two pipes that were originally in this location were 20 feet long. The two new pipes will be 39 feet long
which will create approximately 19 linear feet of additional stream impact. This was discussed with Kim
Browning on September 17t" and Kim indicated that she wanted the additional impacts reported in this memo
but that it would not require a change and resubmittal of the PCN. She also stated in an email on September
22"d that the crossing would be exempt from 404 permitting requirements because its an agricultural crossing.
Erin Davis indicated in an email on September 215Y that no 401 certification modification would be required for
the same reason. Construction of this project is scheduled to begin on October 5t". Please let us know if any
additional information is needed either to support the amendment to the mitigation plan or regarding the
additional stream impacts.

I just wanted to follow up with our conversation from last week and confirm that since the crossing is determined to be ag exempt, it will not get authorized as an impact and is
therefore not included in the impact length, and a permit modification will not be required. (This assumes that you have met the requirements of the exemption, including avoiding
and minimizing impacts for the crossing.)

Correct, as long as the failed culvert replacement occurs "in place" and you're not extending the footprint of the culvert or installing additional dissipater pads, no permit mod is
required.

Kim & Erin - I asked Charlie to determine if there would be a change in stream impacts due to the switch from bridge to culvert. There are no wetlands in that location. This is
what he said: The crossing will serve an established, ongoing agricultural operation so we expected it to be exempt from 401/404 permitting. No impact length associated with
this crossing was submitted in the PCN. Therefore there is no change in impacts. Does that make sense? If this is correct, then we don't need to change the permits, right? It may
also help to know that an agricultural crossing that was previously established at this location failed in September of 2018 (Hurricane Florence), so we will just be replacing the
culverts. Thanks.

I apologize for the delayed response. If the new culvert meets all of the requirements for the
agricultural crossing exemption, then a 401 WQC approval modification is not needed.

Erin — I tried to call to discuss this and got your voicemail message. I spoke with Kim about this
yesterday but also want to let you know the new culvert (that replaces the bridge) on Lyon Hills will
be about 19 LF longer than the original culvert in that location. Do we need to do anything or
provide any additional information in terms of the 401 permit? Please let me know ASAP. We are
