PROJECT SUMMARY: The applicant is proposing to expand an existing private docking facility, with a proposed access walkway, fixed platorm, gangway, and floating dock expansion which would increase the existing slip count from two to four. 229 Marsh Hen Derive Roy Holdford Page Two 9. PROJECT DESCRIPTION The project site is located at 229 Marsh Hen Drive, off Channel Haven Canal and adjacent to the AIWW/Myrtle Grove Sound, in Wilmington, New Hanover County. To locate the property of interest from the Wilmington Regional Office (WiRO), travel southwest on Cardinal Drive Extension until you reach Eastwood Road. Turn left at Eastwood Road and travel east approximately 2.0 miles until you reach Military Cut -Off Road. Turn right on Military Cut -Off Road and continue onto Oleander Drive for approximately 3.3 miles until you reach Pine Grove Drive. Turn left onto Pine Grove Drive and travel south for approximately 2.0 miles until you reach Masonboro Loop Road. Turn right onto Masonboro Loop Road and travel south approximately 2.5 miles until you reach the Channel Haven subdivision, which would be located on the left. Turn left onto Channel Haven Drive South and then turns right to stay on Channel Haven Drive North. Travel 0.3 miles and turn right onto Marsh Hen Drive, and the property of interest will be on the left. The project site is approximately 0.33 acres and the primary vegetation consists of maintained lawn grass and ornamental landscaping. Currently the property has a single family residence, driveway, and shed. The project site has approximately 104 LF of shoreline frontage along Channel Haven canal and is currently stabilized with a bulkhead. The elevation on the property ranges from 0 to 14 ft above NHW. The Channel Haven Canal is manmade and the area surrounding it is a developed residential neighborhood, bordered by homes to the north and south. Existing structures on the project site include a single-family residence and a private docking facility, which includes a gangway for access (-6'x 3') extending waterward from the bulkhead, which lands on a floating dock (-6' x 50'), oriented parallel to the shoreline. No CAMA permits related to the docking facility were found, however aerial photography depicts is current configuration prior to 1993. A database search did return CAMA General Permit No. 44874-D, which was issued on 7/6/2010 for the replacement of the bulkhead. At the project site, the canal is approximately 65' wide, and connects with the AIWW approximately 1600' to the east of the subject. The New Hanover County Land Use Plan classifies the adjacent waters and the adjacent high ground portion as Conservation. The property is zoned as Residential (R-15). The waters of Channel Haven Canal are classified as SA by the NC Division of Water Resources. These waters are designated as PNA by the NC Division of Marine Fisheries and are closed to the harvest of shellfish. PROPOSED PROJECT The applicant is proposing to expand an existing private docking facility, with a proposed access walkway, fixed platform, gangway, and floating dock expansion which would increase the existing slip count from two to four. The applicant is proposing to remove the existing access gangway, and construct a deck and access area (18' x 10') in the 30' buffer for Coastal Shorelines, landward of the existing bulkhead. The access area would lead to a proposed fixed platform (10' x 10') extending in a waterward direction to the northeast, overhanging the existing bulkhead. From the proposed fixed platform, the applicant is proposing a gangway oriented in a southeasterly direction, paralIeI to the shoreline, landing on a 90' x 6' floating dock in the same orientation. The proposed extension of the floating dock from 50' to 90' in length would constitute an increase from 2 existing slips to four proposed slips. The applicant states that the construction methodology will consist of utilizing hand tools to complete the access pier, and floating dock extension. 229 Marsh Hen Drive Roy Holdford Page Three 10. ANTICIPATED IMPACTS As proposed, the proposed structures would extend approximately 10' into the canal where the water body is approximately 65' wide, meeting the '/4 width rule. As proposed, the facility would encroach into the adjacent 15' riparian corridor setback on both the eastern side 233 Marsh Hen Drive (Rogers) and the western side at 229 Marsh Hen Drive (Smith) but the applicant has obtained the necessary waiver from both property owners to allow for the encroachment and included this in the application. The proposed structures would be located 2' feet away from neighboring riparian corridor line on each side, and approximately 15' away from neighboring docking facilities to the east, and 17' away from the neighboring docking facility to the west. The application states that the proposed facility would accommodate four (4) vessels in total. The proposed docking facility would shade incorporate 640 SF of open water public trust area and incorporate 180 SF of high ground. Minor increases in turbidity should be expected during construction. If this agency does not render a permit decision within 70 days from September 28, 2020, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road.
