The NCWRC is willing to grant the requested additional extension into the anadromous fish moraotirium for Greenville
Utility Commission's (GUC) raw water intake project in the Tar River, provided our recommendations are followed. All
work should occur within the already constructed coffer dam and should be completed, along with the removal of the
dam, no later than March 31, 2010. It is our understanding that the removal of the dam would require the use of a
vibratory hammer and we recommend that GUC use the quickest and least environmentally damaging methods to
remove the sheet piling from the river substrate and minimize sound and vibrations from the hammer to the greatest
extent practicable. There is currently a turbity curtain that is in place which we recommend being in place during the
removal of the coffer dam.
The NCWRC appreciates the coordination with us for the request for this extension. Please feel free to contact me if you

I understand Josh is out of the office. We received the following email from DWQ stating that Wildlife Resources
Commission (WRC) concurs with a March 31St extension. This should fulfill the WRC condition of the USACE 404 permit
modification that Josh sent this morning. As such, GUC is continuing work and will touch base with the agencies next
week on project status.

Shearin, Bennett Wynne left me another message this morning indicating he would support granting an extension (to
the previously granted extension) for the work to be completed by March 31, 2010, with the request that the extension
be conditioned such that noisy vibrating equipment utilization be kept to a minimum. Additionally, I would request that
all parties reassess the project by mid-week of next week (March 22 - March 26, 2010) to determine if the project can
realistically be completed by March 31, 2010. Thanks, Ian McMillan

Thanks Sharon. Ian McMillan (DWQ) is granting us a conditional approval until March 31St since Wildlife Resources
Commission is not ready to make a decision. If WRC makes a decision prior to the 31s' then DWQ will revise their permit
as necessary. Is there any chance the USACE is willing to do the same so GUC can complete work and get out of the river
as soon as possible? We would greatly appreciate it. Please advise.
