The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR)
received and accepted a signed Permit Transfer Application Form for the subject project on January 16,
2020 with additional information requested on March 17. 2020 and received on May 12, 2020. The
current and proposed permittees have requested to transfer the permit in accordance with 15A NCAC
02H.1045(1)(a). A preliminary in-depth review of the documentation submitted with the transfer request
determined that the application is incomplete and that additional information is needed.
To continue the review and processing of this transfer request, please provide the following
documentation in a single, hard copy submittal packa>7e to complete the application and demonstrate
compliance with the permit:
15A NCAC 02H.1045(2)(b)(ii): The documentation provided from the NC Secretary of State for
Sensation Weigh Properties, LLC identifies Todd Porterfield as the manager of this LLC instead
of Gabe Soriente as identified in Section E.3 of the application. Since Mr. Soriente is listed in
Section E.3 and signed Section F of the application is not listed with the documentation provided
from the Secretary of State, please either:
a. provide official documentation demonstrating that Mr. Soriente is a manager of this LLC,
or;
b. provide a letter of authorization from Mr. Porterfield and update Section E.3 of the
application to reflect Mr. Porterfield as the manager of this LLC.
All of the requested information listed above should be received in this Office by June 10, 2020, or the
application will be returned as incomplete. Please note that only two letters requesting additional
information is allowed in the State Stormwater Program for a total of 30 days to submit the requested
additional information. The Division is allowed 90 days from the receipt of a complete application to
transfer the permit. If the information is not satisfactorily provided after either this second request. the
project will be returned. if the project is returned and you wish to re -submit later, you will need to
resubmit all required items at that time, including the application fee.

Please note that if, upon review of the submitted information or upon a deficient compliance inspection of
the project, it is determined that a major modification to the permit is required to resolve the compliance
issues, the transfer application will be returned as incomplete. Upon the issuance of the modified permit,
and the successful completion of any work required by the modified permit and/or the restoration of the
site to design condition, the applicant will need to submit an updated transfer application and a new fee to
the Division to start the transfer process over again.
Please remember that the permittee is responsible for complying with the terms and conditions of the
permit and the approved plans and specifications until the Division approves the transfer request.

addressing any compliance issues, the project must found be in compliance with the permit prior to
approving the transfer. To continue the review and processing of this transfer request, please provide the
following documentation in a single, hard cony submittal package to complete the application and
demonstrate compliance with the permit:

4. On February 27, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected the subject project to detennine the status of compliance
with this permit, last issued on September 12, 2019. DEMLR file review and site inspection
revealed that the site is not in compliance with the terms and conditions of this permit. A copy of
the completed form entitled "Compliance Inspection Report" summarizing the findings of the
recent inspection is attached to this letter. Please either address the following items to
demonstrate compliance with the permit or submit a plan of action that provides a timeline in
which the following compliance issues will be resolved. If the proposed permittee would like to
accept responsibility for resolving these items, please submit a new Section F of the application
with that option selected.

Attached are the Stormwater Permit Certifications that you requested last month. Both sites are partial certifications, as
neither are complete. 1501 Sensation Weigh does not yet have its Travelift-Lift Piers/Pit-Concrete approach aprons,
docks and marina necessities or the #57 stone (4" min thick) on a geotextile expanded boat storage per last year's
permit action. 1201 Sensation Weigh is still lacking two of its long intended buildings, and one additional one, currently
a membrane structure, is only partial size.
Hope this allows you to complete the permit transfers.

The Beaufort Marine Center (1501 Sensation Weigh) permit was modified in September 2019. The permitted footprint
has not yet been constructed in totality, as the change in ownership only happened recently. I will be glad to certify the
project's completion, when the project is completed. I am currently working with Mr. Soriente on a possible update to
slip layout and Travelift location for CAMA, which will of course, require a plan revision or minor modification for
stormwater.
Likewise for Moores Marine Yacht Center. I will be glad to certify the existing stormwater plans, but I do want to verify if
Mr. Soriente is happy'with the existing plans or if a plan revision/plan modification is prudent.
I'd say that I will be making a site visit in the near future, but it might be delayed by ongoing CDC and State social
distancing requirements. I definitely trigger multiple check boxes for being an old dude.

received and accepted a signed Permit Transfer Application Form for the subject project on January 16,
2020. The current and proposed permittees have requested to transfer the permit in accordance with 15A
NCAC 02H.1045(1)(a). A preliminary in-depth review of the documentation submitted with the transfer
request determined that the application is incomplete and that additional information is needed.
Since the transfer was submitted under NCAC 02H.1045(1)(a) and the proposed permittee did not select
the option in Section F of the application form where they agree to be the entity responsible for
addressing any compliance issues, the project must found be in compliance with the permit prior to
approving the transfer. To continue the review and processing of this transfer request, please provide the
following documentation in a single, hard _copy submittal package to complete the application and
demonstrate compliance with the permit:
'I/ l . 15A NCAC 02H.1040(4): Section E.I of the transfer application lists the proposed permittee as
the purchaser. However, the provided documentation implies that Sensation Weigh Properties,
LLC is already the property owner. Please confirm the response in Section E. l of the application.
2. 15A NCAC 02H.1045(2)(b): The documentation provided from the NC Secretary of State is for
Banks Boatworks, LLC instead of Sensation Weigh Properties, LLC (i) Please provide
documentation showing Sensation Weigh Properties, LLC is an active corporation in good
standing with the NC Secretary of State. (ii) If the designated person listed in Section E.3 and
�j signed Section F is not listed with the documentation provided from the Secretary of State,
official documentation showing the titles and positions held by the signing official must be
provided.

4. On February 27, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected the subject project to determine the status of compliance
with this permit, last issued on September 12, 2019. DEMLR file review and site inspection
revealed that the site is not in compliance with the terms and conditions of this permit. A copy of
the completed form entitled "Compliance Inspection Report" summarizing the findings of the
recent inspection is attached to this letter. Please either address the following items to
demonstrate compliance with the permit or submit a plan of action that provides a timeline in
which the following compliance issues will be resolved. If the proposed permittee would like to
accept responsibility for resolving these items, please submit a new Section F of the application
with that option selected.
v-'a. Permit Condition IL 10 and 15A NCAC 02H.1042(4)(a): A copy of the certification for
the most recent version of the permit could not be found in the file. Please provide a
copy of the Designer's Certification (partial or final) confirming that the project was built
in compliance with the approved plans.
All of the requested information listed above should be received in this Office by April 2, 2020, or the
application will be returned as incomplete. If additional time is needed to submit the requested
information, please email your extension request prior to this due date to the email address provided
below with a justification and a date of when the requested information will be submitted, which shall be
no later than 15 days past the original due date. Please note that only two letters requesting additional
information is allowed in the State Stormwater Program for a total of 30 days to submit the requested
additional information. The Division is allowed 90 days from the receipt of a complete application to
