Stewart is submitting additional requested materials for the express stormwater review for
permit modifications to the issued State Stormwater permit for the noted project.
In response to comment la, an additional label has been added to 02-CB to clarify the
requirement for the upturned elbow. Sheets C-135-Pl and C-136-PI have been included to
document this change.
In response to comment 1b, the previously submitted plans called out the upturned elbow as
being required to provide 9.50" of storage. This exceeds the required depth of storage for all
proposed permeable pavement systems.
In response to comment 2, row 23 has been corrected to accurately reflect the depth to the
seasonally high water table. An updated hard copy of the supplement has been provided to
document this change.
In response to comment 3, the updated supplement form has been emailed to provide an
electronic copy.

to provide full response and documentation for all requests.

I'm sorry for the delay. I was not in the same location yesterday as the file. Thank you for directing my attention to the
call out for 9.5". 1 had missed that. If it is intended to provide an overflow 9.5" above the bottom of the aggregate
depth, the resulting elevation would be considered the storage elevation and should be listed in Row 22. However, row
22 of the preamble pavement section of the supplement currently lists that the storage elevation provided for DA 5 is
8.35' or 10.2 inches above the bottom aggregate elevation of 7.5'. If it is intended to provide a consistent overflow
depth/elevation, Row 22 of this section of the supplement should be updated to reflect that resulting elevation.

upturned elbows to ensure the minimum storage volume will be contained". As submitted an April 24Ih, the up -turned
elbow detail calls -out a depth of 9.50" for the storage, and all systems require less than 9.50" of storage.

The Wilmington Regional Office received and accepted a modified Express State Stormwater
Management Permit Application for the subject project on April 6, 2020 with additional information
requested on April 16, 2020 and received on April 24, 2020. A preliminary in-depth review of that
information has determined that the application is not complete and that additional information is needed.
To continue the review, please provide the following additional information in a single, hard cony
submittal package:
15A NCAC 02H.1042(2)(g)(vii) and .1050(1) and (5): The plans were updated to include a detail
of an upturned elbow for the perforated pipe proposed within the permeable pavement sections.
Please:
a. Ensure an upturned elbow will be provided on the perforated pipe connecting to 02-CB.
The plans are missing a callout that one will be provided at this structure.
fib. Identify the top elevation of the upturned elbows to ensure the minimum required storage
volume will be contained. Please ensure these elevations are consistent with the storage
elevation of the design rainfall presented in Row 22 of the permeable pavement section of
the supplement.
V 2 15A NCAC 02H.1051(1): Row 23 of the infiltration system section of the supplement for
Drainage Area I lists the depth to the seasonal high water table (SH WT) as 250.32 inches or
20.86 ft. The difference the SHWT and the ground elevation appears to be closer to 10 feet.
Please confirm the depth reported in Row 23 to ensure a typo has not been made.
3. 15A NCAC 02H.1042(2): Please email the supplement form to the email address provided below
so that it can be preserved electronically per the regulatory requirements.
4. Due to the potentially minor nature of these comments, the express additional information review
fee has been waived.
Please remember to confirm that any revised information is presented consistently throughout the

All ofthe requested information listed above should be received in this Office by May 7, 2020, or the
application will be returned as incomplete. If additional time is needed to submit the requested
information, please email your extension request prior to this due date to the email address provided
below with a justification and a date of when the requested information will be submitted, which shall be
no later than 5 business days past the original due date. Please remember that extension requests delay
the issuance of the final permit. Also, please note that only two letters requesting additional Information
is allowed in the State Stormwater Program. If the information is not satisfactorily provided after the
second request, the project will be returned. If the project is returned and you wish to re -submit to the
Express Program, you will need to reschedule the project through the Express Coordinator for the next
available review date and will need to resubmit all required items at that time, including the application
fee.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215. l and is subject to enforcement
action pursuant to NCGS 143-215.6A.

Management Permit Application for the subject project on April 6, 2020. A preliminary in-depth review
of that information has determined that the application is not complete and that additional information is
needed. To continue the review, please provide the following additional information in a single, hard
copy submittal package:
15A NCAC 02H.1042(2)(a)(iv) and .1042(2)(0: The drainage area and built -upon area for the
SCMs presented in the calculations are not consistent with the information presented in the
application or supplement. Please confirm the information is presented consistently.

pavement. Since this system is designed to infiltrate, please provide additional details
demonstrating that an upturned pipe or other feature is provided allowing the design
volume to be stored in the permeable pavement prof -tie so that it can infiltrate into the
subsoil. Figure 2 on page 3 of Chapter C-5 of the Stormwater Design Manual provides
c�`w w0_rk4 an example outlet / overflow structure for infiltrating permeable pavement. If such a
feature is not provided, the perforated storm drain provides an opportunity for the runoff
to bypass the infiltration process and would require the permeable pavement systems to
be designed for detention instead of infiltration.

information, please email your extension request prior to this due date to the email address provided
below with a justification and a date of when the requested information will be submitted, which shall be
no later than 5 business days past the original due date. Please remember that extension requests delay
the issuance of the final permit. Also, please note that only two letters requesting additional information
is allowed in the State Stormwater Program. If the information is not satisfactorily provided after the
second request, the project will be returned. if the project is returned and you wish to re -submit to the
Express Program, you will need to reschedule the project through the Express Coordinator for the next
available review date and will need to resubmit all required items at that time, including the application
fee.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215. l and is subject to enforcement
action pursuant to NCGS 143-215.6A.

Stewart is submitting materials for an express meeting for permit modifications to the issued
State Stormwater permit for the noted project. Changes include:
I. Revisions to the permeable pavement on Nutt Street Extension:
In the previously approved plans, the North -South Roadway was called Old
Front Street. It is now called Nutt Street. The alignment of Nutt Street has
also changed since the last submittal, and subsequently the drainage area
for "permeable pavement east A" (DA 5), "permeable pavement east B" (DA
6), and "permeable pavement west" (DA 7) have all changed. The drainage
area for "infiltration system C" (DA 2), "permeable pavement A" (DA 3), and
"permeable pavement B" (DA 4) have not changed since the previously
approved plans.
The previously approved plans had permeable pavement extending beyond
the parking spaces into the Nutt Street roadway for "permeable pavement
east B" (DA 6). The permeable pavement has been reduced and is now only
in the parallel parking places. The roadway grading has been revised so the
road is crowned and only 7.38' of the roadway sheet flows to the permeable
pavement parking spaces, sheet C-136 shows this dimension. This revision
provides a maximum 1:1 ratio of impervious to the permeable pavement.
Plans have also been revised to reflect the City of Wilmington's decision to
proceed with a granite curb in lieu of a concrete curb and gutter.
The remaining portion of the now crowned Nutt Street will sheet flow along
the gutter of Nutt Street to a new storm structure on the west side of the
road near the Cowan Street roundabout. The new storm structure will tie to
the proposed onsite storm network that is ultimately piped to the proposed
Rtank infiltration gallery, "infiltration system A" (DA 1).
The proposed Rtank infiltration gallery on the NW portion of the site has
been expanded to the north to account for added water quality volume
from the road runoff, "infiltration system A" (DA 1).
1. Temporary Condition for Nutt Street Promenade and Alleys:
a. The previously approved plans included the full build out of the Nutt Street
Promenade and the "Alleys" between the adjacent undeveloped parcels and

the North Waterfront Park site with asphalt, granite curbing, and pavers.
The adjacent undeveloped parcels are currently going through the
development review process at the City of Wilmington and upon approval
will be constructing their building improvements right up to the North
Waterfront Park property line. This construction will require that
construction equipment operate in the footprint of the Promenade and
Alleys, which would have destroyed the proposed full build out
improvements along with the associated stormwater treatment system.
b. In lieu of constructing the full build out of the Nutt Street Promenade and
Alleys at this time, the City is proposing to construct an interim condition
consisting of a 15' asphalt walkway in the Nutt Street Promenade and a 5'
concrete sidewalk in the Alleys. The full build out of the asphalt, granite
curb, pavers, and stormwater treatment system in these locations will occur
following the completion of construction of the adjacent parcels. The full
build out condition remains as originally designed and permitted.

If you recall, we set down back in November for a scoping for a permit Mod. For North Waterfront Park. We have
confirmed a design approach and understand that it will require a major permit modification.

To whom it may concern:
Stewart is requesting a express meeting for permit modifications to the issued State
Stormwater permit for the noted project. Expected changes include:
1. Revisions to the permeable pavement on the East side of Nutt Street Extension:
a. The previously approved plans had permeable pavement extending beyond
the parking spaces into the Nutt Street roadway. The permeable pavement
has been reduced and is now only in the parallel parking places. The
roadway grading has been revised so the road is crowned and only half of
the roadway sheet flows to the permeable pavement parking spaces. This
revision provides a maximum 1:1 ratio of impervious to the permeable
pavement.
b. The remaining portion of the now crowned Nutt Street will sheet flow along
the gutter of Nutt Street to a„new storm structure on the west side of the
road near the Cowan Street roundabout. The new storm structure will tie to
the proposed onsite storm network that is ultimately piped to the proposed
Rtank infiltration gallery.
c. The proposed Rtank infiltration gallery on the NW portion of the site has
been expanded to the north to account for added water quality volume
from the road runoff.
2. Temporary Condition for Nutt Street Promenade and Alleys:
The previously approved plans included the full build out of the Nutt Street
Promenade and the "Alleys" between the adjacent undeveloped parcels and
the North Waterfront Park site with asphalt, granite curbing, and pavers.
The adjacent undeveloped parcels are currently going through the
development review process at the City of Wilmington and upon approval
will be constructing their building improvements right up to the North
Waterfront Park property line. This construction will require that
construction equipment operate in the footprint of the Promenade and
Alleys, which would have destroyed the proposed full build out
improvements along with the associated Stormwater treatment system.
b. In lieu of constructing the full build out of the Nutt Street Promenade and
Alleys at this time, the City is proposing to construct an interim condition
consisting of a 15' asphalt walkway in the Nutt Street Promenade and a 5'

concrete sidewalk in the Alleys. The full build out of the asphalt, granite
curb, pavers, and stormwater treatment system in these locations will occur
following the completion of construction of the adjacent parcels. A plan
sheet showing the interim condition will be included with the revised plans.

alternative designs were discussed at the meeting, the requested needed to be clear that those alternatives were not

solution would not be considered an alternative design. We are treating the impervious area in question with a
infiltration gallery that has been expanded to handle the added runoff. I'll include images to help with describing.

The narrative dated January 31, 2020 is not very specific. Since there were alternative designs and variations to the
rules were discussed in the scoping meeting, please update the narrative to clearly describe the proposed design and
demonstrate that it will meet the all applicable requirements and be eligible for the express program. As we discussed
in that meeting, projects that propose alternative designs or variations from the rules are not eligible for the express
program. Types of projects that are not eligible for the express program are listed at the bottom of the express fee
schedule, which can also be found onthis website.

Thank you for choosing to use the Express program. The Express Mormwate submittal meeting has been
scheduled for March 24, 2020 at 10 AM here in the Wilmington DEQ office.
Please remember that the stormwater express program requires the following:
1. The project is eligible for the express process and is not excluded as described in the 2" footnote of the express
stormwater fee schedule.
2. The owner or an employee of the owner who is knowledgeable in the project such as a regional manager or
project manager (but not the consultant) attends the express submittal meeting
3. A submittal package that includes:
a. Originally signed and notarized application forms (copies or unsigned farms are not accepted);
b. The person signing the application forms needs to meet the requirements in .1040;
c. Application fee ($4000); and
d. The submittal requirements in .1042
If the items listed herein are not provided, this will prevent the project(s) from being accepted at the
express submittal meeting. In order to keep the Express program efficient and in an effort to
accommodate as many projects as possible, please let us know in advance if any of these applicable items
cannot be provided at the meeting.
Please let us know of any issues with this date and time. Otherwise, we look forward to seeing everyone then.

To whom it may concern:
Stewart is requesting a scoping meeting to discuss and receive direction on
expected permit modifications to the issued State Stormwater permit for the noted
project. Expected changes include:
1. Revisions to the permeable pavement on the East side of Nutt Street
Extension.
2. Interim condition for the street connection from Harnett Street to the park
(referred to on the plans at Nutt Street Promenade). For a period during
construction of the project and neighboring project, the city plans to use a
simplified emergency asphalt path vs. the paver and pervious concrete
pavement as soon on the plans. At the conclusion of the project the final
condition of the street will be installed per approved plans.
3. The consideration of a stormwater wetland SCM vs. an infiltration gallery at
the southwest portion of the site.

With that known, how best to move forward with our requested meeting? This was a complex project to get permitted
and hoping not to create a mountain out of a mole hill with the request. We just want to be sure we are in good
