Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000 cffective January 1, 2017. We are forwarding Permit No, SW8 180805, dated August 29, 2018, for the construction, operation and maintenance of the built -upon areas and the stormwater collection system and/or vegetated conveyance system associated with the subject project. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. The designated permit holder, Par 5 Development Group, LLC, shall be responsible for meeting the conditions and limitations specified therein. As required for compliance, a copy of the final deed listing Par 5 Development Group, LLC as the property owner must be submitted within 30 days of the property being purchased. Please pay special attention to the permit conditions regarding the limitation of built -upon area, modification of the project., the operation and maintenance of the Stormwater collection system and/or vegetated conveyance system, and'the procedures for changing ownership of and/or transferring the permit. Please also pay attention to the permit conditions that requires the recordation of deed restrictions, easements, and the maintenance agreement, which must all be provided along with certification upon completion of the project. The stormwater runoff from the site will be routed to an infiltration trench operated and maintained by HT of Ocean Isle Beach, LLC (the "Master Permittee') under the terms and conditions set forth in the latest version of Stormwater Management Permit No. SW8 060406 (the "Master Permit"). This permit shall be effective from the date of issuance until rescinded and shall be subject to the following specified conditions and limitations: t. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the approved plans and specifications. The stormwater runoff associated with this project has been approved to be discharged into an off -site stormwater system permitted under the latest version of the Master Permit. The stormwater runoff from the permitted built -upon area of this project must be collected and conveyed to the permitted off -site stormwater system. 2. The built -upon area allocated to this development by the Master Permit, is 31,425 square feet. This project proposes 31,425 square feet. This permit does not provide any allocation of built - upon area for future development. 3. This lot is limited to the amount of built -upon area indicated in this permit and the approved plans and specifications. The project must maintain a built -upon area less than or equal to the amount permitted under the Master Permit. A total built -upon area in excess of the maximum allowed amount will require a modification to the Master Permit prior to construction and/or the construction of additional stormwater control measures. II. SCHEDULE OF COMPLIANCE A copy of the final deed listing Par 5 Development Group, LLC as the property owner must be submitted within 30 days of the property being purchased. It is the responsibility of the permit holder; Par 5 Development Group, LLC; to notify the Division of any changes in ownership and request an ownership/name change for the stormwater permit. However, please be reminded that if the purchase agreement or contract between Par 5 Development Group: LLC and HT of Ocean Isle Beach, LLC is dissolved, cancelled or defaults, and the Division is not notified by Par 5 Development Group; LLC to transfer the permit, then the responsibility for permit compliance reverts to the property owner; HT of Ocean Isle Beach; LLC. As the property owner, HT of Ocean Isle Beach; LLC must notify the Division immediately of the permit ownership change and submit a completed Name/Ownership form to the Division within 30 days. Otherwise HT of Ocean Isle Beach; LLC will be operating a stormwater treatment facility without a valid permit which is a violation of NC General Statue 143-215.1 and may result in appropriate enforcement action in accordance with North Carolina General Statute §143- 215.6A through §143-215.6C being taken against the property owner; HT of Ocean Isle Beach; LLC. 3. This permit is issued contingent on the construction of the permitted off -site stormwater system being complete and in compliance with the latest version of the Master Permit, issued to the Master Permittee, and as subsequently modified; transferred, or renewed. Prior to the construction of any built -upon area associated with this permit, the Master Permittee shall have constructed; operated, maintained; and certified the off -site stormwater system in compliance with the Master Permit. 4. The project shall be constructed in accordance with the conditions of this permit and the approved plans and specifications. 5. The stormwater collection system and/or vegetated conveyance system shall be entirely constructed; vegetated, and operational prior to the construction of any lot development; per the approved plans and specifications. 6. During construction, erosion shall be kept to a minimum and any eroded areas of the stormwater collection system and/or vegetated conveyance system will be repaired immediately. 7. All stormwater collection systems; vegetated conveyance systems and/or maintenance accesses must be located in public rights -of -way, dedicated common areas that extend to the nearest public right-of-way, and/or permanent recorded easements that extend to the nearest public right-of-way for the purpose of inspection, operation, maintenance; and repair. 8. The permittee shall at all times provide and perform the maintenance necessary, as listed in the signed Operation and Maintenance Agreement titled Stormwater Collection System Maintenance Requirements, a part of the Offsite Supplement, to assure that the permitted stormwater collection system and/or vegetated conveyance system functions at the approved design condition to capture and adequately convey stormwater runoff to the permitted off -site stormwater system. The approved Operation and Maintenance Agreement is incorporated by reference into this permit and must be followed in its entirety and maintenance must occur at the scheduled intervals. 9. The final plats for the project must be recorded with the Office of the Register of Deeds. The recorded plat must reference the Operation and Maintenance Agreement and must also show all public rights -of -way, dedicated common areas, and/or permanent drainage easements, in accordance with the approved plans. 10. The permittee is responsible for verifying that the proposed built -upon area for the entire project does not exceed the maximum allowed by this permit. . Upon completion of the project, the permittee shall determine whether or not the project is in compliance with the permitted plans and take the necessary following actions: a. If the permittee determines that the project is in compliance with the permitted plans, then within 45 days of completion, the permittee shall submit to the Division one hard copy and one electronic copy of the following: i. The completed and signed Designer's Certification provided in Attachment A noting any deviations from the approved plans and specifications. Deviations may require approval from the Division; ii. A copy of the recorded maintenance agreement;' iii. Unless already provided, a copy of the recorded deed restrictions and protective covenants: and iv. A copy of the recorded plat delineating the public rights -of -way, dedicated common areas and/or permanent recorded easements; when applicable. b. If the permittee determines that the project is not in compliance with the permitted plans; the permittee shall submit an application to modify the permit within 30 days of completion of the project or provide a plan of action, with a timeline, to bring the site into compliance. 12. No person or entity, including the permittee; shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications; and calculations including, but not limited to, those listed below: a. Any modification to the approved plans and specifications,. regardless of size. b. Redesign of or addition to the approved amount of built -upon area. c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, or resizing of any component of the approved stormwater collection system and/or vegetated conveyance system shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement for BUA credit that was not included in the approved plans and specifications. g. The construction of any 57 stone area or trails to be considered a permeable surface that were not included in the approved plans and specifications. h. Other modifications as determined by the Director. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice; the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of modified plans and certification in writing to the Director that the changes have been made. 14. Prior to transfer of the permit, the stormwater collection system and/or vegetated conveyance system will be inspected by Division personnel. The project and the stormwater collection system and/or vegetated conveyance system must be in compliance with all permit conditions. Any items not in compliance must be repaired, replaced or restored to design condition prior to the transfer. III. GENERAL CONDITIONS 1, Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 2. The issuance of this permit does not preclude the permittee from complying with and obtaining any and all other permits or approvals that are required in order for this development to take place, as required by any statutes, rules, regulations; or ordinances, which may be imposed by any other Local, State or Federal government agency having jurisdiction. Any activities undertaken at this site that cause a water quality violation or undertaken prior to receipt of the necessary permits or approvals to do so are considered violations of NCGS 143-215.1, and subject to enforcement procedures pursuant to NCGS 143-215.6. In the event that the stormwater collection system and/or vegetated conveyance system fail to perform satisfactorily, the permittee shall take immediate corrective actions. This includes actions required by this Division and the stormwater rules such as the construction of additional or replacement stormwater collection system and/or vegetated conveyance system and/or stormwater control measures. These additional or replacement measures shall receive a permit from the Division prior to construction. 4. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form; accompanied by the supporting documentation as fisted on the form, to the Division at least 60 days prior to anyone or more of the following events- - a. Any ownership change including: i. The sale or conveyance of the project area in whole or in part; except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; ii. Dissolution of the partnership or corporate entity; subject to NCGS 570-2-01(e) and NCGS 57D-6-07: b. Bankruptcy; c. Foreclosure, subject to the requirements of Session Law 2013-121; d. A name change of the current permittee; e. A name change,of the project, f. A mailing address change of the permittee; 5. The permittee is responsible for compliance with all of these terms and conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. 6. The permittee grants Division staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted project. 7. The permit issued shall continue in force and effect until,the permittee files a request with the Division for a permit modification; transfer, or rescission; however; these actions do not stay any permit conditions. 8. Approved plans, application; supplements, calculations, operation & maintenance agreement, and specifications for projects are incorporated by reference and are enforceable parts of the permit. A copy of this permit, application, supplements; operation and maintenance agreement, and approved plans and specifications shall be maintained on file by the permittee at all times. 9. Unless specified elsewhere; permanent seeding requirements for the vegetated areas must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit; revoking and reissuing the permit; or terminating the permit for cause as allowed by the laws; rules; and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143-215.1 et.al. Grass height will not exceed six inches at any time. 2. Accumulated sediment and trash will be removed from the collection system_ as necessary., Swales and ditches will be reseeded or sodded following sediment removal: 3. Eroded areas of swales and ditches will be repaired and reseeded. Swales and ditches will be revegetated as needed based on monthly inspections. 4. The collection system, including catch basins, curb cuts, velocity reduction devices, and piping, will be inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb 'ci ts, velocity reduction devices, and piping. 5. The collection system may not be altered in any way without prior approval from NCDENR Division of Energy, Mineral and Laud Resources. I acknowledge and agree by my signature below that I am responsible for maintaining the stortnwater collection system in accordance with the five maintenance procedures listed above. The soils of the site consist of Pactolus fine Sand and Leon fine sand, with grades ranging from 0.5% to 2.0%. Approximately 2.0 AC will be graded to allow construction of a commercial project with paved parking and paved access. The runoff from the site is estimated using the rational method 10-year design storm and rainfall data for the area. Construction is scheduled to begin as soon as all permits and approvals are obtained. EROSION CONTROL MEASURES: The attached plans and specifications outline the requirements for erosion control measures. Silt fencing will be provided along each side of the entrance drive where stormwater would be expected to sheet flow from disturbed areas directly to adjacent property. A gravel construction entrance will be constructed at the Station Trail entrance. The existing basin on the site will be modified to act as a sediment basin during construction and will be restored to its shown contours. Maintenance will be provided by the grading contractor and developer. STORMWATER MANAGEMENT MEASURES: The project site is located in the Town of Sunset Beach, Brunswick County and is already part of an existing stormwater permit #SW8-060406. The stormwater runoff from the development will be directed to the existing stormwater infiltration system. The stormwater infiltration system was designed to accommodate this site impervious area lot coverage. The existing permit is being modified to create the outparcel this project will be built on. An off -site permit is being requested for this project. CONSTRUCTION SEQUENCE: The contractor will install the gravel construction entrance and silt fence prior to beginning any clearing and grading operations. EXECUTION 3.1 General: Take every practicable measure during construction or suspension to work to minimize erosion and siltation. Measures should include good construction practices, temporary physical barriers to sediment travel, settling basins for new ditches, and establishment of vegetative cover. 3.2 Construction Practices 3.2.1 Avoid dumping soil or sediment into any wetland or watercourse. 3.2.2 Maintain an undisturbed vegetative buffer where possible between a natural watercourse and trenching and grading operations. 3.2.3 Avoid equipment crossings of streams, creeks, and ditches where practicable. 3.2.4 Grade all cut, fill and ditch slopes to minimum slope of 3:1, unless otherwise shown or directed. 3.3 Temporary Physical Barriers are required where sedimentation on offsite property or excessive erosion is a problem. 3.3.1 Mulch shall be used for temporary stabilization of areas subject to excessive erosion and for protection of seedbeds after planting where required. 1. Apply grain straw and hay at a rate of 75 to 100 pounds per 1,000 square feet and wood chips at a rate of 500 pounds per 1,000 square feet. Jute and mesh should be installed as per manufacturer's instructions. 2. Asphalt emulsion for slope stabilization should be applied at a rate of 1,000 gallons per acre. Asphalt emulsion used for anchoring straw should be applied at a rate of 150 gallons per ton of straw. 3.3.2 Silt Fences shall be used at the base of slopes to restrict movement of sediment from the site. Clean silt fence of accumulated sediment after each rainfall event or when it exceeds a depth of 0.5 feet above natural grade. 3.3.3 Stone Check Dams, placed at the discharges of creeks, ditches, and swales, shall consist of Class A or Class B erosion control stone at minimum two feet high and three feet thick across the watercourse, with a one foot thick layer of gravel on upstream side. Remove sediment if accumulated to a depth of 1.0 feet at upstream face. 5 3.4 Vegetative Cover: Establish and maintain permanent vegetative cover on all unpaved areas disturbed by the work. 3.4.1 Preparation of Seedbed: Areas to be seeded shall be scarified to a depth of 4 inches and until a firm, well pulverized, uniform seedbed is prepared. Lime, phosphorous and fertilizer shall be applied during the scarification process in accordance with the following rates: Lime: 45 pounds per 1000 square feet Phosphorous: 20 pounds per 1,000 square feet - Fertilizer: 17 pounds per 1000 square feet 3.4.2 Seeding: Disturbed areas shall be seeded with 2 to 3 pounds per 1000 square feet of the specified seed mixture. Seed shall be worked into the bed to a depth of 1/4 inch. Regrade and seed eroded areas immediately 3.4.3 Mulch all areas immediately after seeding. Mulch shall be applied and anchored as specified hereinbefore. EXECUTION 3.1 General: Take every practicable measure during construction or suspension to work to minimize erosion and siltation. Measures should include good construction practices, temporary physical barriers to sediment travel, settling basins for new ditches, and establishment of vegetative cover. 3.2 Construction practices 3.2.1 Avoid dumping soil or sediment into any wetland or watercourse. 3.2.2 Maintain an undisturbed vegetative buffer where possible between a natural watercourse and trenching and grading operations. 3.2.3 Avoid equipment crossings of streams, creeks, and ditches where practicable. 3.2.4 Grade all cut, fill and ditch slopes to minimum slope of 3:1, unless otherwise shown or directed. 3.3 Temporary Physical Barriers are required where sedimentation on offsite property or excessive erosion is a problem. 3.31 Mulch shall be used for temporary stabilization of areas subject to excessive erosion and for protection of seedbeds after planting where required. 1. Apply grain straw and hay at a rate of 75 to 100 pounds per 1,000 square feet and wood chips at a rate of 500 pounds per 1,000 square feet. Jute and mesh should be installed as per manufacturer's instructions. 2. Asphalt emulsion for slope stabilization should be applied at a rate of 1,000 gallons per acre. Asphalt emulsion used for anchoring straw should be applied at a rate of 150 gallons per ton of straw. 3.3.2 Silt Fences shall be used at the base of slopes to restrict movement of sediment from the site. Clean silt fence of accumulated sediment after each rainfall event or when it exceeds a depth of 0.5 feet above natural grade. 3.3.3 Stone Check Dams, placed at the discharges of creeks, ditches, and swales, shall consist of Class A or Class B erosion control stone at minimum two feet high and three feet thick across the watercourse, with a one foot thick layer of gravel on upstream side. Remove sediment if accumulated to a depth of 1.0 feet at upstream face. 5 3.4 Vegetative Cover: Establish and maintain permanent vegetative cover on all unpaved areas disturbed by the work. 3.4.1 Preparation of Seedbed: Areas to be seeded shall be scarified to a depth of 4 inches and until a firm, well puiverized, uniform seedbed is prepared. Lime, phosphorous and fertilizer shall be applied during the scarification process in accordance with the following rates: Lime: 45 pounds per 1000 square feet Phosphorous: 20 pounds per 1,000 square feet Fertilizer: 17 pounds per 1000 square feet 3.4.2 Seeding: Disturbed areas shall be seeded with 2 to 3 pounds per 1000 square feet of the specified seed mixture, Seed shall be worked into the bed to a depth of 1/4 inch. Regrade and seed eroded areas immediately 3.4.3 MOch all areas immediately after seeding. Mulch shall be applied and anchored as specified hereinbefore. Reapply as necessary to retain cover until grass is established. 3.5 Construction Entrance: Provide an aggregate drive, 20 feet wide by 50 feet long by 6 inches thick at each entrance to the site used by construction vehicles; until such time as the permanent roadway is constructed. Remove soil if accumulated to a depth greater than 0.5 inches. 3.6 Maintenance: The Owner and Contractor shall be responsible for maintaining all temporary and permanent erosion control measures.
