JOHN M. HARRIS, Substitute Trustee in the Deed of Trust hereinafter mentioned, of Carteret County, as
Grantor, whose address is PO Box 712, Morehead City, North Carolina 28557 and CAPITAL BANK, N.A., as
Grantee, whose address is 333 Fayetteville St., Suite 800, Raleigh, North Carolina 27601(The designation
"Grantor" and "Grantee" as used herein shall include said parties, their heirs, successors and assigns, and shall
include singular, plural, masculine, feminine or neuter as required by context).
WHEREAS, on September 3, 2009, Ocean King, LLC, a North Carolina limited liability company,
executed and delivered unto CB Trustee, LLC, as Trustee, a certain Deed of Trust, Security Agreement,
Assignment of Leases & Fixture Filing which was duly recorded on September 4, 2009, in Book 1320, Pages
141, et seq. in the Office of the Register of Deeds for Carteret County, North Carolina ("Deed of Trust"); and
WHEREAS, the Deed of Trust conveyed to the `trustee the real property described in herein as collateral
for the repayment of the related promissory note in the amount of $3,150,000.00; and
WHEREAS, because the indebtedness secured by said Deed of Trust being overdue and unpaid, the
holder of the indebtedness called upon the Grantor, who was substituted as Substitute Trustee by instrument
recorded on August 5, 2011 in Book 1382, Page 326, Carteret County Registry, to foreclose said Deed of Trust;
and
WHEREAS, Grantor initiated a foreclosure proceeding in the Office of the Clerk of Superior Court of
Carteret County, North Carolina (F ile# 11 SP 426) and pursuant to the initiation of the foreclosure proceeding, a
final hearing was held before the Clerk of Superior Court of Carteret County on December 8, 2011; and
WHEREAS, at such hearing, the Clerk of Superior Court of Carteret County entered an Order
authorizing Grantor, as Substitute Trustee, to proceed with the foreclosure of the Deed of Trust; and
WHEREAS, after due advertisement and notice and compliance both with the terms of the Deed of
Trust and the laws of North Carolina, on February 21, 2012, Grantor offered for sale to the highest bidder the
property which is hereinafter described and which is the same property encumbered by the aforementioned
Deed of Trust, said sale being conducted at the Carteret County Courthouse in Beaufort, Carteret County, North
Carolina; and a Report of Sale showing the initial bid was filed with the Clerk of Superior Court by the Grantor
on the 21 st day of February, 2012;
WHEREAS, CAPITAL BANK, N.A., at the expiration of the ten (10) day upset bid period with no
upset bids being made, became the Iast and highest bidder with a bid of $2,100,000.00; and
WHEREAS, the upset bid remained open for more than ten (10) days and no upset bid was offered and
no objection was made to the sale above -referenced; and
WHEREAS, on the day of March, 2012 the Grantor executed and delivered a deed to CAPITAL
BANK, N.A. upon receipt of the purchase price; and the purchase price has been paid or credited to note holder;
NOW THEREFORE, Grantor, acting as Substitute Trustee as aforesaid and acting pursuant to the
powers conferred upon him by order of the Clerk of Superior Court of Carteret County, North Carolina, in
consideration of that certain property located in Carteret County described herein and the sum of $2,100,000.00
for the bid amount, to him in hand paid or credited to note holder, has bargained and sold and by these presents
does bargain, sell and convey unto CAPITAL BANK, N.A., its heirs, successors and assigns, the' land sold as
aforesaid, the same being more particularly described as follows:

TO HAVE AND TO HOLD the said lands and premises, together with all privileges and
appurtenances as thereunto belonging unto the said Grantee, its successors and assigns, forever, in as full and
ample manner, as Grantor, Substitute Trustee, is authorized and empowered to convey the same, subject
however, to the following:
Any and all unpaid Carteret County and Town of Atlantic Beach ad valorem taxes, and all other liens
and encumbrances which by law have a priority superior to the priority granted to the Deed of Trust which was
the subject of the foreclosure proceeding referenced herein, and the five easements recorded subsequent to the
Deed of Trust (such easements being more particularly described on Exhibit A attached hereto). Grantor makes
no warranty, express or implied, as to title, quality or condition of the property hereinabove described.

Introduction:
The proposed Ocean King Condominiums is a redevelopment project located at the
intersection of Last and Atlantic Boulevard in Atlantic Beach, North Carolina. The
project consists of 6 existing parcels, A thru D, E, and G.
Parcels A-D will be combined for a total of 0.77 acres and will be the site for a 14 story
condominium building, two two-story duplex condominiums; a pool and two gazebos.
Parking will be provided on the first five levels of the 14 story building and underneath
the duplex condominiums. Stormwater treatment will be provided with an infiltration
basin located under the pool.
Parcel E is 0.25 acres and \aril] provide a parking area and thru access from East Atlantic
Boulevard to East Boardwalk Drive. An underground trench infiltration system is
proposed for stormwater treatment
Parcel G is 0.37 acres and will be used as a spray irrigation site for the wastewater system
associated with the condominiums.
The redevelopment of these parcels will reduce the overall impervious area from 35,801
square feet to 32,064 square feet. In addition, a significant amount of impervious area
that was previously within the 6W CAMA setback will be removed from that area.
According to the NCDLNR Stormwater BMP manual the infiltration devices proposed
will provide 85% total suspended solids removal. A subsurface investigation by ECS
Carolinas, UP indicates that the infiltration areas proposed have tan; fine to medium
sand with infiltration rates from 21.4 to 27.7 inches per hour.
StormNvater Treatment Parcel A-1):
For Parcels A-D stormwater treatment will be provided by and infiltration basin located
under the pool. The basin is sized to treat the runoff from a 1 inch storm x 3 for the areas
ofthe pool deck and two story condominiums that are located within the 120 foot CAMA
setback. The volume of the storage has been tripled because no overflow or vegetative
filter is proposed. The southern wall of the basin is proposed to be 4" lower than the
other three sides so that in the case of a large storm event water will flow from the basin
safely to the south.

According to CAMA rules, no facilities can be built within the 120 foot setback to serve
facilities outside of the 120 foot setback, no stormwater is being routed from the 14 story
complex to the infiltration area. There is no practical way to treat the runoff from the 14
story building, and as this is a redevelopment project, it is proposed to route the
stormwater runoff from this building to the existing public stormwater system.
Stormwater Treatment Parcel E:
An infiltration trench located under- the parking area is proposed as stormwater treatment
for Parcel L. "fhe water enters a splitter box through a system of storm pipes and inlets.
The splitter box keeps the infiltration system off-line by bypassing runoff from storms in
excess of 1 inch x 2 to the public stormwater system. No vegetative filter is possible with
this site, so the treatment volume was doubled-
Stormwater Treatment Parcel G:
Parcel G is being used for spray irrigation for the wastewater treatment system serving
the condominiums. Because there is no room for any type of BMP, this is a
redevelopment project, and this parcel is proposed to be only 13.4% impervious, no
stormwater BMP's are proposed for Parcel G.
Conclusion:
This project will benefit water quality in three ways
1. The overall impervious area will be reduced by 3,737 square feet or 10.4%.
2. Impervious area is being removed from the area within the 60 foot CAMA
setback.
3. Infiltration devices are being utilized to the maximum extent practicable to treat
stormwater runoff before it leaves the site.

Dear Mr. Daugherty,
ECS Carolinas, LLP (ECS) recently conducted an infiltration evaluation for the proposed
infiltration areas at the site located at the parcels•A-D on Atlantic Boulevard in Atlantic Beach,
North Carolina. This letter, with attachments, is the report of our evaluation.
Field Testing
On December 28, 2007 ECS met with Mr. Bill Daugherty with Ocean King, LLC on site where
he located the requested test locations. ECS then conducted an exploration of the subsurface
soil and ground water conditions at six requested locations shown on the attached Site Diagram.
The purpose of this exploration was to obtain subsurface information of the suitability of the in -
place soils for the proposed infiltration area. We explored the subsurface soil and ground water
conditions by advancing one Band auger boring into the existing ground surface at the six
requested boring locations. We visually classified the subsurface soils and obtained
representative samples of each soil type encountered. We also recorded the ground water level
observed at the time of each hand auger boring. The attached Infiltration Evaluation Form
provides a summary of the subsurface conditions encountered at each hand auger boring
location.
The ground water level and the seasonal high ground water level (SHWL) were estimated at
each boning location below thekexistzug grade elevation. Below is a summary of each boring

We have conducted six infiltration tests near the hand auger borings to estimate the infiltration
rate for the subsurface soils. The infiltration tests are typically conducted at two feet above the
SHWL.
