We are responding to your letter of May 31, 2012 regarding the subject project as
follows:
1. Per the attached guidance from Linda Lewis we are only required to demonstrate
that the 10 year 24 hour storm with infiltrate without overtopping at half the
reported rate. Our calculations demonstrate that will work here.
2. There are no wetlands on the site. This has been indicated on the plans.
3. It was our understanding that the existing material from the existing pond bottom
to the SHWT was to be removed and replaced with clean sand. That is why our
detail on Sheet C4 shows 2 feet of clean sand between elevation 12.0 and 10.0.
The existing pond bottom is at 12.0, the SHWT is at 10.0.
4. The SHWT is at 10.0. Please fix that on the supplement.
We will email you the plan Sheet C2 with the wetland note and put 2 copies in the mail.

Option #4, starts with a minimum system design that can accommodate either the pre/post or the 1.5",
whichever is applicable, based on the applicable rule and the classification of the receiving stream. From there
you go on to demonstrate that the system can also accommodate the 10 year 24 hour volume without
overtopping.
With option #4 only, you get to route the storm and include the volume that infiltrates during the 24 hour storrri_
'event (at % the infiltration rate), and subtract that volume from the 10 year 24 hour total volume. This id
probal,ly best demonstrated via the HydroCAD anatysis!
I would use the equation in 16.3.6 to determine the amount of area needed to infiltrate those volumes in 24
hours, i.e_, T = 1 day. If you can't provide the calculated area, then add the leftover uninfiltrated volume to your
minimum volume to store, i.e., pre/post difference or 1.5", and provide additional storage volume in the system,
and set your weir at the elevation where you meet the new volume required.

"- Good Afternoon Linda,
I have a question regarding the ability to waive the bypass and LS/VFS requirements per section 16.3.9.4
We have project that has a natural low area onsite and we are planning to construct a berm around the area to create a
natural infiltration area. We have received our soils report and infiltration rates are good within the proposed basin (8
in/hr). Using the simple method I find the 10yr storm volume = 22,000cf; to provide active storage for this volume 1 must
set the top of my outlet structure at 52.60'. Running this drainage model in HydroCad with Y2 of the specified infiltration
rate (4 in/hr), I get a peak of 51.85' +/-.
Based on the above information is it allowable to set the outlet structure @ the peak elevation or must I set it at the
total active storage volume elevation of 52.60'?

Has Vince gone out there again since his 4/19/12 visit? On that report he said that there was an old pond that would be
backfilled with clean sand and that the bottom of the infiltration basin would be at the top of the new clean sand. What
will be the change from that scenario?

1, the undersigned natural person of the age of eighteen years or more, do hereby organize a
business corporation under the laws of the State of North Carolina, as contained in Chapter 55 of the
General Statutes of North Carolina, entitled "North Carolina Business Corporation Act", and all
amendments thereto, and to that end do hereby set forth the following:
I. NAME
The name of the corporation is GOGAS Corporation.
U. PURPOSE
The purpose for which the corporation is organized is to engage in any lawful act or activity
for which the corporation may be organized under the North Carolina Business Corporation Act.

VII. LIMITATION OF LIABILITY
No director of the corporation shall have personal liability arising out of an action whether
by or in the right of the corporation or otherwise for monetary damages for breach of any duty as a
director, provided, however, that the foregoing shall not limit or eliminate the personal liability of a
director with respect to (i) acts or omissions that such director at the time of such breach knew or
believed were clearly in conflict with the best interests of the corporation, (ii) any liability under
Section 55-8-33 of the North Carolina General Statutes or any successor provision, (iii) any
transaction from which such director derived an improper personal benefit, or (iv) acts or omissions
occurring prior to the date of the effectiveness of this Article VII. As used in this Article VII, the
term "improper personal benefit" does not include a director's reasonable compensation or other
reasonable incidental benefit for or on account of his or her services as a director, officer, employee,
independent contractor, attorney, or consultant of the corporation.
Furthermore, notwithstanding the foregoing provision, in the event that Section 55-2-02 or
any other provision of the North Carolina General Statutes is amended or enacted to permit further
limitation or elimination of the personal liability of directors of corporations, the personal liability of
the corporation's directors shall be limited or eliminated to the fullest extent permitted by the
applicable law.
This Article VII shall not affect any provision permitted under the North Carolina General
Statutes in the articles of incorporation, bylaws or contract or resolution of the corporation
indemnifying or agreeing to indemnify a director against personal liability. Any repeal or
modification of this Article VII shall not adversely affect any limitation hereunder on the personal
liability of the director with respect to acts or omissions occurring prior to such repeal or
modification.
ARTICLE VIU. EFFECTIVE DATE
These articles of incorporation shall be effective upon filing.

Phil,
1.) 10yr24hr Volume: I asked Linda about her email, and she told me that her intent was that the minimum size of
the infiltration system would be for the 1.5" volume or the pre/post"difference (call that volume X). Then, in
order to waive the VFS, offline bypass and not have to increase the volume of the system, the applicant also
calculates the 10 yr 24 hr volume via the Simple method (call that volume Y) and then calculates the volume that
infiltrates through the bottom during that 24 hours at % the reported infiltration rate (call that volume Z). If
volume Y can infiltrate within the system designed for volume X at % the reported infiltration rate within 24
hours, without overtopping (discharging), or if the leftover volume (Y minus Z) after 24 hours is less than X, then
it's OK. The system doesn't have to be sized to "contain" the 10 yr 24 hour storm. If the leftover volume (Y
minus Z) is larger than X, then the minimum volume of the system has to be increased from X to (Y minus Z). I
see the stage and volume 10yr24hr information from CAD, but I don't see the 10yr24hr storm volume per
Simple Method following this procedure? I think that the design will work from my talcs, it is just a matter of

follows:
1. Per the attached guidance from Linda Lewis we are only required to demonstrate
that the 10 year 24 hour storm with infiltrate without overtopping at half the
reported rate_ Our calculations demonstrate that will work here.
2. There are no wetlands on the site. This has been indicated on the plans.
3. It was our understanding that the existing material from the existing pond bottom
to the SHWT was to be removed and replaced with clean sand. That is why our
detail on Sheet C4 shows 2 feet of clean sand between elevation 12.0 and 10.0.
The existing pond bottom is at 12.0, the SHWT is at 10.0.
4. The SHWT is at 10.0. Please fix that on the supplement.
We will email you the plan Sheet C2 with the wetland note and put 2 copies in the mail.

Option #4, starts with a minimum system design that can accommodate either the pre/post or the 1.5',
whichever is applicable, based on the applicable rule and the classification of the receiving stream. From there
you go on to demonstrate that the system can also accommodate the 10 year 24 hour volume without
overtopping.
With option #4 only, you get to route the storm and -include the volume that infiltrates during the 24'hour storm
event (at %2 the infiltration rate), and subtract that volume from the 10 year 24, hour -total volume. This is
probably best demonstrated via the HydroCAD_analysis.
I would use the equation In 16.3.6 to determine the amount of area needed to infiltrate those volumes in 24
hours, i.e., T = 1 day. If you can't provide the calculated area, then add the leftover uninfiltrated volume to your
minimum volume to store, i.e., pre/post difference or 1.5", and provide additional storage volume in the system,
and set your weir at the elevation where you meet the new volume required.

I have a question regarding the ability to waive the bypass and LSNFS requirements per section 16.3.9.4
We have project that has a natural low area onsite and we are planning to construct a berm around the area to create a
natural Infiltration area. We have received our suits report and Infiltration rates are good within the proposed basin (8
in/hr). Using the simple method i find the 10yr storm volume = 22,000cf; to provide active storage for this volume I must
set the top of my outlet structure at 52.60'. Running this drainage model In HydroCad with % of the specified infiltration
rate (4 in/hr), I get a peak of 51.85' +/-.
Based on the above information is it allowable to set the outlet structure @ the peak elevation or must 1 set it at the
total active storage volume elevation of 52.60'?

The Wilmington Regional Office received and accepted a State Stormwater Management Permit Application for
GOGAS #20 on April 19, 2012. 1 was notified today that the design accepted on this date is in conflict with the
State's Soil Scientist's findings from the same date, and that redesign will be necessary. The application submitted
on April 19, 2012 therefore has not been reviewed. Review will be delayed pending the redesign submittal.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received in this Office prior to June 25, 2012, or the application will be returned as incomplete.
The return of a project will necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a time extension to the
Division at the address and fax number at the bottom of this letter. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application
to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation
Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-
215.6A.

The Wilmington Regional Office received and accepted a State Stormwater Management Permit Application for the
subject project most recently on May 23, 2012. A preliminary in-depth review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
1,) 10Year14Hour Storm: Please provide the 10yr24hr simple method volume calculation and the drawdown
time for this volume. Please show that this volume can infiltrate at half the reported rate per Option 4 of
page 16-9 of the BMP Manual.
2.) Wetlands: Please either delineate wetlands on the plan or include a note that there are no wetlands onsite.
3.) Bottom of Basin: The State Soil Scientist's report shows that there is an existing manmade pond onsite that
will be backfilled with clean sand, and that the bottom of the proposed infiltration basin will be located at the
elevation of the top of the clean sand (at the top of the old pond). Please confirm that the top of the old
pond=top of the "new" backfilled sand=bottom of proposed infiltration basin=12.Omsl.
4.) SHWT: There appears to be a typo on the supplement which says that the SHWT is at 1.0msl. The plans
say that it is at 10.Omsl. I will fix the supplement to show 10.Omsl and initial the change unless you have
objections
Please note that this request for additional information is in response to a preliminary review, The requested
information should be received in this Office prior to June 13, 2012, or the application will be returned as incomplete.
The return of a project will necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a time extension to the
Division at the address and fax number at the bottom of this letter. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application
to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation
Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-
215.6A.
