On July 3, 2014, Chris Baker of the Wilmington Regional Office of the Division of Water Quality
(DWQ) inspected 7976 Market Street in New Hanover County to determine compliance with
Stormwater Management Permit Number SW8 120318 issued on May 1, 2012 DWQ file
review and site inspection revealed that the site is not compliant with the terms and conditions
of this permit Please find a copy of the completed form entitled "Compliance Inspection
Report" attached to this letter, which summarizes the findings of the recent inspection
As indicated in the attached inspection report, the following deficiencies must be resolved
1 Please provide an Engineers Certification for the above referenced project
Please inform this Office in writing before September 10, 2014, of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies Failure to
provide the requested information, when required, may initiate enforcement action including
the assessment of civil penalties of up to $25,000 per day If a written plan of action is not
submitted to this office by August 10, 2014 then DWQ staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed
Please be reminded that if any ownership or name change has occurred it is the permittee's

Stormwater Narrative

7976 Market Street is an existing 165 acre site with two (2) existing residential dwelling
units with existing gravel parking located in New Hanover County, NC The existing dwelling
units are to be remodeled and expanded to become a restaurant We are proposing to add gravel
parking in the rear of the site and asphalt parking in the front The asphalt driveway access to
the rear parking has been designed as one-way, in order to reduce impervious surface and
disturbed area Parking has also been strategically located in order to save as many existing
trees as possible
The existing topography of the site splits the property, having the front portion of the
site sloping toward Market Street (Northwest) at approx 0 5%, while the rear slopes to the
existing delineated "404" wetlands (Southeast) at approx. 4 o% Runoff will be directed to Two
(2) proposed Infiltration Basins (Infiltration Basin #1 & Infiltration Basin #2) by means of sheet
flow and 3 1 grassed swales
Infiltration Basins#1 & 2 have been designed to treat 2 5 times the 1 5" runoff volume
while using 1/2 infiltration rates found in the soils report A total of 33 33% impervious is
proposed for the site This includes 4,367 s f of Existing Building & Expansion, 1,26o s f of
proposed sidewalk, 17,588 s f of proposed parking, 800 s f for outside sitting area, and 2,500
for future BUA Total Impervious Area for the site 1s 26,515 s f Runoff from this site is
discharged to Pages Creek Classification SA,HQW Index #18-87-22 By the enclosed USGS map
7976 Market Street is outside the 1/2 mile radius of SA waters
Drainage Area #1 consists of 3,555 s f of existing building/expansion area, 8,000 s f of
parking area,1,26o s f of sidewalk and 800 s f of outside sitting area This drainage area runoff
is treated by sheet flow to Infiltration Basin #1 Infiltration Basin #1 provides 4,374 cf of storage
which 1s 2 5 times greater than the required 15" minimum design volume
Drainage Area #2 consists of 812 s f of proposed building expansion area, 9,588 s f of
parking area, and 2,500 s f for future BUA This drainage area runoff is treated by sheet flow
and 3 1 grassed swales to Infiltration Basin Area #2 Infiltration Basin #2 provides 4,024 cf of
storage which is 2 5 times greater than the required 15" minimum design volume

Description of Violationlsl: This project started land disturbing activity prior to
issuance of the land disturbing permit and prior to the required preconstruction meeting

This letter constitutes Notice of Violation of Section 23-237 (4), Section 23-248 (b),
and Section 23-248 0) Please refer to Section(s) 23-250 (b), Section 23-251 (a) (1) ,
Section 23-251 (a) (2), Section 23-251 (a) (3), Section 23-251 (a) (4), Section 23-251 (b),
Section 23-252 (a) and Section 23-252 (b) of the New Hanover County's Soil Erosion and
Sedimentation Control Ordinance for penalties prescribed by this ordinance
Section 23-237 Mandatory standards for land disturbing activity
No land disturbing activity subject to the control of this Article shall be undertaken except
in accordance with the following mandatory standards
(4) Pnorplan approval No -person shall initiate any land disturbing activity that will
disturb more than one acre on a tract unless 30 or more days prior to initiating the
activity, an erosion and sedimentation control Plan must be both filed with and Approved
by the county Once a plan has been approved, the land disturbing activity must be
conducted in accordance with the plan and permit conditions The county shall forward
to the Director of the Division of Water Quality a copy of each erosion and sedimentation
control plan for a land disturbing activity that involves the utilization of ditches for the
purpose of dewatering or lowering the water table of the tract
N.
Section 23-248 Erosion and sedimentation control plans
(b) Persons conducting land disturbing activity on a tract which covers one or more areas
shall file three copies of the erosion control plan with the county at least 30 days prior to
beginning such activity and shall keep another copy of the approved plan and a posted
copy of the permit at the job entrance, or on the job site before construction begins No
land disturbing activity is allowed until both the land -disturbing permit and, if applicable,
a County Stormwater ATC permit has been approved After approving the Plan, if the
county either upon review of such plan or inspection of the job site, determines that a
significant nsk,of accelerated erosion or offsite sedimentation exists or if design changes
have been made'to the original plan, the county will require a revised Plan Pending the
preparation of the revised plan, work shall cease or shall continue under conditions
outlined by the approved plan and/or appropriate regulatory authority
U) AnyRerson engaged in land disturbing activity who fails to file a Plan in accordance
with the Ordinance or who conducts a land disturbing activity except_m accordance with
provisions of an approved Plan _and/or
_the perrrut conditions shall be deemed in violation
of this article
Section 23-250 Inspections and investigations
(b) If through inspection it is determined that a person engaged in land disturbing
activity has failed to comply with the Act, this Ordinance, or rules or orders adopted or
issued pursuant to this Ordinance, or has failed to comply with an approved Plan or
permit conditions, a notice of violation shall be served upon that person by registered or
certified maxi or other means reasonably calculated to give actual notice The notice shall
set forth the measures necessary to achieve compliance with the Plan, specify a
reasonable time period within which such measures must be completed, and warn that
failure to correct the violation within the time period will result in additional civil and
criminal penalties for a continuing violation However, no time period for compliance
need be given for failure to submit an erosion control Plan for approval or for obstructing,
hampering or interfering with an authorized representative while in the process of
carrying out his official duties If the person engaged in land disturbing activity fails to
comply within the time specified, enforcement action shall be initiated
Section 23-251 Penalties
(a) Civil penalties
(1) Any person who violates any of the provisions of this Ordinance, or rules or
orders adopted or issued pursuant to this Ordinance, or order adopted or issued
pursuant to this Ordinance or the Act by the commission, or who initiates or
continues a land disturbing activity for which an erosion control Plan is required
except in accordance with the terms, conditions, and provisions of an approved
plan, shall be subject to a civil penalty The maximum civil penalty for a violation
is $5,000 00 per calendar day A civil penalty may be assessed from the date of the
violation Each day of a continuing violation shall constitute a separate violation
The person alleged to be in violation will be notified of the violation by registered or
certified mail, return receipt requested or other means reasonably calculated to
give actual notice The notice shall describe the violation with reasonable
particularity, specify a reasonable time period within which the violation must be
corrected, and warn that failure to correct the violation within the time period will
result in the assessment of a civil penalty or other enforcement action If, after the
allotted time period has expired, the violator has not completed corrective action, a
civil penalty may be assessed from the date of the notice of violation However, no
time period for compliance need be given for failure to submit an erosion control
Plan for approval or for obstructing, hampering or interfering with an authorized
representative while in the process of carrying out his official duties
(2) The County Manager or his designee shall determine the amount of the civil
penalty to be assessed under this subsection and shall notify the person who is
assessed the civil penalty of the amount of the penalty and the reason for assessing
the penalty In determining the amount of the penalty the County Manager or his
designee shall consider the degree and extent of harm caused by the violation and
the cost of rectifying the damage, the amount of money the violator saved by
noncompliance, whether the violation was committed willfully, and the prior record
of the violator in complying or failing to comply with this article and shall direct the
violator to either pay the assessment or contest the assessment within 30 days
after the receipt of the notice of assessment, by filing a petition for a contested case
in the Office of Administrative Hearing in accordance with Article 3 of Chapter
150B of the General Statutes Notice of the assessment shall be by registered or
certified mail or other means reasonably calculated to give actual notice
(3) Any appeals from the determination of the Office of Administrative Hearing
shall be made by the Secretary of the Department of Environment and Natural
Resources in accordance with Articles 3 and 4 of Chapter 150B of the General
Statutes Appeal from the final decision of the Secretary of the Department shall be
to the Superior Court of the county where the violation occurred Such appeals
must be made within 30 days of the final decision of the Secretary of the
Department of Environment and Natural Resources If payment is not received or
equitable settlement reached within 30 days after demand for payment is made, the
matter shall be referred to the county attorney for institution of a civil action in the
name of the county in the appropriate division of the general courts of justice for
recovery of the penalty A civil action must be filed within three years of the date
the assessment was due An assessment that is not contested is due when the
violator is served with a notice of assessment An assessment that is contested is
due at the conclusion of the administrative and judicial review of the assessment
(4) Civil penalties collected pursuant to this article shall be credited to the general
fund of the county as nontax revenue
(b) Criminal Penalties Any person who knowingly or willfully violates any provision
of this article, or rule or order adopted or issued pursuant to this article, or who
knowingly or willfully initiates or continues a land disturbing activity for which an
erosion control plan is required except in accordance with terms, conditions, and
provisions or an approved plan, shall be guilty of a Class 2 misdemeanor which
may include a fine not to exceed $5,000 00 per calendar day
Section 23-252 Injunctive relief
(a) Whenever the governing body has reasonable cause to believe that any person is
violating or threatening to violate this article or any rule or order adopted or issued
pursuant to this article, or any term, condition, or provision of an approved erosion
control plan, it may, either before or after the institution of any other action or proceeding
authorized by this article, institute a civil action in the name of the county, for injunctive
relief to restrain the violation or threatened violation The action shall be brought in the
superior court of the county
(b) Upon determination by a court that an alleged violation is occurring or is
threatened, it shall enter such orders or judgments as are necessary to abate the violation
to ensure that restoration is performed, or to prevent the threatened violation The
institution of an action for injunctive relief under this section shall not relieve any party to
such proceedings from any civil or criminal penalty prescribed for violations of this article
Corrective measurelsl needed and Time to Comply: Immediately cease all land
disturbing activity, except for stabilization of disturbed areas on this project until the
Land Disturbing permit has been issued and the preconstruction meeting has been held
A civil penalty in the amount of $5,000 has automatically been assessed for this
violation If the deadlines for corrective measures are not met, an additional daily $5,000
civil penalty will be assessed Once the plans have been approved and the Land
Disturbing Permit has been issued, you will have the opportunity to appeal this

action or to request an appeal of this Notice of Violation once all repairs have been made
onsite and/or the plans have been approved

7976 Market Street is an existing 165 acre site with two (2) existing residential
dwelling units with existing gravel parking located in New Hanover County, NC The
existing dwelling units are to be remodeled and expanded to become a restaurant We
are proposing to add gravel parking in the rear of the site and asphalt parking in the
front The asphalt driveway access to the rear parking has been designed as one-way, in
order to reduce impervious surface and disturbed area Parking has also been
strategically located in order to save as many existing trees as possible
The existing topography of the site splits the property, having the front portion
of the site sloping toward Market Street (Northwest) at approx o 5%, while the rear
slopes to the existing delineated "404" wetlands (Southeast) at approx 4 o% Runoff
will be directed to Two (2) proposed Infiltration Basins (Infiltration Basin #1 &
Infiltration Basin #3) by means of sheet flow Infiltration Basin #2 has been included
based on New Hanover County requirements but has not been included in these
calculations Drainage area #2 that drains to Infiltration basin#3 includes all the area of
Infiltration Basin #2 and surrounding impervious surface
Infiltration Basins#1 & 3 have been designed to treat 2 5 times the 15" runoff
volume while using 1/2 infiltration rates found in the soils report A total of 44 21%
impervious is proposed for the site This includes 4,376 s f of Existing Building &
Expansion,1,26o s f of proposed sidewalk, 25,345 s f of proposed parking, and 800 s f
for outside sitting area, for a Total Impervious Area of 31,772 s f Runoff from this site is
discharged to Pages Creek Classification SA,HQW Index #18-87-22 By the enclosed
USGS map 7976 Market Street is outside the 1/2 mile radius of SA waters
Drainage Basin Area # 1 consists of 3,555 s f of existing building/expansion
area, 8,000 s f of parking area,1,26o s f of sidewalk and 800 s f of outside sitting area
This drainage area runoff is treated by sheet flow to Infiltration Basin #1 Infiltration

17), running thence South 43 degrees 47 minutes East
along the southwestern line of said pool company tract
and with said line extending 400.0 feet to an iron
pipe; thence south 46 degrees 13 minutes West and
parallel with said road 180 0 feet to an iron pipe,
thence North 43 degrees 47 minutes West and parallel to
the first call 400.0 feet to an iron pipe in the
southeastern line of said road: thence North 46 degrees
13 minutes East along said line of said road 180.0 feet
to the point of Beginning; the same containing 1.65
acres and being a portion of the Koonce tract fronting
on U.S. Highway No. 17 and conveyed to Bayshore

We received this application, and I have a few questions for you
1 ) SA Waters Is this site within a half mile of and draining to SA waters? It appears that you are designing this site
to comply with the SA waters requirements (1yr24hr pre/post), but not the "no discharge to SA requirements"
(where you would send the "excess" flow to a level spreader/filter strip per the 2008 Rule's Section
2(b),(1)(b)(4) )
2 ) SHWT I see that the SHWT elevations were found to be at 50", 36", and 26" respectively What were the
existing elevations from which these distances were measured? I see that the bottoms of the cells will be at
28 0, 28 0, and 24 D respectively Since the SHWT has to beat least 2ft from the bottom of each cell the max
SHWT elevations would be 26 0, 26 0, and 22 0 respectively
3) In Situ Soils There area lot of references in the supplements to in situ soils Bioretention cells are supposed to
be filled with a specified mix of media, not necessarily in situ soils How will the media in these cells meet the
media requirements specified in the manual?

7976 Market Street is an existing 165 acre site with two (2) existing residential
dwelling units with existing gravel parking located in New Hanover County, NC The
existing dwelling units are to be remodeled and expanded to become a restaurant We
are proposing to add gravel parking in the rear of the site and asphalt parking in the
front The asphalt driveway access to the rear parking has been designed as one-way, in
order to reduce impervious surface and disturbed area. Parking has also been
strategically located in order to save as many existing trees as possible 7976 Market
Street proposes disturbing 1.59 acres for the construction of the building expansion,
parking, infrastructure, and (3) Bio-Retention areas
The existing topography of the site splits the property, having the front portion
of the site sloping toward Market Street (Northwest) at approx 0 5%, while the rear
slopes to the existing delineated "404" wetlands (Southeast) at approx 4 0% Runoff
will be directed to three (3) proposed Bio-Retention areas by means of sheet flow The
site has been designed to treat the 1 5" runoff and lyr 24hr pre -post requirements A
total of 48.20% impervious is proposed for the site This includes- 4,376 s f of Existing
Building & Expansion, 1,26o s f of proposed sidewalk, 28,219 s f of proposed parking,
and 800 s f for outside sitting area, for a Total Impervious Area of 34,646 s f Runoff
from this site is discharged to Pages Creek Classification SA,HQW Index #18-87-22
Drainage Basin Area #1 consists of 3,555 s f of existing building/expansion
area, 8,00o s f of parking area, 1,26o s f of sidewalk and 800 s f of outside sitting area
This drainage area runoff is treated by sheet flow to Bio-retention Area # 1 Bio-
retention Area # i provides 3,929 cf of storage which is adequately sized to treat the 1.5"
& 1yr24hr pre -post requirements Overflow from Bio-retention area # 1 is distributed to
an Existing Drop Inlet located in front of the site
Drainage Basin Area #2 consists of 812 s f. of proposed building expansion area,
and 10,178 s f of parking area This drainage area runoff is treated by sheet flow to Bio-
