All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On September 9, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a file review inspection of Flowers Development Corporation, located at Friendly Rd, Morehead City in Carteret County to determine the status of compliance with the State Stormwater Management Permit Number SW8 120114 issued on July 23, 2012. DEMLR review of aerial photos available online indicates that the pond has been constructed. However, the DEMLR file review revealed that the site is not in compliance with the terms and conditions of this permit. Please . find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Per Section 11.7 of the permit, please submit a completed designer's certification indicating that the project has been constructed in accordance with the permit, approved plans, specifications, and other documentation. Any deviations from the approved plans and specifications must be noted on the certification. Please inform this Office in writing before October 12, 2015, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by October 12, 2015 then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. If the property covered by this permit has been/will be sold or legally conveyed to another entity or if the permit holder has changed its name and/or mailing address, or if the project name has been changed, it is your responsibility as the permittee to submit a completed and signed Name/Ownership change form to DEMLR at least 30 calendar days prior to making the changes. Presently, Mr. Flowers does not intend to construct the mini storage portion of the permitted plan for at least one year, as the current economic climate does not support immediate construction. Mr. Flowers and discussed the project, including re -permitting project in phases. He has decided to move forward as permitted, has obtained a contractor and is in the process of constructing the stormwater wet detention facility as permitted. We will inspect the facility during and at the completion of the project and will provide the Designer's certification. We feel this satisfies the violation of NOV 3023 PCO275. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 120114, issued to you on July 23, 2012, The project has been found in violation of Stormwater Permit Number SW8 120114, issued pursuant to the requirements of the stormwater rules, 15A NCAC 2H.1000. The violations found are: Failure to build according to the approved plan. The BMP has not been installed and the collection system has not been constructed as approved. The runoff from the newly constructed impervious area appears to be directed to a perimeter swale. Per Section 11.1 of the Permit, the stormwater management system shall be constructed in its entirety, vegetated, and operational for its intended purpose prior to the construction of any built upon area. Once the stormwater management system has been constructed, Section 11.7 of the Permit requires a designer's certification to be submitted certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Neither this report, nor the field tests performed are intended to serve as geotechnical recommendations or as a basis of pavement design selection. In April 2011 and January 2012, Susan Sayger, PE performed a subsurface soil exploration at the site of the proposed Flowers Development Corporation project. The site is to be located at 310 Friendly Road, within the town limits of Morehead City, Carteret County. Based on information from the provided plans, a wet detention and forebay system is proposed to meet the DENR high density stormwater requirements. As such, hand auger borings were performed at 35 foot intervals 25 feet from the northerly property line. In January 2012 a second observation was made at same locations, confirming the earlier findings. See attached boring location map. From general observations and the existing and historical use of the property it appears the area of the proposed pond has been been vacant for some time. Per the Carteret County soils map, the in -situ soils are of the Ap, Arapahoe series. Although County soils maps are not used as a direct determination of the elevation of SHWT, soils series information is helpful in field determination. In the instance of this project, Ap series suggests poorly drained, sandy loam soils , with a relatively high SHWT. FIELD EXPLORATION As stated above, field investigation of the site were made twice, including hand auger borings. Free standing water was not observed in the borings. The soils observed at the locations shown on the attached boring location map were identified by color (hue and chroma), texture, moisture content and other soil characteristics, such as odor, in keeping with standards soil classification guidelines such as the USCS and Munsell soil chart. Based on the field observations, corresponding soil classifications, and the generalized subsurface conditions, the depth to seasonal highwater table appears to be approximately 2.8-3 feet, Elevation = 15.1. Soils and classification were observed as follows: O Horizon- Organic -Topsoil to 6 inches, litter layer, friable with coarse roots. A Horizon- Beneath top soil to 15-18 inches, loose grayish -brown and sandy loam, fine roots at upper end of horizon, . B Horizon -From 18 inches to 36 inches, in -situ soils darker, chroma of 2, towards a black sandy loam. In comparing the old plans with the new ones, the shorter forebay wall has been moved into the pond a few feet to create additional volume. I find that the orifice calculation remains an issue. Although Ms. Sayger has reduced the orifice diameter from 3" to 2.65", this is still too large and it drains the pond down in approximately 33.5 hours. In my previous correspondence with Ms. Sayger, I pointed out to her that while 2.65" was closer, it was still less than 2 days. I also suggested that a more standard stock size of 2", 2.25" or 2.5" would be a better choice from the standpoint of availability and drawdown time. In comparing the Q values in her drawdown calculations to ours, I find that her Q value is more quickly reduced over time than ours, which is not readily explained. We are using the same '/z hour time interval, so her flowrates and discharge volumes should be exactly the same as ours. She may be using a different orifice equation (neither the size of the orifice nor the orifice equation is specified in her calculations) or she may be calculating the driving head at the invert of the orifice instead of to the centerline, or she could be using a different orifice coefficient than the standard 0.6, or any number of other possibilities. Please bear with me as I explain in preface to a conversation later tomorrow. The drawdown calculation you provided for the 2.65" orifice shows that the pond reaches permanent pool in 33.5 hours, which is less than the 48 hour minimum. For the drawdown calculation to work properly, you must hit 48 hours first before you get to permanent pool. If you get to permanent pool before 48 hours is up, then you know that something is wrong. I also notice that your Q values for each half-hour start out at the beginning very close to what I am getting, but they get smaller more quickly. Are you calculating the head to the centerline of the proposed orifice? It is the technically correct way to determine the orifice flowrate. Also, are you using the standard orifice equation, Q = C❑ A (2gH)12 and the standard sharp -edge orifice discharge coefficient, C❑ of 0.6? If you are using different constants, variables or equations, please list them and provide your justification for using them. Your calculations do not show any of the constants, variables or equations you used to determine the flowrate for each half-hour interval and the resulting stage. I think you have the process down, but because we are coming up with such different results, I'm just not sure of the basis for your numbers. This is how I have set up the routed drawdown calculation: Start with full temporary pool volume (14259) at the temporary pool elevation (17.85), q=0 and discharge =0 at the start. Determine how much volume was discharged through the orifice during the first half hour based on the full measured head from the orifice centerline to the storage elevation. Subtract that volume from the starting temporary pool volume. Interpolate the stage at the beginning of the next half hour based on the amount of volume remaining to be drawn down at the end of the previous half hour. Repeat the process. Hopefully, if you estimated the orifice size close enough, you'll hit 48 hours before you get to the permanent pool elevation. If not, adjust the orifice size and rerun the calculation until you get that result. I also notice that the beginning stage for your drawdown calculation is 17.81, but the specified temporary pool elevation is 17.85. Your drawdown calculation should begin at 17.85. The simplest approach, as has been offered before, is to rearrange the standard orifice equation to solve for Area, using the average head, H13, and the target flowrates for a 2-day drawdown (14,259 divided by 172800 seconds in 2 days) and a 5-day drawdown (14,259 divided by 432000 seconds in 5 days.) Once you know the range of orifice areas that will work, just pick an area in-between and check it using the average head measured to the centerline of the proposed orifice. For example: 142591172800 = .083 cfs 14259 / 432000 = .033 cfs Rearranging the orifice equation to solve for area, A = Q 1 C❑ (2gh)12 + Substituting .083 and .033 for Q and using gravity, g = 32.2 ft/seC2 and estimated average head of (17.85 — 16.5)/3 = 0.45, the resulting orifice Area for a 2 day drawdown is 3.86 square inches, and the resulting orifice Area for a 5 day drawdown is 1.55 square inches. Converting these areas into a diameter, D = 2(A / iT )112 results in a range of suitable diameters from 2.2" to 1.4". Don't go any larger than 2.2" and no smaller than 1.4". You then select a suitable orifice size and test it in the orifice equation using an average head to the centerline and see if it works, or you could plug it into the falling head drawdown to see if it works. Georgette asked me to research the topic and here's what I have come up with: To preface our discussion, I need to remind you that the Division's goal, as required in the rules, is to use the most conservative calculation methods. In addition, Section .1008 (e)(2) of the rules requires the discharge rate of the orifice to be designed such that the pond draws down to permanent pool in 2-5 days "following the design storm." This has been interpreted since the inception of the rules to mean that the rain has stopped, and a full pond needs to be drained down in 2-5 days. Having said all that, we understand and agree that in the real world, the drawdown orifice is engaged during the storm event, however, since we want to follow the rules and be conservative, the Division does not give credit for the volume discharged during the storm, nor have we ever calculated the drawdown time starting at the beginning of the storm. The HydroCAD program creates an inflow hydrograph for a selected storm event and then calculates a peak inflow, a peak elevation and a peak outflow based on that storm event, the specified outlet device type(s) and the invert elevation of the outlet device(s). This program is great for documenting the stage -storage volume relationship provided in a BMP based on the surface areas and elevations. However, we believe that the use of the inflow routing to prove that the pond draws down in 2-5 days is questionable. I have the following questions regarding the program output: 1. The design storm at the top of the page says it's a Type II 24-hr Rainfall = 2.95", so I'm wondering if the inflow and outflow values are calculated using 2.95" of rain vs. just 1.5". 2. The "drawdown" time starts at the beginning of the storm event. 3. You cannot add the 0.15 cfs weir flow to the orifice flow. Since we are only interested in orifice flow (a max of 0.26 cfs for a 3" orifice) the output needs to be adjusted to remove the weir flow. Both methods DWQ uses (Falling Head and Standard Orifice Equation) indicate that this 3" orifice under the static conditions of a full pond and an average head of 0.4 feet, will draw down the pond in 29 hours after the design storm rainfall stops. The orifice drawdown equation that we use in our spreadsheets is simple and conservative, and is based on a static condition in the pond, where the rain has stopped (i.e., following the design storm) and the pond level is at the temporary storage elevation and must be brought back down to normal pool elevation. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Seasonal High Water Table: Due to the concern with the seasonal high water table determination for this project, the Division asked their soil scientist, Vincent Lewis, to evaluate the seasonal high water table in the location of the wet detention pond. Mr. Lewis visited the site on April 8, 2012 and determined the seasonal high water table to be less than 12 inches from the surface based on the soil characterization in the vicinity of the proposed pond. Additionally, he found saturated sand at a depth of 12 inches. Based on Mr. Lewis's site visit, it appears that the proposed permanent pool elevation will be more than 6" below the seasonal water table. In this case, additional calculations and analysis are required per Section 10.3.2 of the NC BMP manual. Please evaluate the pond based on this section of the manual, specifically Item 2 on page 10-9, in order to demonstrate the pond will function as intended. 2. Please detail how an average depth of 4.5 was determined. The wet detention pond supplement indicates that Option 2 was selected to determine the average depth. Using the equation provided in the NC BMP manual for Option 2, and the surface areas, elevations, and depths reported on the supplement, the calculated average depth is 4.17 ft, which is rounded down to 4.0 ft as follows: 10.25 x (1 + 9206)] + [(7312 2 2413) x Qb3lb2)] = 4.17 ft 3. The provided forebay volume, 5,535 ft3, appears to include the volume between elevations 11.25 and 15.56. a. Please begin the forebay volume calculation at 12.25. The sediment accumulation depth is not part of the provided volume.. b. With a forebay berm weir provided at the permanent pool elevation, 15.0 , the forebay volume can only be considered between elevations 12.25 and 15. If you wish to consider the forebay volume up to an elevation of 15.56, please remove the provided weir, revise the permanent pool elevation to 15.56 and revise the temporary pool elevation as needed to provide a minimum of 14,259 cubic feet of storage volume above the new permanent pool elevation. The inflow hydrograph from HydroCAD has been presented in support of the pond's drawdown time. This hydrograph appears to reflect the inflow to the pond, not the outflow. HydroCAD also provides a Stage -Discharge function, which can be used to demonstrate that the required storage volume, based on the 115" storm event, is drawn down time through the orifice,within the required 2-5 day timeframe. The Stage - Discharge function must start at the temporary pool elevation under full head and end at the permanent pool elevation under no head. Another option for demonstrating the average drawdown time for the required storage volume through the selected orifice would be to use the standard orifice equation available in Chapter 3 of the NC i3MP manual, where the average head, h, is calculated as H13. 5. On page 3 of the wet detention pond operation & maintenance agreement (O&M), please revise the elevations reported in the text area prior to the basin diagram to reflect actual depths. For instance, for the main pond the depth would be 6.1 ft. 6. Please remember that a change to one number may have a domino effect on other numbers. Please check all plans, calculations and forms for consistency and make changes as needed. Please note that this request for additional information is in response to a preliminary review. The requested information should be received in this Office prior to June 11, 2012, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Soils Report: a. The soils report identifies that the groundwater table was encountered at an elevation of 15.1. Please note that the groundwater table is not the same thing as the seasonal high water table (SHWT). Please provide the elevation of the SHWT in the vicinity of the proposed pond. b. Soils reports are typically prepared by soil scientists or geotechnical engineer. Please either provide the soil classification qualifications of the engineer, Sue Sayger, who prepared the provided soil report or provide a soils report from a licensed soil scientist. 2. Please delineate the wet detention pond drainage area on the plans. 3. Please detail how an average depth of 4.5 was determined. The wet detention pond supplement indicates that option 1 was selected to determine the average depth. Using the provided permanent pool volume and surface area, the average depth according to option 1 should be 3.3 ft, or 3.5 ft once rounded. 4. It.appears that the permanent pool volume, average depth, and associated calculations include the 1-foot sediment accumulation depth. The depth of the permanent pool is considered to be difference between the permanent pool elevation and the top elevation of the sediment storage and does not include the minimum 1-foot sediment accumulation depth (refer to Figure 10-2b and Section 10.3.4 of the NC BMP manual). Please revise the calculations, supplement, and other documentation to consider just the permanent pool above the sediment accumulation depth in the pond calculations. For instance, since the forebay is only 1 ft deep, the forebay would comprise entirely of the sediment storage and would not contribute any volume toward the permanent pool volume. It is required that the forebay contain approximately 20% of the permanent pool volume. The sediment clean out/rem ova I elevation (bottom of the permanent pool) is reported inconsistently in the application documents. For instance, the wet detention pond supplement identifies this elevation as 12.0 while the Operation & Maintenance Agreement (O&M) lists it as 9.9. Please present the information accurately and consistently throughout the documents. 6. Please do not round the SA/DA ratio to the tenth decimal place, instead this ratio should be rounded to the hundredth decimal placer This will help to reduce rounding errors, -- which may result in deficiencies. 7. On the wet detention pond supplement and in the calculations, the temporary pool elevation is identified at an elevation of 17.43 ft; however the next available outlet appears to be set at an elevation of 16.3. Since the temporary pool elevation is considered to be set at the next available outlet above the permanent pool, please list the temporary pool as the next available outlet and ensure that the information is consistent and accurate. 8. The drawdown rate for the temporary pool should be based on the design storm and required storage volume, not the actual storage volume. With the current orifice size of 3", the required storage volume will drawdown in less than two days. Please resize the orifice and provide calculations demonstrating that the drawdown rate for the required minimum storage volume is between 2 and 5 days. 9. Please provide Section III of the wet detention pond supplement, the Required Items Checklist. 10. Please ensure the elevations and depths listed on page 3 the wet pond O&M are consistent. For instance, the current pond design calls for the sediment removal elevation in the forebay to be 15 ft while the permanent pool elevation is 15 ft. In this scenario, the depth in the forebay is 0.0 ft. (please refer to item 3 of this letter for the issues surrounding the forebay design) 11. Please provide additional grading detail, especially along the edges of the property, to help demonstrate that the runoff from the impervious areas will be directed to the stormwater collection system and that no offsite area enters the pond drainage area. 12. The plans indicate that the pond discharge will be directed onto the property owned by Best Ventures LLC. Please demonstrate that there is an existing natural drainage channel that is on this property and either provide a letter from that property owner agreeing to the proposed discharge of water or demonstrate that there is a drainage easement for this discharge. 13. On plan sheet SW-2, please identify the sediment removal elevations of the pond. 14. If the top of the forebay weir is set at an elevation of 17 ft, please demonstrate how the forebay will return to a permanent pool elevation of 15 ft. One option is to propose a weir set at or just below the permanent pool elevation. Ideally this weir would be located to maximize the flow path. 15. Please increase the quantity of plants listed in the planting schedule. Section 10.3.7 of the NC BMP Manual requires a minimum of 50 plants per 200 sf of shelf area. 16. Please remember that a change to one number may have a domino effect on other numbers. Please check all plans, calculations and forms and make changes as needed. I have a project that has been submitted that looks like it is physically located within a half mile of SA waters, and drains to that SA water but first goes through a named stream classified as SB# (in the White Oak basin the # is just for sewage). Two years ago we made the call (below) that if the project ultimately drained to an SA stream then the project is subject to SA. But, in the example 2 years ago the project drained first to an unnamed stream (Jones Pembroke Lake in Landfall) and then to SA. Does it matter that this project will first drain to a named stream? From our standard diagram I don't think that there is a difference in how we apply the named or unnamed original receiving stream if the project ultimately drains to an SA receiving water. Right? I drew the attached quick maps. Also, the project is on Friendly Rd and it first drains to Peltier Creek, and then to SA. "As the Crow Flies" the project is within a half mile. On the ground it is over a half mile. Does that matter? A lot is backed up to an ORW, but the assigned classification is SA ORW. It is that dammed up portion of Howe Creek called Pembroke Jones Lake. The dam's been there since 1970, but our EMC maps show the Lake as ORW. I think we've established that the Lake is NOT SA because of the dam, and it is freshwater, so the requirements of the Limited Residential would not apply? The site plan proposes construction of a 3.89 acre commercial site with 69% impervious surface coverage. This includes 117,333 sq.ft of building (42,950 sqft of office and five ministorage facilities), 74,383 sgft of parking and driveway and 52,115 sgft of pervious surfaces. The site is located at 310 Friendly Road, off Bridges Street, Morehead City, in Carteret County, North Carolina. The northerly and easterly adjacent parcels are currently wooded and vacant. The southerly adjacent parcel is ministorage site. The plan is for construction of a slab on -grade, metal -storage buildings and office, finish floor elevations vary at approximately 18.5 feet. The 3.89 acre is zoned commercial. The owner and operator of the facility is Mr. Richard Flowers. In general, the parcel drains over a minimal grade across site towards an existing ditch along Friendly Road. As seen on the included location and topo map, the ditch and the site drains to an unclassified existing ditch, then over one half mile to Peletier Creek, a tributary of the Bogue Sound, classified as a SB water. STORMWATER MANAGEMENT As seen on the attached drawings, the required stormwater event (1.5") is being stored and treated by a• forebay and wet detention pond. All impervious surfaces (parking area and roof drains) will drain overland flow to forebay. Run-off sediment will settle out in the forebay and run-off will flow across the weir across and into the main pool. The 1-year event will draw down over 62 hours through a 2- inch orifice and outfalling to the existing ditch along Friendly Road, with a peak elevation of 15.7 feet. The project proposes to utilize permeable pavement to stay below the permit trigger of 10,000 square feet of new built -upon area, which became effective October 1, 2008, in the 20 coastal counties. The attached development plans and permeable pavement supplement form propose using permeable concrete with a gravel base depth of 6", which has a managed grass factor of 60% and a permeable pavement area of 6,085 square feet. This results in a pavement built -upon area of 2,434 square feet, and a net effective project built -upon area of 9,764 square feet. It has been determined that the project will have less than 10,000 square feet of new net built -upon area and therefore does not require a stormwater permit. This determination is effective only if: 1, The proposed development plans and construction sequence are implemented as shown; 2, The permeable pavement is designed, installed and maintained at the area, elevation and grade shown on the plans; 3. The total net effective built -upon area stays below 10,000 square feet. 4. Traffic volumes are less than 100 axles per day; 5. Not all permeable pavements get a 60% reduction. The percentage of "managed grass credit" that is applied to a permeable pavement depends on the type of pavement and the depth of the gravel base. If you will note on the supplement form, if you put an "X" in the blank area for a permeable concrete without a gravel base, the managed grass factor is 40%, not 60%. 2. The credit is applied only if the pavement is properly constructed per the design specifications listed in Section 18.3.3 of the BMP Manual. The BMP Manual is a supplement to the regulations and is meant to provide further explanation of the minimum BMP design requirements in the rules in a straight -forward manner, easy to understand format. Permeable pavement was added to the BMP Manual in July 2007, so there is no specific reference to it in the rules. The Division was directed to allow these credits for permeable pavement due to Senate Bill 845, which requires the use of permeable pavement on all parking lots created after April 1, 2009, despite there being no specific regulation allowing the use of permeable pavement in the stormwater rules. In authoring the chapter on permeable pavement, the Division researched acceptable design, construction and maintenance practices and adapted those practices into the BMP Manual such that the permeable pavement will function. If you adhere to the design, construction and maintenance minimums of permeable pavement as specified in the BMP Manual, then the Division we will be able to confirm that you have <10000 sf of BUA and do not need a permit. As previously explained, the Town of Morehead City requested a Division review of this project and confirmation of the claim that there is <10000 sf of BUA. I believe we should answer the questions above before we get into specific design criteria, noting that the installation must and will be designed properly. Ms. Veltman is not as familiar with the numerous permeable pavement design guidelines and is more comfortable with the Division making the call that all the requirements have been met. This is the prerogative of the City. Please submit 2 sets of the grading and layout plans, a complete permeable pavement supplement form, a signed permeable pavement O&M agreement, a cover letter containing a narrative statement about the project, and the name, mailing address and phone number of the owner as well as the street address of the project. If the project is a commercial development, I would require the applicant to demonstrate that <100 vehicles per day will utilize the parking lot. Depending on how much traffic is anticipated, only the parking spaces themselves should be permeable pavement. The driveway aisles should be regular pavement as they will see all of the traffic.
