Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in our
custody readily available to the public for review and copying. We also have the responsibility to the public to
safeguard these records and to carry out our day-to-day program obligations. Please read carefully the following
guidelines signing the form:
1. Due to the large public demand for file access, we request that you call at least a day in advance to
schedule an appointment to review the files. Appointments will be scheduled between 9:00am and
3:00pm. Viewing time ends at 4:45pm. Anyone arriving without an appointment may view the
files to the extent that time and staff supervision_ is_ayaiIable.
2. You must specify files you want to review by facility name. The number of files that you may review
at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits. Cost per
copy is .05 cents for copies. Payment may be made by check, monev order, or cash at the
reception desk. Covies totaling $5.00 or more can also'be invoiced for your convenience.
4. FILES I UST BE KEPT IN ORDER YOU FOUND THEy1. Files may not be taken from the
office. To remove, alter, deface, mutilate, or destroy material in one of these files is a misdemeanor
for which you can be fined up to $500.00. No briefcases, large totes, etc. are permitted in the file
review area.
5. in accordance with General Statue 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.

Option 2 would need a modification to the permit as it would create a chain reaction causing the rest of the pond design

I passed your question and photos on to others here in the Wilmington office and in Raleigh. The consensus was that
the entire vegetated shelf needs to be provided. It was also noted that a plan revision or similar request should have
been submitted prior to making the changes to the approved design. Considering the pond's current condition, 3
options were offered:
Remove the rip rap and filter fabric from the vegetated shelf and plant as specified. A plan revision should also
be submitted documenting the revised pond design.
Submit a modification to the permit to modify the pond to raise the orifice invert in order to create the required
vegetated shelf above the rip rap line.
A combination of the 2 options above in order to obtain the required vegetated shelf (will likely also result in a
modification to the permit).

As a follow-up to our phone conversation this morning, I am writing to respectfully request a minor variance from the
approved plan for the above referenced project (State Stormwater Permit No. SW8 111203). With a few minor
adjustments left to do, the pond is ready for my PE certification except for the required plantings on the littoral shelf.
As I mentioned on the phone today, the SECU site contractor had quite a problem earlier this year when he began his
work. With the seasonal high groundwater being recorded at elevation 7.25, the contractor had trouble excavating to
elevation 1.0. As you can see in the enclosed photo named " SECU Retention Pond Sand", the wet sands ran
continuously not allowing the contractor to shape the bottom of the pond as required. SECU relied on their project
geotechnical engineer, Geotechnologies, Inc, to help them resolve the problem which is apparently common in this
area. With a combination of dewatering and installing a layer of rip rap / filter fabric along the inside walls of the pond
from elevation 1.0 to approximately 7.0, the contractor was able to stabilize the lower portion of the wet pond to the
required dimensions (which have been verified with an as -built survey). Do to this constructability problem, the
contractor is now unable to plant the shallow water plants.
I have enclosed one other picture of the finished pond configuration for your information and review. I am prepared to
instruct the contractor now to go ahead and install all the required shallow land plantings prior to final inspection and
certification but I wanted to discuss this matter with DWQ before we did anything.
As I mentioned on the phone, I am available to meet with you to discuss this matter either at your office or at the site as
you deem necessary.

CARTERET COUNTY, NC
The proposed project is located on a +/- 3.0 acre lot located in the northeast quadrant
of the intersection of NC Hwy.70 and Dinners Point Road. The site is currently covered with a
grass mixture and has been left uncut for sometime. Topography is fairly flat with elevations
ranging from elevation 8 at the front of the property to elevation G along the rear part of the
parcel. There 15 currently a small channel running through the middle of the site draining from
front to back. This channel has been field verified by ACOE personnel and we have received a
Jurisdictional Determination stating that there are no waters of the U5 present on th15 51te. A
COPY of th15 1 0/ 1 1120 1 1 letter is enclosed in this report. The total area being disturbed for
the project is 3.42 acres which takes into account a proposed deceleration lane along U5 70 as
required by the North Carolina Department of Transportation. The site is tributary to Gibbs Creek
within the White Oak River Basin and 15 within V2 mile of 5A/HQW waters (Index # 2 1 -35- 1 - 10).
This proposed plans call for the development of a +/- G,700 5J. Credit Union office and
associated parking lot. The site will be serviced by Town of Beaufort public water and
wastewater collection. The total proposed overall impervou5 area 15 G4, 150 s.f. or
approximately 54.9% of the total 5ste area. Due to the existing site grade constraints not all of
the proposed impervious area has been routed to the 5tormwater wet pond due to the existing
topography and elevation of the Pinner5 Point Road and Highway 70 ex15ting ditch fine grades.
In order to provide the permanent pool level within the required G-inches of the seasonal high
water table, it was necessary to raise the site approximately G-feet and make the road
connection tie-ins, which makes it difficult if not impossibie to route all of the new impervious
areas to the proposed pond. However, we have maximized the impervious areas draining to the
pond to the greatest extent p05511?le and have designed the wet pond surface area based upon
all of the on -site impervious area. Approximately 0.09 acres of impervious area will drain along
the NC Hwy.70 and Dinners Point Road ditch line. The proposed site plan will provide for an
'overall 5tormwater management plan that includes wet pond surface detention to detain the
increase storm water runoff. There will be an enclosed Storm drainage system which wili empty
into the pond forebay. The storm water design is High Density Commercial, Coastal Storm water

designed to capture the difference from the pre -developed runoff volume and post -developed
runoff volume and Slowly release �t over a 2-5 day time period. The wet pond has al5o been
designed for 90% T55 removal. In addition, we have designed an engineered Level Spreader /
Vegetated filter 5trap per 5tormwater rule 15 A NCAC 2H. 1008 (c)(4) and 5e55ion Law 2008-
201 1 for Coastal Counties for the discharge from wet detention basins. There 15 no off -site
runoff coming onto the 5+te or into the proposed BMP. In addition, the project does not have
buffer requirements and the project is not located within a buffer.
The flow leaving the 5tormwater wet pond has been routed to the existing natural channel and
released at or below the pre -developed Q-1 24 hour storm peak rate and Q- 10 24 hour storm
peak rate. Plea5e find a summary of pre -developed conditions compared with the po5t-
developed conditions on the following page.

The permanent wet pond will be utilized as temporary erosion control measure (riser
basin). Temporary diversion berms/ditches will convey runoff to the riser basin.
Please refer to Pre -developed Drainage Area Map DA- I for the pre -developed drainage
patterns leaving the site. Currently, the pre -developed drainage pattern on -site is divided into
two drainage areas (On -site Drainage Area # 1 -2.08 ac. and On -Site Drainage Area #2-0.79
acres). On -site Drainage area # I currently drams to the rear of the site via an existing man-
made ditch. On -site Drainage area # I drains to Off -site Drainage area #2 via the same existing
ditch through the adjacent site to the southern most property line to Point A as shown on the
map. On -site Drainage Area #2 drains to the existing roadway channel along NC Highway 70 and
Pinrer5 Point Road and continues along the roadway channel south of the 51te. In order to
provide an analysis for any increase of stormwater to the adjacent parcel located east of the site
we have also included a pre -developed Off -site Drainage Area #4 for comparison to the post -
developed condition. Therefore the overall analysis relative to the Pre -developed and Post -
developed conditions analyzes these three different drainage patterns as summarized below:
I ) On -site Drainage area # I and Off -site Drainage Area #2 which drain to Point A.
2) On -site Drainage Area #4 (Po5t-developed DA-2 map) and Off -site Drainage Area #4
which drains to Point B.
3) On -site Drainage Area #3 which drains to the NCDOT right-of-way.
Post -developed Drainage Area Map DA-2 depicts the post -developed drainage areas.
On -site Drainage Area # I represents the drainage area tributary to the proposed wet detention
pond. There is a small area off on -site Area (On -site Drainage Area #2) which does not dram
through the pond, however a accounted for in the drainage calculation to Point A along with Off -
site Drainage Area #2. Drainage Area #3 Not to Pond, is also a small area not draining through
the pond. This drainage area flows into the NCDOT right-of-way; please note this area 15 le55
than the pre -developed condition. There is a small amount of impervious area within this drainage
basin which also does not dram to the pond; however the water duality storage volume was
designed to accommodate this area and over treat the developed area draining through it.
There 15 also a small amount of area (On -site Drainage Area #4) which now drams through Off-51te
Drainage Area #4 to Point 5. The intent of this study and management plan is to ensure the
post -developed drainage through the adjacent properties to Points A and 5 are equal or less
than the pre -developed condition, which is shown in the Overall On and Off -site Drainage Area
Evaluation table on the following page. It also the intent to show that the On -site Drainage Area
#3 which flows to the NCDOT right-of-way has -also not increased from the Pre -developed to the
post -developed condition.
The purpose of the On-51te 5ub5urface Drainage System and Pond DA-3 map is relative
to the design of the on -site subsurface drainage system and proposed NCDOT driveway pipes.
Thts map should not be utilized to compare the overall drainage system since the NCDOT right-
of-way was not included in the overall analysis, only the respective on -site drainage areas.

The proposed project 15 located on a +/- 3.0 acre lot located in the northeast quadrant
of the inter5ect1on of NC Hwy.70 and Pmners Point Road. The site is currently covered with a
grass mixture and has been left uncut for sometime. Topography 15 fairly flat with elevations
ranging from elevation 8 at the front of the property to elevation G along the rear part of the
parcel. There 15 currently a small channel running through the middle of the site draining from
front to back. This channel has been field verified by ACOE personnel and we have received a
Juri5dictiona! Determination Stating that there are no waters of the U5 present on this site. A
COPY of this 10/ 1 11201 1 letter 15 enclosed in this report. The total area being disturbed for
the project is 3.42 acres which takes into account a roposed_cfeceleration Jane along U5.70 a5=,
required by the North Carolina Department of ansp�i=atron=The_sit-e—is Abu a�fo Gib 5 re'eci—
withm the White Oak River Basin A is within 1/2 mile - of 5NI-QW wat~ c �(Endcx # 2 I -35- I - 10).
This proposed plans call for the development of a +/- G,700 5.f, Credit Union office and
associated parking lot. The site will be serviced by Town of Beaufort public water and
wastewater collection. The total proposed overall impervious area ss G4, 150 s.f. or
approximately 54.9% of the total site area. Due to the existing 51te grade con5traint5 not all of
the impervious area has been routed to the stormwater wet pond. Approximately 0.09 acres of
impervious area will drain along the NC Hwy.70 and Pmners Point Road ditch line. The proposed
site plan will provide for an overall stormwater management plan that includes wet pond surface
detention to detain the increase storm water runoff. There will be an enclosed storm drainage
system which will empty into the pond forebay. The storm water de51gn 15 High Density
Commercial, Coastal Storm water regulations. Since the wet pond is located within �/2 mile of 5A

two drainage areas (On -site Drainage Area # 1 -2.08 ac. and On -site Drainage Area #2-0.79
acres). On -site Drainage area # I currently drains to the rear of the 51te via an existing man-
made ditch. On -site Drainage area # I drams to Off -site Drainage area #2 via the same existing
ditch through the adjacent site to the southern most property line to Point A a5 shown on the
map. On -site Drainage Area #2 drains to the existing roadway channel along NC Highway 70 and
Pinners Point Road and continues along the roadway channel south of the site. In order to
provide an analysis for any increase of 5tormwater to the adjacent parcel located east of the site
we have also included a pre -developed Off -site Drainage Area #4 for comparison to the post -
developed condition. Therefore the overall anaiysis relative to the Pre -developed and Post -
developed conditions analyzes these three different drainage patterns as summarized below:
I ) On -site Drainage area # I and Off -site Drainage Area #2 which drain to Point A.
2) On -site Drainage Area #4 (Post-deveioped DA-2 map) and Off -site Drainage Area #4
which drains to Point B.
3) On -site Drainage Area #3 which drains to the NCDOT right-of-way.
Post -developed Drainage Area Map DA-2 depicts the post -developed drainage areas.
On -site Drainage Area # I represents the drainage area tributary to the proposed wet detention
pond. There is a small area off on-51te Area (On -Sete Drainage Area #2) which does not drain
through the pond, however is accounted for in the drainage calculation to Point A along with Off -
site Drainage Area #2. Drainage Area #3 Not to Pond, 15 also a small area not draining through
the pond. This drainage area flows into the NCDOT right-of-way; please note this area 15 less
than the pre -developed condition. There 15 a small amount of impervious area within this drainage
basin which also does not drain to the pond; however the water quality storage volume was
de51gned to accommodate this area and over treat the developed area draining through it.
There is also a small amount of area (On -site Drainage Area #4) which now drams through Off -site
Drainage Area #4 to Point B. The intent of tN5 study and management plan 15 to ensure the
post -developed drainage through the adjacent properties to Points A and B are equal or less
than the pre -developed condition, which 15 shown in the Overali On and Off -site Drainage Area
Evaluation table on the following page. It also the intent to show that the On-51te Drainage Area
#3 which flows to the NCDOT right-of-way has also not increased from the Pre -developed to the
post -developed condition.
The purpose of the On -site Subsurface Drainage System and Pond DA-3 map is relative
to the design of the on -site subsurface drainage system and proposed NCDOT driveway pipes.
This map should not be utilized to compare the overall drainage system since the NCDOT right-
of-way was not included in the overall analysis, only the respective on -site drainage areas.

I promised I would follow up on the requirements for projects within % mi of draining to SA waters that are proposing an
85% pond. I talked with Kelly Johnson (who has been trying to finalize guidance for projects within % mi of and draining
to SA waters) and she did confirm that a secondary BMP (not just a LS/VFS) is necessary for projects that propose using
an 85% pond. The reasoning behind this is that these ponds already, by definition of an 85% pond, need a LS/VFS. So
essentially, the discharge from an 85% pond must be directed to a secondary BMP, which then must go to a LS/VFS.
Needless to say, a 90% pond would make things a lot simpler.
I am attaching the draft guidance I referred to in the meeting yesterday. Please note that this guidance has not -yet
been approved and I am only providing it in hopes that it may help you interpret the requirements of the Session
Law. If you wish to be a part of the work group that Kelly is working with to finalize the guidance, feel free to contact

What I was trying to imply is that the ENTIRE Low density supplement isn't needed if no swales are proposed on the
commercial lot. The only form needed at that point is the application. The table on page 3 of the application is
sufficient to show that the site meets the low density

Happy New Year, I hope you had a great Holiday.
We are wrapping up obtaining signatures from adjacent land owner relative to the Low Density Permit application for their
Parcel. Based upon your previous correspondence it sounds as if there are no proposed swales all we need to submit is
the Low Density application with no O&Ks. I have attached a pdf and circled in red the area of pavement which will sheet
drain across the ground. We did modify the driveway slope connection to 10%. There is a very small amount of drainage
which will be directed and sheet drain to this location. If you could confirm this is correct, it would be greatly appreciated.
We hope to be calling early next week to schedule the express review.

The curb outlet supplement has been included in the low density Supplement or as the separate grass Swale
supplement. You will notice that the Low Density supplement now has that same swale table. For commercial sites that
meet the LD requirements, a low density supplement isn't needed unless swales are proposed. If swales are proposed, I
suggest that it is easier to fill out the low density supplement w/ 0&M to identify those swales than it is to fill out
separate grass swale supplements for each.

Thank you for the information. I have re -graded the pond slightly to obtain the 3.27 feet average depth which allows us to
utilize the 3.5 depth relative to the SA/DA for the pond. So, I am able to design the wet pond for the 90% TSS with the
engineered level spreader as we reviewed the other day, so it appears we have that aspect worked out.
I'm also pulling together a low density permit for the adjacent property as we discussed and wanted to obtain some
clarifications relative to the requirements for this application. In reading through the requirements it appears that a low
density supplement is not required since the project does not propose to subdivide and sell lots — correct? Are there any
other supplements required, I thought there used to be a curb outlet supplement, since we have proposed cub and gutter
along the entrance drive which is located on the adjacent property. Please advise what information or requirements there
are for the low density permit for the adjacent property.
