Guidelines for Access! The staff of Wilmington Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to carry out our day-to-day program obligations. Please read
carefully the following guidelines signing the form'
L Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment to review the files. Appointments will be scheduled
between 9:00am and 3:00pm. Viewing tirrre ends at 4:45pm. Anyone arriving without an
appointment may view the tiles to the extent that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
Cost per copy is 2.5 cents for ALL copies if you snake more than 25 copies. There is no
charge for 25 or less copies. Payment may be made by check, money order, or cash at the
reception desk. Copies can also be invoiced for your convenience.
4. FIDES MUST BE KTPT IN ORDER YOU FOUND THEM. Files may not be taken from
the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a
misdemeanor for which you can be fined up to $500.00, No o briefcases, large totes, etc, are
permitted in the file review area.
5. In accordance with General Statue 25-3-512, a $25.00 processing fee will be charged and
collected for checks on which payment has been refused.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

redevelopment of impervious surfaces, and for the construction, operation and
maintenance of 2 underground infiltration trenches in compliance with the provisions of
15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the approved
stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Water Quality and considered
a part of this permit.
This permit shall be effective from the date of issuance until August 23, 2016, and shall
be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater systems have been approved for the management of
stormwater runoff as described in Section 1.6 on page 3 of this permit. The
stormwater controls IaPeled North aro South have been designed to handle the
runoff from 117,958 ft and 60,644 ft , respectively; of impervious area. Since
this is a redevelopment project, and space would not allow, a vegetated filter
could not be provided.
3. The tract will be limited to the amount of built -upon area indicated in Section 1.6
on page 3 of this permit, and per approved plans. This permit makes no
allocation of built -upon area for future development.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of bypass structure, filter media, flow
spreader, catch basins, piping and vegetated filter.
g. A clear access path to the bypass structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.

5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored 'to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the -Director'
that the changes have been made.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Attached is the resubmittal for the above referenced project. The following are
responses to comments dated July 11, 2006:
1. Someone affiliated with the NC State Ports Authority should sign the
application and supplements. In the past the Director has signed the
applications. Since you are not affiliated with the State Ports and will
not be the responsible party for continued compliance with this
permit, please provide a signed letter of authorization from the
Director, indicating that you are authorized to sign the permit
application on behalf of the State Ports Authority.
The underground systems will be owned and
maintained by Duke Construction; therefore, Duke has
signed the revised supplement forms. In addition, a
consent form signed by the Port has been provided.
2. Please express the built -upon areas listed in Section 111.6 in square
feet.
Built -upon areas have been provided in square feet on
the permit application form.
3. The plans appear to indicate that 2 separate systems have been
provided, each with it's own drainage area, north and south. If this is
the case, and the systems are not connected such that they function
as one, please revise the calculations, application and plans.
Calculations should be provided for each system, the application
should be completed with one column for each proposed system, a
separate, originally signed supplement should be provided for each
system, and the plans should provide separate details for each
proposed system.

The calculations, applications and plans have been
revised to show two separate underground facilities,
north and south. Revised supplement forms have also
been provided. An additional cross -sectional detail has
been provided on sheet C1.09.
4. Please delineate the drainage area for each proposed system.
The drainage area has been delineated for each
proposed system and is shown on sheet C1.04.
5. Please provide a bypass/overflow structure detail.
A bypassloverflow detail has been provided. The
overflow is located on the building downspout. See
detail 4 on sheet C1.09.
The supplement indicates that the storage elevation is at 8.0,
however, if the trench is only 3.5' high, the storage/overflow
elevation cannot be higher than 5.43 (1.93 + 3.5).
The overflow has been designed such that when the 1"
storm is contained in the underground system, the
stormwater will back-up into the roof leaders and be
discharged through the overflow in the downspout.
Please add the nearest intersection of two major roads to the vicinity
map. A major road is any 1, 2 or 3 digit NC, US or interstate
highway. Ideally, the vicinity map should be geared toward driving to
the site from Wilmington.
An additional area map has been added to sheet C1.01
showing the requested information.
8. Please indicate the appropriate bottom and storage elevations on the
section details for each trench.
Bottom and storage elevations have been added to the
to the trench cross -sections on sheet C1.09.

The Wilmington Regional Office received a Stormwater Management Permit Application for NC
State Ports Morehead City Warehouse on July 10, 2006, with a scheduled Express Review
date of July 11, 2006. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater
review:

letter. The request must indicate the date by which you expect to submit the required
information.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not

Project Summary
The proposed project is located at the Port of Morehead City in Carteret County, North
Carolina. The project consists of a new warehouse facility that will be built on currently
developed Port property and includes the construction of associated access drives and a
railroad spur to serve the warehouse. Additionally, an inclusive approach is being
prepared for the area surrounding the proposed project that addresses the demolition of '
" Ophelia" storm damaged adjacent buildings along with the subsequent stabilization and
redevelopment of these areas.
Existing, Conditions
The area that is addressed by the proposed project and overall plan includes
approximately 19.9 acres. It is located on the western side of the port, south of the Port
Terminal Road; see attached layout. The port is located on Bogue Sound and the
adjacent surface water is classified as SC waters. Most of the project area consists of
existing impervious areas or is pervious areas used for cargo storage, truck queing and
parking areas.
Proposed Project
The proposed project consists of two elements. The first element is the proposed
warehouse facility. The warehouse will be approximately 177,000 square feet and will
be built on the west side of the Morehead Port, adjacent to berth 9. The warehouse will
be constructed in an area that is currently paved hardstand and serves as a
storage/laydown area. There will not be any restrooms or other facilities that will
generate wastewater for the warehouse. The second element of the project consists of the
demolition of several hurricane damaged buildings and storage areas. These areas will be
converted to open storage to offset the loss of the current storage areas with the
construction of the warehouse.
Summary
As a result of this project, there will not be any additional discharge points to the adjacent
surface waters. All drainage from the warehouse and other refurbished areas will use the
existing storm drainage system.

9. PROJECT DESCRIPTION
Duke Construction, on behalf of North Carolina State Ports Authority, has requested that the attached application
be processed under the Express Permit Review Program.
The project site is located at 113 Arendell Road, adjacent to the Morehead City Turning Basin, in Morehead City,
Carteret County. To get to the site, take Hwy 70 east from Newport towards Beaufort. Turn right at the last stop
light before crossing the high-rise bridge heading into Beaufort. The North Carolina State Ports Authority
(NCSPA) facility will be located on the right. The lot averages 8-10 feet above mean sea level. The NCSPA
currently operates as a loading and off-loading shipping facility.
The NCSPA facility (later referred to as "The Port") is comprised of approximately 100 acres and is located in an
area of high industrial activity. Multiple commercial and U.S. Government operations use the adjacent waters
(Turning Basin and Morehead City Shipping Channel) as a means of shipping and receiving merchandise.
The Port is heavily developed with very little vegetation. Land grasses and ornamental landscaping represent what
little vegetation there is on the site.
It should be noted that impervious coverage at the site, within the 75' Area of Environmental Concern (AEC), is
currently around 100%. The Port has an existing stormwater management plan, but the proposed development has
prompted the facility to revise the stormwater collection and treatment system. A newly designed stormwater
infiltration system has been proposed in the vicinity of the new warehouse, loading dock and rail line. The Division
of Water Quality is currently reviewing the stormwater package under the Express Stormwater Review Program.
The Carteret Land Use Plan classifies the area in the vicinity of the project area, as Developed. The waters in the
project area are classified as SC by the N.C. Division of Water Quality. They are NOT designated as a Primary
Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The Port is proposing to develop the property by constructing a 177,100 sq. ft. warehouse, two concrete loading
docks, rail line and stormwater collection system. Additionally, the applicant is proposing to demolish two
buildings and several concrete staging pads.
Beginning along the western side of the property, adjacent to Berth 9, the applicant proposes to install a stormwater
collection and infiltration system. As proposed, the system will provide stormwater collection for the new
warehouse, loading docks, rail line and other impervious areas that are directly and indirectly associated with the
modification request.
Immediately east of the underground stormwater infiltration system, the applicant is proposing to construct a 771' x
231' warehouse. The warehouse would be constructed in an area that is currently paved and being used as a
storage/laydown area. A "heavy duty" asphalt apron (varying in width from 50'-70') would be constructed around
the warehouse to support the commercial grade loading equipment being used to transport material in/out of the
building. Two concrete loading docks would be constructed along the eastern side of the building, one at each end.
The loading docks would provide vehicular/mechanical access to the warehouse and proposed rail line. As
proposed, the rail line (approximately 1,770 linear feet) would run from north to south and tie into the existing rail
lines that run throughout the Port.
In addition to the proposed development, the applicant is requesting approval to demolish/remove two buildings
and several concrete laydown areas from the property. According to the applicant, both of the buildings were
damaged due to previous hurricanes. Because the buildings are in disrepair, the applicant proposes to demolish
them and convert the area into open storage to offset the loss of space with the construction of the proposed
warehouse.

10. ANTICIPATED IMPACTS
The proposed warehouse, loading docks, rail line, stormwater collection system, asphalt aprons and building
demolition would disturb approximately 866,844 square feet of highground. According to the application package
and site drawings, no new work is being proposed within the 30' Coastal Shoreline Buffer. The applicant is
currently in the process of obtaining approval from the Division of Water Quality for the collection and treatment
of stormwater runoff resulting from the proposed development.

Re: Detailed Soils Evaluation at NC Ports Authority, Morehead City, NC.
Dear Mr. Parker:
Soil & Environmental Consultants, PA (S&EC) performed a preliminary soils evaluation
at the NC Ports Authority, located in Morehead City, Carteret County, NC. At the five
requested locations the following was performed by S&EC: 1) a profile description to
seven feet (or as deep as possible with hand augers), 2) water table measurement, and
estimation of permeability, 3) hydraulic conductivity, and seasonal high water table. The
purpose of this evaluation Is to provide additional information for designing storrrlwater
infiltration basins. The following is a brief report of the methods utilized in this
evaluation and the results obtained.
Soil/Site Evaluation
A site evaluation was performed by Walter Cole, LSS and Sarah Menser SSIT and Don
Wells LSS to acquire the information noted above. The evaluation was performed by
making hand auger borings to a depth of 7 feet at five locations which were located with
a GPS receiver and are shown on the attached map and identifying and recording the soil
morphological conditions at those five locations in order to develop soil profile
descriptions. There are soil profile descriptions included with this report and shown on
the attached map.
The soils varied over the site, however most borings revealed loamy sand surface
horizons consisting fill material and coarse to fine sandy textured subsurface horizons.
The lower portion of the profile consisted of fine to coarse sand (marine deposits) with
various amounts of shell fragments that was saturated in most cases. The auger borings at
locations 1, 2, 3 and 5 contained a thin clayey subsurface layer or "lenses" in their
profiles (silty clay loam and silty clay). S&EC determined the seasonal high water table
based on redoxomorphic features. S&EC also measured the observed water table and the
"blue line" depth, which is the saturated, gleyed marine deposited material with shell
fragments. Please note that storm water infiltration systems must be a minimum of two
feet above the seasonal high water table.
Soil boring 4 had sandy textured subsurface horizons and should have an estimated
hydraulic conductivity of greater than 0.52 inches per hour. Soil boring 1 had loamy sand
and clay fill material and an actual silt loam subsurface layer that has an estimated

hydraulic conductivity of 0 .14 to 1.4 inches per hour. Soil boring 3 had loamy sand fill
material over a 2 inch clay lens that has an estimated hydraulic conductivity of 0.01-0.14
inches per hour. Measurements would be needed to definitively show that this layer is
above the 0.52 inches per hour threshold.
The permeability estimates are based on the soil texture and are obtained from the
USDA-NRCS (United States Department of.Agriculture - Natural Resource Conservation
Service) official series description. No actual site specific testing of hydraulic
conductivity was performed. Since the rules require hydraulic conductivity of 0.52"/hr,
the permeability estimates were converted to conductivity on the profile description
tables. This report does not address setbacks or buffers from surface waters.
