SW DOC TYPE ❑ CURRENT PERMIT ❑ APPROVED PLANS ❑ HISTORICAL FILE COMPLIANCE EVALUATION INSPECTION DOC DATE �L9Dp69'�� YYYYMMDD Crystal Bluffs Rehabilitation Center Overview of Proposed Stormwater Management Plan Background: The project is located on Bridges Street Extension in Morehead City. A rehabilitation center is proposed on this 5 acre parcel. The proposed development is high -density. The stormwater management plan will employ six infiltration basins to achieve conformity with the State's stormwater regulations requiring that the runofffrom the 1" 1.5 inches of rainfall be captured and infiltrated into the ground. The surface soils are highly permeable with observed infiltration rates of almost 9 "per hour. However, portions of the site have a relatively high perched water table resulting in a shallow depth to the seasonal high water table. This factor along with the State's requirement that the bottom of infiltration devices be located a minimum of 2 feet above the seasonal high water table, limits the potential to excavate the infiltration basins. As a result. considerable fill must be brought to the site to achieve final proposed grades. Stormwater Management Stormwater runoff from the 1.5" rainfall event from all proposed impervious areas on the site will be collected via curb & gutter and channeled to flumes in the curb that will direct the runoff through grassed swales to the proposed infiltration basins. Each of the infiltration basins is sized to contain the full volume of the runoff from the 1.5" rainfall event. Each basin is equipped with a bypass system to handle flows that would result in storage volumes in excess of the infiltration basin design volume. The bypass system consists of an inlet box with weir elevation set to correspond to the water surface elevation associated with the design storage volume of the basin. Stormwater pipe designed to accommodate the 10-year storm event would route water from the bypass inlet box to the discharge point near the northwest corner of the site. The bypass pipe will discharge into a riprap energy dissipater that will in turn discharge into a sodded swale. Due to the highly permeable soils on the site, the time required to infiltrate the design storage volume is far less that the maximum allowable period of 5 days for each of the proposed infiltration basins. To ensure that the proposed building would not be inundated with water in extreme rainfall events (such as those that could occur with hurricanes) that would exceed the storage capacity of the infiltration basins and the flow capacity of the bypass system, the grading plan for the site has been designed such that stormwater would flow over the curbs, across the parking areas, and away from the proposed building. This was completed at your request to'deterniine conductivity'rates for on -site storm water retention, treatment and/or disposal': Based on our discussion, this impoundment area will be approximately 30 to,36 inches below current land surface. The Iocation of the proposed bio-retention-impoundment area is in a wooded'area along the northern property line. Based on hand auger soil borings made to a depth of four feet below'land,surface, a seasonal high water table was noted' at 24 inches' below land surface. This seasonal high water table is noted by a spodic horizon.located in.the soil profile. A spodic horizon is•a zone of organic cementation and/or accumulation and it is considered a "water restrictive" layer. The�soil series that is located at'this site is similar to the Leon Soil Series. The Leon soil is a poorly drained'soil formed from coastal plain sediments.. Refer to the soil profile'descriptions for additional information. The soil boring locations are shown on the attached' sketch map. On the northwestern to north -central part�of the property, S&EC did observe a "perched" water table at a depth of 24 inches below li.nd.surface and tile soil had moist to wet soil conditions above this depth during the.evaluation. On the northeastern side of the property, S&EC did not encounter groundwater within 48 inches of,the land surface. If more detailed water table information'is needed, we recommend installing monitoring wells in order to measure.rhe-actual water table; however it is the opinion of S&EC that this depth will be at (or slightly greater than)!24 inches below land surface in most areas of the property, especially during the winter months. Saturated hydraulic conductivity (Ksat): of the unsaturated zone was measured in situ using Compact Constant Head Peirmeameters.(CCHP). The method used in these measurements is the constant -head well-permeai e.ter technique (also known as shallow well pump -in technique and borehole permeaineter technique) described ih ,"Amoozegar, A. and, A. The Ksat was measured•at one Iocation at a depth of 38 inches below land surface. The desired depth (head) of water in the hole was set at 6. inches. Because of high conductivity of the soil, two CCHPs were used to provide water -to each auger hole. Even with two CCHPs providing water to the hole it was not possible to provide the desired 6- inch depth of water in the hole and the measured amount of water flowing from each of the CCRPs was greater than the maximum amount that could flow from the units appropriately. Therefore, we calculated a Ksat value using 180 cm'/minute from each CCHP (360 cm3/niinute for two units) and 6 inches of head. The resulting Ksat [approximately 17.9 ft/day equivalent to 135 gal/(ftZd)] is conservatively less'than the actual saturated hydraulic conductivity of the soil at this site. Site # Soil Horizon Hole Depth Ksat value On/hr) . Ksat- t BH, Sand 38" 8.95 Due to the very moist soil conditions, the lower portion of the soil could not be tested with the Ksat permeameter. A water "slug" test measurement would be needed to definitively show the measured conductivity rates in these lower soil layers. Depending on which location is used and the depth of the basin, the spodic soil layer may have to be removed to meet the 0.52"/hr hydraulic conductivity threshold. Noah K. Duncan, an individual resident of Wake County, North Carolina ("Member') is the sole member of the Company. Solely for federal and state tax purposes and pursuant to Treasury Regulations Section 301.7701, the Member and the Company intend the Company to be disregarded as an entity that is separate from the Member_ For all other purposes (including, without limitation, limited liability protection for the Member from Company liabilities), however, the Member and the Company intend the Company to be regarded as a separate legal entity that is separate and apart from the Member. ARTICLE I FORMATION OF THE COMPANY 1.1. Formadfon. The Company was formed on November 28, 2005, upon the filing with the Secretary of State of the Articles of Organization of the Company. The principal place of business of the Company within the State of North Carolina shall be at such place or places as the Manager may from time to time deem necessary or advisable. 1.5. Purposes and Powers. (a) The purpose of the Company shall be to engage in any lawful business for which limited liability companies may be organized under the Act. (b) The Company shall have any and all powers which are necessary or desirable to carry out the purposes and business of the Company, to the extunt the same may be legally exercised by limited liability companies under the Act. 1.6. ARTTCLE H DEFE%i TIONS The following term used in this Agreement shall have the following meanings (unless otherwise expressly provided herein): "Act" means the North Carolina Limited Liability Company Act,' as the same may be amended from time to time_ "Agreement" means this Operating Agreement, as amended from time to time. "Articles of Organization" means the Articles of Organization of the Company filed with the Secretary of State, as amended or restated from time to time. "Code " means the Internal Revenue Code of 1986, as amended from time to time (and any corresponding provisions of succeeding law). "Manager" means the Person or Persons designated as manager pursuant to Section 3 A. "Member ",means Noah K. Duncan. "Membership Certificate" means a written certificate which evidences and certifies the Member's Membership Interest in the Company. Each Membership Certificate shall be in such form as the Manager prescribes, and when issued, executed by the Manager and sealed with the Company Seal or a facsimile thereof. The Membership Certificates shall be numbered and registered in the order in which they are issued, and upon issuance the name in which each Membership Certificate is issued, together with the Membership Interest and the issuance date, shah be entered in the Company's records book. "Person" means an individual, a txust, an estate, a domestic corporation, a foreign corporation, a professional corporation, a partnership, a limited partnership, a limited liability company, a foreign limited liability company, an unincorporated association, or another entity. Indemnification of Manager for Management Semiles. The Company shall indemnify Noah K. Duncan in connection with his service as Manager to the Company to the fullest extent permitted or required by the Act, as amended from time to time, and the Company may advance expenses incurred by such person upon the approval of the Manager upon the receipt by the Company of a signed statement agreeing to reimburse the Company for such advance in the event it is ultimately determined that the Manager is not entitled to be indemnified by the Company against such expenses. ARTICLE W RIGHTS AND OBLIGATIONS OF MEMBER 4.1. Name and Address of Memben The name, address, and Membership Interest of the Member is reflected in Schedule I attached hereto. 4.2. Limited Liaba ty. The Member shall not be required to make any contribution to the capital of the Company except as set forth in Schedule 1,, nor shall the Member, in his capacity as such, be bound by or personally liable for any expense, liability, or obligation of the Company, except to the extent of his interest in the Company and the obligation to return distributions made to him under certain circumstances, as required by the Act. The Member shall be under no obligation to restore a deficit Capital Account upon the dissolution of the Company or the liquidation of Membership Interest. ARTICLE V CAPITAL CONTRIBUTIONS AND LOANS The Member has contributed property to the Company as the initial Capital Contribution as set forth opposite his name on Schedule I attached hereto. The Company will be dissolved upon the happening of any of the following events: (a) All or substantially all of the assets of the Company are sold, exchanged, or otherwise transferred (unless the Manager has elected to continue the business of the Company); (b) The Member signs a document stating its election to dissolve the Company; (e) The entry of a final judgment, order, or decree of a court of competent jurisdiction adjudicating the Company to be bankrupt, and the expiration without appeal of the period, if any, allowed by applicable law in which to appeal; (d) The expiration of the term of the Company (as set forth in Section 1.6); or (e) The entry of a decree of judicial dissolution or the issuance of a certificate for administrative dissolution under the Act.. 8.2. Liquidation. Upon the happening of any of the events specified in Section 8.1 and, if applicable, the failure of the Manager to continue the business of the Company, the Manager or any liquidating trustee designated by the Manager will commence as promptly as practicable to wind up the Company's affairs, unless the Manager or the liquidating trustee (either, the "Liquidator' determines that an immediate liquidation of Company assets would cause undue loss to the Company, in which event the liquidation may be deferred for a time determined by the Liquidator to be appropriate. Assets of the Company may be liquidated or distributed in kind, as the Liquidator determines to be appropriate_ The Member will continue to be entitled to Company cash flow and Company profits during the period of liquidation. Articles of Dissolution. Upon the dissolution and commencement of the winding up of the Company, the Manager shall cause Articles of Dissolution to be executed on behalf of the Company and filed with the Secretary of State, and the Manager shall execute, acknowledge, and file any and all other instruments necessary or appropriate to reflect the dissolution of the Company. ARTICLE rX WSCELLANEOUS 9.1 Records The records of the Company will be maintained at the Company's principal place of business or at any other place the Manager selects, provided the Company keeps at its principal place of business the records required by the Act to be maintained there. 9.2. Survival of Rights. Except as provided herein to the contrary, this Agreement shall be binding upon and inure to the benefit of the parties, their successors and assigns. 9.3. Interpretation and Governing Law. When the context in which words aze used in this Agreement indicates that such is the intent, words in the singular number shall include the plural and vice versa. The masculine gender shall include the feminine and neuter. The Article and Section headings or titles shall not define, limit, extend, or interpret the scope of this Agreement or any particular Article or Section. This Agreement shall be governed and construed in accordance with the laws of the State of North Carolina without giving effect to the conflicts of laws provisions thereof. 9.4. Severability. If any provision, sentence, phrase, or word of this Agreement or the application thereof to any person or circumstance shall be held invalid, the remainder of this Agreement, or the application of such provision, sentence, phrase, or word to persons or circumstances, other than those as to which it is held invalid, shall not be affected thereby. 9.5. Agreement in Counterparts. This Agreement may be executed in several counterparts, each of which shall be deemed an original, and all of which shall constitute one and the same instrument. 9.6. Tax Matters Manager. For purposes of this Agreement, Noah K. Dmcan shall be the Tax Matters Manager. 9.7, Creditors Not Benefited Nothing in this Agreement is intended to benefit any creditor of the Company. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not -transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. Suite 260 Cary, NC 27511 Re: Century Care Site, Morehead City, NC Dear Mr. Daniel: On February 8, 2006, Soil & Environmental Consultants, PA (S&EC) ,performed a soil evaluation and Saturated Hydraulic Conductivity (Ksat) measurements at the site referenced above. This was completed at your request to determine conductivity rates for on -site storm water retention, treatment and/or disposal'. Based on our discussion, this impoundment area will be approximately 30 to 36 inches below current land surface_ The location of the proposed bio-retention impoundment area is in a wooded area along the northern property line. Based on hand auger soil borings made to a depth of four feet below land surface, a seasonal High water table was noted at 24 inches below land surface. This seasonal high water table is noted by a spodic borizon located in the soil profile. A spodic horizon is a zone of organic cementation and/or accumulation and it is considered a "water restrictive" layer. The soil series that is located at this site is similar to the Leon Soil Series. The Leon soil is a poorly drained soil formed from coastal plain sediments_ Refer to the soil profile descriptions for additional information. The soil boring locations are shown on the attached sketch map. On the northwestern to noilh-central part of the property, S&EC did observe a "perched" water table at a depth of 24 inches below land surface and the soil had moist to wet soil conditions above this depth during the evaluation. On the northeastern side of the property, S&EC did not encounter groundwater witbiun 48 inches of the land surface. If more detailed water table information is needed, we recommend installing monitoring wells in order to measure the actual water table; however it is the opinion of S&EC that this depth will be at (or slightly greater than) 24 inches below land surface in most areas of the property, especially during the winter months. Saturated hydraulic conductivity (Ksat) of the unsaturated zone was measured in situ using Compact Constant Head Permeameters (CCHP). The method used in these measurements is the constant -head well permearneter technique (also known as shallow well pump -in technique and borehole permeameter technique) described in "Amoozegar, A. and A. Because of high conductivity of the soil, two CCFTPs were used to provide water to each anger hole. Even with two -CCBPs providing water to the hole it was not possible to provide the desired 6- inch depth of water in the hole and the measured amount of water flowing from each of the CCHPs was greater than the maximum amount that could flow from the units appropriately, Therefore, ,,ve calculated a Ksat value using 180 cm3/mianute from each CCHP (360 cm3/minute for two units) and 6 inches of head. The resulting Ksat [approximately 17.9 ft/day equivalent to 135 gal/(ftzd)] is conservatively less'than the actual saturated hydraulic conductivity of the soil at this site. Site # SO Horizon Sole Depth. Ksat value (in/hr) Ksat-1 BH, Sand 38" 9.95 Due to the very moist soil conditions, the lower portion of the soil could not be tested with the Ksat permeameter. A water "slug" test measurement would be needed to definitively show the measured conductivity rates in these lower soil layers. Depending on which location is used and the depth of the basin, the spodic soil layer may have to be removed to meet the 0.52"ltnr hydraulic conductivity threshold. As noted above, the measured rates were made in -the unsaturated soil zone and are not intended to provide values of the saturated zone, possible mounding or the rate of water movement off site.
