In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO .

FOR THE
construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until September 29, 2016, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1 _ This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 65,775 square feet of
impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. This permit makes no allocation for any
future built -upon area.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

11. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
6. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior.to occupancy of the facility.

7. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the -shoreline.
d. The maximum horsepower for a fountain in this pond is listed in Section
1.6 (1) of this permit.
B. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
9. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified. elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Mall (K.T. Commons) Shallotte, Brunswick County.
The following responses are to Linda Lewis' telephone request to me on
09/27/2006.
L Two copies of revised calculation pages 4a and Sa covering
forebay volumes and orfice size have been sealed and signed and
are enclosed.
2. Two copies of the Storm Water Management Plan are submitted
on "white print paper" rather than blue print copies originally .
submitted.
3. The bottom elevation of the forebay has been revised to elevation
28.0 feet rather than decreasing the volume.
4. The project name was changed to "K.T. Commons" by the owner
sometime in July or later? I did not learn of it until after the July
submittals for this project. The project is the same with a new
name.
Please resume review of this project using the above requested
information furnished.

I called Eric back and added one more item. The forebay volume he had provided was
well outside the acceptable range of 18W-22W of the permanent pool volume, so I
have requested that either the forebay be deepened to 3.51, or the volume of the
forebay be reduced to an acceptable range of 1809 - 2211 cubic feet.

Mr. McGinnis:
I am unable to make any "assurances" as to when a permit will be issued,
however, we are under a time limit. The additional information we requested was
received on July 17, 2006. Our time frame for this permit is anytime prior to
October 17, 2006, but we are running a little over 60 days at the moment, so I
projected that it would be issued the last week of September. That was by no
means a guarantee that the permit will be issued. The information submitted by
the consultant still has to be reviewed for completeness and accuracy, and if ii
is not, additional information will need to be requested again. Please be
reminded that the 90 day time clock begins upon receipt of a complete
application.
I apologize for not being able to return your phone calls in a timely manner. I
get upwards of 25 calls and over 5o emails daily, and it is simply impossible tc
return them all and get my permit review work done. I make the choice to spend
my time reviewing and issuing permits and put returning phone calls on the back
burner because most of the calls I get are for permit status.
The Shallotte Mini Mall is the next project for me to review and, if Mr. Matzke
has adequately addressed each of the 18 deficiencies, you will have your permit
by the,end of the week. However, it has been my experience that with so many
deficiencies, other questions are bound to come up.
Kamran Goudarzi is listed as the applicant, so you would not be able to pick up
the permit- only Mr. Goudarzi can do that. We can certainly call you to let you
know that the permit has been issued.

and you would be available by appointment only. She also informed me that if
I were to call your office number to make an appointment, I would go directl
to your voice mail and that you did not check your voice.mail every day. I
did manage to get your email address from her.
My last contact with your office assured me that we should receive our permit
by the third week in September. I made the trip to your office today to get
this permit. I tried to give this info to one of your people today and the
answer from her was "Oh well". She then told me that our permit was next in
line and on your desk. She said that we should have what we needed by the en(
of this month (I think that would be this week). Since the month ends on
Saturday, will I be able to get the permit this'Friday?
For your information our Project Engineer called your office several times
last week, left messages, and his calls were never returned. The same
treatment was received by him two months ago as he was trying to obtain
information regarding our client's permit. At this time I made a visit to
your office and delivered the maintenance agreement for this property.
I feel like we have been very patient with your office. I think the answers
that I received today were very much amiss. we were told in July that your
office was short on manpower and could not keep up with your work load. I cai
understand your inability to keep up with your work load, but T think the
answers that I received today (especially from government employees) were
very slighting. I left a message on your voice mail today and would very mucl
appreciate an answer from you as to when I can go to your office and get.thi,
permit.

Dr. Gourdazi would need to sign a statement essentially stating that he gives you
authority to pick up the permit (SW8 060442) on his behalf. Please include the
project number and name in the statement. When you come by, we'll also have you
sign a separate statement indicating that you picked up the permit and the approved
plans on his behalf.
I left a phone message for Eric Matzke just a few minutes ago requesting a few more
items:
1. Seal the revised calculation pages.
2. Let me know if the project name needs to be changed to K.T. Commons.
3. Send me 2 sets of better quality plans. The ones I got are blueprints and the
details are so faded out, they are unreadable. I asked that the drawings be printed
on white paper to provide some contrast.

For Storm Water Project No. SW8 060442 Commercial Mini
Mall Shallotte, Brunswick County.
The following responses are to DWQ letter 07/10/06 and correspond to
the items as numbered in that letter.
1. The receiving stream name and classification have been provided
in section 111.6. Additionally a map indicating drainage route to
receiving stream is submitted herein.
2. An authorized agent has been designated in section VII.
3. The owner has initialed blanks on page 2 of supplement.
4. A vegetation schedule for 3:1 side slopes and the 6:1 shelves has
been added to the storm water management plan drawing.
5. The 6:1 shelve widths have been designated as 10 feet on the
storm water management plan drawing.
6. Appropriate blanks on page 3 of the supplement have been
annotated to show feet rather than elevations. The clean out
elevation of 28.5 has been shown on supplement so a 3 foot pond
depth will always be maintained.
7. The owner's name has been printed above his signature in section
VI-1I of the application.
8. The phone number of the owner has been provided in section 1.3.
9. The appropriate blanks addressing 3:1 L W ratio by use of a
baffle have been initialed by owner.
10.The drainage area boundary for 2.04 acres has been added to the
storm water management plan drawing. Off site drainage to
storm water retention pond was accounted for in the original
submittal. Notes have been added to plan drawing to clarify off
site to pond and on site not draining to pond.

11.The l" minimum calculated volume of 5532 cf to size the orfice
has been used and a replacement page of that calculation is
submitted.
12.The fore bay actual volume of 3393 of has been reported on the
supplement. All values now shown on the supplement are
provided volumes; not minimums.
13. The street address has been shown in section 1.5
14. The top elevation of the baffle was raised to 32.5 ,top of
temporary pool.
15. A 1" = 20' site plan of the project giving dimensions for
buildings, parking lot and sidewalks is submitted.
16. All sidewalks are located, labeled and dimensioned on 1"=20' site
map referenced in No. 1.5 above.
17.The invert of the 4" PVC orfice pipe has been changed to
elevation 31.5, top of permanent pool.
18. All slopes in the fore bay have been changed to 3:1. Volume
calculations of the fore bay utilizing 3:1 side slopes have been
redone and are submitted as a replacement page for that
calculation.
Please resume review of this project using the above updated
information furnished as requested.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Commercial Mini Mall Shallotte on April 28, 2006. A preliminary review of that information has
determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. Please provide the receiving stream name and classification in Section 111.6 of the
application. Where does the road ditch end up? Please follow the drainage until it
enters a named water body, and report that water body on the application. You
can look up the water body and its classification on DWQ's home page at:
http://h2o.enr.state.nc.us/bims/reports/reportsWB,html
2. Please complete Section VII, the agent authorization. This is the place to
designate who will be providing the necessary information regarding the
stormwater application, on your behalf. This is normally the design engineer.
3. Please hand initial the blanks on page 2 of the supplement form.
4. Please specify the type of vegetation to be planted on the side slopes of the pond
and specify the type of wetland species to be planted on the 6:1 shelf. Please
note that Weeping Love Grass is not recommended for use in North Carolina as
either a temporary or permanent ground cover.
5. Please specify the width of the 6:1 shelf on the plan or section view of the pond.
6. The blanks on page 3 of the supplement above the pond section diagram are for
the sediment removal depths, not elevations. Please report these numbers as
depths. Additionally, the pond may never be less than 3' deep, so the sediment
removal elevation would 28.5, which corresponds to a sediment removal depth of
3.0 feet.
7. Please print your name in the blank above your signature in Section VI11 of the
application, to verify that it is your signature.
8. Please provide a phone number in Section 1.3 of the application, where you can
be reached during normal business hours. One

10. Please delineate the 2.04 acre drainage area to this pond. The
calculations indicate the possibility that the 2.04 acre DA contains some
offsite drainage area. If so, please identify the offsite drainage area and
it's acreage. Additionally, any offsite drainage that is not rerouted around
the pond must be accounted for in the pond design at the full build -out
potential.
11. Please use the minimum calculated 1" volume of 5,332 cubic feet to size
the orifice.
12. Please report the forebay volume actually provided in the pond (3600 ftz?)
on the supplement. The supplement appears to report only the minimum
required forebay volume of 2,115 ft. The supplement should reflect all the
provided elevations, areas and volumes for this pond, not the minimums.
13. Please provide the street address of the project in Section 1.5 of the
application.
14. Please revise the top elevation of the baffle wall to at least the temporary
pool elevation of 32.5, in order to act as a true means of providing a 3:1
L:W ratio in this pond.
15. Please provide dimensions for all of the proposed built -upon area
including the building, parking lot and sidewalks.
16. There are no sidewalks noted on the plans, however, most commercial
developments provide a sidewalk between the parking lot and the building
in order for customers to access the building. Please locate, label and
dimension the sidewalk.
17. The invert of the 4" PVC orifice pipe on the inside of the outlet structure
should be set at the permanent pool elevation. The current configuration
will cause the permanent pool to be somewhat higher than 31.5.
18. All slopes to be vegetated must be 3:1 or flatter. Unless the forebay slopes
above the permanent pool are to be riprapped or stabilized by means
other than vegetation, please grade them back to 3:1 or flatter.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to August 10,
2006, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this
letter. The request must indicate the date by which you expect to submit the required
information. The Division is allowed 90 days from the receipt of a completed application
to issue the permit.

III. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2FI .1008.

1.11. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Clieck and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, rc-seed as necessary to maintain good vegetative cover, ITlow vegetative
cover to maintain a maximum height of'six inches, and remove trash as needed.
1 Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from [tic wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water duality (i.e.
stockpiling near a wet detention basin or stream, etc.). '
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
