Hudson and Onslow County Board of Education Meadowview Elementary School Onslow County FOR THE construction, operation and maintenance of an overall 30% low density project with a curb outlet system and development of high density pockets with treatment by four hydrodynamic separators, each followed by a 100' long minimum grassed swale, in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules' and the approved stormwater management plans and specifications, an other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. Please note in particular the operation and maintenance requirements of Section 11.4 of this permit. The Permit shall be effective from the date of issuance until June 27, 2016 and shall be subject to the following specific conditions and limitations: 1. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This permit covers the construction of 378,181 square feet of built -upon area as follows: (a) OS buildings- 104,308 sq ft; (b) OS parking and driveways- 223,665 sq ft; and (c) OS sidewalks and courtyards- 50,208 sq ft. The hydrodynamic separator stormwater systems for the four pockets of high density have been approved for the management of stormwater runoff as described in Section 1.12 on page 3 of this permit. The stormwater control for the four pockets of high density has been designed to handle the runoff from a total of 125,300 square feet of impervious area. 3. The overall tract built -upon area percentage for the project must be maintained at 30%, per the requirements of Section .1005 of the stormwater rules. 4. Approved plans and specifications for projects covered_ by this permit are incorporated by reference and are enforceable parts of the permit. Page 2 of 8 State Stormwater Management Systems Permit No. SW8 060347 5. This project proposes a curb outlet system. Each designated curb outlet swale or 100' vegetated area shown on the approved plan must be maintained at a minimum of 100' long, maintain 5:1 (H:V) side slopes or flatter, have a longitudinal slope no steeper than 5 /o, carry the flow from a 10 year storm in a non -erosive manner, maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 6. Runoff conveyances other than the curb outlet system swales and piping for high density pockets of the tract, such as erimeter ditches, must be vegetated with side slopes no steeper than 3:1 (H:V� 7. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. No piping shall be allowed in the low density portions of the tract except those minimum amounts necessary to direct runoff beneath an impervious surface such as a road or under driveways to provide access. 9. Roof drains must terminate at least 30' from the Mean high Water line. 10. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 11. The runoff from all built -upon area within the permitted, high density pocket drainage areas of this project must be directed into the permitted stormwater control system. 12. Curb outlet swales, vegetated areas and other vegetated conveyances, and the stormwater management system shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built - upon surface, per the approved plans. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 4. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Semiannual scheduled Inspections {every six months} and as discussed in following paragraphs. b. Sediment removal and as discussed in following paragraphs. C. Mowing, and revegetating of the side slopes. d. immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, piping, and the flow spreader mechanism. A signed Operation and Maintenance Agreement (attached) for both the curb outlet systems and VortSentry® units are incorporated by reference and are enforceable parts of this permit. The VortSentry® units shall be cleaned when the sediment depth has accumulated to a depth of 3 feet in the treatment sump and as described in Table 1 of the signed O&M Agreement (attached). The inspection and maintenance log (page 2 of O&M Agreement) must be completed for each VortSentry® unit after each rainfall event and maintenance event. The site and VortSent" units will be subject to inspection by the Division of Water Quality. If Section 11.4 items a. through f. of this permit are determined by a Division inspector to be deficient or inadequate, the Division may impose monitoring requirements for the VortSent" units, which at a minimum will include influent and effluent monitoring and reporting of Total Suspended Solids (TSS) for a minimum of 10 rainfall events over a 12 month period with at least one sampling event in each of the four quarters, as defined under the Division's Preliminary Evaluation Period (PEP) for proprietary stormwater treatment technology. 5. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, piping, or altering any vegetative conveyance shown on the approved plan. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 060347 6. The Director may determine that other revisions to the project should require a modification to the permit. 7. Records of maintenance activities must be kept and made available to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 8. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the .approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 10. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 11. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 12. Filling in or piping of any vegetated conveyances (ditches, swales, etc.) associated with the permitted project, except for average driveway crossings, is strictly prohibited by any persons. 13. If the stormwater system was used as an Erosion Control device, it must be restored to design conditions prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 16. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of 10 years from the date of completion of construction. 17. The final plats for the project will be recorded showing all required swale easements and common areas, in accordance with the approved plans. III. GENERAL CONDITIONS, Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Qualityy, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. Page 5 of 8 State Stormwater Management Systems Permit No. SW8 060347 2. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 3. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 4. The permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit transfer request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. The permittee is responsible for compliance with all the terms and conditions of this permit until the Division approves the permit transfer. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances imposed by other government agencies (local, state and federal) which have jurisdiction. If any of those permits or approvals result in revisions to the plans, a permit modification must be submitted. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of this permit. 9. The permittee grants permission to DENR Staff to enter the property during business hours for the purposes of inspecting the stormwater control system and it's components. 10. The permittee shall notify the Division of Water Quality of any name, ownership or mailing address changes within 30 days. Permit issued this the 27th day of June 2006. The runoff from this site flows to an unnamed tributary to Blue Creek, which is classified SC NSW. The project is proposed to be built under the Low Density Option of the State's Stormwater Rules. The project built -upon area is 26.8% with an allowable 30% for this drainage basin. Stormwater runoff from the paved drives and parking areas will flow through Curb Outlets and 5:1 grassed swales with a minimum length of 100 feet prior to intersecting other drainage swales and tieing to existing swales. The roof drainage from the building will be piped to flow thru 5:1 grassed swales prior to tieing to other swales. It was agreed that a pocket of high density exists involving the parking areas in the center of the property. Generally, we consider a high density pocket when built -upon area is approximately 10 percentage points above the definition of low density or approx 40% BUA for a HD pocket in this case. You can spread the parking areas to avoid creating a HD pocket, but our preferred approach is an engineered BMP since school expansions quickly make school sites high density anyway. Treatment options for the HD pocket that we discussed with Linda on 3/24 and with you today include: (a) hydro -dynamic device (we will waive the PEP monitoring requirements but an O&M agreement will be required); (b) sand filter; (c) infiltration, and•(d) bioretention.
