In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of 2 underground infiltration trenches in
compliance with the provisions of 15A NCAC 2H .1000 {hereafter referred to as the
"stormwater rules'} and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until March 14, 2016, and shall
be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
controls have been designed to handle the runoff from 30,240 ft and 4,330 ft2
respectively, of impervious area. The infiltration trenches must be operated with
a 50' vegetated filter. Runoff from the 663 ft concrete pool deck area will sheet
flow across a minimum 30' wide grassed area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. No allotment of built -upon area has been
made for future development under this permit.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of bypass structure, filter media, flow
spreader, catch basins, piping and vegetated filter.
g. A clear access path to the bypass structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major"permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

The Division received the previously requested information regarding this Express
stormwater application on February 24, 2006. The application is incomplete. Please
provide the following information by March 14, 2006, to continue the review:
1. Two sets of the revised plans are required whenever you need to resubmit. upon
approval, one set is returned to the applicant with the permit, and one set stays
in the file.
2. The 663 square feet for the pool deck needed only to be removed from Da ff3
column, not from the Total Drainage Area column. Please revise the 772 sq. ft.
currently reported in the "Other onsite" box to 1,435 sq. ft., revise the total to
35,233 sq, ft., and remove all references to Drainage Basin 43.
Everything else looks to be in good order, so upon receipt of the extra set of
plans and the revised page 2 of the application, this permit can be issued.

Thank you for your comment letter dated February 1.5, 2006 regarding the above -mentioned
project. Your comments (in italic) are provided below followed by our response:
1. Please provide documentation of your status as president of this corporation. Current
information available from the Secretary of State website indicates only that you are the
incorporator and the corporation's initial registered agent.
Please find in this submittal documentation illustrating that Mr. Mark Evans is in -
fact the President of La Costa Development Corporation.
2. Please remove Vincent Lewis' name from the soils report in regard to the determination of the
seasonal high water table. Vincent is there only to advise Division staff as to the feasibility of the
infiltration system, and to verify the soils information provided by your consultant. He is not
your consultant therefore he should not be referenced in the soils report. If your consultant agrees
with the reported Seasonal High Water Table, then only your consultant need be referenced in the
soils report.
+ Please find that Mr. Vincent Lewis' name has been removed from the Stormwa ter
Narrative.
3. Please provide a more detailed bypass detail. Both the plan and profile views should show the
catch basin in Trench 92. That catch basin needs to be numbered on the plans. The profile view
needs to show the actual invert (7.0 in each case) and size the pipe leaving each catch basin and
the invert where that pipe enters the 6" DIP bypass. I would suggest that the actual 6" ductile
iron pipe that the catch basins bypass into be placed at a slope rather than flat.
Please find that a detailed bypass detail has been provided on Plan Sheet CG-502.
The plan and profile views of the infiltration systems now show both trench #1 and
trench #2 as well as all bypass pipe lengths, inverts, and slopes. We have cpasid

your suggestion to slope the bypass pipe from the catch basins but prefer not to do
so due to the construction issues that would result from conflicts between the bypass
and the infiltration pipes.
4. Is the 663 ft2 of BUA reported in Drainage Area 3 for the concrete surrounding the pool? If yes,
please remove that column from the application, since you are not proposing a system to treat
that runoff. Please indicate the grading for that concrete area on the plans.
• Please find that the 663 ft2 of concrete around the pool in drainage area 3 has been
removed from the application and that a note regarding the grading for the area
surrounding the pool has been placed on Plan Sheet CG-101.
5. The impervious area tised in the calculations for Trench #2 is incorrect. It was apparently
rounded down to 0.09 acres, when in reality 4,330 f2 is 0.099 acres, or 0.1 acres rounded. The
resulting increase in percent impervious and Rv factor increases the required minimum volume.
The minimum volume is more than what has been provided in the system.
Please find in this submittal the corrected impervious area for Trench #2. The revised
information is represented in all calculations, the Infiltration Supplement Form
(SWU 107), and on Plan Sheet CG-101 is the revised required minimum volume of
531 cf based on 0.10 acres of impervious area instead of 0.09 acres. As a result Trench
#2 has been revised to provide 684 cf of storage.
6. PIease provide a vegetated filter detail on the plans to include a flow spreader (specify type of
material), width, longitudinal slope, spot elevations, etc.

Dear Mr. Evans:
The Wilmington Regional Office received an Express Stormwater Management Permit
Application for La Costa Bay on February 8, 2006, with a scheduled review date of February
14, 2006. A preliminary review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
1. Please provide documentation of your status as president of this corporation.
Current information available from the Secretary of State website indicates only
that you are the incorporator and the corporation's initial registered agent.
2. Please remove Vincent Lewis' name from the soils report in regard to the

Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to March 1,
2006, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this
letter. The request must indicate the date by which you expect to submit the required
information.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A. .
Please reference the State assigned project number on all correspondence. Any .
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not
acceptable. If you have any questions concerning this matter please feel free to call me

(100,000) all of one class, designated as common stock.

8. The purpose of the corporation is:
a) To buy, sell, develop, improve, exchange, and generally deal in real
properties improved and unimproved, office buildings, storage buildings, dwelling
houses, barns, wharves, water rights, and privileges; to build, construct, operate,
maintain, lease, and maintain a general real estate agency and broker's business,
including the right to manage estates, to act as agent, broker, or attorney in fact for
any person or corporation; to make and obtain loans upon real estate, improved or
unimproved, and to supervise, manage, and protect such property and loans, and all
interest and claims affecting the same; to have the same insured against fire and other
casualties; to investigate the credit, financial solvency and sufficiency of borrowers,
mortgagors, and sureties upon bonds, mortgages, and undertakings; and to improve,
manage, operate, sell, mortgage, lease or otherwise dispose of any property, real or
personal, and taken mortgages and assignments of mortgages upon the same.

b) To engage in any lawful act, or activity for which corporations may be organized
under the laws of the State of North Carolina.
9. A shareholder (his personal representative, legatee, or donee) shall not sell, transfer,
pledge, encumber, or in any manner dispose of any share of the corporation without compliance with
the following procedure, except transfers without consideration to permitted transferees. Permitted
transferees shall include only the personal representative, spouse, descendants, or ancestors of the
share holders, or any trust for the primary benefit of such spouse, descendants, or ancestors. A
shareholder desiring to sell, transfer, pledge, encumber, or in any manner dispose of any shares (other
than in transfers without consideration to permitted transferees) shall obtain a bona fide written cash
offer from a third person to purchase the shares, and before accepting this offer, shall (1) deliver to
the corporation a copy of the offer disclosing the identity of the purchaser and the price offered and
(2) offer in writing to sell the shares referred to in the offer to the corporation or its nominee selected
without regard to any preemptive right. The corporation shall have thirty (30) days after receipt of
the offer to accept it. If the corporation accepts the offer, the shares referred to in it shall forthwith
be delivered to the corporation against the payment of the purchase price. If the corporation does
not accept the offer in the thirty (30) day period, the shareholder may accept the offer of the third
person, and the shares subject to the offer shall thereafter be free from the restrictions and provisions
of this section. If shares are transferred to a permitted transferee, they shall remain subject to the
restrictions and provisions of this section.
10. The corporation shall indemnify all directors, officers, employees and agents against
liability and expenses in any proceeding (including without limitation, a proceeding brought by or
on behalf of the corporation itself) arising out of their status as such or their activities in any of the
foregoing capacities. The corporation shall also, and to the same extent, indemnify any person, who
at the request of the corporation is or was serving as a director, officer, partner, trustee, employee
or agent of another foreign or domestic corporation, partnership, joint venture, trust or other
enterprise or as a trustee or administration under an employee benefit plan. Such persons shall be
entitled to recovery from the corporation of reasonable costs, expenses, and attorneys fees in
connection with the enforcement of rights to indemnification granted herein, pursuant to N.C.G.S.
55-8-57.
11. These articles will be effective upon filing.
