In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of sand filter in compliance with the provisions
of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data
as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until October 25, 2016, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.7 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 62,920 square feet of
impervious area.
3. The tract will be limited to.the amount of built -upon area indicated on page 3 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.
6. This is an after -the -fact permit. The stormwater facilities covered by this permit
must be fully constructed and operational prior to January 25, 2007.

1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
.built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of sand filter structure, orifices, catch
basins and piping.
g. When the infiltration capacity of the sand filter has been reduced such
that the 1" runoff bypasses the system without infiltrating, the sand must
be removed and replaced.
h. Access to the sand filter structure must be available for inspection and
routine maintenance.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
.supporting data.

6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. ' The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to"the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The- permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.

2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Dear Mr. Kelley:
The Wilmington Regional Office received previously requested information regarding
the pending Stormwater Management Permit Application for Walgreens - Swansboro on
August 7, 2006. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the
stormwater review:
1. Sheet C-3.0, the Grading and Erosion Control Plan shows storm drain lines
entering on both sides of the filter. Please note that the storm drain lines need
to enter on the sediment chamber side, not the sand chamber side. Please
revise the Grading plan to show the proposed storm drain lines entering on
the sediment chamber side of the sand filter. Please also add the points
where the storm drain lines will enter the sand filter to the sand filter detail.
Response: Sheet C3 shows two storm lines entering on one side and one storm
line exiting on the other side. Refer to the attached sheet C9 for details. At the
clearwell, the system is designed to allow an exit from any side. The detail has
been modified to show where the storm drain line will enter and leave the sand
filter.
2. There appear to be 5 orifices leaving the sand filter, of two different sizes.
Please label the orifice outlet diameters on the sand filter section A -A
detail and add the orifices to the plan view detail.
Response: The two small holes are weep holes that are screened to prevent
loss of filter material. The three larger holes are the perforated drain pipe holes.
The sand filter system does not include filter media.
3. It appears that the orifices are running parallel with the chambers under
the sand side instead of perpendicular and coming through the wall at
designated intervals, per the design in the current BMP manual. Is the
orifice pipe perforated? If so, please specify the type and size of
perforated pipe and that it be wrapped in some type of filter cloth to keep
the sand out.
Response: Correct, the perforated drain pipes run parallel inside the chamber
under the sand bed. See response to question #2 above for the drain holes.
The media and pipe will be installed per the current BMP manual. The pipe will
be perforated and wrapped in filter fabric with a stone layer. A note has been
added to the plans to describe this.
4. Please show on the plans and details how the sand filter orifices will
ultimately connect into the existing drainage system to provide positive
drainage.
Response: The sand filter detail shows this best. The sediment side of the
chamber can fill from any point along the entire filter. As the sediment side fills,

water will spill into the sand side through the flow ports. If the sand cannot pass
the water fast enough the wafer will bypass the filter system over the bypass
weirs at the end of the system at the clearwell. Once the water enters the
clearwell, by either the under drain system or the bypass weir, water will exit the
system by a 15" pipe and into the appropriate catch basin.
5. Section B-B of the sand filter shows a "tapered opening in the centerwall
of the clearwell." The elevation of this opening appears to allow runoff,
which may enter the chamber on the other side, to "bypass" the sand filter.
Please raise the elevation of this opening to the weir elevation between
the two chambers to eliminate the possibility of bypassing.
Response: The only way water can enter the clearwell is through the
underdrain system on the sand side or over a bypass weir on both sides. Once
water enters the clearwell, water can equalize on both sides of the system to exit
the system wherever necessary. This allows the outlet pipe to be placed on the
sand side or sediment side for ease of design. No filter media will be placed in
the clearwell. The tapered opening does not empty the sand chamber.
6. The calculated minimum required surface area per chamber is 480 ft2.
This proposal only provides 240 ft2 of area per chamber. Please revise.
Response: The size of the sand filter has been increased to meet the minimum
requirements.
7. As previously requested, please add the nearest intersection of two major
roads to the vicinity map. A major road is any 1, 2 or 3 digit NC, US or
interstate highway. The four digit State Road numbers are not considered
major roads.
Response: The vicinity map has been.updated.
8. The application received on June 29, 2006, indicates a total proposed
BUA of 68,379 ft2, however, the BUA accounted for in the sand filter sizing
calculations is only 58,079 ft2. Please explain this discrepancy.
Response: We have captured the runoff to the maximum practical extent which
is 93% of the site (62,920 SF). Due to site conditions, approximately 7% of the
site cannot be directed to the sand filter.
9. Please delineate the drainage area to the sand filter.
Response: The drainage area has been delineated.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to September
26, 2006, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this
letter. The request must indicate the date by which you expect to submit the required
information.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A. The project is already
in violation for construction without a permit, and enforcement action is currently being
pursued.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not
acceptable. If you have any questions concerning this matter please feel free to call me

revised the site built sand filters to underground sand filters. Above ground sand filters could not capture
all the surface runoff from the site. Also attached with this submittal are updated sand filter calculations.
Below is our response to your latest comments dated August 2, 2006:
1. A note has been added to sheet C-1.0 stating there are `no' wetlands on the site.
2. We have connected all storm drain lines to the underground sand filter.

This letter is being written to explain the reason for not meeting the surface area
requirement. G& O has made every attempt to utilize sand filters to the maximum
practical extent. Due to site characteristics, there is only one practical area where a sand
filter will function properly. All other areas place the outlet of the sand filter below the
invert elevations of the existing drainage structures. While not meeting the minimum
surface area requirement, we have met the required sand volume. Given that the sand
filter cross section is 4' x 3' in each chamber, we believe there is adequate area to
properly settle out suspended solids in the sediment chamber. Please see the attached
details and calculations. Please call Don Gibbs at (919)532-2312 if you have any
questions.

Certain civil penalty assessment factors in N.C.G.S. §143B-282 1(b) reflect
favorably on KA Swansboro Partners, LLC. To the best of the company's
knowledge, there has been no harm to the natural resources of the State, to private
property or to public health. To the best of the company's knowledge, there has been
minimal to no damage to ground or surface water quality or quantity or to air quality.
The cost of enforcement procedures, $235.25, is relatively low. KA Swansboro
Partners, LLC has not been assessed penalties for permit violations before.
Moreover, the violation was not committed intentionally or willingly. The
engineer working on this project, Donald Gibbs of Greenehorne & O'Mara, Inc., was
under the impression that the grading permit for this site covered stormwater issues.
When Mr. Gibbs realized he was mistaken, he immediately submitted a permit
application, and since that time has diligently worked with the DWQ Wilmington

The Wilmington Regional Office received a Stormwater Management Permit Application for
Walgreens - Swansboro on August 1, 2006, with a scheduled Express Review date of August
2, 2006. A preliminary review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
Please either delineate all wetlands on site, disturbed or undisturbed, or note on
the plans that none exist.
2. Based on the calculations, it appears that the proposal is to treat the runoff from
less than 20% of the proposed impervious surfaces. This is not acceptable.
Please collect and treat all of the runoff from all of the built -upon surfaces.
3. Please provide sand filter details to include a plan view with contours and
dimensions and a cross section view with elevations.
4. Based on the geotechnical report, which indicates a high water table, the sand
filter will need to be lined with a geotechnical liner or clay to prevent infiltration
directly into the water table.
5. Please add the nearest intersection of two major roads to the vicinity map. A
major road is any 1, 2 or 3 digit NC, US or interstate highway: Ideally, the vicinity
map should be geared toward driving to the site from Wilmington.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to August 16, 2006, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the permit.

The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A. The project is already
in violation for construction without a permit, and enforcement action is currently being
pursued.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not
acceptable. If you have any questions concerning this matter please feel free to call me

III. SAND FILTER OPERATION AND MAINTENANCE AGREEMENT
Regular maintenance is essential to the long-term performance and durability of the sand filter, as it is with all
stormwater BMP's. The Sand Filter system is defined as the sediment chamber, the sand chamber, and the flow
regulator or outlet device.

At a minimum, the following maintenance activities shall be performed:
I. Depending on the types of activities occurring within the drainage area, most sand filters will show a
decreased capacity for filtration after a few years. At least once a year, each filter must be inspected after a
P design storm event to determine if the filter bed is passing the runoff within 24 hours.
2. If the filter is not passing the runoff completely within 24 hours, the first 2"-3" of discolored sand must be
removed and replaced with new sand. The removed sand must be dewatered and disposed of properly.
3. At the same time that maintenance is performed on the sand chamber, the sediment chamber shall be
pumped and cleaned. Remove accumulated sediment when it reaches a height of 6" in the sediment
chamber. The removed sediment should be dewatered and disposed of properly.
4. At least once every quarter, check that the drawdown orifice is clear of obstruction.
5. Vegetation within an open sand filter must be mowed regularly to limit the height to 12". Vegetation within
a closed sand filter must be removed.
6. Direct access to the sand and sediment chambers must be provided for maintenance and inspection.

Please find attached our plan of action (item # 1) for obtaining the referenced storm water management
permit to correct the allege violation noted in your letter dated June 15, 2006. When we received the
letter request for a state storm water management permit application dated April 25, 2006 we were under
the impression that the erosion control and sedimentation permit was the only permit required as we had
reduced the runoff from the existing site with the proposed Walgreens. Once we received notification,
we immediately took steps to obtain separate storm water management permit.
We have submitted for an express review for the storm water management permit (item # 2) with
NCDWQ on June 16, 2006. We have incorporated comments received from the department regarding
the recommended storm water management for this site and have submitted for express review. We
currently are awaiting a specific date for the express review from your office. Upon approval of the
permit, the construction of the storm water management system will be installed as soon as possible
(item # 3). We will notify your office as soon as work has been completed (item # 4),

This letter transmits notice of a civil penalty assessed against Kelley Austin Properties, LLC in
the amount of $4,235.25 which includes $235.25 in investigative costs. Attached is a copy of the
assessment document explaining this penalty.
This action was taken under the authority vested in me by delegation provided by the Secretary
of the Department of Environment and Natural Resources and the Director of the Division of
Water Quality. Any continuing violation(s) may be the subject of a new enforcement action,
including an additional penalty.

Acting pursuant to delegation provided by the Secretary of the Department of Environment and
Natural Resources and the Director of the Division of Water Quality, I, Edward Beck, of the
Division of Water Quality (DWQ), make the following:
FINDINGS OF FACT:
A. Kelley Austin Properties, LLC is a Corporation organized and existing under the laws
of the State of North Carolina.
B. Kelley Austin Properties, LLC is the owner of record and has developed a
commercial site known as Walgreens — Old Hammock Road Swansboro located on
the corner of NC Highway 24 and Old Hammock Road in Swansboro, Onslow
County, North Carolina.
C. On December 28, 2005, DWQ Wilmington Regional Office received a copy of a
Letter Of Receipt Of Erosion Control Plan, dated December 27, 2005, for Walgreens
— Old Hammock Road Swansboro.
D. On April 25, 2006, DWQ Wilmington Regional Office sent a written request for a
State Stormwater Management Permit Application to Stephen C. Austin, Manager,
Kelley Austin Properties, LLC for Walgreens — Old Hammock Road Swansboro.
E. On May 11, 2006, DWQ Wilmington Regional Office received a State Stormwater
Management Permit Application for Walgreens — Old Hammock Road Swansboro.
F. On May 24, 2006, DWQ Wilmington Regional Office sent a letter returning the State
Stormwater Management Pen -nit Application, that was received on May 11, 2006, for
Walgreens — Old Hammock Road Swansboro, to Mike Kelley, Member/Manager,
Kelley Austin Properties, LLC. The application was returned because it lacked the
necessary basic elements to be accepted for review.
G. On May 31, 2006, DWQ Wilmington Regional Office received the following
materials related to the Walgreens — Old Hammock Road Swansboro project:
1. A letter, dated May 25, 2006, concerning the existing conditions of the site and
the constraints of the site
2. Another Stormwater Management Permit Application

A letter, dated May 26, 2006, confirming that T. Michael Kelley and Stephen C.
Austin are the two owners (members) and two managers of Kelley Austin
Properties, LLC
H. On June 2, 2006, DWQ Wilmington Regional Office sent a letter returning the State
Stormwater Management Permit Application, that was received on May 31, 2006, for
Walgreens -- Old Hammock Road Swansboro, to Mike Kelley, Member/Manager,
Kelley Austin Properties, LLC. The application was returned because it lacked the
necessary basic elements to be accepted for review.
1. On June 12, 2006, DWQ Wilmington Regional Office received another State
Stormwater Management Permit Application for Walgreens — Old Hammock Road
Swansboro.
J. On June 13, 2006, DWQ Wilmington Regional Office inspected the Walgreens — Old
Hammock Road Swansboro site and observed that the foundation and walls of the
building had been constructed. The foundation of the building resulted in an increase
in impervious surface at this site or otherwise decreased the infiltration of
precipitation into the soils.
K. On June 16, 2006, DWQ Wilmington Regional Office issued a Notice of Violation
And Recommendation For Enforcement for Walgreens — Old Hammock Road
Swansboro.
L. On June 16, 2006, DWQ Wilmington Regional Office received a Request for Express
Permit Review for Walgreens — Old Hammock Road Swansboro.
M. On June 22, 2006, DWQ Wilmington Regional Office received a written "Plan of
Action" for Walgreens — Old Hammock Road Swansboro. The written "Plan of
Action" contains the following components:
Plan of Action, Walgreens — Old Hammock Road Swansboro
On June 16, 2006, Greenhorne &O'Mara, on behalf of Kelley Austin Properties,
LLC, submitted a request and application for an express review. This express
review is scheduled for August 2, 2006.
Upon approval of the pennit, Kelley Austin Properties, LLC will start the
construction of the stonnwater management system.
Kelley Austin Properties, LLC will notify DWQ Wilmington Regional Office as
soon as the work has been completed.
N. For development activities located within the 20 coastal counties, a State Stormwater
Management Permit is required by NCGS 143-215.1 and 15A NCAC 2H .1003 for
development activities that require a Coastal Area Management Act Major Permit or
an Erosion & Sedimentation Control Plan.
O. Onslow County is a Coastal County as defined by 15A NCAC 2H .1002(4).
P. The land disturbances associated with Walgreens — Old Hammock Road Swansboro
site required an Erosion &'Sedimentation Control Plan

Q. The Division of Land Resources approved an Erosion & Sedimentation Control Plan
for the site on January 11, 2006.
R. Kelley Austin Properties, LLC failed to obtain a State Stormwater permit prior to
construction of impervious surfaces.
& As of this date, Kelley Austin Properties, LLC has not obtained a State Stormwater
permit for Walgreens — Old Hammock Road Swansboro.
T. The cost to the State of the enforcement procedures in this matter totaled $235.25.
Based on the above Findings of Fact, I make the following:
II. CONCLUSIONS OF LAW:
A. Kelley Austin Properties, LLC is a "person" within the meaning of G.S. 143-215.6A
pursuant to G.S. 143-212(4).
B. Onslow County is a coastal county as defined by 15A NCAC 2H.1002(4).
C. Kelley Austin Properties, LLC is engaging in development activity at this site, which
requires an approved Erosion & Sedimentation Control Plan.
D. Kelley Austin Properties, LLC violated NCGS 143-215.1 and 15A NCAC 2H .1003
by failing to secure a Stormwater Management Permit prior to construction of the
project known as Walgreens — Old Hammock Road Swansboro.
E. Kelley Austin Properties, LLC may be assessed civil penalties in this matter pursuant
to G.S. 143-215.6A(a)(2), which provides that a civil penalty of not more than
twenty-five thousand dollars ($25,000) per violation per day may be assessed against
a person who is required but fails to apply for or to secure a permit required by G.S.
143-215.1, or who violates or fails to act in accordance with terms, conditions, or
requirements of such permit or any other permit or certification issued pursuant to
authority conferred by this Part.
F. Kelley Austin Properties, LLC may be assessed civil penalties pursuant to G.S. 143-
215.6A (a)(6) which provides that a civil penalty of not more than twenty-five
thousand dollars ($25,000.00) dollars per violation may be assessed against a person
who violates a rule of the Commission implementing this part, Part 2A of this Article,
or G.S. 143-355(k).
G. The State's enforcement cost in this matter may be assessed against Kelley Austin
Properties, LLC pursuant to G.S. 143- 215.3(a)(9) and G.S. 143B-282(b)(8).
H. Edward Beck, of the Division of Water Quality, pursuant to delegation provided by
the Secretary of the Department of Environment and Natural Resources and the
Director of the Division of Water Quality, has the authority to assess civil penalties in
this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:

Accordingly Kelley Austin Properties, LLC is assessed a civil penalty of:

site.

16, 2006.

By copy of this letter to the Onslow County Building Inspector, this Office is requesting
that the Building Inspector consider withholding building permits and Certificates of
Occupancy for this project until this matter is satisfactorily resolved.

On December 28, 2005, the Wilmington Regional Office received a copy of an Erosion Control
Plan for the subject project. The North Carolina Administrative Code requires any project that
must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA Major
permit to apply for and receive a Stormwater Management Permit by the Division of Water
Quality. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action
by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed
application form, fee, and supporting documentation, or a written response regarding the
status of this project and the expected submittal date must be received in this Office no later
than May 24, 2006. Failure to respond to this request may result in the initiation of enforcement
action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan
approval letter must NOT be considered the Coastal Stormwater Management Permit, which

Dear Linda:
Please see attached the storm water permit application and review fee check for $ 420 for plan amendment
approval to the existing developed site. Following up on your letter dated May 24, 2006 regarding the plan
amendment request approval for the existing developed site with a new proposed Walgreens store Jn
Swansboro, NC. Our storm water design for the redevelopment project was to determine a suitable
stormwater management measure for the proposed site based upon the existing conditions of the site.
Please note the following investigation and constraints controlling the proposed storm water design of the
redevelopment project.
I. High groundwater levels found in the soils investigation eliminated the ability to use high
density measures such as infiltration basins and infiltration trenches. The groundwater was
found to be at or within 1-2 feet of the existing grade. Please see attached the existing soils
investigation for the proposed project.
2. Grade constraints required us to tie into the adjacent property and adjacent surfaces at the
existing grade due to shared access drives.
3. The existing site drains directly into the state storm water drainage system with no stormwater
management provisions.
4. Set aside 7,415 SF of additional pervious area for improved conditions from before with the
original development. The existing site includes a Napa Auto Paris store and dry cleaners with
associated asphalt paving and curb and gutter, parking lots across the site providing with
impervious area coverage of 75,794 SF. The proposed Walgreens, site decreased the
impervious area with landscape islands throughout the proposed parking areas decreasing the
impervious area of the existing site to 68,379 SF and thus reduces storm water runoff.
5. Underground storm water drainage lines adjacent to the site has adequate capacity to handle
the existing runoff.
6. Could not use pervious pavement due to seasonal high groundwater table which would bubble
thru the pavement holding surface water.
Based upon the constraints controlling final design we eliminated the practicable use of detention ponds,
infiltration basins, and infiltration measures. The best suitable storm water management measure was
reducing the total runoff from the site and tie into the storm water system rather than high density measures

noted in your letter which will not work with the low plasticity clays that we have. Reduction of surface
runoff is a good storm water management this proposed site thus reducing the current flow into the state
storm drainage system. We have applied and received an encroachment agreement to make this tie with the
reduced runoff from our new improved conditions on site. We propose to continue to handle storm water
with reduced runoff thru the off site storm drainage system currently handling the existing site with our
reduced runoff flows.
No high density supplement form was included or operations and maintenance plan as the storm water is
handled within a closed system.

TV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following itallcized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
J. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality, These covenants may not be
changed or deleted without the consent of the $tare.
Z. No more than square feet of any lot shall be covered by srructures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface ofswimmingpools.
3. Swales shall rant be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modh7cation prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system_ These connections to the storm water control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and. protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

Following up our conversation this morning please see attached the letter of receipt for stormwater
Management Permit Application for Stormwater Project Number SW8051243 for the proposed Walgreens
store in Swansboro, NC. Please see attached the vicinity map, existing site plan, proposed site plan , and
grading plan for the proposed project. We have attached the letter of approval for the erosion and
sedimentation control plan, and storm water calculations for your use.
The existing site includes a Napa Auto Parts store and dry cleaners with associated asphalt paving and curb
and gutter, parking lots across the site providing an impervious area coverage of 75,794 Sr. The proposed
Walgreens site decreases the impervious area with landscape islands throughout the proposed parking areas
decreasing the impervious area of the existing site to 68,379 SF. No additional stormwater management
devices are proposed since sheet flow runoff is handled off site thru storm drainage pipes and because the
post -construction impervious area is less the pre -construction impervious area thus negating the need for
stormwater management measures beyond catch basins and drop inlets. Silt fence has been added to
prevent sediment from leaving the site. We propose to continue to handle the reduced runoff thru the off
site storm drainage system.

Management permit for modification or plan amendment request.

On December 28, 2005, the Wilmington Regional Orrice received a copy of an Erosion Control
Plan for the subject project. The north Carolina Administrative Code requires any project that
must receive either Sadirnes station and Erasio-n Control Plan approval andfor a CAMA Major
permit to apply for and receive a Stormwater Managament Permit by the. Division of Water
Quality. Any construction on the subject site; prior to receipt of the required permit, will
constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action
by this Office.
Either a Storr€ water Permit Application Package including 2 Sets of plans, completed
application form, fee, and supporting documentation., or a written response regarding the
status of this project and the expected submittai date must be received in this Office no later
than May 24: 2006_ Failure to respond to this request may result in the initiation of enforcement
action, and constructions may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accornpanies the Erasion Control Plan
approval letter must NOT be considered the Coastal Stormwater Management Permit, which

This office has reviewed the subject erosion and sedimentation control plan and hereby
issues this Letter of Approval with Modifications and Performance Reservations. A list of the
modifications and reservations is attached. This plan approval shall expire three (3) years
following the date of approval, if no land -disturbing activity has been undertaken, as is required
by Title 15A NCAC 4B .0129. Should the plan not perform adequately, a revised plan will be
required (G.S. 113A-54.1)(b).
Please be advised that Title 15A NCAC 4B.0118(a) requires that a copy of the approved
erosion control plan be on file at the job site. Also, you should consider this letter to give the
Notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance
with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance -oriented,
requiring protection of existing natural resources and adjoining properties. If, following the
commencement of this project, it is determined that the erosion and sedimentation control plan is
inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statute 113A-51 thru 66), this office may require revisions to the plan and
implementation of the revisions to insure compliance with the Act.

Acceptance and approval of this plan is conditioned upon your compliance with Federal
and State water quality laws, regulations, and rules. In addition, local city or county ordinances
or rules may also apply to this land -disturbing activity. This approval does not supersede any
other permit or approval.

This plan approval shall expire three (3) years following the date of approval, if no land
disturbing activity has been undertaken, as is required by Title 15A NCAC 413.0029.
2. The developer is responsible for the control of sediment on -site. If the approved erosion and
sedimentation control measures prove insufficient, the developer must take those additional steps
necessary to stop sediment from leaving this site. Each sediment storage device must be
inspected after each storm event. Maintenance and/or clean out is necessary anytime the device
is at 50% capacity.
3. Any and all existing ditches on this project site are assumed to be left undisturbed by the
proposed development unless otherwise noted. The removal of vegetation within any existing
ditch or channel is prohibited unless the ditch or channel is to be regraded with side slopes of 2
horizontal to 1 vertical or less steep. Bank slopes may be mowed, but stripping of vegetation is
considered new earthwork and is subject to the same erosion control requirements as new
ditches.
4. The developer is responsible for obtaining any and all permits and approvals necessary for the
development of this project prior to the commencement of this Iand disturbing activity. This
could include agencies such as the Division of Water Quality's stormwater regulations, their
enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army Corps of
Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal
Management's CAMA requirements, the Division of Solid Waste Management's landfill
regulations, the Environmental Protection Agency and/or The U.S. Army Corps of Engineers
jurisdiction of the Clean Water Act, local County or Municipalities' ordinances, or others that
may be required. This approval cannot supersede any other permit or approval; however, in the
case of a Cease and Desist Order from the Corps of Engineers, that Order would only apply to
wetland areas. All highland would still have to be in compliance with the N.C. Sedimentation
Pollution Control Act.
5. If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the
developer is responsible for compliance with the requirements of the Division of Water Quality,
the Corps of Engineers and the Environmental Protection Agency (EPA) respectively. Any
erosion control measures that fall within jurisdictional wetland areas must be approved by the
aforementioned agencies prior to installation. The Land Quality Section must be notified of a
relocation of the measures in question to the transition point between the wetlands and the
uplands to assure that the migration of sediment will not occur. If that relocation presents a
problem or contradicts any requirements of either DWQ, the Corps, or the EPA, it is the
responsibility of the developer to inform the Land Quality Section regional office so that an

adequate contingency plan can be made to assure sufficient erosion control remains on site.
Failure to do so will be considered a violation of this approval.
6. Any borrow material brought onto this site must be from a legally operated mine or other
approved source. A single use borrow site or an area to waste material is only permissible if it is
operated under the total control of the Financially Responsible person or firm who is developing
this site and has been separately permitted and incorporated as part of this plan meeting all the
requirements of NC General Statue 74-49(7)f.
7. This permit allows for a land disturbance, as called for on the application plan, not to exceed
1.7 acres. Exceeding that acreage will be a violation of this permit and would require a
revised plan and additional application fee. Any addition in impervious surface, over that
already noted on the approved plan, would also require a revised plan to verify the
appropriateness of the erosion control measures and stormwater retention measures.
8. The construction detail for the proposed silt fence requires reinforcing wire and posts a
maximum of 8 feet apart. Omission of the reinforcing wire is a construction change that
necessitates more posts for support, i.e., the spacing distance needs to be reduced to no greater
than 6 feet apart.
9. A graveled construction entrance must be located at each point of access and egress available to
construction vehicles during the grading and construction phases of this project. Access and
egress from the project site at a point without a graveled entrance will be considered a violation
of this approval. Routine maintenance of the entrances is critical.
10. The North Carolina Sedimentation Pollution Control Act mandates a shortened time frame in
which to re-establish vegetative groundcover. Slopes (including cuts, fills, and ditch banks) left
exposed will, within 21calendar days after completion of any phase of grading, be planted or
otherwise provided with groundcover sufficient to permanently restrain erosion.

If the same person conducts the land -disturbing activity & any

or is a landfill regulated by the Division of Waste Management. If
the land -disturbing activity and any related Morrow or waste activity
are not conducted by the same person, they shall be considered
separate land -disturbing activities and must be permitted either
thru the Sedimentation Pollution Control Act as a one -use borrow
site or through the Mining Act.

TV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following it deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development phor to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped. or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and. protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on ail parties and persons
claiming under them, that they will run with the land. that the required covenants cannot be changed or deleted
