Myers, Executive Director 19 May 2009 Mr. Kevin Tweedy, PE Michael Baker Engineering, Inc. 8000 Regency Parkway, Suite 200 Cary, NC 27518 Subject: Steele's Mill Dam Removal, Richmond County, North Carolina. Dear Mr. Tweedy: Biologists with the North Carolina Wildlife Resources Commission have reviewed your request to begin work on removing the Steele's Mill dam this summer. Our staff does not have any objections to the removal of the dam during the summer provided the work begins after June 30. We continue to request that efforts are made to minimize sediment and erosion to the maximum extent possible. Thank you for the opportunity to comment on this project. If you need additional information, please contact our office at (336) 449-7625. Sincerely, Shari L. Kulz@ncmail. net>, <ian. mcmil lan@ncmail. net> CC: "Jessica rohrbach" <jrohrbach@mbakercorp.com>, <Howard.Schnabolk@noaa.gov> Hello all, After discussing the permit request with my supervisor, it was agreed that the application submitted is ok as is except that, in addition to what Eric mentioned, I will need some additional information regarding the exact location of the temporary stream crossing and the amount of fill material required to do so, as well as any bank stabilizing material located in wetlands or below the OHWM of the stream. It is actually good that the PCN includes the proposed Phase II activities since we need to evaluate those possible impacts as well, whether they happen 5 years from now or never. I've also discussed the issue of the Section 106 consultation with NOAA and SHPO, and since NOAA is the lead federal agency on this project (they are funding it) they will be invovled with developing the MOA, not the Corps. We cannot proceed with permitting until this document is complete and approved by us. So in the meantime, I will be withdrawing the permit application in order to stop the 1130 day" clock (even though it was received May 30th and should've been done over 2 months ago). Please keep in mind, as I have mentioned before, that I will be out of office from October 1- 20. I will be happy to assist where/when I can. Thank you, Emily Emily R. Everyone then walked up to the dam and stood along the right abutment to view the dam and the creek upstream and downstream. Discussed the plans for the removal, that include for the dam structure to be completely removed, but the abutment walls on either side of the dam will remain after demolition. Rock material removed from the dam will be used to provide additional toe protection along the abutments. Discussed the fact that the sluice gate of the dam has been open for at least 7 years, so there is no current backwater from the dam. The group walked approximately 150 feet upstream of the dam to gain a better. Upstream of the dam, the creek is free-flowing and appears to be mostly stable with dense herbaceous vegetation on the stream banks. Therefore, the group agreed that sediment release is not expected to be a concern for the removal of the dam. The group walked down the proposed construction access to the point where construction equipment will cross the creek channel to access the dam. Kevin Tweedy described the proposed access plans. Construction equipment will cross the channel at a perpendicular angle to access a mid-channel bar on the opposite side of the creek. The equipment will then move upstream on the bar material to get to the dam - this approach should minimize disturbance to the stream bed. In areas where the stream bed may be disturbed through construction, Mike Wicker agreed that USFWS would do a survey for mussels prior to equipment being brough in, and if species were found, they would be relocated to another stream reach away from disturbance. Shari Bryant indicated that she and/or members of her staff may be interested in participating in this work. Shari Bryant and Mike Wicker also indicated that NCWRC and USFWS would like to see the demolition work occur during the period from October 15 through March 15. If USACE decides NW 27, then that's OK, and we will use GC 3689. the PCN should simply indicate the amount of impact (stream length) which encompasses the footprint of the dam. Attached plans should also only describe the dam removal work. Please ensure to discuss the presence of bedrock as a stabilizing factor which should prevent headcutting upstream from the dam removal site, as this was a concern of folks in the Fayetteville Regional Office. Ryan felt that it was important to do the survey while the water is still warm and if the demolition did not occur until later in the winter that is fine. As I said at the meeting I hope the permit can be issued as quickly as possible so that the demolition can occur in the fall during the best environmental conditions. If we get rain just prior the 14th we may have to reschedule but assuming the weather will cooperate we are planning to conduct the mussel survey/relocation on October 14.
