Lewis,Lmda Sent Tuesday, April 26, 2016 9 23 AM To 'David Newsom' Cc: Johnson, Kelly, Scott, Georgette Subject FW Coastal Orthopedics - Jacksonville (NEW PROJECT) Mr Newsom After discussion with Kelly, and in reading through the March 15, 2010 permit for Royal Creek IP, the deed restrictions that are supposed to be recorded prior to the sale of any lot (copied below) specify that the Division will do the reviews The City has the option of modifying the SW8 000308 permit to change these deed restrictions to specify that either the City or the State can issue the individual lot high density permits Until the City requests that modification, the state should do those reviews Prior to the sale of any lot, deed restrictions must be recorded which limit the development on the future lots, per Section I, Part 7 The recorded statements must follow the form a "The buyer is required to collect all stormwater emanating from all impervious surfaces (also known as built -upon area), from the individual lot, and from within the public right-of-way fronting the lot, and from any offsite areas that will drain to the system, as defined in 15A NCAC 2H 1000, and treat it in Structural Stormwater Control Measures as required for high density development, also defined in 15A NCAC 2H 1000 (typically, but not limited to, a wet detention pond) to b "The buyer is required to submit for and obtain a State Stormwater Management Permit for high density development from the Division of Water Quality prior to any construction on the lot " c "The buyer is required to accept, collect and treat that portion of the stormwater generated on public street rights -of -way (including future road widening and/or extensions) that is tributary to and/or fronting the lot " d "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State " e "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State " "No one may pipe or fill in any curb outlet swale without permission from the Division " Linda From Lewis,Linda Sent. RE Coastal Orthopedics - Jacksonville (NEW PROJECT) Mr Newsom Has the Royal Creek IP (000308) been renamed to Jacksonville Industrial Park? If so, we'll need to get that name change documented This is an excerpt from the most recent SW8 000308 permit This permit is issued with the understanding that future lots will be subdivided based on market demands and individual buyer needs Each lot must provide its own stormwater management BMP and must submit an individual high density stormwater permit application prior to construction Prior to selling lots, a copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat The recorded copy must contain all of the statements required by this permit, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds The City of Jacksonville shall be required to notify the Division within 30 days of sellmg a lot, and shall submit a revised Master plan as a plan revision request along with the sale notification The Division will process these plan revision requests as a tracking mechanism So, it's not a low density permit — each lot must submit a high density application and design an Individual BMP Since each lot has to get their own HD permit, there's no confusion over which agency issued the offsite permit I think the more overriding factor is the ownership Since the City owns the IP, they were not able to permit themselves So we wrote the permit and put in the above condition In this case, I'm not sure it matters who issues the high density permit, the City or the state It sounds like the intent is for the state to process a plan revision submitted by the City as each lot is subdivided and sold, and then either the state or the City can issue the HD permit to the lot owner I will double-check with Kelly and Georgette and get back to you on this Linda From David Newsom (mailto crystalcoastene@bizec rr com) Sent Tuesday, April 26, 2016 7 30 AM To Lewfs,Linda <Iinda lewis@ncdenr gov> Subject Coastal Orthopedics - Jacksonville (NEW PROJECT) I know John Pierce discussed this with you and I hate to also bother you with it but I want to be sure that I understand correctly before preparing SW permit application Pierce indicates that we should permit this new project under the City's program I can certainly do that but It seems a little contrary to past permtting practices While the new Coastal Orthopedics project is proposed on the same lot as a previously permitted BUT NOT BUILT project (Noland Properties SW8 051012) But the project site (Tract 1 Jacksonville Industrial Park) is already covered under and existing Low Density permit (or that is my recollection) If we permit the NEW project under the City's program (like the one we had to fix and Carolina Forest)? construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately 3 The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to a Semiannual scheduled inspections (every 6 months) b Sediment removal c Mowing and revegetation of slopes and the vegetated filter d Immediate repair of eroded areas e Maintenance of all slopes in accordance with approved plans and specifications f Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping g upon request to authorized personnel of DWQ The records will indicate the date, activity, name of person performing the work and what actions were taken 5 Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria a The fountain must draw its water from less than 2' below the permanent pool surface b Separated units where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond c The falling water from the fountain must be centered in the pond, away from the shoreline d The maximum horsepower for a fountain in this pond is 118 horsepower 6 The facilities shall be constructed as shown on the approved plans This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data 7 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation Any deviations from the approved plans and specifications must be noted on the Certification A modification may be required for those deviations 8 If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility 9 Access to the stormwater facilities shall be maintained via appropriate easements at all times 10 The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below a Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc b Project name changge c Transfer of conveyance shown on the approved plan 11 The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction 12 A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction Page 4 of 7 State Stormwater Management Systems Permit No SW8 051012 13 The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made III.
