Dear Mr. Hackney:
Permit Extension
Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development
approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010.
The law extends the effective period of any stormwater permit that is set to expire during this time
frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 050709, which was set to expire on December 29, 2015, is now
in effect until December 29, 2019. Please resubmit the renewal application and fee at least 180 days
prior to December 29, 2019, which would be June 29, 2019. A copy of the Renewal Application can be
obtained from the following website: http://portal.ncdenr.org/web/wq/ws/su/statesw/forms—docs.
Request for Additional Information
On April 2, 2014, the Division received an incomplete State Stormwater Permit Transfer Request Form
for the project listed above as the application package lacked the necessary elements to accept it for
review. Please provide the following information in order to accept the Transfer application package:
1. In the Declaration of Covenants, Conditions, and Restrictions for Stones Edge recorded in Book
5112 Page 1125 with New Hanover County, a definition of the Planned Community Act is
provided on page 4 however it could not be found in this document where it states that Stones
Edge was formed under the Planned Community Act. Please either provide a citation where the
Declaration indicates that this development was a planned community as defined in Chapter
47F of the General Statues or provide a legal response with citations to the sections of the
Declaration that support this development meets all of the requirements of Chapter 47F.

of the stormwater management system have been conveyed to the proposed permittee in
accordance with the condominium or planned community declaration.

4. If you have it, please provide documentation, such as meeting minutes, indicating Mr. Passmore

Please note that per Section 11.15 of the permit, the development must be found in compliance
with all the permit conditions prior to the transfer. Any items not incompliance must be repaired
or replaced to the design condition or the permit must be modified to approve the current
condition prior to the transfer.
Notice of Inspection
On May 9, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected Madison Park in New Hanover County to determine the status
of compliance with the State Stormwater Management Permit Number SW8 050709 issued on
December 29, 2005. DEMLR file review and site inspection revealed that the site is not
compliant with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of
the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. It appears that the number of lots and the lot layout has changed slightly from the
approved plans.
2. The pipe proposed behind lots 1 and 2 to direct runoff to the stormwater system could
not be located.
3. A roof drain was found to have been installed at the rear of the lots near the outlet for
pond 1.
4. According to aerial photos available online, it appears that Pond 2 has a different shape
than approved.
5. The difference between the provided permanent pool and temporary pool elevations in
Pond 2 appears to be less than the approved 2 ft.
6. An additional swale and piped collection system has been constructed to convey what
appears to be offsite drainage around the system.
7. A slight bit of erosion was found on the bank and around the inlet. Also, a tree was
found growing in front of the pond inlet.
In order to correct these deficiencies:
1. Please confirm that the number of lots and. the lot layout is consistent with the approved
plans.
2. Per Section 11.12.i of the permit, please demonstrate how the runoff from lots 1 and 2 will
be directed to the stormwater collection system. Additionally, please confirm that the
remaining lots drain into the permitted collection system by providing roof drain gutters
that are directed to the street and/or collection system, grading the lot to drain toward he
street, or by providing perimeter swales and directing them to the pond or street. Only
those lots that naturally drain into the system are not required to provide these
measures.
3. Please confirm that the stormwater ponds and outlet structures have been constructed
according to the plans.
4. Continue to operate and maintain the ponds per the signed operation and maintenance
agreements.
5. Per 11.4 of the permit, please submit to the Division for approval any revised or modified
plans, specifications, and calculations.
Please inform this Office in writing before June 25, 2014, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by June 25, 2014 then DEMLR staff will re -inspect the site
and issue a Notice of Violation if the listed deficiencies have not been addressed.

If the project has changed its name, ownership, or mailing address, it is your responsibility to
submit a completed and signed Name/Ownership Change form to DEMLR at least 30 calendar
days prior to making the changes. Please include the name, mailing address and phone
number of the person or entity that is now responsible for this permit on the Name/Ownership
Change form.
