On September 1, 2006, the Wilmington Regional Office received a complete plan revision for
Stormwater Management Permit Number SW8 050558. The revisions include a reduction in
BUA due to shortening the access drive and making it a cul-de-sac and relocating the level
spreader and vegetated filter so that they are located on the property. It has been determined
that a formal permit modification is not required for the proposed changes. We are forwarding
you an approved copy of the revised plans for your files. Please replace the old approved plan
sheets 1, 2, 3, 4, 5, 6, 15, 16, 17 and 19 of 20, with the new ones enclosed.
Please be aware that all terms and conditions of the permit issued on September 2, 2005,
remain in full force and effect. Please also understand that the approval of this revision to
the approved plans for the subject State Stormwater Permit is done on a case -by -case
basis. Any other changes to this project must be approved through this Office prior to
construction. The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

Dear Mr. Bartlett,
On September 2, 2005, the Wilmington Regional Office issued a high density
stormwater permit for Seaside Landing, with permit No. SW8050558. As a result of
some minor changes to the project resulting from agreements with adjacent property
owners, several changes have been made to the project layout. This letter serves to
address those changes as they relate to the stormwater permit. Final drawings are
enclosed for your records.
The following changes have been made to the project layout:
1) The access drive to Seaside Landing has been modified. The result is a net
loss in impervious area, and there is no adverse effect on the stormwater
collection or treatment system.
2) The level spreader has been moved from the adjacent property to the west,
to on the project site. This affected the elevations of By-pass Box 5 (BP-5),
as well as Junction Box 8 (JB-8)
Please let me know if you have any questions or would like to discuss these changes in
greater detail.

The Division received a plan revision for the subject project on April 25, 2006.
The cover letter was addressed to Paul Bartlett. Please be advised that Paul is one
of our Express permitting engineers. The only correspondence you should be sending
Paul is in regard to a current Express permit. This project has already been
permitted. Should you desire to have the plan revision approved in the Express
program, you need to contact Cameron weaver to schedule a review date. The fee for
an Express plan revision is $1000.00.
If you want to utilize the regular program for approving this plan revision, there
is no fee, however, the time required to permit it will be a longer.
You only submitted one set of the plans. Please be advised that all applications,
modifications and plan revisions require a minimum of 2 sets of plans in order to
process and approve the revision.
None of the plan sheets submitted shows the location of the infiltration trench
system, the bypass structure, or the relocated vegetated filter. Please submit 2
copies of the plan sheets that contain this information.

listed above. G.S. 113A-54.1(a) requires that this office approve or disapprove a submitted revised plan within
15 days of receipt of such plan. Failure to act by this office within this time period shall be deemed approval of
the revised plan.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.

plan. Sheet 19, "Stormwater Details" explains these items in more
detail. However, the vegetated filter is not currently called out on
the stormwater plan. At the outfall of the bypass line, rip rap leads
into a level spreader. Once dissipated into the level spreader, runoff
flows across the undisturbed 80ft+ vegetated area down to the
intracoastal waterway. In the future, I will make sure to label such
areas to avoid any confusion.

HIGH DENSITY DEVELOPMENT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of an underground infiltration trench in
compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until September 2, 2015, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 77,948 square feet of
impervious area. This trench must be operated with a 50' vegetated filter.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. There is no allotment for future built -upon
area at the tract.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this.
project must be directed into the permitted stormwater control system.

must be maintained at design conditions:

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections' (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of bypass structure, filter media, flow
spreader, catch basins, piping and vegetated filter.
g. A clear access path to the bypass structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

2) Please provide an infiltration system inspection/access port for
each row, as detailed on Sheet 19 for the longest row; and
illustrate and label the locations on the Site Plan (Sheet 4),

Inspectionlaccess ports have been added to both ends of each row.

3) Please clarify the "Approx. 75 AEC Line" by providing a line data
table and supporting survey documentation.
A line data table has not been included on the plans per our
conversation on August 29, 2005. In our conversation, we discussed
the methodology used in determining the Approx. 75 AEC Line". To
summarize, survey points were taken at the back side of the bulkhead
on the subject property. The "Approx. 75 AEC Line" was generated by
offsetting these survey points 75 ft. to the north. This resulted in a
conservative approximation, due to the small beach (4-5ft wide) that
exists on the south side of the bulkhead.
4) Please reference the Stormchamber model number on detail
Sheet 19 and the supplement Form SWU-107 and provide a
specifications sheet (capacity, dimensions) to add to the P.E.-
stamped calculations.
The Contech Stormchamber does not have a model number in that the
manufacturer only makes one size, or model. To clarify this model over
any other, a note has been added to details #3 and #6 on Sheet 19
that names the Contech "Stormchamber". A specifications sheet has
been included to add to the P.E.-stamped calculations

In accordance with S&ME Proposal 617-05 dated February 14, 2005, S&ME personnel have
recently conducted one double -ring infiltrometer test of the surficial soils at the subject site at the
approximate location shown in Figure 1. Specifically, our representatives performed the following
work items on March 15, 2005:
1. Advanced three hand-augered borings across the site in order to visually
classify the in -place soils. A Munsell Soil Color Chart was used to define the :t
hue and chroma of the recovered soil samples. d'

`2..- Conducted one double -ring inf ltrometer test at a depth of 8 inches below the
existing ground surface at Location 3. This testing was conducted in general
accordance with American Society for Testing and Materials (A, TM)
procedure D-3385 entitled, "Infiltration Rate of Soils in Field Using Double -
Ring Infiltrometer".
Based on our field classifications of the excavated soils at the hand-augered boring locations, the in -
place soils consist of fine to medium sands with varying amounts of silt, shell fragments, and
organics, which extended to the maximum completed boring depth of 50 inches below the existing
ground surface. Water was encountered in the borehole at Locations 2 and 3 at a depth of 47 inches
below the existing ground surface. The site water level will fluctuate with climatic and seasonal
conditions, however, and may be higher or lower at other times of the year. It is our opinion that the
depth to the seasonal high water table could occur at a depth of about 3 to 3'/z feet below the
existing ground surface.

Placement of dredged or fill material within waters of the US and/or wetlands without a Department of the Army permit may
constitute a violation of Section 301 of the Clean Water Act (33 USC § 1311). If you have any questions regarding this

Basis For Determination: The site is an old _field system dominated by broom sedlxe and other Trasses. Soils and
hvdrolo2ic indicators demonstrate that the ]and within the Rroiecf boundaries do not meet 404 wetland criteria needed
to establish Federal jurisdiction. The site includes drainage ditches that appear to have been cut from upland soils and
that drain toward the Intracoastal Waterway. Although the ditches contain water and wetland vegetation. the Corps
does_not assert_ jurisdiction because of their upland oriZin and that fact that thev do not interconnect with other 404
wetlands on site. See attached map and sketch.

on the Standard Permit or acceptance of the LOP means that you accept the permit in its entirety, and waive all rights to appeal the

• OBJECT: If you object to the permit (Standard or LOP) because of certain terms and conditions therein, you may request that the
permit be modified accordingly. You must complete Section II of this form and return the form to the district engineer. Your
objections must be received by the district engineer within 60 days of the date of this notice, or you will forfeit your right to appeal
the permit in the future. Upon receipt of your letter, the district engineer will evaluate your objections and may: (a) modify the
permit to address all of your concerns, (b) modify the permit to address some of your objections, or (c) not modify the permit
having determined that the permit should be issued as previously written. After evaluating your objections, the district engineer
will send you a proffered permit for your reconsideration, as indicated in Section B below.
B: PROFFERED PERMIT: You may accept or appeal the permit

Dear Mr.'Knott:
On May 11, 2005, the Wilmington Regional Office received a copy of a Letter of Receipt of
Erosion Control Plan for the subject project. The North Carolina Administrative Code requires
any project that must receive either Sedimentation and Erosion Control Plan approval and/or a
CAMA Major permit to apply for and receive a Stormwater Management Permit by the
Division of Water Quality. Any construction on the subject site, prior to receipt of.the required
permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate
enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed
application form, fee, and supporting documentation, or a written response regarding the
status of this project and the expected submittal date must be received in this Office no later
than July 18, 2005. Failure to respond to this request may result in the initiation of enforcement
action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan
approval letter must NOT be considered the Coastal Stormwater Management Permit, which
will be signed by the Water Quality Supervisor. Please reference the Project Number above

This office has received a soil erosion and sediment control plan for the project listed above which
was submitted as required by the North Carolina Sedimentation Pollution Control Act (G.S. 113A-57 (4)).
The Act requires that all persons disturbing an area of one or more acres of land must obtain approval
of a soil erosion control plan prior to the commencement of the land -disturbing activity (G.S. 113A-54(d) (4)).
The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving
authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30-day period will be deemed approval of the
plan.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance
with Federal and State water quality laws, regulations and rules.
Please provide a copy of the most current deed and the adjusted clearing limits.
