Inspection Summary:
The permittee has not responded to the August 6, 2008 inspection report. It does not appear that the maintenance
issues listed in tha report have been addressed.
The permitted facility has not been certified.The permittee must provide the certification that the pond and the project's
built -upon area has been built in accordance with the permit.
The recorded deed restrictions are incorrect and must be corrected by filing and recording an amendment to reflect all of
the statements as listed in the permit, word for word. A BUA restriction of 18.73% of the lot may or may not be less than
the maximum amount specified in Attachment A to the permit.
The permittee is required to notify the Division of any ownership, mailing address or project name changes by completing
and submitting the Name/Ownership Change form. Prior to transfer of the permit to the Association, the project must be
in compliance with the permit.

2. The deed restrictions downloaded from the Onslow County Register of Deeds website do not reflect
any of the re uired permit statements. The BUA ger lot is incorrectly restricted to either 18.73% of the
lot (Phases 1-3) or 3,000 sf (Phase 4). Attachment A to the December 13, 2006 permit provides for the
specific maximum BUA per lot in square feet.

Effective August 1, 2013 the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for issuance of the
permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010.
The law extended the effective period of any stormwater permit that was set to expire during this time
frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly,
the permit, which was set to expire on December 13, 2016, shall now be effective from the date of
issuance until December 13, 2020. The project remains subject to the conditions and limitations
specified in the permit issued on December 13, 2006.
On October 1, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected Trifield Estates Section 3, Phases 1-5 in Richlands, Onslow County to
determine the status of compliance with the State Stormwater Management Permit Number SW8
050403 issued on December 13, 2006. DEMLR file review and site inspection revealed that the site is
not in compliance with the terms and conditions of this permit. Please find a copy of the completed
form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of
the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The deed restrictions were incorrectly recorded and no amendment to revise and correct them
has been filed.
2. The wet detention pond has not been certified.
3. The mailing address of the permittee must be confirmed.
4. The permittee has not responded to the August 6, 2008 compliance inspection report. There is
no indication that the maintenance issues have been resolved.
Please inform this Office in writing before November 14, 2014, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by November 14, 2014 then DEMLR staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.

days prior to making the changes. Please include the name, mailing address and phone
number of the person or entity that is now responsible for this permit on the Name/Ownership
Change form.
Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including timely responses to the
Division's written requests for information, operation and maintenance of the permitted
stormwater system, accurate recordation of the deed restriction statements, and notification of
any ownership or mailing address changes. Violations of your Stormwater Management Permit
may be subject to the assessment of civil penalties of up to $25,000 per day per violation.

Footnotes:
When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.
II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

The permanent pool depth is between 3 and 6 feet (required minimum of 3 feet).
The forebay volume is approximately equal to 20% of the basin volume.
The temporary pool controls runoff from the design storm event.
The temporary pool draws down in 2 to 5 days.
If required, a 30-foot vegetative filter is provided at the outlet (include non -erosive flow
calculations)

III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that dray+down of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
