The Division received a complaint from the residents of this project in January 2016 regarding the non-functioning
infiltration basin. The project was inspected on January 25, 2016 and again on February 3, 2016 and it was determined
that the infiltration basin was not functioning as designed,
No response to the February 8, 2016 inspection letter was received, so the Division followed up with a second letter
dated November 2, 2016. No response to the second letter was received and additional complaints from the residents
were received, so the Division issued a Notice of Violation on August 16, 2017. An evaluation of the basin was performed
and on August 14, 2018, a plan of action was finally submitted by White Partners, LLC that included a plan to restore
the basin to design condition. The permittee performed the restoration work in April 2019. Due to the dry weather, the
Division was not able to inspect the project for compliance until a sufficient amount of rain had fallen, which finally
occured on July 13, 2019,
On July 18, 2019, staff observed that the basin is holding water after receiving approximately 0.9 inches of rain on July
13, 2019 and only a trace of rain during the ensuing 5 days. The project is not in compliance and the permit cannot be
transferred at this time.
The permit expired on April 28. 2019 and has not been renewed.
The permittee dissolved the corporate entity effective December 31, 2018.

Inspection Summary:
The Division received a complaint from the residents in January 2016 regarding the non-functioning infiltration basin. The

Having received no response to the February 8, 2016 inspection letter, the Division followed up with a second letter dated
November 2, 2016. Having received no response to the second letter, and additional complaints from the residents, the

2018, a plan of action was finally submitted by the consultant on behalf of White Partners, LLC that included a plan to

Comment: 1. The infiltration basin BMP was full of water on January 25 _2016. The basin was still full of water at
the followup inspection conducted 9 days later. The basin is reguired_to drawdown completely within 5
days. There has been only about a_quarter of an inch of rain since_ January 25 2016.
2. The infiltration capacity of the basin will need to be restored. The bottom of the basin has most likely
been "blinded off' by the accumulated sediment which must now be removed.

The Division received a general question from a homeowner regarding the ability to modify the permit to allow the pond to
retain a higher water level during periods of drought. The HOA doesn't own the permit, so they cannot propose to modify
it. The pond could be lined with bentonite clay to inhibit infiltration, but all of the runoff from the site must drain into the
infiltration basin first to be infiltrated. Only the excess design storm is routed to the pond.
Several of the lots went from duplex lots to single family, but the permit was not modified to reflect this.

I stopped by the site at lunch today and I observed several inches of standing water in the infiltration
basin. I note that the area sustained slightly under one inch of rain on Saturday, July 13, 2019 with
only a trace amount falling since then up to right now.
It is doubtful that the basin will be dry by the end of today. The project cannot be called in compliance
at this time, and the permit cannot be transferred to the HOA.
I think you need to consider the possibility that the water level in the county's pond may be influencing
the localized SHWT in the immediate vicinity of the infiltration basin and that the basin will never be
able to infiltrate within 5 days if that turns out to be true.
One option that is still available is to redesign the existing pond under the 2017 rules to accommodate
the runoff from Bella Sera.
I am sorry -- I had high hopes that this restoration would work.

Dear Mr. Beattie:
On July 18, 2019 staff of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a
follow-up inspection of Bella Sera Villas at Vineyard Plantation located off Futch Creek Road in New
Hanover County, to determine the status of compliance with the State Stormwater Management
Permit Number SW8 050308 issued on April 28, 2005. The permitted infiltration basin was
supposedly restored to design condition in April 2019. The drought delayed the Division's ability to
reinspect the project until now.
It has been determined that the infiltration basin is still not in compliance with the terms and
conditions of the permit or the stormwater rules. Please find a copy of the form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent
inspection. As indicated in the attached inspection report, the following deficiencies must be
resolved:
1. The maintained and restored infiltration basin is still not drawing down within 5 days as
required by the stormwater rules.
2. The permit expired on April 28, 2019 and has not been renewed. Please submit a renewal
application and fee to the Division. It will not be possible to transfer the permit until it is
renewed.
3. The permittee dissolved the corporate entity, White Partners, LLC, effective December 31,
2018. The permittee remains responsible for maintaining, renewing and transferring the
permit.
Failure to provide the requested information, or to respond to this letter with a new plan of action,
including a timeline to resolve the identified deficiencies, by August 22, 2019 are considered
violations of the permit. If the requested information is not submitted to this office by the due date,
then DEM LR staff will re -inspect the site and may issue a Notice of Violation.

In accordance with S&ME Proposal 395-04 dated October 2I, 2004, ME personnel have
recently conducted double -ring infi.ltrometer testing of the surficial soils at the subject site at the
approximate locations shown in Figure 1. Specifically, our representatives perfonned the following
work items on November 9 and 19, 2004: `
Advanced one hand-augered boring near each infiltrometer test location in
order to visually classify the in -place soils. A Mansell Soil CoIor Chart was
used to define the hue and chrorna of the recovered soil samples.
2. Conducted three double -ring infiltrometer tests at a depth of approximately 4
feet below the existing ground surface. This testing was conducted in general
accordance with American Society for Testing and Materials (ASTM)
procedure D-3385 entitled, "Infiltration Rate of SoiIs in Field Using Double -
Ring Infnitrometer".
Based on our field classifications of the excavated soils at the band-augered boring locations, the in -
place soils consist of sands with, varying amounts of silt or clay. Sandy soils extended to the
completed boring depth of 96 inches below the existing ground surface. No water was encountered
in the boreholes. The site water level will fluctuate with climatic and seasonal conditions, however,
and may be higher or lower at other dazes of the year. It is our opinion that the depth to the seasonal
high water table exceeds slat feet below the existing ground surface.

The average infiltration rate at Location B-1 was approximately 1.5 inches per hour. At Location
B-2, the average infiltration rate was approximately 1.4 inches per hour. The average infiltration
rate at Location B-3 was approximately 0.4 inch per hour. A. summary of the field test results is
presented in Tables 1, 2, and 3.

2017 email to the Division, the self-imposed December 1, 2017 deadline has passed and nothing has

1. A plan of action to restore the infiltration basin to design condition;
2. The remaining documents to transfer the permit, i.e., verification of BUA per lot, recorded plats
and a copy of the recorded deed restrictions;

Remedy to malfunction of infiltration pond will be released no later than December I". The timeframe
is to allow for adequate coordination with the HOA if needed.
2. Failure to receive prior approval for changes to the approved plan,
Response: Exhibits are currently being prepared to display current impervious area of each lot is under
the approved threshold shown in recorded plats and HOA does. This exhibit will be provided no later
