On August 8, 2012, David Cox of the Wilmington Regional Office of the Division of
Water Quality (DWQ) reviewed the Engineer's Certification for Bo jangles — 2149
Lejeune in Onslow County to determine the status of compliance with Stormwater
Management Permit Number SW8 050103 issued on October 12, 2010. DWQ file
review and site inspection revealed that the site is compliant with the terms and
conditions of this permit. Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter.
Please be advised that you are required to comply with the terms, conditions and
limitations of your Stormwater Management Permit under Title 15A North Carolina
Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including
operation and maintenance of your permitted stormwater system.
If the project has changed its name, ownership or mailing address, a completed and
signed Name/Ownership Change form must be submitted to DWQ at least 30 calendar
days prior to making the changes. Please include the name, mailing address and
phone number of the person or entity that is now responsible for this permit on the
Name/Ownership Change form.
Please be advised that violations of your Stormwater Management Permit may be
subject to the assessment of civil penalties of up to $25,000 per day per violation. If you

On June 26, 2012, David Cox and Chris Baker of the Wilmington Regional Office of the Division
of Water Quality (DWQ) inspected Bojangles-2149 Legeune BLVD. in Onslow County to
determine compliance with Stormwater Management Permit Number SW8 050103 issued on
April 21, 2006. DWQ file review and site inspection revealed that the site is not in compliance
with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Submit a copy of the Engineer's Certificate.
2. Clean out the forebay,
Please inform this Office in writing before August 14, 2012, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by August 14, 2012 then DWQ staff will re -inspect the site
and issue a Notice of Violation if the listed deficiencies have not been addressed.
Please be reminded that if an ownership change, or a name change or a mailing address
change has occurred, it is your responsibility to submit a completed and signed
Name/Ownership Change form to the Division. Please include the name, mailing address and
phone number of the party who is now responsible for this permit. If you have any questions,

North Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of one (1) wet detention pond(s) in
compliance with the provisions of 15A NCAC 2H A 000 (hereafter referred to as the
"stormwater rules') the approved stormwater management plans and specifications and
other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until April 21, 2016, and shall be
subject to the following specified conditions and limitations:
1. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.8 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 53,087 square feet of
impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. There is no allocation of built -upon area for
any future development.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area(s) of this
project must be directed into the permitted stormwater control system. ti

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not.limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. A Decorative spray fountain will not be allowed in the stormwater treatment
system, because the permanent pool volume is less than 30,000 cubic feet.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.

7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further development, subdivision, acquisition, lease or sale of any, all or
part of the project area. The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for the life of the permit.
13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. At least 30 days prior to a change of ownership, or a
name change of the owner or of the project, or a mailing address change, the
permittee must submit a completed and signed Name/Ownership Change Form
to the Division of Water Quality, accompanied by the supporting documentation
as listed on the form. The approval of this request will be considered on its merits
and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request. Neither the sale of the project
nor the conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.

3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules,- regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
2. The drainage area to the system contains no more than the permitted
amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
11. The permitted amounts of surface area and/or volume have been
provided.
12. Required drawdown devices are correctly sized and located per the
approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf,
and a forebay.
15. The required system dimensions are provided per the approved plans.
16. All components of the stormwater BMP are located in either recorded
common areas, or recorded easements.

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Bojangle's Restaurant on Lejeune Boulevard on April 18, 2006, and issued a
permit on April 21, 2006. The permit referenced the incorrect project number. The new
permit, attached, has been corrected to reflect the actual project number, SW8 050103.
Please discard the previous permit and replace it with this corrected one. Staff review of the
plans and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit
No. SW8 050103 dated October 2, 2008, for the construction of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject
to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless
such demands are made this permit shall be final and binding.

stormwater management system permitted under SW8 971101, as described in

3. The built -upon area allotted to this development by Stormwater Management Permit
No. 971101, is 63,464 square feet. This project proposes 59,294 square feet of built -
upon area.
4. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.

vegetated and operational for its intended use prior to the construction of any built -
upon surface associated with this project.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee is responsible for keeping the stormwater collection system on the lot
clear of debris, and keeping the site stabilized in accordance with the requirements of
the NC Erosion and Sediment Control Design Manual.
4. Bailey & Associates, shall, at all times, provide the operation and maintenance
necessary to assure the permitted stormwater management system functions at
optimum efficiency. The approved Operation and Maintenance Plan must be followed
in its entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.

5. The permittee shall submit to the Director and shall have received approval for revised

6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. Bailey & Associates must keep records of maintenance activities and make them
available upon request to authorized personnel of DWQ. The records will indicate the
date, activity, name of person performing the work and what actions were taken.
8.- This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and other
supporting data.
9. Bailey & Associates is responsible for providing, prior to issuance of a Certificate of
Occupancy, and prior to. operation of the permitted stormwater management facility, a
certification from an appropriate designer for the system installed, certifying that the
permitted facility has been installed in accordance with Stormwater Permit No. SW8
971101, the approved plans and specifications, and other supporting documentation.
Any deviations from the approved plans and specifications must be noted on the
Certification.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. This lot is limited to the amount of built -upon area indicated in the supporting
calculations and per approved plans. The project must have a built -upon area less
than or equal to the amount permitted under Stormwater Permit No. SW8 971101.
Additional built -upon area will require a modification to the overall Permit.
12. Bailey & Associates must record any deed restrictions as required by their permit, and
they must verify that the proposed built -upon area does not exceed the allowable built -
upon area. Once the lot transfer is complete, the built -upon area may not be revised
without approval from the permittee, and responsibility for meeting the built -upon area
limit is transferred to the individual property owner.
13. The drainage features shown as a part of the stormwater management system on the
approved plan shall not be filled in, altered, or piped by any party without first
submitting a revision to the permit and receiving approval from the Division.

14. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In
the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved. The
permittee is responsible for compliance with all terms and conditions of this permit
until such time as the Director approves the permit transfer.
2. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
4. In the event that the offsite stormwater facilities fail to perform satisfactorily, including
the creation of nuisance conditions, Bailey & Associates is responsible for taking
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
5. The permittee grants permission for DENR Staff to enter the property for the purpose
of inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
7. The permittee shall notify the Division in writing of any name, ownership or mailing
address changes at least 30 days prior to making such changes.

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. The runoff associated with this project has been approved to be discharged into a
stormwater management system permitted under SW8 971101, as described in
Section 1.7 on page 3 of this permit.
3. The built -upon area allotted to this development by Stormwater Management Permit
No. 971101, is 63,464 square feet. This project proposes 59,294 square feet of built -
upon area.
4. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.

II. SCHEDULE OF COMPLIANCE
The offsite stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any built -
upon surface associated with this project.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee is responsible for keeping the stormwater collection system on the lot
clear of debris, and keeping the site stabilized in accordance with the requirements of
the NC Erosion and Sediment Control Design Manual.
4. Bailey & Associates, shall, at all times, provide the operation and maintenance
necessary to assure the permitted stormwater management system functions at
optimum efficiency. The approved Operation and Maintenance Plan must be followed
in its entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins
and piping.
g. Access to the outlet structure must be available at all times.

5. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition or selling of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. Bailey & Associates must keep records of maintenance activities and make them
available upon request to authorized personnel of DWQ. The records will indicate the
date, activity, name of person performing the work and what actions were taken.
8. This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and other
supporting data.
9. Bailey & Associates is responsible for providing, prior to issuance of a Certificate of
Occupancy, and prior to operation of the permitted stormwater management facility, a
certification from an appropriate designer for the system installed, certifying that the
permitted facility has been installed in accordance with Stormwater Permit No. SW8
971101, the approved plans and specifications, and other supporting documentation.
Any deviations from the approved plans and specifications must be noted on the
Certification.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. This lot is limited to the amount of built -upon area indicated in the supporting
calculations and per approved plans. The project must have a built -upon area less
than or equal to the amount permitted under Stormwater Permit No. SW8 971101.
Additional built -upon area will require a modification to the overall Permit.
12. Bailey & Associates must record any deed restrictions as required by their permit, and
they must verify that the proposed built -upon area does not exceed the allowable built -
upon area. Once the lot transfer is complete, the built -upon area may not be revised
without approval from the permittee, and responsibility for meeting the built -upon area
limit is transferred to the individual property owner.
13. The drainage features shown as a part of the stormwater management system on the
approved plan shall not be filled in, altered, or piped by any party without first
submitting a revision to the permit and receiving approval from the Division.

14. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.

THIS PROJECT CONSISTS OF THE DEVELOPMENT OF A BOJANGLES RESTAURANT
IN JACKSONVILLE, ONSLOW COUNTY, NORTH CAROLINA. CURRENTLY THE
PROJECT SITE IS DEVELOPED WITH AN EXISTING ONE-STORY BRICK BUILDING,
AN EXISTING CAR WASH STRUCTURE AND A SMALL FRAMED STRUCTURE. THE
MAJORITY OF THE SITE IS COVERED WITH THE EXISTING ASPHALT PAVEMENT
WHICH WILL BE DEMOLISHED. THE PROJECT CONSISTS OF THE DEVELOPMENT

PERCENTAGE OF 73.7%. THE ENGINEERED STORMWATER SYSTEM COMPLIES
WITH THE COASTAL STORMWATER REGULATIONS. THE STORMWATER
DETENTION POND IS SIZED FOR 90% TOTAL SUSPENDED SOLIDS (TSS) REMOVAL.
ALL STORMWATER RUNOFF ON THE SUBJECT PROPERTY WILL BE DIRECTED TO
THE FOREBAY AREA OF THE STORMWATER DETENTION POND. THE POND WILL
DISCHARGE THROUGH AN OUTLET STRUCTURE TO A RIP -RAP ENERGY
DISSIPATOR IN AN EXISTING ROADSIDE DRAINAGE SWALE.
THE TRAFFIC TURN LANE ALONG SIDE NC HIGHWAY 24 WILL CONTINUE TO
DRAIN TO THE EXISTING ROADSIDE CATCH BASINS.
THE PROPOSED DETENTION POND WILL ALSO REDUCE THE PEAK FLOWRATES

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Bojangies Restaurant on April 18, 2006. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit
No. SW8 051013 dated April 21, 2006, for the construction of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject
to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150E of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, INC 27611-7447. Unless
such demands are made this permit shall be final and binding.

construction of impervious areas with runoff to be treated in an offsite permitted stormwater
facility, in compliance with the provisions of 15A NCAC 2H'.1000 (hereafter referred to as
the "stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit. The stormwater runoff from the site will
be routed to a wet detention pond operated and maintained by Bailey & Associates under
the terms and conditions set forth in Permit No. SW8 971101.
This permit shall be effective from the date of issuance until rescinded, and shall be subject
to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. The runoff associated with this project has been approved to be discharged into a
stormwater management system permitted under SW8 971101, as described in
Section 1.7 on page 3 of this permit.
3. The built -upon area allotted to this development by Stormwater Management Permit
No. 971101, is 63,464 square feet. This project proposes 59,294 square feet of built -
upon area.
4. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.

5. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition or selling of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
- 6. - .The Director may determine that other revisions to the project should require a
modification to the permit.
7. Bailey & Associates must keep records of maintenance activities and make them
available upon request to authorized personnel of DWQ. The records will indicate the
date, activity, name of person performing the work and what actions were taken.
8. This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and other
supporting data.
9. Bailey & Associates is responsible for providing, prior to issuance of a Certificate of
Occupancy, and prior to operation of the permitted stormwater management facility, a
certification from an appropriate designer for the system installed, certifying that the
permitted facility has been installed in accordance with Stormwater Permit No. SW8
971101, the approved plans and specifications, and other supporting documentation.
Any deviations from the approved plans and specifications must be noted on the
Certification.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. This lot is limited to the amount of built -upon area indicated in the supporting
calculations and per approved plans. The project must have a built -upon area less
than or equal to the amount permitted under Stormwater Permit No. SW8 971101.
Additional built -upon area will require a modification to the overall Permit.
12. Bailey & Associates must record any deed restrictions as required by their permit, and
they must verify that the proposed built -upon area does not exceed the allowable built -
upon area. Once the lot transfer is complete, the built -upon area may not be revised
without approval from the permittee, and responsibility for meeting the built -upon area
limit is transferred to the individual property owner.
13. The drainage features shown as a part of the stormwater management system on the
approved plan shall not be filled in, altered, or piped by any party without first
submitting a revision to the permit and receiving approval from the Division.

The offsite stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any built -
upon surface associated with this project.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee is responsible for keeping the stormwater collection system on the lot
clear of debris, and keeping the site stabilized in accordance with the requirements of the NC Erosion and Sediment Control Design Manual.
4. Bailey & Associates, shall, at all times, provide the operation and maintenance
necessary to assure the permitted stormwater management system functions at
optimum efficiency. The approved Operation and Maintenance Plan must be followed
in its entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch -basins
and piping.
g. Access to the outlet structure must be available at all times.

14. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
Ill. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director. In
the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this
-.-request will be considered on its merits and may or may not be approved.. The - .-
permittee is responsible for compliance with all terms and conditions of this permit
until such time as the Director approves the permit transfer.
2. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
4. In the event that the offsite stormwater facilities fail to perform satisfactorily, including
the creation of nuisance conditions, Bailey & Associates is responsible for taking
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
5. The permittee grants permission for DENR Staff to enter the property for the purpose
of inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
7. The permittee shall notify the Division} of any name, ownership or mailing address
changes within 30 days.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS

A complete stormwater management plan submittal includes a stormwater management permit application, an
off -site system supplement for each off -site stormwater treatment system, appropriate supplement forms for any
on -site stonnwater treatment systems, and plans and specifications showing all stormwater conveyances and
drainage details for the project.

IV. STORMWATER COLLECTION SYSTEM MAINTENANCE REQUIREMENTS
1. Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time.
2. Accumulated sediment and'trash will be cemoi+ed from the collection system'as necessary.' Swales and
ditches will be reseeded or sodded following sediment removal.
3. Eroded areas of swales and ditches will be repaired and reseeded. Swales and ditches will be revegetated as
needed based on monthly inspections.
4. The collection system, including catch basins, curb cuts, velocity reduction devices, and piping, will be
inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be
cleared away from grates, curb cuts, velocity reduction devices, and piping.
5. The collection system may not be altered in any way without prior approval from NCDENR Division of
Water Quality.

Dear Mr. Marshall:
A review of the Stormwater Management Permit Application regarding the subject project,
indicates that as of this date, information requested on November 21, 2005, has not been
received in this Office within the stipulated timeframe. Per the requirements of Section .1009
(c) of the Stormwater Management Rules, this Office is hereby returning the subject
application as incomplete. The $420.00 application fee has been forfeited and a new fee will
need to be provided if you choose to resubmit this application in the future.
An inspection of the property will be conducted in the near future. You are reminded that any
construction of impervious surfaces on the property prior to receipt of a permit will constitute a
violation of 15A NCAC 2H.1000 and may result in the assessment of civil penalties. By copy of
this letter to the local Building Inspector, this Office is requesting that they consider withholding
the building permits and Certificates of Occupancy forthis project pending issuance of a
Stormwater Management Permit.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Bojangles Restaurant on January 10, 2005 with additional comments being received on
October 21, 2005. A preliminary review of that information has determined that the application
is not complete. The following information is needed to continued the stormwater review:
1. Please adjust the elevations in your hydraulic calculations to correspond with the
elevation used in the wet detention basin supplement.
2. Please explain the difference between the total project area and the drainage area. It
appears that all the site drains to the proposed pond.

Dear Rhonda:
Enclosed please find the following in response to your recent telephone comments regarding the
above -referenced project.
• Revised Project Plans (Three Sets)
• Revised Wet Detention Basin Supplement (Three Copies)
• Supplemental Calculations for the Detention Pond and Forebay Volumes
(Three Copies)
I have adjusted the pond contours and outlet structure by a uniform value of-68.38' to tie the
project to the NAVD 88 datum as requested by the City of Jacksonville. The relative elevation
of all stormwater pond components still remains the same. I have modified the wet detention
supplement to account for these changes.
I have added a berm across the detention pond in an effort to force the incoming flow into a more
circuitous flow toward the outfall structure_ This flow pattern will help to increase the effective
length of the pond. I hope that this change will be satisfactory.
In modifying the pond's geometry, we have adjusted the length and width to keep the same
permanent pool surface area. I have provided supplemental calculations of the pond and forebay
volumes.
We have changed the outlet trash screen to have Four -inch on center bar spacing. We also added
a planting plan for the vegetative shelf: The invert elevations of CB 98 and CB #15 have been
adjusted.
