Dear Mr Penton
Michael F Easley, Governor
William G Ross Jr, Secretary
North Carolina Department of Cnvtronment and Natural Resources
Alan W Khmek, P E Director
Division of Water Quality
On December 14, 2006, the Division received your request to transfer this permit
Unfortunately, only a portion of the necessary documentation was provided Please provide
the following items to continue the processing of this permit transfer
1 Please provide documentation of Mr Norment's status as the President of Shoreline
at Seagate Homeowner's Association
2 Does Mr Norment live in the project, or is he an employee of yours, or of Atlantic
Rental Management? The permit cannot be transferred to the management
company or to the HOA if the president or vice-president are employed by you or the
management company The permit must be transferred to the HOA and the person
signing the transfer form and the Operation and Maintenance plan on behalf of the
HOA must be the president or vice president of the HOA and a person who lives in
the project and is not affiliated with you either professionally or personally
3 The Division received only -page 4 of the required Operation and Maintenance plan
Unfortunately, that O&M refers to a wet detention pond, however, the project was
permitted for an infiltration basin A separate O&M Plan was sign by a Manager of
Shoreline at Seagate HOA, but the signature is unreadable, and the document does
not cover all of the required maintenance items as found on the infiltration basin
supplement form, attached Please have the duly recognized president of the HOA
sign, date, notarize and return the attached 0 & M document
If you have any questions, please do not hesitate to call me at (910) 796-7335
Sincerely,
Linda Lewis

IV. INFILTRATION BASIN OPERATION AND MAINTENANCE AGREEMENT
1 After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion,
trash accumulation, vegetative cover, and general condition
2 Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow
vegetated cover to maintain a maximum height of six inches, and remove trash as needed
3 After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow
structures for blockage and deterioration Remove any blockage and repair the structure to approved
design specifications
4 Remove accumulated sediment from the pretreatment system and infiltration basin annually or when
depth in the pretreatment unit is reduced to 75% of the original design depth The system shall be restored
to the original design depth without over -excavating Over -excavating may cause the required water
table separation to be reduced and may compromise the ability of the system to perform as designed
Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner
that will adversely impact water quality (i a stockpiling near a stormwater treatment device or stream,
etc )
A benchmark shall be established in the pretreatment unit The benchmark will document the original
design depth so that accurate sediment accumulation readings can be taken The measuring device used
to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not
readily penetrate into accumulated sediments
When the design depth reads 1, S' feet in the pretreatment unit, the sediment shall be
removed from both the pretreatment unit and the infiltration basin.
5 If the Division determines that the system is failing, the system will immediately be repaired to original
design specifications If the system cannot be repaired to perform its design function, other stormwater
control devices as allowed by NCAC 2H 1000 must be designed, approved and constructed
I acknowledge and agree by my signature below that I am responsible for the performance of the five
maintenance procedures listed above I agree to notify DWQ of any problems with the system or prior to any
changes to the system or responsible party

continue the stormwater review
V1
Please either delineate all wetlands on site, disturbed or undisturbed, or note on
the plans that none exist
2
Please relocate the outlet structure to the point where runoff enters the basin
Infiltration must be designed as offline system, that is, the bypass of the excess
runoff must occur nor to the runoff entering the basin
/
3
Please verify that the correct corporate LLC name is 313 Greenville, LLC, and
not 313 Greenville Avenue, LLC The Secretary of State does not have a
corporation by the name of 313 Greenville Avenue, LLC, only 313 Greenville,
LLC Please be accurate when providing corporate names on the application

contours, spot elevations and finished floor elevations his is required to
demonstrate that all onsite impervious surfaces are directed into the basin and
that no offsite runoff comes into the basin, unless it has been accounted for
7
Vincent Lewis has indicated that a hardpan clay layer exists at 42" and that the
SHWT is at 40", which is in conflict with the submitted soils information The
minimum bottom elevation for this infiltration system is 18 67
/ 8
The overflow from all infiltration basins must go through a vegetated filter Since
the receiving stream is not SA, the filter must be 30' long Please add the
required filter and a detail (to include elevations, inverts, slopes, etc ) to the
plans

In answer to your questions
2 Infiltration system work differently than wet ponds Per
1008(d)(4) infiltration must be designed such that the excess
volume bypasses the system and does not flush pollutants through the
system I don't know what other infiltration basins you've designed
for the State in the past, but if they were designed in accord with
our criteria, then you should have either provided a bypass for the
excess design storm PRIOR to it entering the basin, or you should
have designed the basin to store the runoff from a larger design
storm If we permitted something that was not in accord with either
of these, then we are not obligated to repeat our mistake
7 I spoke to Vincent about this site He remembered it, and showed
me where he bored I took the approximate elevation of the existing
ground at the bore, subtracted 40" and added back 2' to get the
maximum bottom elevation Do you have any written records of the
visit and it's results> If so, please send them in
8 Infiltration systems will fail quicker if all the runoff is
directed into them for all of the storms Mr Penton will extend the
life of the infiltration basin by installing a bypass However, the
bypass and filter requirements can be waived if the basin can be
designed to hold additional volume (the Division determines the
design storm to be used) For this site, with a restrictive clay
layer and fairly high water table, my judgement would be to use a
design storm of 2" and require the excavation of the clay layer
under the basin, and backfilled with suitable soils
9 Allowing the runoff the spread out naturally across a flat area
usually results in one area of the infiltration basin being used
over and over again, with the other areas utilized only during
really large storms The type of flow spreader mechanism needed is
something that will allow the runoff to be transported to all parts
of the basin on a fairly equal basis I'll leave the specifics to
you, however, one design I have seen that appears to work well is
infiltration piping cut in half, anchored into the bottom of the
pond, and laid in a patten that forces the incoming runoff to be
distributed evenly

Re 313 Greenville Avenue - SW8 041210
W
,
I am in receipt of a copy of your 2/14/05 "Request for
Additional Information" concerning the 313 Greenville
Avenue project (SW8 041210), and would like to attempt
to resolve some of your concerns, and also request
clarification on some items, prior to re -submittal.
1. There is already a note at the top of sheet 1 of 3
which states that "no wetlands exist onsite."
2 I think that I understand your concern with the
outlet structure location (dirty, 1st inch of water
from initial rain should infiltrate & everything after
should bypass), however, the same scenario takes place
on a pond. In that case, you want to see the outlet
structure located at a 3:1 distance from the
entrance. I feel like the placement of the outlet
structure further away from the entrance to the basin
is more beneficial, giving TSS a chance to settle out
before they exit the system while the excess water
travels across the basin. Further more, the logistics
of placing the outlet next to the entrance are very
difficult. Finally, all of the infiltration basins I
have seen and/or designed in the past have not had to
meet this requirement. Please consider my comments.
3 I have changed the owners name to properly
represent the correct LLC. The re -submittal will
reflect the changes.
4. Documentation of the Manager/member status will be
provided with the re -submittal.
5. Dimensioning will be provided on the re -submittal.
6 The grading plan from the construction drawings
will be included with the re -submittal.
7 I'm confused of how you came up with the minimum
bottom elevation of 18.67, because that elevation is
above the existing ground where Vincent performed his
test. The rules for infiltration basins (if I'm
reading the application correctly) state that there
2 of 4 2/21 /2005 8 22 AM
Re 313 Greenville Avenue - SWS 041210
n
must be a 2 ft separation between the SHWT and the
structure bottom and a 3 ft separation from any
impervious soil horizon and the bottom of the j
structure. Vincent did not encounter any
groundwater during his test, so I am again confused
about your statement that the SHWT was at 4011, despite
the fact that the impervious soil horizon separation
requirement takes precedence over the SHWT separation
requirement in this case. According to my
calculations, if the existing ground at the test
location is 17.5, then the imp. soil horizon is at
14.0, and the bottom of the structure must be 17 or
higher. We will confirm the ex. ground location
elevation prior to re -submittal.
8 On the last infiltration basin I had permitted,
there was an exception to the vegetated filter rule if
the basin met the 25 yr, 24 hr event requirements for
flow rate, and the 10 yr, 10 min requirements for
volume. Does this project qualify for this exception
if it meets those requirements)?
9. What is a flow distribution mechanism The basin
bottom is proposed as flat. The water should spread
out naturally.
10 There is already a not on sheet 2 of 3 stating
that "all roof drains must be directed to the
stormwater system and or parking lot." I will place
this note on all other sheets that apply
I will await response from you prior to re -submittal,
namely on items 2, 7, 8, and 9. I look forward to
working with you to resolve these issues.
Sincerely,
Howard Resnik, PE

ECS Pro3ect No 22 11131
Dear Mr Penton
Engineering Consulting Services, Ltd (ECS) recently oinducted an infiltwtiotl evaluation for
313 Greenville Avenue in Wilmington, North Carolina This letter, with attaohmcnts, tS the
report Of our investigation
Field Investigations
On December 2, 2004, ECS conducted an investigation of the subsurface soil and ground water
oonditcons at the proposal Storm water infiltration at the. requested location shown on the
attached Site Sketch The purpose of this investigation was to obtain subsurface ►nforamtion of
the suitability of the in -place soils for tic infiltratioa of ,;wrm water runoff We tnvestigated the
subsurface soil and ground water conditions by drilling one hand auger bonng to a depth of
approximately six feet below the existing ground surface We visually classified the qubsurface
soils dnd obtained representative samples of each bod type encountered We also recorded the
ground water level observed at the tithe of the hand auger boring The attached Infiltration
Evaluation Form Provides a 6urnmairy of the subsurface conditions encountered at the hand
auger boring location
Our field classification indicuad that the subsurface sods at the test location consisted of a
strata of topsoil overlying a strata of gny fiite to medium sand overlying a Strata of gray clayey
sand to sandy clay
Ground water war encountered at the time of our exploration at the test location it a depth of 72
inches below the existing ground surface The seasonal high ground; water level at the test
location is approximately 4$ inches below existing surface grade
We have conducted an infiltration test scar our band auger boring to estimate Infiltration rates
for the subsurface soils The infiltration test was conducted within the upp4r stratum of silty
sends, where the base of as infiltration system will need to be at least 24 inches above seasonal
high round water levels The result of this test is sunrunanzed on the Intiltration Evaluation

At the rcquested location, the infiltration test was perkrmed 8l a depth of approximately 24
inr.hcs Wow surface grade and indicated an infiltration rate of 12 00 inches per hour
It is likely that the Seasonal high groundwater conditions and infiltration rates can vary across
this site due to naturally occurring soil types and because of the surface topography
