Matthews & Bell Cove, LLC Bell Cove Multi -Family Coast Guard Road & NC 58, Emerald Isle, Carteret County FOR THE construction, operation and maintenance of two underground infiltration trenches in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until December 3, 2014, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 on page 3 of this permit. The stormwater controls identified as 1 and 2 on the plans have been designed to handle the runoff from 28,954 ft2 and 23,315 ft2, respectively, of impervious area. Each trench must be operated with a 50' vegetated filter. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per the approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the appropriate permitted stormwater control system, per the approved plans and calculations. Classification of Water Body: "SA" II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. MowinQ and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. Page 3 of 7 State Stormwater Management Systems Permit No. SW8 permit# 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. Page 4 of 7 State Stormwater Management Systems Permit No. SW8_permit# lll. GENERAL CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. Permit issued this the 3rd day of December 2004. Description of Project PROJ # SW 04-i1 { 7j 1. Type of Development Bell Cove is being proposed as a multi -family condominium project with the required parking, a club house and pool and is located within the Town of Emerald Isle's planning jurisdiction. The development is being divided into two phases as indicated on the plans. 2. Earth Disturbing Activities a. Demolition, excavation and grading for the installation of drainage and utility improvements. b. Grading for the construction of proposed buildings and parking, including bulkheads. 3. Drainage The property is located on the north side of Coast Guard Road at the corner of Highway 58 (Emerald Drive) and Coast Guard Road. The site drains to Bogue Sound which is classified as ORW. The project is not affected by the 575' AEC line associated with draining to an ORW waterbody, therefore we are proposing an underground infiltration stonnwater treatment system that has been sized for a 2" rainfall, per the requirements of the Town of Emerald Isle. Erosion and Sedimentation Control Measures The following measures are proposed for the site. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete. 1. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off -site sedimentation is controlled. Fencing will also be placed around all drop inlets as shown on the drawings. 2. Seeding — All disturbed areas will be seeded within 14 days following construction in accordance with the seeding schedule shown on the plans. 3. Stone Construction Entrance — Stone construction entrance will be used to reduce the transport of sediment off site. 4. Riprap outlet protection — Riprap to be installed at locations shown on plans to reduce energy at high velocity areas. 5. Temporary Sediment Traps — Sediment traps will be constructed as shown on plans and serve to trap sediment and prevent from the sediment moving off site in concentrated areas. During the construction phase there will be additional sediment storage around each drop inlet and protected with silt fence. Maintenance Plan 1. All erosion and sediment control measures shall be checked for stability and effective operations following every runoff producing rainfall event or at least once per week. Repairs required shall be completed immediately to the dimension and functions indicated on the plans. 2. Sediment shall be removed form behind the sediment fencing when it becomes 0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary to maintain a barrier. 3. All seeded areas shall be fertilized, seeded and mulched within 15 days of disturbance. Disturbed areas shall be fertilized, reseeded and mulched as necessary according to the Contract documents to establish and maintain a dense vegetative cover. 4. Sediment shall be removed from the sediment traps when the capacity has been reduced by fifty (50) percent. C. Construction Schedule (One phase only) 1. Obtain plan and approval and other applicable permits. 2. Initiate demolition, clearing and grubbing operations in applicable areas. 3. Install temporary gravel construction entrance. 4. Construct all temporary sediment traps as indicated on the plans 8. Rough grade site. 9. Install stormwater collection system with erosion control measures specified for inlets, including the infiltration system. 10. Construct buildings and install gutters as specified on plan. 11. Construct parking lot, drives and sidewalks. 12. Remove any accumulated sediment form the stormwater treatment collection system. 13. After site is stabilized, remove remaining temporary measures and install permanent vegetation on disturbed areas within fourteen days of land disturbance. 14. Prior to initiating Phase 2, Phase I shall be stabilized. D. Design Assumptions 1. Design storm is ten years. 2. The rational method was used for the design. E. Infiltration Basin and Trench Operation and Maintenance 1. After every runoff producing rainfall event and at least monthly inspect the bypass/overflow structure for blockage and deterioration and the infiltration system for erosion, trash accumulation, grass cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash and blockages as needed to maintain system performance. 3. Remove accumulated sediment annually or when depth is reduced to 75% of the original design depth. Restore depth to original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. 4. The water level in any monitoring wells will be recorded after a 1 inch rainfall event and at least once a month. Chronic high water table elevations (within I foot of the bottom of the system for a period of three months) shall be reported to DWQ immediately. 5. If DWQ determines that the system is failing, the system will immediately be repaired or replaced to original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed. 6. Remove accumulated sediment from the infiltration system annually or when depth in the unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without overexcavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the depth at the benchmark reads 3.50', the accumulated sediment shall be removed from the system. F. Coastal Stormwater Regulations The North Carolina Division of Environmental Management implemented coastal stormwater regulations in coastal counties on January 1, 1988. These regulations are detailed in 15 NCAC 2H.1000 Stormwater Management. These rules allow for a development to be considered under various options. NCDENR-DWQ "Stormwater Management" rules and regulations (NCAC 15-2H-.1000) were used as guidelines in making this evaluation. The proposed areas for stormwater infiltration usage were evaluated in particular. The proposed project is greater than 1 acre in size, has >25% impervious surfaces, and drains to Class O.R.W. - S-A. Waters within Bogue Sound. If a project drains directly to Class S.A. Waters or their unclassified tributaries, stormwater must be treated by infiltration basins or an equivalent alternative method. This tract appears to drain to S.A. Classified Waters. Thus on this tract, stormwater would be managed through infiltration treatment systems or their equivalents. The tract is situated on typical ridge -slough beach dune topography, with excessively well drained sandy ridges at --15 - 28 ft elevations, and poorly drained sandy sloughs at --8 - 11 ft elevations. The portions evaluated crossed the extremes of this topography. Portions of the sloughs have been historically filled through USACOE. Principle soil and site requirements for an infiltration system are: --the infiltration system's bottom must be 2 ft or greater from the seasonal high water table; --must be capable of complete draw - down within 5 days; ---the soil's hydraulic conductivity must be >0.52 inlhr; —recent fill material is not usable; —historic fill materials (<1977) can be used if it meets the minimum site criteria stated above. The enclosed land & soils map shows the various land/soil types found (see soils map). The following are brief descriptions of these land & soil types for stormwater infiltration usage: The "Green" Areas (see soils map) are excessively well to well drained, sandy natural soils that are +10 ft thick. These soils have an estimated seasonal high static water table +48 to 120 inches from the present surface based upon soil wetness indicators, which should coincide with the -r9 - Page 1 of 10 ft elevation levels. Estimated permeability is +10 -20 in/hr to >48" depths. These soil types should be considered as usable for infiltration stormwater systems. Pending location within the tract, the bottom of any infiltration basin could be 2 - 14 ft into the present ground surface. Recommended design application rates are 5 -10 in/hr. These areas should be capable of accommodating typical infiltration basin, infiltration panels, or infiltration tubing with filter cloth & rock. Soil types found are Fripp. The "Yellow" Areas (see soils map) are well to moderately well drained, sandy natural soils that are +10 ft thick. These soils have an estimated seasonal high static water table +24 to 48 inches from the present surface based upon soil wetness indicators, which should coincide with the -9 - 10 ft elevation levels. Estimated permeability is +5 -15 in/hr to >48" depths. These soil types should be considered as usable for shallow placed infiltration stormwater systems. Pending location within the tract, the bottom of any infiltration basin could be 0 - 2 ft into the present ground surface. Recommended design application rates are 3 - 7 in/hr. These areas should be capable of accommodating shallow placed infiltration basin, infiltration panels, or infiltration tubing with filter cloth & rock, with or without man-made sidewall berms. Soil types found are Fripp, Corolla, and Pactolus. The "Pink" Areas (see soils map) are somewhat poorly to poorly drained, sandy natural soils. These soils have an estimated seasonal high static water table 0 - <24 inches from the present ground surface, based upon soil wetness indicators, which should coincide with the -9 - 10 ft elevation levels. These soils types should be considered as unsuitable for infiltration stormwater usage due to shallow depth to seasonal high water table. The "Dark -Gray" and "Light -Gray" Areas (see soils map) are poorly to very poorly drained, with high organic surfaces. These areas are 404 Wetlands that are inundated to non -inundated. These soil areas are unsuitable for infiltration stormwater usage. These soils are typically in the lowest elevations between -7 - <10 ft contours. The tract has very diverse topography and natural drainage classes. The "Green" and "Yellow" areas designated on the soil map should be utilized for typical stormwater infiltration usage. In order to maintain the 2 ft separation buffer from the system's bottom, it should be above the -12 ft elevation levels_ The present plan appears feasible for the 2 southern most infiltration systems. The northern system appears to be in unsuitable natural soils or cut -fill sandy materials with poorly to somewhat poorly natural drainage conditions. Careful planning and design should be exercised to insure that adequate areas of these usable soil areas are reserved for stormwater infiltration treatment, and relatively preserved in their natural state. NCDENR-DWQ Stormwater Section should be contacted for their concurrence of any proposed development and stormwater management system. Soil logs can be provided upon request. Larry F. There was general discussion regarding the reasons for formation of Bell Cove, LLC. The three members reported that they had purchased property from Paxon M. Holz in 2002 at a purchase price of $1 million with Paxon M. Holz financing $500,000.00, W. Randy Campbell had paid $250,000.00 and Ronnie Watson and Stephen E. Matthews had each paid $125,000.00 towards purchase of the property, and the property was held by the three parties as follows: W. Randy Campbell - 50 % undivided. interest Ronnie Watson - 25% undivided interest Stephen E. Matthews - 25% undivided interest The members reported that they had secured approval for the re -subdivision of Tracts 1 and 2 of the commercial division on Reed Drive which they had purchased from Paxon M. Holz from the Town of Em,eiald Isle, and that they planned to develop the property into a mixture of commercial acid residential uses. There was a strong possibility for the sale of the commercial tract on Coast Guard Road with the remaining property to the northwest being developed as a mixed presidential and commercial community. Members proposed to borrow the necessary funds from Branch Banking & Trust Company in order to pay off the $500,000.00 note and deed of trust due Paxon M. Holz, and following discussion of the purposes and the direction in which the members intended to take the company, the meeting then preceded to the election of managers. Upon nominations being duly made and seconded, it was moved that W. Randy Campbell, Ronnie Watson, and Stephen E. Matthews serve as Co -Operating Managers, that Stephen E. Matthews serve as Secretary, and that W. Randy Campbell serve as Treasurer. Randy Campbell - 2,500 shares representing his $250,000.00 contribution; Ronnie Watson - 1,250 shares representing his initial contribution of S 125,000.00; Stephen E.
