Due to a misinterpretation of the rules, staff required a permit for the wastewater treatment facility and for the two subsequent redevelopment projects. After meeting with the Coast Guard on October 20, 2009, regarding the 3 separate building projects at this site, the WWTF expansion, the Armory foundation, and the Public Works Building Replacement, the Division agrees that the projects are not subject to State Stormwater permitting at this time due to the following: 1. None of the proposed projects is located within the drainage area of the previously approved BMP; 2. None of the projects require a CAMA Major or a Sedimentation Erosion Control Plan; 3. None of the projects exceed 10,000 square feet of new built -upon area. Please keep in mind that this determination applies only to the current proposed activities. Future disturbance or construction of impervious surfaces in excess of 10,000 square feet, or such that either an Erosion and Sedimentation Control Plan or a CAMA Major permit is required, will result in the requirement to submit a Stormwater Management Permit application prior to construction. The purpose of the meeting was to discuss three projects the USCG is proposing to conduct at our Sector North Carolina facility located at 1305 East Fort Macon Road, Atlantic Beach, Carteret County, North Carolina, in reference to whether the projects were subject to the state storm water requirements. The USCG Sector North Carolina facility is presented in Enclosure (1) Construction Drawings T-01. Based on that meeting, the USCG is providing you with this submittal summarizing the three proposed projects and the rationale for determining why those projects are not subject to the North Carolina's State Coastal Storm Water requirements promulgated under Session Law 2008-211 State Senate Bill 1967. In order to establish existing conditions at the facility, Construction Drawings T-01 sheet 1 of 2 in Enclosure (1) shows an approximate 5 acre area at the southwest portion of the site which is subject to the existing State Storm Water Permit SW8 040405. Additionally, Construction Drawing T-01 sheet 2 of 2 in Enclosure (1) documents the current impervious surfaces / built upon areas at the facility. The three proposed projects are summarized below and their locations are shown on Construction Drawing T-01 sheet i of 2 in Enclosure (1): o Replace the Waste Water Treatment Plant (WWTP): The USCG proposes to remove and replace the W WTP and drain field. The location of the W WTP will not change. The total land disturbance for this project is conservatively estimated to be 0.8 acres. The total built upon area is 1,630 square feet. o Install Armory Foundation: The USCG proposes to provide a concrete pier -type foundation for the Armory. The location of the Armory will not change. The total area of the Armory is 250 square feet. Because the Armory is already on -site, there is no net increase in built upon area. o Construct a Public Works Building: The USCG proposes to remove the existing building B9 and install a new Public Works Building on the footprint for building B9 and in the gravel parking area northeast portion of building 139. The Public Works Building is proposed to occupy a 2400 square foot area, but because it is being placed upon the footprint of building B9 as well as part of the gravel parking area, there will be no net increase in built upon area. First, since the three proposed projects are located outside of the Permit S W8 040405 drainage area, they are not subject to that permit. Secondly, to be subject to the State 2008 Coastal Storm Water requirements, the three proposed projects must exceed one of the threshold criteria stipulated in the state law. The three proposed projects do not require Coastal Area Management Act (LAMA) major permits. The three proposed projects do not require Erosion and Sedimentation Control Plans since they do not disturb one acre or more. The three proposed projects to do not add more than 10,000 square feet of built upon area to the facility. Additionally, the area outside of the SW8 040405 drainage area will be eligible for redevelopment exclusion requests in accordance with the October 2008 rules if no net increase in impervious area is proposed and the redevelopment plan provides storm water control equal to or better than the previous development. Therefore, based on the threshold criteria stipulated in the NC Coastal Storm Water requirements, the three proposed projects are not subject to the NC Coastal Storm Water requirements. At the conclusion of the October 20, 2009 meeting, NCDENR Division of Water Quality staff were in agreement with this conclusion. Regarding the W W"VP proposed project, the USCG has already submitted a "State Storm Water Notice of Intent, SWG040000 - General Permit to Construct a Linear Utility Line and Associated Incidental Built -Upon Area" to NCDENR. During the October 20, 2009 meeting, it was determined that this General Permit was not required, and NCDENR returned the uncashed check application fee. Therefore, USCG will consider the permit application revoked. The USCG intends to implement the three proposed projects. It's really hard to tell from the site drawings. Some of the section views show the tops of the various components of the new plant above grade. If that's true, the amount of BUA reported on the application, 200 sf, seems a bit underreported. Can you please clarify? The meeting was held in the conference room of NCDENR DWQ in Wilmington, NC. The following items were discussed and the following decisions made: 1. The general scope of the three planned USCG projects was discussed. A. The wastewater treatment facility was discussed. The plant should incorporate removing an existing treatment vault and appurtenances and replacing it with a new on -site package treatment facility. The new facility will add approximately 1600 sf of BUA. B. The new Public Works building will involve removing an existing structure and replacing it with a new 2400 sf building. The new construction will create no net increase in BUA. C. The last of these planned projects will involve placing an existing armory on an elevated foundation. This project will result in a minimal or no net increase in BUA. 2. A brief review of the 2004 permit for the ATON Building was discussed. The building added approximately 2979 sf of BUA. No triggers for this project could be noted because it likely fell below the 1 acre permit requirement of that year's applicable requirements. NCDENR stated none of the three proposed projects would trigger the need for a permit because: A. They were smaller than the 10,000 sf minimum. B. They fall outside the 2004 permit area. C. Current requirements allow for staged development impacting less than 10,000 sf. 4. It was noted that the existing BMP (detention pond) is oversized by approximately 5,000 cu. Ft (30%). Oversized BMP could be applied to future developments on the site. 5. NCDENR would issue an administrative permit for the entire site, less what was permitted in 2004 could be pursued. Nothing would be "permitted" in this scenario, but NDDENR would be able to track the site through the permit. The would likely not be desired by creating multiple regulations For USCG Atlantic Beach. The following action items are to be completed by the USCG. A. The USCG has already submitted a "State Storm Water Notice of Intent, SWG040000 - General Permit to Construct a Linear Utility Line and Associated Incidental Built -Upon Area" to NCDENR for the Waste Water Treatment Plant proposed project. Since this General Permit was not required, the USCG will submit a letter to NCDENR requested this General Permit to be rescinded. NCDENR will respond back indicating their agreement and return the Permit application. During the meeting, NCDENR returned the encashed check application fee. B. As indicated in paragraph 5.A. above, the USCG will submit a letter to the NCDENR identifying the three projects discussed during the meeting, why these three projects are not subject to the NCDENR State Storm Water requirements, and provide the state with the current Site Plan. Sullins Director Subject: Site Visit for Technical Assistance Project Name: SW8 040405, USCG Fort Macon Location/County: Carteret County Dear CDR D'Orazio: Dee Freeman Secretary Since visiting Fort Macon on March 17th, I have discussed this facility's options for adding built upon area (BUA) with other Division staff, including the original permit writer. The reason your facility was issued a permit (SW8 040405) for only a portion of the site is because the test of the site was built before stormwater regulations were in effect in North Carolina (before 1988). The permit therefore only addressed the area that was adding impervious surface, and did not address the pre-1988 portion of your site. Any impervious area added after 1988 needs to be covered in a State Stormwater permit. The intent of the site visit was to discuss rebuilding a structure washed off its foundation by a hurricane, and I understand that there is also a desire to build an armory. Any other projects that have added BUA since 1988 and are not covered in a State Stormwater permit must be addressed in the permit modification. We discussed that there may have been projects that created impervious area at the facility that are not covered in the permit. Technically, any impervious areas that have been constructed at your facility since 1988 and are not covered under a State Stormwater permit are in violation. The Division will seek to bring any non- compliant areas of your facility into compliance, but will work with you to do so through the permit modification process. Unfortunately, your options will be more limited than i had originally thought. The redevelopment exclusion offered under the 2008 Coastal Rule (SL 2008-211), is not available to this site because only sites developed prior to 1988 and which do not currently hold a State Stormwater permit can apply for the redevelopment exclusion. Because your project currently holds a State Stormwater permit, it will require either a minor or major modification under the 2008 Coastal Rule. A major modification will be required if there is a net increase in permitted BUA (over 92,701 ft2) at your facility or if the existing stormwater best management practices (BMPs) have to be increased in size to accommodate the additional runoff resulting from adding BUA. Major modifications for high density projects draining to SA waters must control and treat a volume equal to the difference in the pre and post 1-year, 24-hour storm. The existing high density permit for this facility, SW8 040405, was issued on December 8, 2004 and lists a drainage area of 223,027 sq-ft including 92,701 sq-ft of impervious area. The impervious area included 19,276 sq-ft of buildings, 28,200 sq-ft of streets, 35,983 sq-ft of parking, 8,528 sq-ft of sidewalks, and 714 sq-ft of "other" built upon area (BUA). Water is treated in an infiltration basin before it discharges into the Bogue Sound, which is classified as shellfish waters (SA waters). It is my understanding that the proposed armory would add 296 sq-ft of impervious area for a total of 92,997 sq-ft of impervious area. I also understand there were some challenges in directing the water to the infiltration basin when the original permit was issued, and that it may be difficult to direct the water resulting from adding the armory to the existing infiltration basin. The current permit was issued under the 1995 version of 15A NCAC 2H .1000. This rule was modified in 2008 under SL2008-211. The items covered by your existing permit will continue to be permitted under the 1995 rule. However, new impervious areas will be covered by the 2008 version of the rule. I have attached a copy of this rule for your review. The 2008 rule sets or increases several new requirements. First, the required design storm has increased. Projects draining to SA waters must collect and treat either the volume resulting from the 1.5" storm or the volume difference between the lyr24hr storm's pre and post conditions; whichever is greater. Your engineer will be able to direct the water resulting from the Armory to the basin, and if so, he/she can determine if the existing basin is large enough to contain the additional volume. There are other new requirements, but I do not have enough information to determine whether or not they will cause any reason for concern. For instance vegetated buffers are now required (30ft for redevelopment), if the site discharges to wetlands it must do so non-erosively (the velocity must be less than or equal to 2 ft/sec), projects draining to SA waters must demonstrate that there will be no direct point of discharge to SA water [see Section 2(b)(1)(c)), and there is now a requirement that the bottoms of infiltration basins need to have 2ft of clearance from the seasonal high water table (SHWT). Please have your engineer review the 2008 Coastal Rule, propose a design, and submit an application. If the engineer has questions during the design process, please have him or her contact me. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Access to the stormwater facilities for inspection and maintenance shall be provided at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. Stormwater Treatment Narrative Group Fort Macon is a United States Coast Guard facility and is located near the far eastern tip of Bogue Banks Island in North Carolina. The installation is located on the Bogue Sound side of Bogue Banks near Beaufort Inlet across from the mainland town of Morehead City. The adjacent property (-385 acres) and waterfront is owned by the State of North Carolina and serves as Fort Macon State Park. The construction of the existing 27-acre (inclusive of sound property) facility was started in 1924 after land was donated to the U.S. Treasury Department. Significant improvements/additions have been constructed over time during different periods including the late 1930's, the late 1940's, the 1960's, the 1980's, and the 1990's as the Coast Guard's requirements and mission changed. The typical tidal range is 3.1 feet based on the tide tables with a spring tide range of 3.7 feet. All elevations provided in this report and on the drawings are referenced to NGVD (National Geodetic Vertical Datum). As for the existing stormwater system, overall, very little of the installation's current impervious area stormwater is being treated. Most of the impervious area runoff is drained directly to the Sound or to a single, undersized catch basin/pipe system that also drains directly to the Sound with no treatment. Therefore, the construction of any stormwater treatment facility is going to be beneficial to water quality. Reconstruction of the existing drainage system was not included in the cost estimates since the entire system is undersized and would need to be replaced. This would be a project separate from the development of treatment systems to allow construction of the buildout proposed in the Master Plan. Also, with development of the Master Plan the overall impervious area percentage for. the entire facility will actually decrease from 46% to 43% further improving water quality from the existing condition. Based on discussions with NCCAMA and NCDWQ personnel and the results from a preliminary study, a preferred alternative was investigated for stormwater treatment. The finalized alternative consisted of the installation of a combination storage facility (dry pond) behind the main building on campus and an infiltration system at the existing volleyball court to treat 5.12 acres of the site (including the new ANT building area) at a cost of $136,000. As designed, stormwater collects in the storage facility by gravity drainage and is then pumped to the infiltration basin/field at a rate of —175 GPM (please see the attached plans). The infiltration basin/field consists of numerous laterals which will spread out the flow over an area of 30' by 65'. The infiltration basin/field will be constructed of clean sands with an infiltration rate of at least 20 in/hr. The infiltration basin/field has been oversized to allay any concerns about the seasonal high groundwater table and the fact that it will treat 5.12 acres. At the end of each lateral a cleanout is provided for maintenance, and a benchmark for sediment cleanout is also provided at the storage facility. Once the benchmark elevation for sediment storage is reached in the storage facility it should be cleaned out, and the lateral pipes should also be inspected and sediment removed from them using the cleanouts provided. The sediment within the infiltration basirdfield will be replaced once the Division of Water Quality determines that the system is not functioning as designed. This will be easy to tell as the floodwater will begin expressing itself once the system has clogged to an unacceptable level. Overall, the construction of any stormwater treatment system will greatly improve water quality near the installation. The combined storage/infiltration system will treat 5.12 acres of the site that before were not treated at all. The future development plans of the installation will reduce the overall impervious areas percentage from 46% to 43%. Bioretention areas can also be used near the new Engineering Building to further improve stormwater quality at a later date once the designs have been completed. Specifically, our representatives performed the following work items on September 16 and 17, 2002: 1. Advanced one hand-augered boring near each of the three infiltrometer test locations in order to visually classify the in - place soils. A Munsell Soil Color Chart as used to define the hue and chroma of the recovered soil samples. 2. Conducted three double -ring infiltrometer tests at depths ranging from about 5 to 22 inches below the existing ground surface. This testing was conducted in general accordance with American Society for Testing and Materials (ASTM) procedure D-3385 entitled, "Infiltration Rate of Soils in Field Using Double -Ring Infiltrometer" . The shallow depth to water (ranging from 27 to 37 inches below the existing ground surface at the time of our field work) prevented our personnel from advancing the hand-augered borings below a depth of 4 feet. Our representative+ noted that the soils encountered below a depth of approximately 32 to 36 inches consisted of slightly silty sand with a trace of shells. The measured infiltration rates at test location I ranged from about 18 to 22 inches per hour with an average infiltration rate of approximately 19 inches per hour. At test location 2, the measured infiltration rates ranged from about 0.2 to 0.3 inch per hour with an average in£i.ltration rate of approximately 0.3 inch per hour. However, the Division would be more than happy to take this matter up again when the funding is allocated for this project. Either Linda Lewis or I would be more than happy to phone or write the folks who decide your funding and explain why' stormwater management measures are required by North Carolina, and why it would benefit water quality once in place. Neither Linda nor I understand exactly what's done at this facility, but I have read nothing that tells me that this proposed project is an essential component of homeland security. PARTIES: The parties to this UNDERSTANDING are the United States Coast Guard (USCG) and the State of North Carolina, Division of Water Quality (NCDWQ). 2. AUTHORITY: This UNDERSTANDING is authorized under the provisions of 14 U.S.C. SS 93(d), which authorizes the Coast Guard to cooperate with federal, state and private agencies. 3. PURPOSE: The purpose of this UNDERSTANDING is to set forth terms by which the USCG will construct a new Aids to Navigation (ANT) building prior to the completion of stormwater permit requirements set forth by the NCDWQ. 4. BACKGROUND: In a recent Stormwater Management Study (Attachment #1) conducted by Moffatt & Nichol Engineers, they identified that the North Carolina Division of Water Quality (NCDWQ) would agree to sign a Memorandum of Understanding (MOU) to allow the construction of a new Aids to Navigation (ANT) building at the Coast Guard Base Fort Macon in Atlantic Beach, North Carolina. The current ANT building was constructed in 1938 as an equipment building and was converted to an ANT building in 1977. In 2000, the Coast Guard began a design project to renovate the existing ANT building, but this design was deferred for future funding. In 2002, the scope of work was then changed to construct a new 2900 SF ANT building at another location on the base that would alleviate the current flooding issues found at the existing building site. The NCDWQ required that a stormwater management study be performed and ultimately a new stormwater system be installed prior to the construction of the new ANT building. During the study, Moffatt & Nichol Engineers met with the NCDWQ and identified that the Coast Guard had an operational challenge complying with their requirements. Due to the future stormwater system being located at the current ANT building site, the existing ANT building would need to be demolished prior to the installation of the stormwater system. This would displace the ANT crew and their equipment, which would be operationally unacceptable to the Coast Guard. In the meeting with the agency, it was identified that a MOU would be acceptable to the NCDWQ if certain provisions were made, which are discussed later. The Coast Guard has created a Master Plan (Attachment #2) for Base Fort Macon, which is a planning document that outlines future construction at the Base for the next 20 years. Although the Coast Guard has no obligation to construct any of the identified facilities, nor the funding obligated to do so, it is the most accurate planning document the Coast Guard has for the recommended future development at Base Fort Macon. For the basis of this MOU, the Coast Guard will utilize this Master Plan (dated April 2001) to identify the anticipated future construction at the Base that will impact stormwater permit issues. Therefore, the overall increase to total impervious layer would be minimal for the short period of time needed to construct the new stormwater system. Also, the attached Stormwater Management Study (Attachment #1) provides the analysis that determined the location of the fixture stormwater system. For the recommended location to be used, the ANT personnel must occupy the existing ANT building during the construction of the new ANT building, and the new stormwater system cannot be installed until the ANT personnel are relocated to the new ANT building. Therefore the only feasible order of construction for this scenario is: (1) construct new ANT building, (2) demolish existing ANT building, and (3) install new stormwater system. 5. RESPONSIBILITIES: The Coast Guard agrees to perform the following acts upon receipt of stormwater management pen -nit approval: a.) Construct new 2900 SF ANT building at Base Fort Macon in accordance with plans and specification. b.) Subject to the availability of funds, and upon completion of the new ANT building, demolish existing ANT building which will provide the necessary space for construction of the new stormwater system. The Coast Guard will work closely with the NCDWQ to determine an acceptable time frame that will be agreeable to all parties involved. c.) Subject to the availability of funds, design and construct a new stormwater system following the completion of the new ANT building and demolition of the existing ANT building. Again, the Coast Guard will work closely with the NCDWQ to determine an acceptable time frame that will be agreeable to all parties involved. d.) Discuss with the NCDWQ any changes to the Master Plan that may impact the stormwater management permit. e.)
