Dear Ms. Lewis,
My name is Suzanne Wessel and I am the President of the HOA at Plantation
LandinglSagewood. The site being developed under SW8 040220 by Clayton/Mungo is adjacent to
our community and fronts on the same street which is Plantation Landing Drive. I also live within 500
feet of this site.
I'm writing to request the NCDEQ re-examine the stormwater permit design for Villages at
Plantation Landing with intent to compel Clayton/Mungo to correct their stormwater
management system design before beginning construction. This is noted in the permit
compliance section #5.
The owner of the permit is ClaytonlMungo development group. Residents in close proximity to the site
development, including myself, have monitored the runoff/drainage from this site for months right up
to the extreme street flooding and muddy erosion sediment from Dorian. There is still standing muddy
water several hundred feet running east on Plantation Drive. The south side of the site drains during
every rainstorm. Muddy water seeps down the street for days after any rain. We have photo support
of this.
I viewed and copied the file for permit SW8 040220 and confirmed there are several design and
compliance violations on this site. The south site of this site has directed flow straight onto Plantation
Landing Drive which is in violation of the permitted design and contrary to the design statements. All
drainage is supposed to flow into the filtration basin on the north side of the site. It does not and never
has. The pictures attached taken on the south side give an inkling of the design flaws or intentional
departures: 1) b direct flow pipe sends uninterrupted flow onto our street 2) a culvertldrain pipe that is?
supposed to direct flow into an infiltration basin but does not' Plus, it's not a solid pipe!
3) In addition, none of the compliance maintenance has been -done, retention/filtration pond '
maintenance, erosion control and cleanup, etc.)
New Hanover County has sent inspectors and erosion control engineers in response to numerous
complaints from property owners and the HOA. I am aware, the county manages quantity, the state
manages quality which covers design.
Please contact me at any time if you require more information and can offer our community some
assistance. We have worked hard in Plantation Landing to follow our permit guidelines for stormwater
management. The amount of water being directed unfiltered and unabated is unacceptable.
New developments should not be allowed to solve their draining issues by simply dumping it downhill.

On September 21, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project in response to a complaint by the adjacent HOA.
The project is located along Plantation Landing Drive in New Hanover County and is covered by
State Stormwater Management Permit Number SW8 040220 which was issued most recently on
April 16, 2019. The project is under construction, and I understand that you have been working
with Ms. Melissa Lyles of New Hanover County Erosion and Sediment Control to resolve some
known issues. Please ensure that the following are resolved so that the project can be certified
when it is completed. If a permit modification is needed to do so, please apply for a permit
modification.
1. The elevations of swales F4, F5 and F6 need to be verified.
2. Swales FI and F2 have interference with utility piping.
Please be advised that, as the permittee, you are required to comply with the terms, conditions and
limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative
Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation and
maintenance of the permitted stormwater system.
Please also note that any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the stormwater rules is subject to enforcement action as set
forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $2S,000 per day.

attach a copy of the inspection report for the subject project. I don't note any real problems other
than the basin needs to be cleaned up and the inlet and outlet need to be maintained and restored to
design condition.
Also, in regard to the ownership change, please ensure that Clayton Properties Group, Inc. is listed
with the NCSOS and include a copy of the NCSOS filing with the updated transfer application. The
paperwork you sent me indicates that they are a Tennessee corporation.
I also forgot to tell you that the document you provided earlier; i.e., the written consent of the CPG
Board, is essentially an authorization for all of those Assistant Secretary's to sign the permit
application. Per NCAC 02H.1040(1) this authorization document has to be signed by an "appropriate
authority", i.e., a person of at least the level of VP in the corporation. None of the folks who signed
that document have any title. Steven Mungo is the only VP listed.
