As noted in your Inspection Report, the stormwater pond has not been certified by Crystal Coast Engineering, PA. We have conducted an inspection on May 20th 2011 and sent our report to Coastal Contractors, Inc. with recommended measures to repair eroded areas and maintain the woody vegetation on pond slopes and specifically in the forebay. 2. We have concluded that the severe drought in Onslow County is the principal reason for the low pond overflow level. 3. See item #1. We are hopeful that this response addresses all concerns. Penuel PO Box 12037 Jacksonville, NC 28546 Subject: Request for Additional Information Stormwater Project No. SW8 040106 Coastal Contractors Inc. Office Site Onslow County Dear Mr. Penuel: The Wilmington Regional Office received a Stormwater Management Permit Application for Coastal Contractors Inc. Office Site on January 8, 2004. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1, Please either delineate all wetlands on site, disturbed or undisturbed, or note on the plans that none exist. 2. Please delineate the 5.57 acre drainage area. 3. Please specify pond side slope vegetation and the wetland species to be planted on the 6:1 shelf. 4. The gravel area is shown as sheet flowing into the pond. Please provide a catch basin and curbing for this area so that the runoff can be collected and directed into the forebay of the pond. 5. Please add the nearest intersection of two major roads to the vicinity map or note the direction to NC 24 on the vicinity map. 6. Please report the surface area provided at elevation 23.06 in the calculations to demonstrate that sufficient storage is available for the 1" volume. 7. Please review the orifice calculation. A 1" orifice is much too small to deal with over 16,000 cubic feet of volume. The calculations indicate that a 1.68" diameter orifice is needed to draw down the pond in 3.5 days. However, the consultant then rounds this diameter down to 1", which results in a 9.9 day drawdown time (see section 5 of the calculations at the top of the page). The best way to avoid rounding down too far is to obtain a range of sizes based on the 2 and 5 day flowrates, and pick one in- between. In this case, the size range is 1.4" to 2.2". 8. Please initial page 4 of the application and page 2 of the supplement. N, C. Penuel 1 IS Harold Avenue Swansboro, NC 28584 RE: Project Name: Coastal Contractors Inc. Office Site Project ID: Onslo-2004-185 Countv: Onslow Compliance Deadline: 14 days from receipt of this letter Dear Mr. Penuel: .Michael F. Easley, Governor William G. Ross Jr., Secretary On August 23, 2005, personnel of this office inspected a project located on Highway 17, Jacksonville in Onslow County, North Carolina. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act (Act) of 1973. The inspection revealed a land -disturbing activity of approximately 7 acres being conducted. It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, G.S. 113A-50 to 66, Title 15A, North Carolina Administrative Code (NCAC), Chapter 4. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations that were found are: Failure within 15 working days or 30 calendar days (whichever period is shorter) of completion of any phase of grading to plant or otherwise provide exposed, graded slopes or fills with ground cover, devices, or structures sufficient to restrain erosion. G.S. 113A-57(2). Slopes on the site are bare and vulnerable to erosion. To correct these violations, you must: Provide groundcover on all slopes on the site. Groundcover must be sufficient to restrain erosion. Wilmington Regional Office 127 Cardinal Drive Ext., Wilmington, North Carolina 28405-3845 • Phone: 910-796-72151 FAX: 910-350-2004 Notice of Violations Mr, Edward E. Penuel August 24, 2005 Page 2 of 2 Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until an adequate cover of grass or other ground cover (such as properly applied and secured, mulched seeding or appropriate rip -rap) is established which is, in fact, sufficient to restrain accelerated or man-made erosion. The penalty for an initial violation could be an assessment of up to $5,000.00. A time period for compliance is not required for enforcement of this violation pursuant to NCGS 113A-61.1(c) and NCGS 113A-64(a)(1). Therefore, the initial violation may be referred to the Director, Division of Land Resources, for appropriate action. Please be advised that i f these violations are not corrected within 14 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take appropriate legal action against you pursuant to NCGS 1 13A-64. That action could be the assessment of a civil penalty, and the amount may be up to S5000 per day for each day of the violation. The penalty maybe assessed from the date of the violation, NCGS 113A-64(a)(1). If the violations are corrected within the time period specified for compliance, no further legal action will be pursued. Please be advised that any new land -disturbing activity associated with this project should not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so that work can be inspected. You should not assume that the property complies with the Act until we have notified you. After installation, all erosion control measures must be maintained in proper working order until the site is completely stabilized. We solicit your cooperation, and would like to avoid taking further enforcement action. At the same time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the relevant statute and administrative rules may be examined at this office or will be sent to you upon request. Should you have questions concerning this notice or the requirements of the Act please contact either Janet Russell or me at your earliest convenience.
