North Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of 4 sand filters in compliance with the
provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit
This permit shall be effective from the date of issuance until September 17, 2014, and
shall be subject to the following specified conditions and limitations
I. DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater
runoff as described in Section 15 on page 3 of this permit The stormwater
controls have been designed to handle the runoff from the built -upon area within
the specified drainage area, as per Section 15 of this permit
3 The tract' will be limited to the amount of built -upon area indicated in Section 15
of this permit, and per the approved plans

4 The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system

ll. SCHEDULEIOF COMPLIANCE
1 The stor'mwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
2 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
3
3 The facilities shall be constructed as shown on the approved plans This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data
4 The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and revegetation of slopes and the vegetated filters
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of sand filter media, orifice devices,
vegetated filters, catch basins and piping
g Access to the sand filters must be available at all times
5 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ The records will indicate the date,
activity, name of person performing the work and what actions were taken
6 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations

7 If the stormwater system was used as an Erosion Control device, it must be
restoredAo design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
8 Access to the stormwater facilities shall be maintained via appropriate
easements at all times
9 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below _
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Project name change
c Transfer of ownership

d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further subdivision, acquisition, lease or sale of all or part of the project
area The project area is defined as all property owned by the permittee,
fdr which Sedimentation and Erosion Control Plan approval or a CAMA
Ma)or permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
10 The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction
11 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction
12 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
III. GENERAL CONDITIONS

1 This per"mit is not transferable except after notice to and approval by the Director
In the event of a change of ownership, or a name change, the permittee must
submit ajormal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate
The approval of this request will be considered on its merits and may or may not
be appr6,Ved The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request
2 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
3 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
4 In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
includingthose as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
5 The permittee grants DENR Staff permission to enter the property during normal
business hours for the pur ose of inspecting all components of the permitted
stormwater management facility
6 The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
7 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual

Site Description
The site, located approximately 2,800 feet east of the intersection of NC
Highway 210 and NC Highway 172, serves as the location for the Coastal Min,
Storage business The property is a 7 92-acre parcel of developed land
Currently, the site consists of approximately 0 13 acres of residential/commercial
buildings, 1 04 acres of commercial storage buildings and 2 12 acres of
impervious roadways The site is approximately 42% impervious
The site is can be generally described as consisting of two elevation tiers
The upper tier, generally at elevation 49 O-ft MSL, begins at the front of the
property, adjacent to NC Highway 172 The site gently slopes until the middle of
the property, where is slopes more significantly down to the second elevation
tier The second tier's elevation is generally 36 00 MSL The head of a natural
drainage swale is located near the middle of the property and runs to the
eastern property line This swale serves as the natural confluence point for the
property The site discharges to the east and ultimately to an unnamed tributary
of Everett Creek Everett Creek has a water classification of SA HQW The site
however, is located less than a mile and a half from these waters
Project Description
This Stormwater Management Plan accounts for existing and proposed
development of the site The existing site has an impervious area of
approximately 42% The proposed development, consisting primarily of
additional storage bays and asphalt roadway, would increase the impervious
area to approximately 46% An additional 1 52 acres of undeveloped, open land
will be purchased and added to the property Please see the plans for the
approximate location of the land acquisition
Stormwater runoff generated by the existing, proposed, and future
development will be treated primarily with sand filters Stormwater will be
collected and conveyed via roof drains, yard inlets, sheet flow, and HDPE pipe

After discussions with North Carolina Department of Environment and
Natural Resources, Division of Water Quality's staff, it was determined the best
option for stormwater treatment is by using surface sand filters Several sand
filters were designed, in accordance with NCDENR's Stormwater Management
Best Management Practices manual, to treat the project drainage area's runoff

Erosion Control Measures
Silt Fence
A silt fence will be constructed along the length of the down gradient
project boundary The silt fence will prevent sediment from entering the
existing ditches Temporary rock dams will be strategically placed along
the silt fence
2 Temporary Gravel Construction Entrance/Exit
An existing segment of gravel roadway will be utilized as the construction
entrance/exit This entrance/exit will provide a buffer area where vehicles
can drop their mud and sediment to avoid transporting it onto public
roads, to control erosion from surface runoff, and to help control dust
Construction Schedule
1) Obtain plan approvals and applicable permits
2) Flag the work limits
3) Hold pre -construction meeting
4) Install temporary gravel construction entrance

of rainfall are considered to meet the 85% TSS removal requirement In most of North Carolina, this
represents the runoff of over 90% of all storm events
3.2 Design Requirements
Sediment Chamber
• Volume = 540 ft3 per acre of drainage area
• At least 18 inches deep
• A surface area of at least 360 ftx /acre
• Positive drainage to this chamber either in conduit or surface drainage
• No outlet except to sand chamber
• Outlet to the sand chamber to result in sheet flow
• Volume = 540 ft3 per acre of drainage area
• At least 18 inches of sand particles less than 2 min average diameter
• A surface area of at least 360 fe /acre
• An outlet positioned and sued such that the sand chamber will drain completely in 24 hours ,
• No single outlet pipe sized greater than 6 inches, in order to provide a minimum of 12 inches of sand
above pipe
General
• Access to both chambers must be sufficient for all maintenance activities Because the sediment
from at least the first chamber will be somewhat wet when maintenance occurs, heavy equipment
access should be provided
• The filter must be designed to structurally withstand any load that is expected to occur (water
quantity, sediment quantity and surface loading)
The design parameters above assume an average filtration rate of 0 04 gal/min/ft with one foot of head
on the sand surface This rate is needed in order to allow the runoff from the first inch of rainfall to
pass through the filter within a period of 24 hours The effect of this is that each square foot of sand
must transmit approximately 62 gallons of water over a period of 24 hours This design assumes that
drainage through the sand chamber wilI be occurring throughout the duration of runoff Storms that
exceed one inch of runoff, depending on their intensity and duration, may overflow the sand filter In
these situations, runoff may not receive the same level of treatment as runoff from smaller storms
Where stormwater quantity control is required, runoff that will flow over the sand filter must be
considered in addition to the water flowing from the normal outlet from the sand filter
Two examples of sand filters are shown below The first example, Figures 4 and 5, is one that might be
used in an area where land values are very ingh, or where there are severe physical limitations in siting a
BMP This design uses a concrete structure and can be located or constructed in such a way as to occupy
no developable land The second example, Figure 6, is a sand filter that might be used on a project where
spatial limitations are present, but there is some land available for stormwater management This design
does not use the same precast -concrete structure that is used above, and would be less expensive to
construct, but would take more land area than the first example presented

3.3 Maintenance
' Regular maintenance is essential to the long-term performance and durability of the sandfilter, as it is
with all stormwater BMPs At least once a year each filter must be inspected after a storm to determine if
the filter bed is passing the runoff as expected Depending mostly on the activities occurring in the
drainage area, most filters will show some decreased capacity for filtration after a few years
Maintenance operations must be performed when storms of approximately one inch are not passing
through the filter within 24 hours Maintenance for sand filters consists of removing the first two or
three inches of discolored sand, and replacing this with new sand The sand that has been removed
would then be dewatered, if necessary, and then landfilled At the same time that maintenance is
performed on the sand chamber, the sediment chamber should also be primped and cleaned It is most
likely that the sediment removed from the first chamber will need to be dewatered before it will be
accepted at a landfill

Several weeks ago, I met with your consultant to discuss a resolution to the pocket of high
density issue at this site I was presented with a development scheme that included the
addition of 12 acres of site area An additional 300' of acreage was added on the east and
west sides of the protect, with the remainder located on the north side, in back of the
protect This scheme was approvable because it provided an open grassed area for the
runoff to sheet flow across prior to discharge, and centered the development within the
protect area
When the site plan was submitted for permitting, the 300' of area on each side had been
replaced by 15' of area down the east and west property lines, and the vast majority of the
new protect area was all located behind the protect It is the Division's opinion that the
scant 15' of new area has created a pocket of high density at the site and that this issue
cannot be addressed in the Express program in a timely manner
Please either provide at least 100' of site area on each side of this lot, or provide a non -
discharging engineered system to treat all of the runoff If 100' of site area is provided on
the east and west sides, the application can proceed under the low density option If not,
the application must be submitted for review in the regular program as a high density
protect

Thank you again for responding so quickly to our submittal I agree that the location of
undeveloped property is important in relation to the developed land The boundary of
the land acquisition shifted due to a misunderstanding between my client and me I
understand that altering the boundary of the acquisition would warrant further review
from your office
Although the existing property would no longer be surrounded on all sides by the
proposed land acquisition, please note that runoff for the whole project will still be
directed through vegetative buffer areas
The proposed plan for the east drainage area is to sheet flow runoff, via level spreaders,
through vegetative buffers ranging from 30-ft to 120' to an existing wetland area This
wetland area naturally drains to the east
The north drainage area will treat runoff by dispersing flow through a level spreader into
the northwestern portion of the proposed land acquisition, as previously planned
The treatment plan for the west drainage area, "DI-2", was modified slightly Treatment
will still be through a level spreader to vegetative area Due to the shift in the land
acquisition, the level spreader was moved to the north so as to be located behind the
boat & RV storage unit Flow will be diverted from the west to the level spreader via a
vegetated swale Please note that although the location of the level spreader has been
moved, the overall treatment concept for this plan has not changed Comparing the
previous plan to the latest submittal, both level spreaders drain to the same area The
level spreader was simply shifted from one contour (elev 35) to the next lower contour
(elev 34)
No in-depth study has been conducted to determine the future development potential of
the land acquisition However, based upon USGS quad maps, it appears that there is
significant land mass that is theoretically developable Please refer to the previously
submitted 8 5" x 11 " location map Please note that the existing property is
approximately 1,150-ft deep Referring to the USGS quad, tracking 1,150-ft back from
N C Highway 172, the topography indicates a broad tract of land at elevation 30, which
appears to be upland Note the significant positive drainage and relief surrounding this
tract to the north, east, and west

Thank you for your quick turn around I have corrected the plan based upon your
comments Due to a shift in the property acquisition boundary, I have made a few other
slight modifications I have summarized below the changes to the plan
Flow along the existing western property collects at the north end of the property and
discharges to the west We have collected the flow in a grass swale that will convey the
stormwater runoff to a level spreader, located behind a storage unit The swale has
been designed to ensure that non -erosive velocities are maintained for the selected
vegetation species In order to help dissipate the flow, a level spreader will be
constructed at the discharge point Calculations require a level spreader 132-ft A 132-
ft level spreader will be installed
Runoff from the proposed Building #3 and proposed supporting roadway will sheet flow
to the edge of pavement where it will enter a level spreader The level spreader will then
discharge the dissipated flow through a grassy, vegetated area before recharging the
existing wetlands Calculations require a level spreader 36-ft in length An 80-ft
spreader will be installed
Runoff from the proposed Budding #6 and proposed supporting roadway will also
sheet flow to the edge of pavement where it will enter one of two level spreaders (north
edge of pavement and south edge of pavement) The level spreaders will discharge to
grassy vegetated areas Calculations require a level spreader 65-ft, and 56-ft in length
A 70-ft, and 73-ft spreader will be installed (north and south, respectively)

Thank you for taking the time to meet with me yesterday I believe our meeting
produced direction and understanding that can hopefully bring resolution to this
project I have summarized below the key points from our discussion Please let me
know if I failed to include or misunderstood any items
In an effort to maintain qualification for a Low Density Permit, the Owner, Mr Charles
Yopp, has arranged to purchase approximately 12 acres of undeveloped land This 12
acre tract borders his existing property on three sides The 12 acre tract is currently
owned, collectively, by Mr Yopp and his siblings
Upon generally locating the site on a USGS Quad (Sneads Ferry), and after evaluating
the drainage patterns of both the existing and proposed site, we have incorporated level
spreaders into the Low Density Stormwater Management Plan
Flow along the existing western property collects at the north end of the property and
discharges to the west In order to help dissipate the flow, a level spreader will be
constructed at the discharge point Calculations require a level spreader 132-ft A 140-
ft level spreader will be installed
Runoff from the proposed Budding #3 and proposed supporting roadway will sheet flow
to the edge of pavement where it will enter a level spreader The level spreader will then
discharge the dissipated flow through a grassy, vegetated area before recharging the
existing wetlands Calculations require a level spreader 36-ft in length An 80-ft
spreader will be installed
Runoff from the proposed Budding #6 and proposed supporting roadway will also
sheet flow to the edge of pavement where it will enter one of two level spreaders (north
edge of pavement and east edge of pavement) The level spreaders will discharge to
grassy vegetated areas Calculations require a level spreader 36-ft, and 17-ft in length
A 70-ft, and 150-ft spreader will be installed (north and east, respectively)

Furthermore, geofabrics will be utilized to stabilize any fill slopes downgradient of the
level spreaders Calculations, Inherent to the sizing of the level spreaders, have been
made to ensure that non -erosive velocities will be maintained
In our meeting, we also discussed showing more topography in the proposed 12 acre
tract We have generated contours outside of the existing property by evaluating the
USGS Quad map and incorporating it with the property survey Therefore, please note
that the contours, outside of the existing property are not part of the survey provide by
Charles Riggs & Associates

The Wilmington Regional Office received a Stormwater Management Permit Application for
Coastal Mini Storage on April 16, 2004 A preliminary review of that information has determined that
the application is not complete The following information is needed to continue the stormwater review
The Division of Land Quality has indicated that wetlands are on the site Please have a
wetland consultant verify the location of the wetlands
2 Please confirm that the site is not located within '/ miles of SA waters
Please add the elevations to the storm drain inlets
4 Please either direct the drainage from the drainage area `Swale' to the stormwater system
or provide a high -density stormwater system to treat this area Also, provide additional
information on how drainage area DI-5 is getting to the pond Portions of this drainage
area appear to be draining off -site without being treated
Please revise the temporary pool elevation on the supplement to match the details and the
calculations Also, I calculated that the volume is met at elevation 33 93 Please raise the
temporary elevation to this elevation or higher
6 The volume in the forebay is too high The volume should not be greater than 22% of the
total pond volume at the permanent pool level The volume may be greater than 22% if
the bottom elevation of the forebay is the same as the bottom elevation of the main pond
Please reduce the volume in the forebay or lower the forebay bottom to be the same
elevation as the main pond bottom
Please note that this request for additional information is in response to a preliminary review
The requested information should be received by this Office prior to April 30, 2004, or the application
will be returned as incomplete The return of a project will necessitate resubmittai of all required items,
including the application fee

This office has received a soil erosion and sedimentation control plan for the project listed below which was
submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57(4))
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must obtain
approval of a soil erosion control plan prior to the commencement of said land -disturbing activity (NCGS 113A-54(d)(4))
The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving authority must
approve or disapprove the submitted plan within 30 days of receipt Failure of the approving authority to approve or
disapprove the submitted plan within the 30 day period will be deemed approval of the plan if the submitted plan is complete
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to the approval of an
erosion & sediment control plan is a violation of the Act
A copy of any erosion and sediment control plan which could involve the utilization of ditches for the purpose of
dewatering or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ) It is suggested that
you contact the Division of Water Quality at [phone] if any ditches shown on your plan will lower the water table
We have performed a preliminary review of your submitted plan and have determined that additional information
will be necessary before a final review can be completed Enclosed is a checklist of items that must be submitted before
we can complete the review process Failure to provide the additional information may result in disapproval of your plan
The approval of an erosion and sediment control plan is condition on the applicant's compliance with Federal and
State water quality laws, regulations and rules

I did a quick preliminary check of the plans Your official review date is on the
28th, but I think I have covered most everything Also, if you do choose to do
infiltration for the drainage area 'Swale', you will have to get a soils
investigation done to give you the infiltration rates We will meet you on the
site on the 26th at 10 am If there are any utilities out there, have ULOCO locate
them If those buildings were put in before 1968, then they are not required to go
to the pond You may want to check the building permits to verify These are my
ma3or comments
1 Was a wetland delineation actually done9 Please put on the plans who did the
delineation If the owner is the person saying there are no wetlands, he will need
to get a consultant out there to verify
2 Put the elevations on the storm drains
3 How is DA DI-5 getting to the pond? It looks like some of this is draining
off -site
4 The details and calcs show that the Temp Pool Elevation is 33 9, but the
supplement says 34 6 Please revise the supplement Also, I am calculating that
the volume is met at elevation 33 93, so bump the temp elevation up to 34 to have
enough storage Also, the forebay volume is too high We like to see a range of
18-22% You can store more that 22% in the forebay it the forebay depth is the
same as the main pool depth If it is shallower, then too much water is stored at
a shallower depth, adding to sedimentation issues So, make the forebay smaller or
deepen the forebay to be the same depth as the main pool
I think these are my main concerns I will follow up on Thursday when I get back

That is correct Coastal Mini Storage is located about 1/4 mile past the intersection of
172 and 210 I believe the Stormwater Project Number for this job is "SW8031206" As
it stands, DWQ had issued a letter to the owners of the facility, Mr and Mrs Yopp
Cavanaugh responded, on the Yopps' behalf, on January 7th, 2004 In our response, we
had told your office that we were working towards a January 30th submittal I fully
understand that I lust contacted you yesterday, but I suppose I was hoping I would be
able to sneak in for a few minutes before the 30th
I would prefer to meet with you before I submit the permit application February 10th
would work fine for me, would that still be acceptable to your office with regards to
pushing the submittal date to allow this meeting9

I am writing to you regarding stormwater management concerns at Yopp
Mini -Storage, located just outside of Holly Ridge, Onslow County If
you recall, Yopp was in the process of developing a stormwater management
plan for permit submittal when their engineer resigned from the project Yopp
has enlisted Cavanaugh to finish the permit application I have come on to this
project with the understanding that DWQ was not excited about the direction
the proposed stormwater management plan was taking Based upon the design
information that was transferred to me, the site will have a high percentage of
impervious area (definitely a HD permit), and the runoff will be treated in a
detention pond that incorporates a forebay
I was hoping to either meet with you, or speak with you briefly about this site
and the proposed stormwater management plan I am available at your earliest
convenience

This letter is in response to your letter to Mr and Mrs Yopp, dated December 9, 2003,
requesting a stormwater management permit application to be submitted for Coastal
Mini Storage in Onslow county This letter is being submitted at the request of, and on
behalf of, the subject facility and its owners The Yopp's have retained the services of
Cavanaugh & Associates to prepare a Stormwater Permit Application Package for the
subject property Cavanaugh has acquired the necessary field data and has begun the
design process We are diligently working to ready the package for submission as
soon as possible, but we do not believe the information will be finalized for submission
before January 9, 2004 as requested in the aforementioned letter
Based on the remaining work to be performed, we anticipate finalization of the design
and required supporting information such that the package may be submitted to the
Wilmington Regional Office by January 30, 2004 However, we will continue to work
towards an earlier submission if possible

On December 1, 2003, the Wilmington Regional Office received a copy of a Notice of Violations of the
Sedimentation Pollution Control act for the subject project The North Carolina Administrative Code requires any
project that must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to
apply for and receive a Stormwater Management Permit by the Division of Water Quality Any construction on
the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H 1000 and may
result in appropriate enforcement action by this Office
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form,
fee, and supporting documentation, or a written response regarding the status of this project and the expected
submittal date must be received in this Office no later than January 9, 2004 Failure to respond to this request may
result in the initiation of enforcement action, and construction may experience a subsequent delay
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter
must NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality
Supervisor Please reference the Project Number above on all correspondence If you have any questions,

Onslow County, North.Carolina This inspection wastiperformed;to,determine,compiiance',with{the�,Northtr
Carolina Sedimentation Pollution Control'Act of 1973 The inspection revealed gland -disturbing activity of
approximately 1-2 acres being conducted pl- ° ` "
It is our understanding that you and/or your firm are responsible for this land -disturbing activity A The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 1 13A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4 If you feel that you are not responsible
for the following violations, please notify this office immediately
The violations that were found are
1 Failure to file an erosion and sedimentation control plan with this office at least 30 days prior to

To correct these violations, you must
1 Submit a sedimentation/erosion control plan, Financial Responsibility Form and fee to the
Wilmington Land Quality Section I , x,
Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover"
or of "ground cover sufficient to restrain erosion,"- These requirements are not satisfied until a standing cover
of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or man-made

The initial one day civil penalty could be an assessment of up to $5,000 00 A time period for
compliance is not required for this initial one day civil penalty pursuant to NCGS 1 13A-61 1 (c) and NCGS'K
113A-64(a)(1) An initial one day civil penalty is being considered for this project ,
If the violations described in this Notice are not corrected within 30 days following your receipt of this
Notice, the Division of Land Resources may take additional appropriate legal action against you pursuant to
NCGS 113A-64 That action could be the assessment of additional civil penalties and may result in the
initiation of other remedies as prescribed by the Act If additional civil penalties are assessed for the violations,`
the amount may be up to $5,000 00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1)
If all violations are corrected within the time period specified for compliance, additional civil penalties or legal
remedies will not be pursued
Any new land -disturbing activity associated with this project should not begin until the area presently
disturbed is brought into compliance with the Act When corrective actions are complete, you should notify
this office so that the work can be inspected You should not assume that the site is in compliance with the
Act until we have so notified you In addition, once compliance has been achieved, all installed measures must
be satisfactorily maintained until development is complete and the site is fully stabilized to avoid further
violations of the Act

time, it is your responsibility to understand and comply with the requirements of the Act Copies of the
relevant statute and administrative rules may be examined at this office or will be sent to you upon request

recommendation concerns the violation of North Carolina General Statute 143-215 6A, Failing to apply for and receive
a permit required by NCGS 143-215 1 You have failed to respond to a request for a Stormwater Management Permit
Application on August 22, 1997

We have reviewed the material that you have submitted claiming that 0 23 acres of your
current land disturbance is a proposed agricultural activity, i e a future wheat field The limited size
of your wheat field may be an indication that the agricultural activity is not the original intent of the
tract and if limited to only 0 23 acres may indicate that the remaining land disturbing activity is still
one acre or more in size (1 25 - 0 23 = 1 02) In verification of the sincerity of your agricultural claim,
your wheat field should be no smaller than 0 40 acres in size, or,we would be forced to question the
actual size of your mini storage facility State personnel will inspect the field to assure for size
Provided that a field of wheat is indeed planted on this current land disturbing activity sufficient
to limit the remaining land disturbance under one acre in size, we will forego the plan approval
requirement and set aside the application at this time However, if any new land disturbing activity,
regardless of size, is begun on this tract, it will be considered phased development and plan approval
is necessary A failure to obtain that plan approval prior to beginning any new land disturbing activity
(again, regardless of size) will deemed a willful violation of the North Carolina Sedimentation Pollution
Control Act, and enforcement action will reflect that
Although the commerial venture, i e the mini storage facility, is to be under one acre in size,
all temporary and permanent erosion and sedimentation control measures called for on the plan
prepared by Mark Padgett must be installed and maintained Both Linda Lewis of the Division of Water
Quality's Stormwater Program and Janet Paith of the Land Quality Section will routinely monitor this
site for compliance If conditions indicate enforcement action is needed, this office will order a "stop
work" and all applicable regulatory requirements will be reviewed

This office has received a soil erosion and sedimentation control plan for the project listed below which
was submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57)
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land
must obtain approval of a sod erosion control plan prior to the commencement of said land disturbing activity
(NCGS 113A-54(d)(4)) The act further states that this plan must be filed a minimum of 30 days prior to the
activity and the approving authority must approve or disapprove the submitted plan within 30 days of receipt
Failure of the approving authority to approve or disapprove the submitted plan within the 30 day period will
be deemed approval of the plan Commencement or continuation of a land -disturbing activity under the
jurisdiction of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act
This land disturbing activity described in this plan is also subject to the Environmental Management
Commission's review of their regulations to implement stormwater controls in coastal counties (15 NCAC 2H
Section 1000) Contact the Water Quality Supervisor of the Division of Environmental Management to ensure
this activity is in conformance with their rules
