You have a problem First, I hope all is better with your son Second, I received a
call from Gordon Lovingood regarding the outparcel development adjacent the Hampton
Inn I sent him a request for additional information (dated February 11, 2004,
atatched) regarding the plan revision that you were a part of You were copied on
that letter
Mr Lovingood knew nothing about the plan revision and told me that Bryan English
is the owner Mr English *CANNOT * submit a plan revision for a permit where he is
not the permittee As the owner of the outparcel, Mr English has to submit for an
offsite permit
Also, I understand that the project is under construction Without a permit An
inspection will be performed today to verify Mr English will be sent a Notice of
Intent to Enforce, if he owns the outparcel, and if he is constructing without a
permit Please get in touch with him and tell him to stop construction and get an
offsite application together immediately

Here's what the site looks like as of about 2 20 today I directed Bryan to install that
additional silt fence yesterday evening As you can see, its there today) The one
photo where the silt fence is along the left side, if you look close, that stake with the
orange flagging is the edge of the parking lot The pond will go roughly where that
trailer is now A triangular looking thingy, lol
Also these photo's are so that you can make sure we keep our word to you Steve

If you go with a dry pond, please remember that you need another BMP, such as a
grassed Swale, either before or after the dry pond to achieve the 85% TSS removal
Dry ponds only account for 50%
My time line is running about 60 days for a review In order for Mr English to be
open on June 1, he should have the application in to me ASAP And make it perfect -
look at the previous comments I had for Dale's proDect and try to address
everything Don't leave anything blank on the application If something doesn't
apply ( and make sure it really doesn't) mark it N/A Be sure to send me the
original signatures Include a signed Operation and maintenance plan
Make the calculations as detailed as possible, and taking it step by step Show how
all the numbers were obtained And check the math for simple errors in addition and
multiplication Don't forget to have the engineer seal the calculations
Make sure the plans have dimensions, details, contours (existing and proposed),
show the drainage area, and a good vicinity map

The main issue is no longer the status of the pond, although that remains one
issue The main issue concerns the "Plan Revision" that was sent to the Division by
Mr English, apparently Only the permittee can submit a plan revision Mr English
sent in a plan revision to revise a permitted drawing for a permit that HE DOES NOT
OWN He represented himself as the owner of the offsite facility, which is not
true The pond has been permitted to Mr Gordon Lovingood, C-3 Investments, and
even though the pond design does account for the runoff from the outparcel, if Mr
English did not secure provision to use the pond in his sales contract, then I
can't force Mr Lovingood to accept it That has to be between the two of them, and
if they can't come to terms, I can't force it If Mr Lovingood doesn't want to
allow Mr English to use the pond, then it becomes a civil matter
As the owner of the outparcel, Mr English should have applied for an offsite
permit and received his own permit, regardless of the fact that the disturbed area
was <1 acre The parent tract of land already received a land disturbing permit, so
this is Dust a continuation of the original disturbance
Mr English needs to submit an offsite permit application as soon as possible

than the 1 acre threshold requiring a DWQ permit I say this for your
information We do not wish to get into a rock throwing contest with anyone
If you can put pressure on Lovingood to complete his originally permitted pond
construction, and have the engineer of record (Tripp) to complete and submit that
pond certification, we will be happy to re -certify that pond once our portion of
the pro3ect is complete That should take care of all your woes *

agreements and the failure to follow thru on his construction as permitted

The Wilmington Regional Office received a Plan Revision to the approved plans for
Stormwater Management Permit Number SW8 981039 for Hampton Inn Southport on
November 21, 2003 A preliminary review of that information has determined that the
application is not complete The following information is needed to continue the
stormwater review
1 Please provide a statement regarding the current status of the pond in light of
the April 17, 2002, compliance inspection report No response to that report
has been received, and the pond has not been reinspected since then
2 Please provide the required Designer's Certification for the pond The Notice
of Violation that was issued on August 31, 2000, requested that the
certification be submitted upon completion of the work
Please note that this request for additional information is in response to a preliminary
review The requested information should be received by this Office prior to March 11,
2004, or the application will be returned as incomplete The return of a project will
necessitate resubmittal of all required items, including the application fee
If you need additional time to submit the information, please mail, email or fax your
request for a time extension to the Division at the address and fax number at the bottom
of this letter The request must indicate the date by which you expect to submit the
required information The Division is allowed 90 days from the receipt of a
completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215 1 and
is subject to enforcement action pursuant to NCGS 143-215 6A

Do you remember that TV show "Dallas"'> What we have here is two JR's One
is wanting the other to complete that pond, add the forebay, yaddi-yaddi,
and throw in a pond certification If the other doesnt, then He'll see to it
that his construction is stopped until his will is dominant SHOT GUN
NEGOTIONS
The other is saying I have been approved on all of this to begin with, how
did your name get on the final permit, my permit, And we agreed on this a
long time ago'

Too much money, too little time to wait for a civil remedy If Bryan cant
work this out, then we have no other choice but to re -apply for a permit
that the DWQ drainage has already been approved on Will definetly have to be
a fast -track permit I'll contact Laurie tomorrow and get "up -dated" on that
scenario
A shame things came to this point Byran is good people, and I dont use that
term lightly with people You're good people

If you're sure that Mr Lovingood won't let Mr English use the pond,
