Dear Mr Ramsey On August 5, 2009, the Governor signed Session Law 2009-406 This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010 The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date On August 2, 2010, the Governor signed Session Law 2010- 177 which grants an extra year for a total of four (4) years extension Accordingly, Stormwater Permit # SW8 000416 which has already expired on February 19, 2011, is now in effect until February 19, 2015 Please resubmit the renewal application and fee at least 180 days prior to February 19, 2015, which would be August 19, 2014 A copy of the Renewal Application can be obtained from the following website http I/portal ncdenr org/web/wg/ws/su/statesw/forms_docs If you RENEWAL REQUEST Stormwater Permit No SW8 000416 Strand River Brunswick County Dear Mr Safrit Dee Freeman Secretary The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 000416 to Strand River for a High Density Project on February 19, 2001 This permit expires on February 19, 2011 Per 15A NCAC 2H 1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505 00 If this is still an active project please complete and submit the enclosed renewal application prior to August 19, 2010 If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation Please include a copy of the certification with your permit renewal request and processing fee Enclosed is a copy of a sample certification Also enclosed is a new Operation and Maintenance agreement that should be completed and submitted along with your renewal application You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215 1 and may result in Provide a sealed cover sheet for the revised calculations Please refer to the enclosed stormwater management plan calculation booklet 2. Calculating the 1" volume using the Simple Method instead of the SCS Method In the previous submittal, the 1-inch runoff volume was calculated using both the SCS Method and the Simple Method However, the runoff volume calculated by the Simple Method was used in further water quality calculations (i e — design of draw -down orifices, surface area calculations at the 1-inch storage volume level) Please refer to the calculation booklet for additional information 3. Submission of a revised low density supplement form Please find the enclosed low -density supplement form This form has been revised using the new lot total per your request 2. Revised drainage area map for Pond #2 Per your request, the drainage area map for Pond #2 was revised to show the pond in its new location It is important to note that Pond #2 was designed with the appropriate watershed area in the previous submittal 4. Identify the symbol for drainage area in the legend In the previous submittals, the watershed limits of the proposed BMP's were not shown clearly You have requested that the watershed limits be identified in the legend Rather than adding this to the legend, a new set of watershed maps was generated for the development that clearly labels the limits of the contributing watersheds 5. Sufficient BUA for the lots at the ends of Streets "AE" and "X" Per your comment, the allowable BUA for the lots at the ends of Streets "AE" and "X" was increased due to the length of the driveways that will be needed to serve them A conservative driveway area of 3,600 sf (300 ft long by 12 ft wide) was assumed to serve each of these lots This area is in addition to the BUA's previously submitted All necessary changes in the Stormwater Management Permit Application Form were made and a new form is included in this submittal Please refer to Attachment `A' for additional information 6. On -site wetlands delineation In the comment letter, it was requested that all wetlands on -site, disturbed or undisturbed, be delineated or note on the plans that none exist Wetlands do exist on this site and there are two notes (2 & 3), along with a hatching pattern on each plan sheet, that show their extent 2. Per your comment, separate basin areas on not shown as part of this application since all of the receiving streams are either class SC-HQW or C- HQW Also, as shown on Attachment A, the percent impervious for the proposed development is 22%, thus meeting the 30% maximum for low density development for all non -SA and non-ORW waters in coastal counties 4. Tunnel's sand filter not included in previous application Per request, all calculations pertaining to Sand Filter #2 (at the tunnel), along with a column in Attachment A, has been included in this submittal package 5. Curb outlet swales The previous plan set depicted several curb outlet swales that were located in the middle of single-family lots instead of property Imes These have been relocated, and hence re -calculated, to lie either between lots or in common areas G. Lot grading not included in grassed swale design On the previous submittal, the drainage boundaries shown for the grassed swale design did not clearly include anticipated lot grading of the single- family lots For this reason, the drainage area to each affected swale has been revised and each Swale re-evaluated Please refer to the Curb Outlet Supplement for revised calculations and additional information 7. Swales 45A and 45B shown at high point of street Swales 45A and 45B were shown at the high point of the street leading towards Multi -family Area — Phase 11, in the previous plan set In actuality, Water Quality Pond #2 will treat impervious area from the streets in this area Therefore, these swales have been removed in the revised plan set Ms Linda Lewis July 17, 2000 Page 3 8 Water Quality Pond #2 is located within wetlands Previously, Water Quality Pond #2 was located within the wetlands area south of Multi -family Area — Phase II However, in an effort to limit the wetlands impact associated with this project, the pond was relocated to an area northeast of the previous location that is not within the delineated wetland boundaries This pond will continue to treat the impervious surfaces from this area but has been re -designed to take into account changes caused by the re- location Please refer to Sheet PD-2 for additional information 9 Location of Sand Filter #1 The location of Sand Filter #1, as was shown in the previous submittal, is located within the Apartment Site the grading for this sand filter is shown on Sheet C-7 and the related details are shown on Sheet C-9 However, in an effort to aid your review of this project, each of the water quality devices used for this site, with the exception of the grassed swales, are labeled on the overall site plan for the Strand River development These labels are shown on Sheet C-2 10. Pond section details do not show the required items On the previous plan set, Sheets PD-1 through PD-4, pond section details that show the forebay and the required vegetated shelf were not provided The cross-section details that were provided only show a section at the pond outlet structure For this reason, a typical cross-section that shows the required items (i e -- forebay, vegetated shelf, etc ) was provided in this submittal 11. Distance from inlet pipe to forebay berm In an effort to aid in the construction of the proposed water quality ponds and to insure that forebay volumes are correct, the distance from the pond inlet pipes to the toe of the forebay berms was added for each pond in this submittal Ms Linda Lewis July 17, 2000 Page 4 12. Trash rack spacing On the previous trash rack details, the spacing between the rebar was approximately six (6) inches Per your comment, the trash rack details have been revised to limit the spacing to four (4) inches 13. Forebay volumes larger than 20% of permanent pool volume The forebay volumes in all of the ponds previously submitted are considerably over the maximum 20% of the permanent pool volume However, as you noted, since the forebay is as deep as the pond, the TSS removal rate is not adversely affected Therefore, the ponds were not revised to reduce the forebay volume 14. Detention pond orifice size In the comment letter, it was requested that the detention pond orifice size be based on the minimum one (1) inch runoff volume, as calculated using the Simple Method, not the volume actually stored in the pond above normal pool However, while the runoff volume to be stored is computed using the Simple Method, the orifice sizes were not re -computed for the following reasons • In most cases, the crests of the outlet structures were set well above the minimum storage volume to allow for ease of construction In fact, the normal pool elevation of several ponds is the same as the outlet invert Therefore, in order to keep the pond at an elevation as close to normal pool elevation as possible in the event of large rainfall events, the orifice was sized to draw down the volume stored at the spillway crest elevation within 2 to 5 days • The surface areas provided for each pond greatly exceed the minimum, in most cases Therefore, the rise associated with the minimum I" storage volume is relatively small compared to the distance between normal pool and the spillway crest For this reason, the size and number of siphons required, using orifice control, is unreasonable The calculations provided, however, do in fact show the drawdown time Ms Linda Lewis July 17, 2000 Page 5 associated with the minimum I" storage volume Please note that they were kept as close to 2 days as possible so as to allow for the entire volume stored above normal pool to be released within 5 days 15. Impervious liner for sand filters An impervious liner was not shown on the sand filter details in the previous submittal They have since been revised and Bentomat CL (or approved equivalent) has been chosen for this purpose Please refer to Sheet C-9 for additional information 16. 2:1 slopes on sand filter details As noted in the comment letter, all vegetated slopes must be 3 1 or flatter The sand filter details in the previous submittal specified 2 1 slopes The sand filters have since been re -graded, and the details modified, to show the required 3 1 slopes in vegetated areas 17. Recorded drainage easements for curb outlet swales As noted in the "General Notes" section on Sheet C-8 in the previous submittal, all curb outlet swales must be located in recorded drainage easements This note was not shown on the roadway drainage plan sheets Therefore, in response to your comment, this noted has been added on Sheets C-3A to C-3E (See Note #8 on each sheet) 18. Swales 106 and 107 are parallel with the front lot line.
