A preliminary review of the project indicates that before a State Stormwater permit can be issued the following additional information is needed. 1) Please note that the current policy in regards to low density development has changed in regards to how low density development is being permitted. This policy allows up to 10% of the lots to be individually over the 30% coverage threshold. This helps to keep individual pockets within a development from becoming areas of high density. With all 16 lots being proposed to have 40% impervious coverage, this project is currently considered as a high density development under today's guidance. Please provide additional application forms, fee, plans, calculations, narrative, etc. for a "High Density" application package or reduce the amount of impervious coverage per lot to 30% or less. The above requested information must be received in this office prior to December 14, 2006 or your application will be returned as incomplete. The return of this project will necessitate resubmittal of all required items including the application fee. If you need additional time to submit the required information, please mail or fax your request for time extension to this office at the Letterhead address. You should also be aware that the Stormwater Rules require that the permit be issued prior to any development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number as issued by the Division of Water Quality. Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. The Currituck Club PUD is a residential development consisting primarily of low density private home development with a small percentage of commercial area. The Currituck CIub PUD is located +/- 20 miles north of the intersection of U.S. 158 and N.C. 12. Phase 8A is located adjacent to the Windswept Ridge condominiums and was originally planned to be developed as multifamily housing which would be permitted under a "High Density" stormwater permit. In response to today's market, the Currituck Associates / Residential Partnership has decided to develop this land as single family residential lots. This single family lot phase will meet all on the requirements for a Low Density development classification. Previous phases of the development have been pennitted under the Low Density permit option. Phases I & 2 were permitted as a Low Density development under a pen -nit issued by the Division of Water Quality (DWQ) on August 31, 1995. Phase 3 Single Family Residential Lots @ The Currituck Club PUD was permitted in a similar fashion under DWQ Permit Number SW7970119. Phase 4 Single Family Residential Lots @ The Currituck Club PUD was also permitted this way under DWQ Permit Number SW70001 17. Phase 5 Single Family Residential Lots @ The Currituck Club PUD , was permitted in this fashion under DWQ Permit Number SW7020302. Phase 6 Single Family Residential Lots @ The Currituck Club PUD was also permitted in this way under DWQ Permit Number SW7020417. Phase 7 Single Family Residential Lots @ The Currituck Club PUD was also permitted in this way under DWQ Permit Number SW7021 112. Phase14 Single Family Residential Lots @ The Currituck Club PUD was also pennitted in this way under DWQ Permit Number SW7050814. It is important to note at this time that the entire roadway and the associated rights -of -way for all the listed phases have been accounted for under the original permit issued for Phases 1 & 2 of The Currituck Club PUD (as adjusted by the permit for Phase 14). For consistency, the roadways of Phase 8A will be added to this overall roadway calculation and further calculations will be based off of that new roadway figure. The Stormwater Management Plan will utilize a roadside grassy swale infiltration system to manage the stormwater runoff generated by this proposed development. The following narrative will discuss specifically permissible built upon areas, stormwater collection, treatment, storage, and disposal. Allowable Built Upon Area The Currituck County Unified Development Ordinance allows for the individual lot coverage to be 40% maximum. The stormwater regulations allow for a maximum coverage of 30% to still remain in the "Low Density" classification. When the 40% maximum lot coverage is combined with the golf course, subdivision road rights -of -way, and the patio home areas, the effective area is well below the allowable 30% maximum coverage for a low density approval. Evidence of this will be displayed in the following paragraphs. The total land area used in the calculations for "Low Density" development under the Phase 1 & 2 pen -nit (as modified by the Phase 14 permit) is 564.21 acres. This area includes the Patio Home Section, the Golf Course, the Single Family Lots (Phases 1, 2, 3, 4, 5, 6, 7, & 14) and the Subdivision Road Rights -of -Way (Phases 1, 2, 3, 4, 5, 6, 7, & 14). Since the Phase 5 Hammocks section development has been permitted independently from the rest of the phases of The Currituck Club PUD, this number can be adjusted to subtract The Hammocks section development area (564.21 acres - 1795 acres, reference Permit No. SW7001026 = 546.26 acres). The allowable coverage based on the 30% maximum allowable coverage as outlined in the NCDENR, DWQ, Administrative Code Section 15A NCAC 2H .1000 Stormwater Management for properties adjacent to SC waters is, 546.26 acres x 30%(.30) = 163.88 acres. The total coverage as determined in the "Low Density" Stormwater Management Plan for The Currituck Club PUD, Phases 1 & 2, permitted on August 31, 1995, and as modified by the Phase 14 permit (dated September 23, 2005) is 67.52 acres. Again this area of impervious coverage includes all the roadways for all phases (except Phase 8A) of The Currituck Club PUD. Area of the Phase 8A roads and driveways within the Right of Way is 0.83 acres. (Detennined by AutoCAD area routines) L1 � A small parking lot is also proposed to serve the existing tennis courts. The area of this proposed parking lot is .08 acres. The total allowable area for impervious coverage on the single family lots of Phase 8A is approximately 106,730 square feet. This value translates to 2.45 acres. As stormwater management plan applications are submitted for future phases of single family lot subdivision development within The Currituck Club individual lot coverage calculations (40% by ordinance) will again be provided to DWQ staff and those figures will be deducted from the 51.54 acres remaining. A running total will be kept of the allowable coverage verses proposed coverage. Stormwater Collection, Treatment, Storage, and Disposal Collection The stormwater will be directed into roadside swales via site grading and road crowning. The areas of each individual lot which are not impervious, effectively 60% at final build out, will intercept runoff and provide additional locations for stormwater infiltration prior to entering the proposed roadside swale system. Treatment The proposed roadside swales will be vegetated according to the general seeding specifications provided on the Soil Erosion & Sedimentation Control Plan. Stormwater runoff collected by this swale system will undergo debris and pollutant filtration by the proposed vegetation. The vegetation specified on the side slopes of the swales will effectively act as a physical, biological and chemical strainer. In the physical sense the vegetation will act as a strainer to remove debris and larger particulates. In the biological sense the vegetation will participate in the nutrient uptake and may also use some pollutants as a food source. In the chemical sense the soil, water and the vegetation will participate in various chemical processes including biodegration, and oxidation/reduction processes. The vegetation will effectively treat the projected runoff prior to impacting the groundwater or any adjacent surface waters. Note that there are no direct connections to adjacent surface waters. Storage The roadside swale system should provide adequate temporary storage of the first inch of stormwater runoff prior to infiltration. Disposal The disposal will occur within the subsurface via infiltration. Soils onsite provide more than adequate void ratio in the subsurface providing for high infiltration rates and therefor relatively fast disposal. Conclusion The stormwater management system proposed for Phase 14, Single Family Lots, The Currituck Club PUD, will more than adequately serve this subdivision.
