We are forwarding Permit No. SW7060623 dated October 2, 2006, for the construction of the subject project. This permit shall be effective from the date of issuance until October 2, 2016, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit and in the submitted application. Failure to establish an adequate system for operation and maintenance.. of the Stormwater management system .will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. The drainage areas will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 and 7 on page 3 of this permit. The stormwater controls have been designed to handle the runoff from 66,539 square feet of impervious area. 3. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing- all - such, required easements, in -accordance with. the approved plans and permit. 4. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control systems. 5. The stormwater treatment systems include two (2) infiltration basins, and two (2) underground infiltration trench systems to treat runoff from drainage areas A, B & C. For Drainage Area B the stormwater runoff will be captured and treated in a Stormtech 310 piped infiltration trench which will provide 6,960 cubic feet of storage. This trench system is tied directly, by pipe, into infiltration basin "B" which will provide an additional 914 cf of storage volume. These two systems are to work in series in order to provide the minimum storage for the 3.0 inch design storm. 9. Stormwater runoff in Drainage Area C is conveyed to the infiltration trench °C° by the use of porous/permeable pavement. The porous/permeable pavement is required to be properly constructed, operated -and -maintained in -accordance -with -the approved -plans and signed Operation and Maintenance Agreement. II. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plans must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of.eroded areas. e. Maintenance -of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. The stormwater systems shall not be used as Erosion Control devices. They must be kept off line and free from sediment until the project is complete and the entire site has been stabilized. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. Page 4 of 8 State Stormwater Management Systems Permit No. SV 7060507 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. This permit shall be effective from the date of issuance -until October 2, 2016. Application for permit renewal shall be submitted 180 days prior to the expiration date of this permit and must be accompanied by the processing fee. 14. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 9. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. Permit issued .this the 2Id day of October, 2006. The required system dimensions are provided per the approved plans. cc: NCDENR-DWQ Regional Office Dare County Building Inspections Page 8 of 8 STANFORD HOLDINGS, LLC 47170 Highway 12 Buxton, North Carolina Operation and Maintenance Agreement For Stormwater Systems August 9, 2006 AUG P r) 2006 INFILTRATION BASINS INFILTRATION BASINS: Infiltration basins will be monitored and maintained in accordance with the NCDENR Stormwater BMP Manual, Section 3.7." Current criteria for long term monitoring and maintenance include the following: 3.7.10 MONITORING Sediment accumulation will eventually render an infiltration device ineffective, so regular inspections are necessary. Because the trenches and dry wells are below ground and out of sight, the tendency is to ignore inspection and maintenance, which leads to failure. Regular inspections of all types of infiltration devices will help ensure that problems are identified in advance. The monitoring well for observing infiltration devices should consist of a 4- to 6-inch- diameter, perforated polyvinyl chloride (PVC) pipe with a locking cap. The well should be placed near the center of the facility, with the invert at the excavated bottom of the facility. For the first year of operation, installations should be inspected quarterly and after each major storm. After the first year, annual inspections, preferably conducted after a storm. are recommended. In order to monitor performance of the infiltration device, observations should be conducted to determine how long it takes retained water to infiltrate into the soil after a storm event. The determination can be made in two ways. The most informative way is to read the water level several times over a period of days after a large storm. The alternative is a "one -stop" method, where a single reading is taken and compared with the local rainfall record. Although less accurate than the multiple reading method, the one - stop method will still allow significant deterioration in performance to be recognized. 3.7.11 MAINTENANCE Maintenance is very important for infiltration devices. Property owners should be educated in the function and maintenance requirements of infiltration devices. Especially important is the maintenance of vegetated areas that drain to the infiltration system. Areas that are allowed to become bare and unvegetated will contribute excess sediment to the infiltration system and hasten its failure. Maintenance requirements are summarized as follows: • Grass areas, grassed swales, and filter strips leading to infiltration devices should have a dense vegetation cover and be mowed at least twice a year. • Sediment deposits should be removed from pretreatment devices at least annually. • In trenches, the top several inches of aggregate and the filter cloth along the top of the trench or dry welts should be replaced annually or at least when the facility shows evidence that infiltration rates have declined. Proper disposal of the materials removed is necessary; the aggregate and cloth should be appropriately packaged and delivered to the local landfill, if the operating authority approves the disposal. The surface of infiltration trenches must be kept in good condition. Colonization by grass or other plants should be discouraged, since this can lead to reduced surface infiltration rates. In many instances, it is convenient'to cover infiltration trenches with, concrete grid pavers or similar permeable paving systems that can be removed easily and replaced as necessary to service the trench. • The infiltration facility must be dismantled and reconstructed when the infiltration rate unacceptable levels. PERMEABLE PAVEMENT (Turf Stone Pavers) PERMEABLE PAVEMENT (Turf Stone Pavers): The turf stone paver areas will be maintained in accordance with the "NCDENR Stormwater BMP Manual, Section 3.10." Current criteria for permeable pavement maintenance includes the following: 3.10.8 MAINTENANCE Maintenance requirements are critical for the success of permeable pavement. Even though there are significant locational restrictions on the permeable pavement installations, there is still a potential for permeable pavements to clog with sediment. The following installation and maintenance requirements shown in Table 3.10.1 are designed to ensure that the permeable pavement system will work effectively. A maintenance agreement is required for each permeable pavement installation to receive credit. The maintenance agreement should include specific requirements and responsibilities of the property owner and provide for enforcement. Stanford Holdings. Manufacturer recommended criteria for inspection and maintenance includes the following: 13.1 TREATMENT TRAIN INSPECTION AND MAINTENANCE The StormTech recommended treatment train inlet system has three tiers of treatment upstream of the StormTech chambers. It is recommended that inspection and maintenance (I&M) be initiated at the furthest upstream treatment tier and continue downstream as necessary. The following I&M procedures follow this approach providing I&M information in the following order: Tier 1 —Pretreatment (BMP); Tier 2 — StormTech Isolator Row, and; Tier 3 — Eccentric Pipe Header System. 13.2 CATCHBASIN/MANHOLE I&M Typically a stormwater system will have catchbasins and manholes upstream of the detentiordretention system. In some cases these may be the only pre-treatment devices. Regular I&M of catchbasins and manholes should be scheduled and performed as part of a site's routine maintenance plan. CATCHBASIN/MANHOLE — STEP-BY-STEP MAINTENANCE PROCEDURES 1) Inspect catch basins and manholes upstream of StormTech chambers for sediment 2) Remove grate or cover 3) Skim off oils and floatables 4) Using a stadia rod, measure the depth of sediment 5) If sediment is at a depth greater than 6" proceed to step 6. North Carolina For Stornsvater Systems Page 3 8) Record depth & date and schedule next inspection 13.3 PRE-TREATMENT DEVICE I&M Manufacturer's I&M procedures should be followed for proprietary pretreatment devices such as baffle boxes, swirl concentrators, oil -water separators, and filtration units. Table 10 provides some general guidelines but is not a substitute for a manufacturer's specific instructions. Other methods may ap p ly. 13.4 ISOLATORTm ROW INSPECTION Regular inspection and maintenance are essential to assure a properly functioning stormwater system. Inspection is easily accomplished through the manhole or optional inspection ports of an Isolator Row. Please follow local and OSHA rules for a confined space entry. Inspection ports can allow inspection to be accomplished completely from the surface without the need for a con -fined space entry. Inspection ports provide visual access to the system with the use of a flashlight. A stadia rod may be inserted to determine the depth of sediment. If upon visual inspection it is found that sediment has accumulated to an average depth exceeding 3" (76 mm), cleanout is required. Stanford Holdings: LLC Operation and Waintenance Agreement Biamon, North Carolina For Storm -water Systems Page 4 A StormTech Isolator Row should initially be inspected immediately after completion of the site's construction. While every effort should be made to prevent sediment from entering the system during construction, it is during this time that excess amounts of sediments are most likely to enter any stormwater system. Inspection and maintenance, if necessary, should be performed prior to passing responsibility over to the site's owner. Once in normal service, a StormTech Isolator Row should be inspected bi-annually until an understanding of the sites characteristics is developed. The site's maintenance manager can then revise the inspection schedule based on experience or local requirements. 13.5 ISOLATOR ROW MAINTENANCE JetVac maintenance is required if sediment has been collected to an average depth of 3" (76 mm) or more insidethe Isolator Row. The JetVac process utilizes a high pressure water nozzle to propel itself down the Isolator Row while scouring and suspending sediments. As the nozzle is retrieved, a wave of suspended sediments is flushed back into the manhole for vacuuming. Most sewer and pipe maintenance companies have vacuum/JetVac combination vehicles. Fixed nozzles designed for culverts or large diameter pipe cleaning are preferable. Rear facing jets with an effective spread of at least 45" (1140 mm.) are best. Most JetVac reels have a mini-mumof 400 feet (122 m) of hose allowing maintenance of an Isolator Row up to 50 chambers long. The JetVac process shall only be performed on StormTech Rows that have AASHTO class 1 woven geotextile over their angular base stone. STORMTECH ISOLATOR T" ROW - Step -By -Step Maintenance Procedures Step 1) Inspect Isolator Row for sediment. A) Inspection ports (if present). i. Remove lid from floor box frame. ii. Remove cap from inspection riser. iii. Using a flashlight and stadia rod, measure depth of sediment. iv. If sediment is at, or above, 3" (76 mm) depth proceed to Step 2. If not proceed to step 3. B) All Isolator Rows. Step 2) A) B) C) Step 3) i. Remove cover from manhole at upstream end of Isolator Row. ii. Using a flashlight, inspect down Isolator Row through outlet pipe. 1. Mirrors on poles or cameras may be used to avoid a confined space entry. 2. Follow OSHA regulations for confined space entry if entering manhole. iii. If sediment is at or above the lower row of sidewall holes [approximately 3" (76 mm)] proceed to Step 2. If not proceed to Step 3. Clean out Isolator Row using the JetVac process. A fixed culvert cleaning nozzle with rear facing nozzle spread of 45" (1140 mm) or more is preferable. Apply multiple passes of JetVac until backflush water is clean. Vacuum manhole sump as required. Replace all caps, lids and covers. Stanford Holdings, LLC Operation and Maintenance Agreement Buxton, :'forth Carolina For Storinwater Systems Page 5 Step 4) Inspect and clean catch basins and manholes upstream of the StormTech system following the procedures for Classic Manifold Inlet System. 13.6 ECCENTRIC PIPE HEADER INSPECTION Theses guidelines do not supercede a pipe manufacturer's recommended I&M procedures. Consult with the manufacturer of the pipe header system for specific I&M procedures. Inspection of the header system should be carried out quarterly. On sites which generate higher levels of sediment more frequent inspections may be necessary. Headers may be accessed through risers, access ports or manholes. Measurement of sediment may be taken with a stadia rod or similar device. Clean -out of sediment should occur when the sediment volume has reduced the storage area by 25% or the depth of sediment has reached approximately 25% of the diameter of the structure. 13.7 ECCENTRIC PIPE HEADER MAINTENANCE Cieanout of accumulated material should be accomplished by vacuum pumping the material from the header. Cleanout should be accomplished during dry weather. Care should be taken to avoid flushing sediments out through the outlet pipes and into the chamber rows. Generally, Grasspave2 is installed at the same time as project grass installation, nearly the last site construction activity. B. All hard surface paving adjacent to Grasspave2 areas, including concrete walks and asphalt paving must be completed prior to installation of Grasspave2. C. Cold weather: 1. Do not use frozen materials or materials mixed or coated with ice or frost. EXECUTION 3.1 INSPECTION (It is recommended- that Fire Department inspectors be scheduled to inspect installation of Grasspave2 during preparation of the subbase, installation of the base course, and installation of Grasspave2 units. Most small projects can accommodate these inspections all on the same day. Verify with Fire Department if certificates of inspection are required.) A. Install the Grasspave2 units by placing units with rings facing up, and using pegs and holes provided to maintain proper spacing and interlock the units. Units can be easily shaped with pruning shears or knife. Units placed on curves and slopes shall be anchored to the base course, using 16d Common nails with fender washer, as required to secure units in place. Tops of rings shall be between 6 mm to 13 nun (0.25" to 0.5") below the surface of adjacent hard -surface pavements. B. Install sand in rings as they are laid in sections by "backdumping" directly from a dump truck, or from buckets mounted on tractors, which then exit the site by driving over rings already filled with sand. The sand is then spread laterally from the pile using flat bottomed shovels and/or wide "asphalt rakes" to fill the rings. A stiff bristled broom should be used for final "finishing" of the sand. The sand must be "compacted" by using water from hose, irrigation heads, or rainfall, with the finish grade no less than the top of rings and no more than 6 mm (0.25") above top of rings. 3.4 INSTALLATION OF GRASS Install thin sod directly over sand filled rings, filled no higher than the top of the rings.- Sod strips should be placed with very tight joints. Sodded areas must.be fertilized and kept moist during root establishment (minimum of 3 weeks). Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed- 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. If DWQ determines that the system is failing, the system will immediately be repaired or replaced to original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed. b. Remove accumulated sediment from the infiltration system annually or when depth in the unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over - excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to'perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the infiltration system. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the depth at the benchmark reads N A , the accumulated sediment shall be removed from the system.
