On September 19, 2013, the Washington Regional Office received - a plan
revision/addendum for Stormwater Management Permit Number SW7050418. The
revisions/addendum shows the proposed West Park Motors addition, including 61,977 square
feet of impervious area to drain to the existing wet detention basin. This impervious area was
included and already permitted under State Stormwater Permit number SW7050418, issued on
October 21, 2005. It has been determined that a formal stormwater permit modification is not
required for the proposed additions. Please add the submitted plans to the previously approved
plans Pecheles Toyota & Pecheles Ford to include West Park Motors development.
Please be aware that all terms and conditions of the permit issued on October 21, 2005
remain in full force and effect. Please also understand that the approval of this revision to the
approved plans for the subject State Stormwater Permit is done on a case -by -case basis. Any
other changes to this project must be submitted to and approved through the Division of Water
Quality prior to construction. The issuance of this plan revision does not preclude the permittee
from complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

This letter is to notify you that you are in violation of Title 15A North Carolina
Administrative Code (hereby known as NCAC) 2H .1003 for failing to comply with terms,
conditions and limitations of a Stormwater Management Permit. 15A NCAC 2H .1003 is
a rule of the Environmental Management Commission implementing Part I of Article 21
of the North Carolina General Statutes.
On February 23, 2009, Jeffery A. Manning of the Washington Regional Office performed
an inspection to determine the status of compliance with Stormwater Permit Number
SW7050418 issued to you on October 21, 2005 for the subject project, off of US 264 and
NCSR 1436 and lying within Beaufort County, North Carolina. As a result of the site
inspection and file review, the following violations are noted:
1. There is not a signed copy of the Engineer's Certification on file.
2, No maintenance or inspection records have been provided to the
inspector.
3. There are erosion and sedimentation impacts along the drainage ditches.
4. There is vegetation along the detention pond that needs to be removed.

Failure to provide the "Plan of Action" within 30 calendar days, or failure to correct the
violations by the date designated in the "Plan of Action", are considered violations of 15A
NCAC 2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.

detailed above, be abated immediately. Please be advised, these violations and
any future violations are subject to a civil penalty assessment of up to $10,000.00

BLP Holdings, LLC, is currently building a new automotive dealership in Washington, NC.
Permit No. SW7050418 was issued for this project on October 21, 2005. The stormwater control
was designed and permitted to handle the runoff from 446,054 square feet of impervious area,
which included the current project and future building and parking areas. The portion of the
project which is currently tinder construction includes 188,046 square feet of impervious area.
The owner would like to increase the area of the service parking by adding 9,600 square feet of
impervious area as shown on the attached drawings. This increase in impervious area would
leave 248,408 square feet of impervious area for future development under the current
stormwater permit.

Dear Mr. Pecheles:
The Washington Regional Office received a complete Stormwater Management Permit
Application for Pecheles Toyota & Pecheles Ford on August 22, 2005. Staff review of
the plans and specifications has determined that the project,, as proposed, will comply
with the Stormwater Reggulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW7050418 dated October 21, 2005, for the construction of the
subject project.
This permit shall be effective from the date of issuance until October 21, 2015, and shall
be subject to the conditions and limitations as specified therein. Please pay special
attention to the Operation and Maintenance requirements in this permit. Failure to
establish an adequate system for operation and maintenance of the stormwater
management system will result in. future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written
petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-
7.447. Unless such demands are made this permit shall be final and binding.

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules' and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until October 21, 2015, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 446,054 square feet of
impervious area, including future building and parking.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. Approval of future building and parking
plans must be obtained from the Division before construction of this
impervious area begins.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

1. The stormwater management system shall be constructed in its entirety,
vegetated and operational forits intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e.. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. if the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area. 1.1
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
13. This permit shall be effective from the date of issuance until October 21, 2015.
Application for permit renewal shall be submitted 180 days prior to the expiration
date of this permit and must be accompanied by the processing fee.

III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed. name/ownership change form, documentation from
the parties involved, and other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and may or may not be
approved. The permittee is responsible for compliance with all permit conditions
until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revolted and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit:

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all

1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
S W 7 ar0:1 18 as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

Footnotes:
When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.

As you have discussed with Bryan Fagundus with our office, $LP Holdings LLC is preparing to
construct a new automotive sales lot at the intersection of US 264 and Page Road. A reduced
copy of the construction plans is attached for your use.
We have submitted our Erosion and Sedimentation Control Plan to the Land Quality Section for
review. However, since this project includes grading and drainage work within an unnamed
tributary to Mitchell Branch, a stream subject to the Tar -Pamlico Riparian Buffer rules, Land
Quality can not approve the plan without written approval from the Division of Water Quality.
l understand that you have two concerns with our proposed plan: 1) grading within Zone 2 of the
Riparian Buffer and 2) piped discharge into the stream.
This property is currently agricultural fields that have been cultivated up to the edge of the
stream. By limiting the grading to only Zone 2, the health of the vegetation and diffuse flow in
Zone 1 will not be affected. At the completion of the grading operation, all disturbed areas will
be stabilized and new vegetation will be established. This work is exempt under 15A NCAC 2B
.0259(6).
The'stormwater runoff from the proposed development will be directed through grassed swales
and a wet detention pond. These BMPs provide greater than 90% removal of the total suspended
solids, 40% reduction in the amount of the nitrogen released from this site and reduces the peak
flow from this site to less than the predeveloped flow. Since the proposed stormwater
management facility will control the nitrogen and attenuate the flow, then the stormwater outfall
is allowable under 15A NCAC 2B .0259(6).
Please review this project and provide written authorization for BLP Holdings LLC to proceed
with construction.

April 15, 2005. A preliminary' revie..- of your project indicates that before a State Storm..-ater permit can
be issued the following additional information is needed.

Please clarif.• the difference between the 27,027 square feet noted on the plamzs i na='ve and the

Pecheles Ford and Pecheles Toyota are expanding automobile dealerships that are
currently located at the intersection of U.S. Highway 17 and West 15`h Street in
Washington, NC. Due to continued growth and expansion, the dealerships are re -locating
to the proposed site.
The project area for the construction of the proposed facility consists of 15.74± acres,
which will include the showroom buildings, parking lots, and a wet detention basin to
treat stormwater runoff from these areas. The proposed dealerships will have
approximately 27,000 SF under roof and provide asphalt pavement for vehicle display
area, customer parking, and service parking. Future development will expand the the site
to approximately 76,230 SF under roof. A wet detention basin will be utilized to treat
stormwater runoff from the additional impervious surface created by the proposed
facility.
The majority of the existing topography is flat, which is typical of the area. Currently,
site drainage is achieved through a combination of infiltration and sheet flow to either the
NCDOT ditch along US Highway 264 or sheet flow to a ditch that runs along the
northern and western property lines. Native onsite soils consist of Seabrook loamy sand
and Tarboro sand, which are identified as being in hydrologic group C and A,
respectively.
The proposed buildings will be constructed on approximately 3 %z feet of fall material,
which will provide positive drainage away from the buildings while elevating the finished
floor elevation to 3 feet above the 100-year flood elevation. Automobile display areas
will be located on the south and east side of the buildings, between the building and U.S.
Highway 264. Automobile display areas, customer parking and service parking areas
will be asphalt pavement with grass landscape islands interior to the lots.
Stormwater will sheet flow across the proposed parking lot into a storm drainage pipe
network. The pipe networks will empty into three grass swales that ultimately flow into a
wet detention basin,
In order to capture and remove suspended solids from the stormwater runoff generated by
the proposed facility, a wet detention basin has been incorporated into this plan.
According to the NCDENR "Stormwater Best Management Practices" Manual, Wet
Detention Basins achieve a removal rate of 85% for total suspended solids. Wet
Detention Basins are intended to provide stormwater quality benefits to downstream
waters where water quality could be compromised by intensely developed urban areas
where the drainage areas are highly impervious. Wet Detention Basins improve water
quality by maintaining a permanent pool of water that is designed to allow suspended
solids and pollutants to settle out of the stormwater runoff. The proposed Wet Detention

Basin was sized according to the NCDENR "Stormwater Best Management Practices"
Manual.
The wet detention basin receives stormwater runoff from the proposed automobile
dealership site; Lot 1 as shown on the Final Plat for E.R. Lewis Construction Company,
Inc. recorded in Plat Cabinet G, Slide 51-6 of the Beaufort County Registry, which has a
total site area of 11.12 acres. The wet detention basin has been sized to also
accommodate and treat stormwater runoff from Lot 2 as shown on the Final Plat for E.R.
Lewis Construction Company, Inc. This lot is immediately west of the proposed
automobile dealership lot and is 4.62 acres in size. The total drainage area flowing into
the wet detention basin is 15.74 acres, which is the total area of the above mentioned Lots
1 and 2.
The entire site (Lots 1 and 2) is proposed to develop at a maximum density of 65%
impervious cover. The proposed development of both lots I and 2 will include 76,230 SF
of Buildings, 367,824 SF of Parking and 2,000 SF of Sidewalk. Given the total drainage
area and the % impervious cover, the pond can be sized to remove 90% TSS. A
Permanent Pool size of 32,225 SF is required to achieve this removal rate. A permanent
pool size of 38,800 SF is provided, which is more than required to remove 90% TSS.
Stormwater runoff will sheet drain a I" inch runoff volume of 36,311 cubic feet into the
wet detention basin. This will provide a storage depth of approximately 0.83" for the
design storage depth (1" runoff).
In order to ensure that the first flush will be released over a period of 2 to 5 days, a 3"
low flow orifice will be utilized.
The outlet structure for the wet detention basin is a concrete block riser with three open
sides and a fabricated metal trash rack. The weir (three open sides) allows any runoff in
excess of the one inch storm to discharge into an existing ditch via concrete pipe. The
northern slope of the pond will act as an emergency spillway that will empty into an
existing ditch runs along the northern side of the pond.
Wet Detention Basin Operation & Maintenance
The wet detention basin is defined as the wet detention basin, pretreatment including
forebays and the vegetated filter if one is provided.
Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion,
trash accumulation, vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the
temporary pool occurs within 2 to 5 days as designed.
2'. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative
cover, mow vegetative cover to maintain a maximum height of six inches, and
remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.)
quarterly to maintain proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or
when depth is reduced to 75% of the original design depth (see diagram below).
Removed sediment shall be disposed of in an appropriate manner and shall be
handled in a manner that will not adversely impact water quality (i.e. stockpiling near
a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it
will give an accurate depth reading and not readily penetrate into accumulated
sediments.
When the permanent pool depth reads 3.75 feet in the main pond, the sediment shall
be removed.
When the permanent pool depth reads 3.75 feet in the forebay, the sediment shall be
removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the
basin surface. These plants shall be encouraged to grow along the vegetated shelf and
forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the
flushing of sediment through the emergency drain shall be minimized to the
maximum extent practical.
7. All components of the wet detention basin system shall be maintained in good
working order.
During construction of this project, the North Carolina Sedimentation Pollution Control
Act and the Rules and Regulations promulgated pursuant to the provisions of this act

This office received a Coastal Stormwater permit application and plans for the supiect project on
April 15, 2005. A preliminary review of your project indicates that before a State Stormwater permit can
be issued the following additional information is needed.

narrative and show- on plans.
Please regrade the three (3) entrances so that all of the impen•jous runo;_— a7ans to the wet
detention pond. The new impervious area (drive) that is within the right-ofwars may be allowed
to drain back to the road side ditches and not the pond.
i Please provide either additional curbing on the Western most corner along LDS 26- or show- with
additional grading contour lines that all the impervious runoff from the parkins area goes to either
catch basinor the grassed drainage Swale.
Pledse provide nvo cross sectional details of the wet detention pond. These derails should include
the bottom, permanent, temporan, pool, top of dike and forebay weir elevations. the ::1 slope
above permanent pool_ the 6:1 vegetative shelf (min. 10ft wide) around the main pond and
dimensions of the permanent pool.
