Dear Mr. Snider
I am in receipt of the Notice of Violation referenced above dated September 21, 2020. Our response to
the NOV is as follows:
City of High Point Erosion Control inspectors had requested modification to an existing
skimmer basin located on our development. In order to fully access the floor of the skimmer
basin to perform the modifications, we had to pump water out of the basin because the invert of
the discharge pipe is above basin floor. We directed the pump discharge through a silt bag and
a rock filter prior to leaving our site. Unfortunately, the connection from the pump discharge
pipe into the silt bag was not properly sealed and this caused excessive amounts of turbid water
to flow through the rock filter and downstream.
Under the direction of Ms. Homewood, who was onsite at the request of the City of High Point
inspectors, the discharge connection to the silt bag was repaired and wattles (coir logs) were
installed downstream in several locations to trap any residual sediment prior to release into the
unnamed tributaries.
T'o prevent future similar occurrences in the event we need to rapidly de -water this basin, we
will require oln• contractor to have the connection inspected by qualified personnel prior to any
discharge to ensure there are no leaks and conduct pre and post inspections of the downstream
areas to verify compliance.
4. Following her inspection, Ms. Homewood did not indicate that we had caused any sediment
build-up or that stream restoration efforts would be required. We have requested that our
consultant, Lindsey Lengyel with Bluestream Environmental, review this matter and she is in

concurrence that we have adequately addressed the issue and she does not recommend further
action. Ms. Lengyel is copied herein for reference along with our subcontractor and City of
High Point inspectors.
It is my hope that this response adequately addresses this matter so that we may be released from any
further action under this Notice of Violation. Should you have further questions or require additional
