Boat Basin Maintenance Dredging This application is for the purpose of maintenance dredging in our existing boat basin. Periodic maintenance dredging is necessary to maintain the permitted depth and dimensions ofthe basin. The basin is located at the North Carolina Baptist Assembly and is for the private, recreational use of our guests. It is also used at times as an emergency shelter for boaters experiencing mechanical trouble or escaping from summer electrical storms. Whenever possible or necessary, Assembly staff render assistance by providing transportation or admitting to the grounds others providing assistance to these boaters. Oak Island Water Rescue has permission to use the basin and launch ramp, in case of emergency, to more quickly render assistance to persons needing aid on the eastern end of Oak Island, Cape Fear River, Elizabeth River, or ICW. This is the only launch point available to them on Oak Island with immediate access to these waters. A location for emergency helicopter landing on open ground clear of buildings, overhead lines, or other 'obstructions has been designated for their use should it be necessary. The NC Baptist Assembly occupies the property once owned by the US Government and used by the various military entities during the-Civil War, World War I, and World War II on the eastern end of Oak Island adjacent to the Cape Fear River. The basin area was originally dredged and bulkheaded for use by the US Navy. The project will consist of hydraulic dredging to return the basin to its original permitted depth within the original permitted boundary. No deepening or expansion of the basin is requested. The spoil containment area is the same as previously permitted and is well maintained. No wetlands are affected by the project and no backfilling is necessary. NC Baptist Assembly Page Two 9. PROJECT DESCRIPTION The project site is located at the terminus of Caswell Beach Road on the eastern end of Oak Island in Brunswick County. The site is the grounds of a former military area (Fort Caswell), and the NC Baptist Assembly now owns the property and uses the site as a recreational complex for church ministry functions. To access the project location, travel on US HWY 17 to NC 133. Continue south along NC 133 and turn right onto NC 211 at their juncture. Proceed west on NC 211 to the intersection with Long Beach Road. Make a left turn at the traffic light and proceed south along Long Beach Road, crossing the bridge over the AIWW. Go straight at the traffic signal on the island and continue, as this street curves and becomes Caswell Beach Road. Travel to the end of Caswell Beach Road and you will see the gatehouse of the NC Baptist Assembly. Several buildings are located within the complex, including dormitories, activity areas, and administrative buildings. These buildings are served by the Brunswick County water system and a LPP septic tank/field system. There is an existing boat basin with a boat ramp, pier, bulkhead, and a multi-slip docking facility. An access channel leads to the Cape Fear River from the boat basin. Coastal wetlands line the estuarine shoreline side of the property. Much of the high ground area is maintained as lawn area. The upland disposal site is located to the east and south of most of the development on the property, near the front gate. Further east and south lay sand dunes, the Cape Fear River, and the Atlantic Ocean beach. The topography of the property averages about 9 feet above mean sea level. Geomorphic features vary across the tract, and include sand dunes, ocean beach, flat high ground areas, and estuarine environments. Upland vegetation on the property is primarily maintained and landscaped lawn area, with some trees of the Maritime Deciduous Forest type present (mostly Live Oak (Querus virginiana), Cedar (Juniperus virginiana), and Yaupon (Ilex vomitoria)). Soils consist of fine sands in this area. The natural areas surrounding the boat basin and access channel contains a fringe of smooth cordgrass (Spartina alterniflora) which grades into high marsh species including salt meadow cordgrass (Spartina patens), Black Needle Rush (Juncus roemarianus), Glasswort (salicornia spp.), Sea Lavender (Limonium spp.), Salt Grass (Distichlis Spicata), and Sea Oxeye (Borrichia frutescens). The area around the dredged material disposal site is maintained as lawn, and the side slopes and top of the dike are also maintained as grassy areas. The waters of the Cape Fear River are classified SC by the N.C. Division of Water Quality. The tract is within the Ocean Erodible, High Hazard Flood and Inlet Hazard Resources Commission. The Long Term Average Annual Concern, as designated by the North Carolina Coastal Erosion Rate is 2 ft./yr. along this portion of Oak Island. The 100-year storm recession is 270 feet, and the 100 year flood elevation ranges from 14 to 23 feet. The NC Baptist Assembly is processing this major permit application for maintenance dredging due to an oversight, which ultimately lead to expiration of CAMA Major/Dredge and Fill Permit #144-04. The original CAMA/D&F permit (#252-88) was modified several times prior to expiration during the 1990's. Although permit #144-04 was considered a new permit, the scope of work remained consistent with the original proposal with the exception of the basin expansion, which was authorized in 1991. The previous permits have conditionally approved dredging activities to the area located within the confines of the entrance canal, access channel and boat basin. The most recently approved dredging and disposal activities remain as currently proposed. NC Baptist Assembly Page Three PROPOSED PROJECT The applicant proposes to maintain the depth of the boat basin and access channel by dredging approximately 28,000 cubic yards from the two areas combined. The material would be hydraulically dredged and disposed in an upland disposal site located on the Baptists Assembly property. Currently, water depths in the 375'x 240' boat basin average approximately 1.0'-1.5' ft below Normal Low Water (NLW) and depths within the 948' x 60`access channel average 4' below NLW. The applicant proposes to dredge both areas (basin and channel) to their previously permitted depths of 6' NLW and 8' NLW, respectively. Spoil material removed from these areas would be pumped approximately 2,200 linear feet along the roadway (main entrance to the Baptist Assembly) to the spoil containment/disposal area located along the south western portion of the property. The disposal site encompasses approximately 154,000 sq. ft., is 8-10 feet deep, and contains sufficient volume for the proposed project. A subsurface spill pipe would extend from the disposal area beneath the roadway, approximately 400 linear feet, to the neighboring channel that leads to the AIWW and Cape Fear River. 10. ANTICIPATED IMPACTS The proposed maintenance dredging would impact approximately 184,800 sq. ft. of previously dredged shallow bottom and spoil disposal would disturb approximately 154,000 sq. ft. of high ground within the existing dike containment area. As proposed, it appears that the dredging and disposal activities would not impact Coastal Wetlands, Primary Nursery Areas (PNA), beds of Submerged Aquatic Vegetation (SAV) or open shellfishing waters. Increases in turbidity should be expected during the dredging period however, no long term or adverse impacts are anticipated. Maintenance Clause 13) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross-hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site must be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 14) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 15) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 18) No attempt shall be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 19) The West Indian manatee (Trichechus manatus), which is listed as a federally endangered species, has been reported in North Carolina waters. In order to protect the West Indian manatee no work should be done during the period from June 1 October 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be followed.
