The permit approvals for this project included conditions that restoration work (removal of fill from the approximately 1.58-acre area pond bottom, etc.) was to "be completed within 120 days of receipt of all necessary federal, state and local approvals/permits". The DWR approval was dated April 13, 2020 and the USACE approval was dated April 21, 2020. The permitted work required a modification of the DEMLR erosion and sedimentation control (ESC) plan. This permit modification approval was received on August 25, 2020 (copy attached). As of today, the non -permitted fill has been removed from the pond bottom. The fill was removed to the extent and depth of the original pond bottom which was identified in part by the evidence of stumps, soil color, and other indicators of a drained pond bottom, along with the estimated elevation identified within the permit documents. The next step will be to breach the pond dam and stabilize the entire area (seed and mulch). The project engineer is coordinating the dam breach with DEMLR staff. Any potential changes to the breach plan provided in the permit documents will be provided to the USACE and DWR. DEMLR may be reaching out to DWR to ensure the sequencing of the dam breach is acceptable. We provide the follow assumptions/actions and ask for your confirmation of them. Regarding the as -built, we understand that the USACE is looking for "...an as -built survey to ensure that target elevations were met, including comparisons with elevations of those areas within the pond bottom that were not filled or graded." We are assuming that the permittee will only need to survey the approximate red boundary shown on the attached drawing and that they don't need to survey the entire pond bed. This would include getting topographic data roughly 10 to 15 feet outside of the limits of the fill removal limits shown on the attached drawing. Please confirm this assumption is correct. 2. We assume that this as -built survey does not need to extend down to the dam and can be truncated to only show the area upstream (to the west) of the dashed orange line on the attached drawing. Please confirm that our understanding is correct. 3. The site contractor has recommended the application of a temporary seed mix (contractor grass seed blend, e.g., rye, etc.) at the same time that the wetland seed mix is applied and mulched. This is consistent with other wetland restoration efforts that S&EC has done in the past to ensure a quick stabilization of the area prior to the emergence of the wetland species. We find the plan to be acceptable and hereby issue this Letter of Approval. The enclosed Certificate of Approval must be posted at the job site. This plan shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required by Title 15A NCAC 413.0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCGO10000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deq.nc.gov/NCG01. Be advised that 401/404 permits/certifications may provide authorization to work in the areas subject to those permits/certifications, but they do not grant approval to perform this work without the use of an approved erosion and sedimentation control plan for the activity. Additional measures may be required to perform construction in these areas. The applicant is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the applicant must take those additional steps necessary to stop sediment from leaving the limits of disturbance. The following conditions must apply to the removal of soil and waste from the wetland area, otherwise a mining permit is required prior to land disturbance [G.S. 74-49(7)(f)]: a. The excavation or grading is being conducted to provide soil or other unconsolidated material to be used without further processing either on -site or for a single off -site construction project for which an erosion control plan has been approved in accordance with Article 4 of Chapter 113A of the General Statutes. b. The excavation or grading will be completed within one year. C. The excavation or grading will not involve blasting, removal of material from rivers or streams, the disposal of off -site waste on the affected land, or the surface disposal of groundwater beyond the affected land. d. The excavation or grading will not be in violation of any local ordinance. The limits of disturbance must remain less than 5 acres. Any noncompliance with these requirements means that the project must be permitted under the Mining Act. Q Organizational Updates The new permit: Repeats state requirements for E&SC Plans and organizes them with federal construction activity requirements; Is clearly organized by topic; and Has less text and more tables. Technical Updates The new permit: • Requires that the E&SC Plan meet SWPPP requirements (p. 2); • Provides a list of items that must be included in the SWPPP, such as the construction sequence, plans, calculations, etc. (p. 2-4);' • Has updated language on bypasses and upsets that is tailored to construction activities (p. 10); • Puts all timeframes for inspections, record -keeping and reporting in "calendar days" for clarity and consistency (p. 11-14);' • Changes the inspection frequency (during business hours) to at least once per 7 calendar days and after every storm > 1.0 inch (previously 0.5 inch);' and • Excludes weekends, state and federal holidays from normal business hours unless construction activities take place (p. 23). This list is based on website guidance by the DEMLR Sediment Program. The number of calendar days was selected to be as equivalent as possible with the previous permit. The intent is to provide predictability to the inspection schedule. Permittees will no longer receive a copy of the NCG01 permit in the mail with their E&SC Plan approvals and be considered as covered under the permit. Federal rules require that DEMLR receive an NOI on each construction project and issue each construction project its own COC. Under the new NCG01 process, construction sites will continue to receive approval for E&SC Plans from either DEMLR or the delegated local E&SC program just like before. After receiving E&SC Plan approval, permittees will officially obtain coverage under the NCG01 by completing an a-NOI (available at deq.nc.gov/NCG01). The e-NCI will only take about 20 minutes to fill out and submit on-line. Initially, there will be no charge associated with applying for an NCG01 permit but on or around June 1, 2019, DEMLR will begin charging a $100 annual general permit fee as required per §143-215.3D. DEMLR is working on creating a single application form that will allow an applicant to simultaneously apply for an E&SC permit and an NCG01 COC. Mineral' TRACY DAVIS and Land Resources Director ENVIRONMENTAL QUALITY Announcement of Combined Self -Monitoring and Self -Inspection Form The Sedimentation Pollution Control Act was amended in 2006 to require that persons responsible for land -disturbing activities inspect a project after each phase of the project to make sure that the approved erosion and sedimentation control plan is being followed. Rules detailing the documentation of these inspections became effective October 1, 2010. To simplify document of Self -Inspection Reports and NPDES Self -Monitoring Reports, a combined form is now available. The new form was developed to satisfy the requirements of the Sedimentation Pollution Control Act and the NPDES Stormwater Permit .for Construction Activities, NCG 010000. Beginning August 1, 2013, the Division of Energy, Mineral, and Land Resources is responsible for administering both the SPCA and the NPDES Stormwater Permit for Construction Activities NCG 010000. The combined form should make it easier to comply with self -inspection requirements.
