The City of Raleigh received a NWP #32 and WQC #3376 for the construction of the Beaverdam Creek
Sewer Line project. The permitted project is a restoration plan to mitigate damages to impacted wetlands,
stream, and riparian buffers that resulted from the construction of an access road and stream
stabilization/relocation during an emergency sewer repair. The permitted project includes removing fill
placed during construction of the road, providing stream restoration techniques to restore impacted
streams, and a planting plan for all disturbed areas, including riparian buffers and wetlands.
The NWP #32 was issued May 27, 2003 and expires May 27, 2005. The WQC approval expires when the
NWP expires on May 27, 2005. With the permit expiration date approaching, the City of Raleigh
requests an extension of the NWP#32 for this project. Several property and easement issues have arisen
as the City attempted to acquire easements in able to construct the project. Because the easements have
not yet been obtained, the City has not been able to begin construction of this project.
The City is planning to recommend the properties with outstanding easement acquisition issues for
condemnation at the next Council meeting on March 15, 2005. Once the condemnation requests are
approved by the City Council, the attorneys will file suit and the City will be able to enter the properties
to begin construction of this project. Given this process, it is expected the earliest that construction will
be able to begin will be in May 2005, provided no other legal issues arise. It is the City's goal to begin
construction prior to the May 27, 2005 permit expiration date.
We respectfully request an extension to the existing permit for this project. Attached for your review is
the approved NWP #32 and WQC #3376 for this project. Please contact me with any questions or
