4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
Currently, all of the proposed road crossings (i.e. Impact Areas 3, 6, 7, 8 and 12) have been preliminarily installed, in order to access the remainder of the uplands, within the property
The uplands have been cleared of vegetation. Two wetlands (i.e. Wetland B and C) were inadvertently cleared of root mat but have been stabilized and encased in silt fence.
The site is bordered by residential development to the north, Castle Hayne Park, to the west, and the NC DPS Juvenile Detention Center, to the south.
4b. Have Corps permits or DWR certifications been obtained for this project (including all prior phases) in the past?*

The USACE and DWR originally permitted wetland and stream impacts, under Nationwide Permit 29 and WQC 4139, in 2008 and reissued their permits in 2013. The permits authorized
the permanent impact of 0.45-acre of wetlands (0.32-acre riparian and 0.13-acre of non -riparian) and 297 linear feet of warm water stream bed, as well as 0.02-acre of temporary
impact to wetlands, for the purpose of installing utility lines. As mitigation for the authorized impacts, the Applicant was to make payment to the NECFUMB, for 0.32-acre riparian and
0.13-acre of non -riparian wetland restoration and 297 linear feet of warm water stream restoration credits. This was fulfilled on March 28, 2008. The Agencies should have a copy of the
mitigation receipt in their files. The Applicant was also required to provide as -built surveys of the permanent wetland impact areas. The as -built surveys have been included with the new
impact map. Lastly, the Applicant was to record, prior to the conveyance of lots and at the New Hanover County ROD, a Conservation Declaration or similar legal mechanism, for the
purpose of preserving the remaining wetlands on the property. This has not been completed, as the lots have not been sold.

The purpose of this project is to construct roads, install infrastructure and prepare building pads within the existing Parsons Mill Farm subdivision.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The project consists of completing the installation of eight (8) road crossings, which will permanently impact 0.303-acre of wetlands, and installing stormwater and sewer lines, which till
temporarily impact 0.036-acre of wetlands, at three (3) locations. Additionally, in order to get stormwater runoff, from the houses, on lots 76, 77, 79 and 105-107 to the street and then
to the stormwater ponds, 0.142-acre of wetlands will need to be permanently filled. In total, 0.15-acre of permanent riparian wetland impact, 0.295-acre if permanent non -riparian
wretland impact, 95 LF of permanent stream impact and 17 LF of temporary stream impact is necessary to facilitate the development. Please see attached site plan, for details of the
proposed work.
Large machinery, such as dump trucks, backhoes, excavators and front end loaders will be used to complete the work. The machinery will be stored in uplands, when not in use.

period. The temporary stream impact area Will be returned to its original grade and contour before placing coir matting in the bottom. A series of three
baffles may be used downstream of the impact area, to keep sediment from discharging downstream, after the work has been completed.
E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The USACE and DWR originally permitted wetland and stream impacts, under Nationwide Permit 29 and WQC 4139, in 2008 and reissued their
permits in 2013. The permits authorized the permanent impact of 0.45-acre of wetlands (0.32-acre riparian and 0.13-acre of non -riparian) and 297
linear feet of warm water stream bed, as well as 0.02-acre of temporary impact to wetlands, for the purpose of installing utility lines. The Applicant re-
evaluated each impact and was able to reduce impacts to wetlands, at Impact Areas 10, 11, 12 and 14, and stream impacts, at Impact Areas 10 and
12. In total, wetland and stream impacts, in these areas, were reduced by 0.127-acre and 202 LF respectively. Lastly, the Applicant intend to record,
at the New Hanover County ROD, a Conservation Declaration or similar legal mechanism, for the purpose of preserving the remaining wetlands, within
the property.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The Applicant has incorporated strict sediment and erosion control measures into the plan and has undertaken the installation of the protective
measures. The measures are evaluated at least once a week and after a rain event that produces more than 1" of rain Within a 24 hour period.
Additionally, work within the stream will not take place Within 48 hours of a rain event that produces or is anticipated to produce more than 1" of rain
within a 24 hour period. The Applicant also intends to place record a deed notification that will run with the land, in perpetuity, for all lots that contain
wetlands (i.e.
