Lowell Mill Dam is a mass concrete gravity dam and spillway located within the Little River
channel and across adjacent river floodplains approximately 0.3 miles south (downstream) of
Interstate 95 (Exit 105), between the towns of Micro and Kenly. The Lowell Mill Dam Removal
Project Site includes the Lowell Mill Dam and 0.75 acres of adjacent land area.
The North Carolina Dam Removal Task Force designated the Lowell Dam as the highest
priority dam for removal in North Carolina. This dam is targeted for removal by natural
resource coalitions due primarily to water quality degradation, migratory (anadromous) fish
blockage, and endangered species damage within the upper watershed. Removal of the dam is
being undertaken as an alternative form of compensatory stream mitigation for use by the
North Carolina Department of Environment and Natural Resources (NCDENR) Ecosystem
Enhancement Program (EEP) within the Neuse River Basin Cataloging Unit (CU) 03020201. The
project has been developed according to guidelines outlined in Determining Appropriate
Compensatory Mitigation Credit for Dam Removal Projects, March 22, 2004. This guidance
was developed by the U.S. Army Corps of Engineers (USACE), U.S. Fish and Wildlife Service
(USFWS), Environmental Protection Agency (EPA), N.C. Division of Water Quality (NCDWQ),
N.C. of Division of Marine Fisheries (NCDMF), and the N.C. Wildlife Resources Commission
(NCWRC). Upon completion, the project will provide 34,990 Stream Mitigation Units within
the Neuse River Basin Cataloging Unit (CU) 03020201.
B. Purpose and Need:
The NCDENR Ecosystem Enhancement Program (EEP) is responsible for providing
compensatory mitigation for authorized wetland, stream and riparian buffer impacts associated
with transportation-related infrastructure and economic development. As part of their overall
mitigation strategy, the EEP published a request for proposals (RFP) in December 2003 seeking
Full Delivery Projects that would provide stream mitigation credits within the Neuse River
Basin CU 03020201. In response to the RFP, Restoration Systems, LCC submitted the "Lowell
Mill Dam Removal Stream Restoration Site, Johnston County, North Carolina Technical and
Cost Proposal" on March 24, 2004.

Proposed Improvements:
The following Type II improvements which apply to the project are circled:
1. Modernization of a highway by resurfacing, restoration, rehabilitation,
reconstruction, adding shoulders, or adding auxiliary lanes (e.g., parking,
weaving, turning, climbing).

9) Does the project involve any known underground storage tanks (UST's) or hazardous
materials sites?
A review of available environmental databases and information identified one
leaking underground storage tank (LUST) within the one-mile radius of the project
site: Big Boys, Inc located on 595 Bagley Road, approximately 1/2 mile west and ?
upstream of the dam. A review of the records of the NC Division of Water Quality
revealed that of the five LUST incidents that have impacted surface waters in
Johnston County, none were in the Little River drainage. In addition, no visual signs
of potential contamination were noted during a site survey and the extent of the J
contamination was determined to be confined to the Big Boys, Inc. property.
Because proposed site work is limited to the subject property and construction does
not entail any activity other than removing the dam and the sluice gates, the LUST is j
not anticipated to be an environmental concern.

1.0 Introduction
' The NCDENR Ecosystem Enhancement Program (EEP) is responsible for providing
compensatory mitigation for authorized wetland, stream and riparian buffer impacts
associated with transportation-related infrastructure and economic development. As part
of their overall mitigation strategy, the EEP published a request for proposals (RFP) in
December 2003 seeking Full Delivery Projects that would provide stream mitigation
credits within the Neuse River Basin CU 03020201. In response to the RFP, Restoration
Systems, LCC submitted the "Lowell Mill Dam Removal Stream Restoration Site,
Johnston County, North Carolina Technical and Cost Proposal" on March 24, 2004.
The purpose of this study was to evaluate the potential affect that the proposed project, as
described in more detail below, would have on natural and cultural resources at and or near
the project site. The results of this feasibility assessment are provided in the preceding
Programmatic Categorical Exclusion Action Classification Form as well as in the
' summary text below.
2.0 Project Description
Lowell Mill Dam is a mass concrete gravity dam and spillway located within the Little
River channel and across adjacent river floodplains approximately 0.3 miles south

project site includes the footprint of the existing dam and an additional 0.75 acres of
adjacent land area.

The Lowell Mill Dam Removal and Restoration Plan consists of four primary components,
as described below.
Dewaterin?
The dam and impoundment are currently managed in a drained condition due to high
hazard conditions and potential for dam failure. The impoundment will remain
dewatered from Spring 2004 until the dam is removed (currently scheduled to take
place in 2005).
Sediment Management
Sediment retention studies suggest that large volumes of sediment are not retained in
the vicinity of the dam. Throughout a majority of the reach, exposed rock is visible on
one or both banks, including the area surrounding the dam site. Within 300 feet of the
dam, the lake bottom (through the historic channel section) was rocky and at the same
approximate elevation upstream and downstream of the dam. This indicates that flow
velocities are high enough to cause scour and self-armoring of the stream near the dam,
even with the dam in place. Water surface profile analyses and comparison to FEMA
studies of the river also confirm relatively high velocities within the reach upstream of
the dam.
Sediment deposition upstream of the dam appears to be primarily on the overbank
floodplain areas and within intermittent sediment wedges above the lake pool.
Significant sediment deposition is present in the floodplain upstream of the spillway
structure along the left channel bank. At this location, the floodplain resides several
feet higher than downstream of the dam. As a result, the upstream channel may incise
within the elevated floodplain sediment on the left bank after removal of the dam.
Therefore, the floodplain portion of the dam beyond the left river bank will be lowered
to the top of this floodplain sediment wedge. The foundation of the floodplain portion
of the dam ties into an existing knick-point (bedrock outcrop). Approximately 1 to 3
feet of dam remnant will be left on the native bedrock surface to augment the function
of this knick-point in retaining deposited floodplain sediment. This sediment is
heavily vegetated with trees that are decades in age. However, aquatic species
migration will not be impacted by this floodplain sediment reduction effort as
described below.
Dam Removal
The dam will be entirely removed from the right bedrock contact, through the old mill
structure, and across the bankfull channel of the river. The dam will be angle (step) cut
along the left bank to conform to upstream channel bank and the design bankfull
channel dimension. This process will involve a two-stage, vertical fracture and
removal in place. Fracture methods likely to be used may include expansive concrete,
diamond wire saw, hydraulic breaking, and/or localized explosives. The fracture
pattern and method is dependent, in part, upon rock size distribution required for

stream stabilization. All rebar, metal or foreign material will be removed from the dam
material and carried to an off-site location.
All concrete rock and boulder-sized material will be used in the river channel to form
in-stream and bank stabilization structures across the dam site. Immediately
downstream of the dam, a scour pool has developed within the former floodplain along
the left side of the dam. The pool likely resulted from impinging flows over the dam,
' plus the extensive loss of normal sediment load that was historically deposited on the
floodplain. Concrete (boulder-size) material will be used to re-establish the historic
floodplain, channel, and bankfull profile through this area.
Dam Site Stabilization
After removal of the dam, the river section through the immediate dam site will be
stabilized with rock material (as described above), erosion control matting, seeding,
and vegetation planting. Access paths will be ripped, matted, and seeded with native
herbaceous species. Appropriate tree species will be planted on all exposed surfaces
and sediment, including floodplain elements such as bald cypress (Taxodium
distichum), swamp tupelo (Nyssa biflora), overcup oak (Quercus lyrata), willow oak
(Q. phellos), American sycamore (Platanus occidentalis), river birch (Betula nigra),
and laurel oak (Q. laurifolia). Open areas along the dam escarpment will be planted
with mesophytic tree species such as American beech (Fagus grandifolia), hickory
(Carya tomentosa, C. ovata), northern red oak (Quercus rubra), white oak (Quercus
1 alba), and yellow poplar (Liriodendron tulipifera).
Removal of this dam will provide functional benefit to an 82-square mile watershed.
Within the watershed, 223,840 feet (44.3 miles) of tributary will become available as
spawning habitat for 6 species of anadromous fish. In addition, 11 rare and endangered
species will also benefit from restoration of a connected, free-flowing river within the
region. These species have been documented below the Lowell Dam but have been
largely extirpated upstream of the structure, within the impounded pool. This project will
complement and expand upon three other dam removal projects in the Neuse and Little
Rivers (Quaker Neck Dam Removal, Cherry Hospital Dam Removal, and Rains Dam
Removal) that restored access to 1000 miles, 54 miles, and 49 miles of anadromous fish
I spawning and endangered species habitat, respectively.
3.0 Environmental Constraints
An evaluation was conducted in order to identify possible environmental constraints that
have the potential to either affect or be affected by the proposed project. Three specific
categories of environmental constraints were evaluated: 1) an Environmental Screening of
potential conditions related to hazardous wastes, 2) Cultural Resources, and 3) Threatened
and Endangered Species. These evaluations consisted of a review of available records and
a preliminary visual site inspection. Summaries of the findings are provided below:
A. Environmental Screening
An Environmental Data Resources (EDR) Radius Map with GeoCheck was generated
for the subject site. The radius search for this report was the ASTM standard of one
mile. The EDR report identified one leaking underground storage tank (LUST) at a
site operated by Big Boys, Inc on 595 Bagley Road, which is approximately %Z mile
west, uphill of dam. A review of the records of the NC Division of Water Quality
revealed that of the five LUST incidents that have impacted surface waters in
Johnston County, none were in the Little River drainage. In addition, no visual signs
of potential contamination were noted during a site survey. The extent of the
contamination was determined to be confined to the Big Boys, Inc. property. Because
proposed site work is limited to the subject property and construction does not entail
any activity other than removing the dam and the sluice gates, the LUST is not
anticipated to be an environmental concern. A copy of both the EDR Database
Report and the Environmental Screening Inspection Form are included as
attachments.
B. Cultural Resources
The dam was constructed in 1914 and powered a gristmill, a common facility along
the Fall Line region of North Carolina. Today, there are no remaining structures
associated with the former mill except the dam and the degraded sluice gates.
Available records were reviewed at the North Carolina Department of Cultural
Resources, State Historic Preservation Office (SHPO), and Office of State
Archaeology (OSA) to determine the presence of known historic preservation sites or
sites of archeological importance on or near the study site. Human habitation and
archaeological resources may exist on convex upland ridges near the project site and
river corridor. However, no land disturbing activities are proposed within these areas
that may affect cultural resources. The SHPO has determined that the dam and
remaining structures are not eligible for inclusion on the National Register of Historic
Places. A letter to that effect is attached. Based upon these findings, the removal of
the Lowell Dam is not anticipated to impact any known historic or archaeological
resource.
C. Protected Species
Available records of the NC Natural Heritage Program (NHP), the United States Fish
and Wildlife Service (USFWS), and the North Carolina Wildlife Resources
Commission (NCWRC) were reviewed to determine the presence of any threatened,
or endangered species or critical habitats on or near the project site. No identified
occurrences of protected species or designated critical habitats are located at or
adjacent to the site. A summary of the listed species and a preliminary assessment of
the potential project impact is provided below:
Haliaeetus leucocephalus bald eagle Threatened Historic
Bald Eagle habitat is typically mature forests near large bodies of water; however
most nesting sites are known and there none in the vicinity of the project. According
to the NHP records search, there are no known occurrences of the species within the
project area. The project will eliminate the impoundment on the Little River above

the dam and restore it to a free-flowing river. This activity should have little or no
effect on the feeding habitat for the species in this area, should they return. Since no
known eagles use this area at this time, it is unlikely that the project will have any
negative effect on the species; rather, there may be a positive effect because of greater
availability of anadromous fish expected to move upstream of the dam after its
removal. There is no Designated Critical Habitat for the bald eagle.
Biological Conclusion: May Affect. Not Likely to Adversely Affect

eterodon dwarf wedgemussel Endangered Current
The dwarf wedgemussel occurs rivers and streams, often burrowed into stable clay
banks where extensive root systems hold soils in place. They may also be found
associated with mixed substrates of cobble, gravel, and sand in lotic systems;
occasionally they may be found in very soft silt substrates. Although the associated
banks of the impoundment above the Lowell Mill Dam are largely wooded, the lentic
nature of the system has eliminated suitable habitat. Suitable habitat is available
downstream of the dam, but there are no known populations in the reach immediately
below it. A stream with a known population of the species drains into the Little River
eight miles above the impoundment. This population may be benefited by the
removal of the dam, allowing for genetic exchange with any potential populations
downstream of the impoundment and dam. Elimination of the impoundment itself is
likely to restore suitable habitat and affect the species in a beneficial manner with the
reestablishment of free flowing stream conditions. There is no Designated Critical
Habitat for the dwarf wedgemussel.
Biological Conclusion: May Affect: Not Likely to Adversely Affect.
Elliptio steinstansana Tar River spinymussel Endangered Current
The Tar River spinymussel is endemic to east-central North Carolina and occurs in
several counties, including Johnston. The habitat for the species includes
unconsolidated beds of coarse sand and gravel in relatively fast flowing water.
Because suitable habitat is not available within the Lowell Mill impoundment and
there are no known occurrences of the species in the Little River immediately
downstream of the dam, it is not likely that the project will have a negative impact on
the species. Removal of the Lowell Mill Dam will likely benefit the species by
restoring the channel of the Little River to a free flowing stream system. There is no
Designated Critical Habitat for the Tar River spinymussel.
Biological Conclusion: May Affect: Not Likely to Adversely Affect.
Picoides borealis red-cockaded woodpecker Endangered Current
The habitat for the red-cockaded woodpecker includes mature pine forests, with
longleaf pine (Pinus palustris) preferred. Suitable habitat does not exist in the
vicinity of the project and there are no known occurrences of the species within the
project area. Removal of the Lowell Mill Dam will not have any effect on the
species. There is no Designated Critical Habitat for the red-cockaded woodpecker.
Biological Conclusion: No Affect.

Rhus michauxii Michaux's sumac Endangered Current
Michaux's sumac habitat is dry, rocky, or sandy upland openings in forests of the
Piedmont and inner Coastal Plain. The species is shade-intolerant and dependent on
some kind of disturbance to maintain the open condition of its habitat. Suitable
habitat does not exist in the vicinity of the project and there are no known
occurrences of the species within the project area. The species has not been reported
in Johnston County during the past 20 years. Removal of the Lowell Mill Dam will
not have any effect on the species. There is no Designated Critical Habitat for
Michaux's sumac.
Biological Conclusion: No Affect.
4.0 Conclusions
Based upon the results of this preliminary feasibility assessment, the Lowell Mill Dam
Removal and Stream Restoration Project is not expected to negatively affect the evaluated
resources located within the project area. In fact, the removal of the Lowell Mill Dam will
beneficially affect anadromous fish passage, protected species habitat, and degraded water
quality.
¦ Approximately 233,840 linear feet of second order or higher, perennial tributary
will be opened to several species of anadromous fish passage as a result of this dam
removal. Of this total, 34,990 feet is situated within the normal impounded water
area.
¦ Habitat for federally listed endangered species, including the dwarf wedge mussel
(Alasmidonta heterodon) and the Tar River spinymussel (Elliptio steinstansana)
will be restored. These species require flowing water that has been lost within the
34,990 feet (6.6 miles) of the impoundment of Lowell Mill Dam. Removal of the
dam will also allow repopulation and genetic exchange / migration of other rare
and / or endangered species along 44.3 miles of the Little River, Buffalo Creek,
Little Buffalo Creek, and Long Branch.
¦ The project watershed contains rivers and streams that are on the 303(d) list,
including the State's designation as Impaired Waters due to stagnation,
sedimentation, and low dissolved oxygen levels. Dam Removal will assist in
removing the impaired status and 303(d) listing from rivers and streams in the
Neuse River Basin. In addition, the project will directly improve degraded water
quality parameters within 34,990 feet under the existing lake pool.

Thank you for your November 24, 2004 letter and the attached feasibility study regarding the
proposed removal of Lowell Mill Dam located in Johnston County, North Carolina. Lowell
Mill Dam is located in the Little River channel approximately 0.3 miles south of Interstate 95
between the towns of Micro and Kenly. This letter provides the U.S. Fish and Wildlife
Service's (Service) response pursuant to section 7 of the Endangered Species Act, as
amended (16 U.S.C. 1531 et seq.) (Act).
Based on the information provided and other information available, the project area does not
contain habitat for the red cockaded woodpecker (Picoides borealis) and Michaux's sumac
(Rhus michauxii). The Service concurs with your determination of no effect for these two
species. As the feasibility study indicates, habitat is present for the bald eagle (Haliaeetus
leucocephalus), dwarf wedgemussel (Alasmidonta heterodon) and Tar spinymussel (Elliptio
steinistansana); however, we believe that this project is not likely to adversely affect these
three species. We believe that the requirements of section 7(a)(2) of the Act have been
satisfied. We remind you that obligations under section 7 consultation must be reconsidered
if: (1) new information reveals impacts of this identified action that may affect listed species
or critical habitat in a manner not previously considered; (2) this action is subsequently
modified in a manner that was not considered in this review, or, (3) a new species is listed or
critical habitat determined that may be affected by the identified action.

As of February 1995, CERCLIS sites designated 'No Further Remedial Action Planned' (NFRAP) have been removed
from CERCLIS. NFRAP sites may be sites where, following an initial investigation, no contamination was found,
contamination was removed quickly without the need for the site to be placed on the NPL, or the contamination
was not serious enough to require Federal Superfund action or NPL consideration. EPA has removed approximately
25,000 NFRAP sites to lift the unintended barriers to the redevelopment of these properties and has archived them
as historical records so EPA does not needlessly repeat the investigations in the future. This policy change is
part of the EPA's Brownfields Redevelopment Program to help cities, states, private investors and affected citizens
to promote economic redevelopment of unproductive urban sites.

When Congress passed the Clean Air Act Amendments of 1990, it required EPA to publish regulations and guidance
for chemical accident prevention at facilities using extremely hazardous substances. The Risk Management Program
Rule (RMP Rule) was written to implement Section 112(r) of these amendments. The rule, which built upon existing
industry codes and standards, requires companies of all sizes that use certain flammable and toxic substances
to develop a Risk Management Program, which includes a(n): Hazard assessment that details the potential effects
of an accidental release, an accident history of the last five years, and an evaluation of worst-case and alternative
accidental releases; Prevention program that includes safety precautions and maintenance, monitoring, and employee
training measures; and Emergency response program that spells out emergency health care, employee training measures
and procedures for informing the public and response agencies (e.g the fire department) should an accident occur.

UMTRA: Uranium Mill Tailings Sites

Uranium ore was mined by private companies for federal government use in national defense programs. When the mills
shut down, large piles of the sand-like material (mill tailings) remain after uranium has been extracted from
the ore. Levels of human exposure to radioactive materials from the piles are low-, however, in some cases tailings
were used as construction materials before the potential health hazards of the tailings were recognized. In 1978,
24 inactive uranium mill tailings sites in Oregon, Idaho, Wyoming, Utah, Colorado, New Mexico, Texas, North Dakota,
South Dakota, Pennsylvania, and on Navajo and Hopi tribal lands, were targeted for cleanup by the Department of
Energy.

EDR's GeoCheck Physical Setting Source Addendum has been developed to assist the environmental professional
with the collection of physical setting source information in accordance with ASTM 1527-00, Section 7.2.3.
Section 7.2.3 requires that a current USGS 7.5 Minute Topographic Map (or equivalent, such as the USGS Digital
Elevation Model) be reviewed. It also requires that one or more additional physical setting sources be sought
when (1) conditions have been identified in which hazardous substances or petroleum products are likely
to migrate to or from the property, and (2) more information than is provided in the current USGS 7.5 Minute
Topographic Map (or equivalent) is generally obtained, pursuant to local good commercial or customary practice,
to assess the impact of migration of recognized environmental conditions in connection with the property. Such
additional physical setting sources generally include information about the topographic, hydrologic, hydrogeologic,
and geologic characteristics of a site, and wells in the area.
Assessment of the impact of contaminant migration generally has two principle investigative components:
1. Groundwater flow direction, and
2. Groundwater flow velocity.
Groundwater flow direction may be impacted by surface topography, hydrology, hydrogeology, characteristics
of the soil, and nearby wells. Groundwater flow velocity is generally impacted by the nature of the geologic strata.
EDR's GeoCheck Physical Setting Source Addendum is provided to assist the environmental professional in
forming an opinion about the impact of potential contaminant migration.

Description of the overall appearance of the subject property and observed industrial/manufacturing
activities (if any):
The Site is mainly forested, agricultural (cotton), and rural residential. The area along the left bank
(looking downstream) is forested. The right bank is fenced with an unpaved access road leading to
the dam. Cotton is actively cultivated approximately 50 feet beyond the fence, which surrounds the
perimeter of the dam. A small residential building and barn are located on the property directly
adjacent to the dam. A small above ground storage tank was observed outside the residence. The
tank appears to contain propane.

Description of identified environmental concerns (if any):
Approximately 500 feet upstream of the dam, just along the right bank of Little River, a small
burning and dumping area was observed. In this area, stained/discolored soils and a foul odor
were present. A larger dumping site was located farther uphill of the right bank. The dumping site
included empty drums, tires, concrete, and other miscellaneous trash. These dumping sites
appear to be associated with the a truck repair shop, in the vicinity of the subject site. The shop is
located in a truck stop area, which services trucks traveling on 1-95.
