Sullins Governor Director December 21, 2009 CERTIFIED MAIL - RETURN RECEIPT REQUESTED Eric Keravuori, Director of Engineering Town of Wake Forest 4011 Elm Avenue Wake Forest, NC 27587 Subject: Proposed Northside Loop and Juniper Road Realignment in Wake County, DWQ Project Number 20091109 Dear Mr. Keravuori: Dee Freeman Secretary The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification and Neuse Buffer Authorization for the aforementioned project, along with additional information received in response to our prior correspondence. In review of this additional information, DWQ has a few more concerns: 1. Level Spreader A: The distance between the 310 contour line and the 308 line is much less than 30 feet. The area down slope of this level spreader is too steep and in addition, the level spreader is located too close to the draw (less than 30 feet). The DWQ recommends that Level Spreader A be relocated so that it is at least 30 feet from the edge of the riparian buffer (along its entire length). Then a 30-foot filter strip with a slope of six percent or less could be graded and sodded to meet difuse flow requirements. The graded area must be completely outside the protected riparian buffer. 2. Level Spreaders B and C: The bypass channels are proposed to pass directly through the vegetated filter strip areas. This is not allowable. 3. Level Spreader H: The riparian buffer down slope of this proposed level spreader has a slope that exceeds eight percent. The DWQ recommends that Level Spreader H be relocated so that it is at least 30 feet from the edge of the riparian buffer (along its entire length). Then a 30-foot filter strip with a slope of six percent or less could be graded and sodded to meet diffuse flow requirements. The graded area must be completely outside the protected riparian buffer. 4. Finally, for the vegetated filter strips that are proposed to be re-graded and sodded (B, D, E and possibly A and H), please provide a specification for a layer of topsoil (the DWQ recommends six inches in depth) and the type of sod you plan to use. Also, please provide watering specifications to establish the sod. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing or notification that the information is forthcoming, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
