I am currently reviewing your application and the following is required in order to complete the review process:
1. Please fill out part C1. Include the impact amount in area B1 and the amount of square feet of the addition that
is in Zone 2
2. The application is not valid until signed and dated
3. Based on the impact map provided, it hard to differentiate the buffer Zone 1 and 2 from the stream channel
included your original survey and please indicate the amount of square feet of impact on that as well. I have
provided an example for your convenience.

My apology for not clearly identifying the patio area.
Below yellow highlighted area is the physical deck/patio area and it won't encroach the riparian
buffer. What you were asking is the dimension line for the drawings.

Mr. Shah,
Since the patio will be in the riparian buffer, a minor variance application is required. Please disregard the previous
application I e-mailed you today. The impact for the patio and the addition will need to be listed in the attached minor
variance application under impacts (part C1). The patio will require mitigation which is a dollar amount per square foot
that is in the buffer (part C2). The addition does not require mitigation as it is allowable. I have included the
applications and a mitigation help document as well.
Once you have the forms filled out and contacted a private mitigation bank and received a statement of availability
letter for the mitigation you can e-mail the forms to me. If you have any questions, please don't hesitate to contact me.
I can talk you through some of the sections if needed.

Thank you for the revised impact map. That makes it very clear what you intend to do. The only new area I see that will
be in the buffer is the addition. The addition is allowed in the buffer as long as you complete the riparian buffer
authorization form that I have attached and a help document for your convenience. The Neuse buffer rules came into
effect in 1997. Any impacts in the riparian buffer area prior to 1997 are considered exempt or existing use. However,
any new impacts in the buffer that are not considered exempt activity do require written authorization from DWR via
the form I have attached
Please complete the attached buffer authorization form and return to me at your convenience along with the impact
map you provided today and I will review it. If you have any questions, please don't hesitate to contact me. Right now,
our building is closed for visitors, but I can certainly help you over the phone.

Our house was built in the year 1997 and obtained possession in 1998. 1 am the first owner.
Btw, it seems like there was no riparian buffer rules from some blogs that I read for properties built prior to year
1998. Please see attached example that was given to us and updated drawing representing Neuse buffer rules of
riparian buffer requirements.
I am not sure if it is possible to make an appointment to discuss further by meeting in person or by setting up an online
meeting.

I reviewed your plans that Josh forwarded to me. Since the stream on your property is subject to the Neuse buffer
rules, there are activities that are allowed in the buffer that require written authorization from the Division. Based on
the documents your provided to Josh, it appears that you are adding an addition to your house and a patio/deck. Based
on the impact map A0.1 that was provided it is unclear what will be encroaching in the riparian buffer. In order to be
able to understand your project, the following items need to be added to the impact map:

• The stream needs to be shown on the plan.
• Show the two zones of the riparian buffer on the plan as measured from the top of the streambank. Zone 1
is measured 30 feet from the top of the stream bank, and Zone 2 is measured from 30 feet to 50 feet. These
riparian buffers parallel the stream pattern.
• Site plan must depict the footprint of the proposed permanent impacts.
• The square footage of the impacts in Zone 1 and Zone 2 must be identified in the application.
The addition and deck is allowable in the buffer with the submittal of a riparian buffer authorization. However, if you
plan to install a stone patio this activity is prohibited and required a Minor Variance. Based on the map you provided, it
is unclear what activity is in the riparian buffer. I have attached an example of an impact map for your reference. Please
do not hesitate to contact me if you have any questions.

Hello Mr. Brigham,
Thank you for your prompt response with my inquiry related to the determination of the buffer zones for my property
at 103 Hanahan Court, Cary, NC. We are planning extensions and City of Cary required a letter in writing for the
approval stating that there is no issue moving forward with the planned extensions.
Please see attached completed form that was requested along with architectural approved diagram by HOA. Let me
know available date and time so I can plan to be at my house during the inspections.
