I'll be in a teleconference/staff meeting most of the morning... All Corps permits place the
onus on the Permittee to not damage the neighbor's property. Bottom line in this case: it is
the Permittee's responsibility to have a successful mitigation project - and not flood his
neighbor (the Numero Uno challenge of PC-Cropland restoration...). I'll check thru channels
for more intel...D

FYI a landowner adjacent to Rutman Creek was in the WaRO today saying that the Rutman Creek
site is causing flooding and timber damage; on;;bis:property.
Is this something that is specifically, addressed in your NW Permit language (e.g. cannot
cause hydrologic trespass)? I have looked through our GC and did not see any such
conditions.
I need to look through the restoration1$lans"and,see if PCS/Land Management/Wetlands Resource
Center addressed this issue in their designs.

I spoke with Al Hodge at WaRO this afternoon, and would like to talk with you about this on
Monday, if you are available. We may need to schedule a site visit to look at the site
drainage, etc., and it seems logical DWQ and USACE would look at this issue together. Are
you available to talk on Monday morning? Please let us know.
