I'have checked with John and Cyndi, and gone over our GC, and we really don't have any language that gives us any responsibility to address this issue. Although it appears that PCS is addressing it. Anecdotally, we have been discussing for a while that the last several months have been very wet, and it is possible that between the blockage in the Moony Canal and the precipitation, the landowners land may have flooded even if'th'e Rutman Creek project was never done. Let me know what you think our next step should be, and if there is anything you want from us here in the CO. The land in question has free drainage all the way down New Lake canal, which runs down New Lake Road. That canal is not blocked. Last year Mooney canal was blocked, which runs down the middle of the project (is not part of the drainage system for the landowner's property) which was one of the outlets for New Lake itself. We didn't have any problems with that last year, but this year the lake is high, and may be high enough to get onto this person's land. We are partnering with the USFWS'"refd'' aff to clean out Everett 1 canal, which is a boundary between our respective properties, which takes off 90 degrees from Mooney Canal, and goes out to the Intracoastal Waterway. David Kitts, the drainage person for the FWS at the refuge, is coordinating with us. Hopefully, that work will start within 2 weeks, and that should take some pressure off the lake. We have done a November, December, January rainfall.analysis using data from the Belhaven station, going back 12 years. The long-term average total for those 3 months is 10.38 inches. This year, we have had 23.32 inches, 225% of average. The next two highest totals in the last 12 years for the three months was 14.13 inches in 2006-07 and 14.28 inches in 2003-04, so we are almost 10 inches over that. I have told the landowner that we will do what,is:necessatly to not have water on his land, if we are the cause. We are not convinced that the project is the cause, and we have asked him to see what happens after Everett canal is cleaned out.
